Her book The Accountability of Armed Groups under Human Rights Law (OUP, 2017) won the Lieber Prize in 2018. I'm your host, Allen Hall, here with Joel Saxum. And our guest today is David Burton. David is a partner at Norton Rose Fulbright, which is based in New York. David is an expert in US tax matters and has experience with structuring tax efficient transactions for renewable operations. David was a managing director and senior tax counsel at GE Energy Financial Services, where he oversaw all the aspects for more than 21 billion in global energy projects. David, welcome to the program. David Burton: Thank you, Allen. It's great to be here. Allen Hall: Okay. So the timing of this could not be better. And Joel and I were just up in Canada trying to explain to the Canadians what the IRA bill meant and why everybody is so confused as to what is happening in America. So we thought we'd bring in the expert to help us with understanding the, all the tax incentives that are built in. Built up into the IRA bill. I don't want to give you a couple of softballs to start with. How about that production tax credit? What is that in the IRA bill? And what does that mean? David Burton: It's $27.50 per megawatt hour for the first 10 years of production. If you transfer the project, the transferee steps into your shoes and does not get to restart the 10 year period. It's a pretty powerful tax credit to get the 2750 megawatt hour. There are requirements you have to meet that we call the fine print that regard prevailing wage and apprentice requirements, which we can get into. Allen Hall: That makes sense to me. That's a really good explanation. I have not heard explained that simply. Joel Saxum: That one's easy. I like that one. I can follow that. Allen Hall: All right. Investment tax credits. Let's raise the heat up a little bit. What is an investment tax credit? David Burton: The base of percentage for the investment tax credit is 30%. Again, you have to comply with prevailing wage and apprentice to even get to 30%. And it's a tax credit that accrues when the project is placed in service, basically operational. And it's 30 percent of a tax basis. Which, you know, more or less is 30 percent of the cost of the project. Rather than having to wait 10 years, you get all, you get the tax benefit all upfront. So, oftentimes the PTC may be a bigger gross amount but it's over 10 years, so sometimes you'll, you're not opt for the ITC because it's a better present value answer, but it's just a question of math. Kevin has over 30 years' executive leadership experience spanning three sectors - healthcare, financial services and professional services - having worked in HR leadership roles for Boots, Abbey National, Capital One, Freshfields, Norton Rose Fulbright, EY and most recently for KPMG as the UK Chief People Officer. In addition through his work with Scope, Nottingham Trent University and two multi academy trusts he has over 15 years' non-executive experience. Kevin now runs his own advisory and consulting business supporting leadership teams with people and talent strategies, succession planning processes, diversity, equity and inclusion practices and HR organisation design. He has recently taken on a role as Equity, Diversity and Inclusion Adviser for Wellcome Trust helping them become a more inclusive employer.In recognition of his passion for and commitment to creating diverse workforces and inclusive cultures Kevin was recognised in HR Magazine's Most Influential UK HR Practitioners 2022. He was also included as one of 35 Advocate Executives in the INvolve Heroes Women Role Model 2021 & 2022 lists and as a Top 50 Ally Executive in the Outstanding LGBT+ Role Models list 2022. From 2020 to 2022 Kevin served as a Steering Group member for the government-sponsored Hampton Alexander/FTSE Women Leaders Review.Kevin holds an honours degree in Politics from the University of York and is a Fellow of the Chartered Institute of Personnel and Development. He lives in Ealing with his second wife Shami and has two adult children from his first marriage. He is a proud Geordie having been born and brought up on the coast in Whitley Bay and is a life long supporter of Newcastle United. Other than following the fortunes of the Toon Army in his spare time you will find him either out enjoying some good food and wine, supping a beer in a proper pub or at a live music gig. Kevin's top leadership tip is to build a diverse team of differing personalities, talents and aspirations. Leading that team will be more challenging but the diversity of thought that it brings and the different abilities each individual offers will lead to superior results. Support and encourage them. Listen to all voices. Include everyone. Recognise their achievements publicly and share your feedback privately. Stretch them with new and exciting work but do not overwhelm them. Yui is a transactions lawyer admitted in New York. She specialises in Asset finance with a focus on the shipping and energy sectors. Yui was raised in Yokohama, Japan, and spent one year in Colorado, U.S. as an exchange student during high school.  She graduated from Keio University (Bachelor of Laws) in Tokyo in 2012 and thereafter obtained a Master of Laws degree from Georgetown University Law Center in Washington, D.C. in 2013.   After completing an internship with the U.S. Federal Trade Commission, Office of International Affairs, where she focused on international collaboration for consumer protection matters, she joined the Tokyo office of Norton Rose Fulbright in 2014.   She then worked in the London office for one and a half years and was involved in transactions with clients based in the U.K. and Europe before returning to the Tokyo office in 2021.   Yui is a strong advocate for Diversity, Equity and Inclusion. It's her passion. She leads, and has been actively engaged in, the Diversity and Inclusion initiatives at Norton Rose Fulbright, both in Tokyo and across the global platform.  Yui is a member of the Gender Equality Committee of Kanagawa Prefecture, which aims to guide local government policy on gender related issues. Yui also joined the executive committee of Women in Law Japan as a volunteer in 2023. A fun fact about Yui is that she is a keen runner and in 2022, she ran a total of 1,015km  - that's the equivalent of 24 marathons!
