Carol highlights the urgent need to reform the law, especially concerning coercion and control in legislative practices. She focuses exclusively on clients who have endured sexual abuse and coercion within cultic groups—not because other forms of abuse are absent, but because the law currently recognizes and addresses this specific type of abuse. The legal system inadequately acknowledges coercion in cases where individuals surrender significant amounts of money to cults or relinquish their rights to education, marriage, parenthood, or the choice not to have children. The law appears to narrowly define coercion, primarily in the context of sexual exploitation. The law also fails to recognize the deception involved when individuals are promised enlightenment through sexual relations with cult leaders, as it does not categorize this as fraud due to its religious context. There should be a legal distinction between legitimate religions deserving of tax exemptions and those that systematically defraud, enslave, or control individuals through coercion. We should not grant tax benefits to organizations that violate the law. Yet, currently, there is no clear standard for religious tax exemptions beyond the essential requirement that organizations do not operate as commercial enterprises. Merchasin is a former partner at Morgan, Lewis, and Bockius in Philadelphia, where she was an employment lawyer investigating issues of sexual misconduct in the workplace. She is currently the head of Sexual Misconduct in Spiritual Communities Counsel at the law firm of McAllister Olivarius, which represents survivors of sexual misconduct in cults and spiritual communities. Carol Merchasin spent many years as an employment lawyer. She has also been a partner in the Philadelphia office of Morgan, Lewis & Bockius and director of Morgan Lewis Resources. She has conducted dozens of workplace investigations and taught investigative techniques to human resource professionals at many Fortune 50 companies. She has since joined McAllister Olivarius, where she heads up a practice covering sexual misconduct in religious, faith-based and spiritual communities.Later in her career, Carol Merchasin was asked to take her investigative background and use it to investigate sexual abuse within various Buddhist and yoga communities. The response she received was one of open hostility – certain religious leaders were not interested in investigating or ensuring their members were safe. Welcome to season 3, episode 7 of the Today is the Day Changemakers Podcast. This week I am joined by a special guest co-host, the incredible Fred Wasiak, founder and president of The Food Bank of South Jersey as well as Inspire Change Honoree for the 2023 International Changemakers Forum. Together, Fred and I interview Steven Cohen. Steven is the author of Leading FromWithin: A Guide to Maintaining Your Effectiveness Through Meditation as well as co-founder and chair of the board of Meditation4Leadership which brings the benefits of mindfulness and meditation practices to the workplace. Along with his zen practices, he has a very successful career as a lawyer, being Manager of the Global Emerging Business Technology Practice at Morgan, Lewis, & Bockius, LLP.  Steven traces his first experience practicing concentration back to playing team sports in his early years, though he had not yet explored meditation. He was first exposed to yoga in response to debilitating back problems for which he sought a cure. Steven described the experience as “a life problem disguised as a back problem”. He explains that though yoga helped his back problems, once he paid more attention to the minute of meditation in the beginning of the session, he began a new journey to mindfulness. This increased focus on meditation helped him stay present, rather than focusing too much on the past or future.  He states, “coming back to the breath can be a metaphor for coming back to what is important”. Steven is a firm believer in letting go of judgment in order to reap the full benefits of meditation. Once he was able to release his self judgements and doubts through practicing meditation, his legal practice tripled and has maintained its level since. He emphasizes that this did not occur because of meditation, but because of the benefits which came from meditation. Steven cites the reasons why people don't meditate as lack of exposure, if exposed, not resonating with the language used, and a fundamental misunderstanding of what meditation really is. Welcome to season 3, episode 6 of the Today is the Day Changemakers Podcast. This week my guest is Abby Daly. Abby is the founder and executive director of the Bridge of Books Foundation, a nonprofit organization doing amazing work within New Jersey, enhancing access to literature among children in need. Abby was named a New Jersey Hero by the New Jersey Hero Initiative and has certainly lived up to the title. Throughout its 20 years in operation, Bridge of Books has distributed 1.3 million books to underprivileged children throughout New Jersey. Abby is a former