Tennessee's legislature isn't just partisan—it's often polarizing. Inside the House chambers, Democrats and Republicans disparage one another, at times—outside, they rarely engage. Has the proverbial political aisle been stretched too far to reach across? It wasn't always this way. There was once camaraderie and compromise. Few understand this culture shift better than Brian Bivens. The East Tennessee native has spent the last 25 years lobbying elected officials. But Bivens bent ears long before he was in the business of bending ears. His father, Steve Bivens, served in the State House from 1978 to 1992. The Cleveland guidance counselor was the House Majority Whip at a time when Democrats ruled the roost. In this episode of Climbing the Charts, Angie Lawless and Brandon Miller sit down with Bivens to examine Tennessee's legislature—its present, past, and personalities.

It's always neat to hear of farms that have been with a family for generations, but is it still possible for a first generation farmer to get started? Ryan Bivens is proof that it is possible, but that doesn't mean it's easy. First generation Kentucky farmer Ryan Biven talks about his path to getting started in farming, why wheat is his favorite cover crop, and how he manages 88 different landlords in his area of central Kentucky. “Just because somebody says you can't do that.…Try it yourself. Do it on a small basis. You have to figure out what can and cannot work for you. You can't break the bank doing it. If you're gonna screw something up, do it on a small trial. Try it out there. And who's to say, if it works, then next year expand it but you know what's best for your own soils.” - Ryan Bivens Ryan farms soybeans, corn and wheat on about 7600 acres, 1200 of which he owns and the remaining he leases from 88 different landlords. Ryan grew up around agriculture and started farming in FFA. After college his wife took an ag teaching job in the community they now live in so he had to start over. He searched for farmland to rent through an ad in the local newspaper and built from there. Ryan shares how he got his start, his approach to soil health, and a whole lot more. “We can't tell each other how to farm. There is not one right way or wrong way to do it. Everybody has to know their own land, they have to know their soils, and they have to know what works for them. If I don't go out and learn something every day, that's the day I need to hang it up and quit. Danelo Cavalcante, a fugitive who had escaped from custody, was successfully captured after nearly two weeks on the run. The escapee had fled Chester County Prison on August 31, mere days after receiving a life sentence for the fatal stabbing of his ex-girlfriend, Deborah Brandao, aged 33. Additionally, he is wanted in connection with a 2017 murder case in Brazil. Law enforcement agencies utilized thermal imaging technology to track him down, and tactical teams swiftly closed in on him around 8 a.m. on Wednesday morning, capitalizing on the element of surprise, as revealed during a police press conference. Cavalcante was discovered asleep, rifle in hand, as law enforcement located him. Caught off guard, he attempted to evade capture by maneuvering through dense underbrush with the firearm, as described by Bivens. If a federal agent violates a citizen's constitutional rights, does a justiciable cause of action arise? If yes, do federal courts have the power to award damages for constitutional violations? These questions have been considered by the U.S. Supreme Court in cases like Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics (1971) and Egbert v. Boule (2022). Three state supreme courts have recently issued competing decisions on whether similar separation of powers concerns arise when state courts recognize rights under state constitutions.Burnett v. Smith, issued on May 5, 2023, was the latest of these three decisions. The case arose after the plaintiff, garbage truck driver Cory Burnett, was pulled over by Iowa Department of Transportation Officer Philip Smith for a cracked windshield. Burnett was eventually arrested by Officer Smith for interference with official acts (Iowa Code §719.1). The charges were ultimately dismissed following a trial. Later, Burnett sued Officer Smith for, among other things, an unreasonable seizure directly under the Iowa Constitution. On appeal, the Supreme Court of Iowa unanimously affirmed the district court's judgment against Burnett and, in the process, held that courts in Iowa cannot imply remedies directly under the Iowa constitution, overruling Godfrey v. State (898 N.W.2d, 2017).In alignment with recent federal precedent, the court held that letting plaintiffs bring constitutional claims without the Iowa legislature first authorizing them “undermined the established allocation of responsibility between the legislative and the judicial branches of government.” This holding is at odds with decisions in Michigan (Bauserman v. Unemployment Insurance Agency) and Nevada (Mack v. Williams) where plaintiffs are allowed to sue without a legislative cause of action, provided certain conditions are met. In December of 2022, the Agency for Healthcare Research and Quality (AHRQ) put out a study titled “Diagnostic Errors in the Emergency Department: A Systematic Review.” This study triggered many news stories from prominent outlets with headlines such as, “More than 7 million incorrect diagnoses made in US emergency rooms every year, government report finds,” from CNN, and “E.R. Doctors Misdiagnose Patients With Unusual Symptoms,” from the New York Times. What was the response? Matt Bivens, MD from Emergency Medicine News responded to the original study in an article titled, “AHRQ Errors Report was ‘Outright Unconscionable.'” Dr. Bivens points out that AHRQ's biggest claims – including that 5.7% of patients are misdiagnosed in the ED and 2.0% suffer an adverse event as a result – were based only on three small studies out of Canada, Spain, and Switzerland (combined n=1,758). Spain and Switzerland did not have emergency medicine residency-trained physicians at the time of the studies. The Swiss study looked at when the diagnosis changed significantly between admittance and discharge to which Bivens responded, “Are we describing errors in this study or just an ongoing collaborative process?” The Canadian study looked at 503 high-acuity patients of which one died of a missed aortic dissection. Bivens notes that this is too small of sample size to be generalized to the American ER population which includes a mix of low and high acuity. Moral of the story? Mistakes do happen in the ED and they do negatively impact patients but be careful in how you interpret studies and news articles that report on them. On this episode, Flying Squirrels broadcaster Trey Wilson talks with pitcher Spencer Bivens, who tells stories about his unique journey through the baseball ranks. Born in Virginia Beach, Bivens grew up in State College, Pennsylvania, before heading off to play junior college baseball in North Carolina. Bivens worked his way to Division II Rogers State in Oklahoma, before landing a spot on a Lions de Savigny in France. He was slated to play for Kotlářka Praha in the Czech Baseball Extraliga before the outbreak of the COVID-19 pandemic in 2020, and he ended up playing for the Lemont Ducks of the Centre County League, an amateur baseball organization in Central Pennsylvania. He got picked up to play in a four-team pod league hosted by the independent Washington Wild Things later in the 2020 summer before signing to play for the Wild Things in 2021. After he was released, Bivens signed with the West Virginia Power of the Atlantic League before being traded to the Gastonia Honey Hunters in North Carolina. Bivens returned to Gastonia to begin the 2022 season and caught the eye of the San Francisco Giants, who signed him to join the affiliated ranks for the first time at age 27. Last year, Bivens pitcher for the Low-A San Jose Giants and the Triple-A Sacramento River Cats before getting some time in the prestigious Arizona Fall League, where he landed a spot on the Fall Stars team. After beginning the 2023 season with the High-A Eugene Emeralds, he was promoted to Double-A Richmond in early May. Bivens talks with Wilson to discuss all the details that surrounded his path to get him to this point in his baseball journey.