attorney who, during her practice, pursued mental health and children's rights cases. She represented individuals who were involuntarily admitted into psychiatric hospitals, protecting the rights of children and providing a voice for them during trying times. This profession introduced Abby to New Jersey's population of disadvantaged youth and later allowed her to reach children in need through her nonprofit work with Bridge of Books.Abby is deeply dedicated to her craft as she hand picks books based on reading levels and interests of children. Her mission is to “bring the world to children through books”. She aims to encourage development of literacy skills and love for reading. She has worked with food pantries, schools, and state prisons to reach the largest number of children. Though Bridge of Books has touched a great deal of lives, they still have much to do. Das Thema Digitalisierung beschäftigt uns schon seit Jahren in allen möglichen Lebenslagen. Viele unserer Lebensbereiche haben sich von der physischen in die Online-Welt verlagert. Man vernetzt sich mit Freunden auf den sozialen Medien, trifft womöglich den zukünftigen Partner über eine Dating App und bestellt die neuesten Klamotten bequem über das Internet. Diese Entwicklung wurde in diesem Jahr durch die Covid19-Pandemie und die darauf resultierenden Kontaktbeschränkungen noch stärker vorangetrieben und reicht mittlerweile längst nicht mehr nur in unser privates Leben hinein. Auch das Marketing musste sich von klassischen gedruckten Werbemitteln wie Broschüren oder Plakaten hin zu digitalen und webbasierten Werbeformen entwickeln.

This year, the Collection Due Process Summit Initiative will be the focus of the ABA Low Income Taxpayer Representative Symposium in Washington, D.C.  It will be held December 3 from 8:30 to noon at Morgan, Lewis and Bockius at low cost with CLE credit.  Go here to register:  https://www.americanbar.org/groups/taxation/events_cle/19litr_resources/ The CDP Summit meeting will include a panels about Opportunities for CDP Improvement and Approaching Change With the IRS.  There will be breakout sessions focused on CDP Notices, Appeals, and Tax Court.  In the meeting, you can give the CDP Summit Initiative feedback on improvements for the CDP process.  If you will be in the Washington, D.C. area that morning, we hope you can attend!

Launching your legal career at a large law firm has many advantages.  Aside from the obvious compensation benefits, large firms provide young associates with access to sophisticated work, more formalized training and a chance to serve large and complex clients.  But the path to partnership at a large firm remains long and challenging.  In fact partnership is not the goal for many associates who start their careers at an AmLaw100/200 law firm. While there are many career paths after leaving a large firm, in-house counsel positions remain a favorite option.  Some associates move into governmental in-house roles while others move into corporate roles. My guest, Raquel Webster, has tried both career paths.  She currently serves as Senior Counsel to National Grid, a gas and electric utility in New England.  She began her legal career as a litigation associate in the Boston office of Bingham McCutcheon (Bingham has since been acquired by Morgan Lewis and Bockius.)  From there she transitioned into a role in the law department of the City of Boston before moving into her current role. Raquel is active in many non-profit causes and serves on several boards.  She was named as one of the 40 Under 40 by the Boston Business Journal several years ago, and she was just named as one of the 2018 Massachusetts Lawyer’s Weekly Top Women of the Law. She has a lot of insight into how the role of in-house counsel differs from private practice.  She also has a lot of practical advice about how to pursue these coveted positions. Today I am happy to welcome Peter Solmssen to the podcast. Peter spent the first 17 years of his legal career at the US law firms of Ballard Spahr and then Morgan, Lewis & Bockius, where he led the German Practice Group. He then moved to the General Electric Company where he was the General Counsel of GE Plastics and then Vice President and General Counsel of GE Healthcare, based in London. In 2007, Peter moved to Germany to join the Managing Board of Siemens as General Counsel and Chief Compliance Officer. Peter’s roles at GE and Siemens involved working across the globe with teams of people across many time zones and cultures. During our conversation, he points out the importance of really listening to what is being said as sometimes there are truly “no words” or even comparable legal constructs that address the issue at the heart of the client or colleague’s concern. When asked about the role that culture plays in compliance, he shares some very unique observations about changing the frame of discussions regarding compliance in order to change the compliance culture in an organization. At the end of our discussion, Peter also gives us his tips for how lawyers can work more successfully across cultures.
