Very soon the session will end, and various bills either will or won't head to Newsom's desk. Some will then get signed and become law. Time is rapidly running out to have your voice impact that decision. Since my last weekly, we got a variety of people coming in to stand for or against the final version of SB 1047. There could still be more, but probably all the major players have spoken at this point. So here, today, I'm going to round up all that rhetoric, all those positions, in one place. After this, I plan to be much more stingy about talking about the whole thing, and only cover important new arguments or major news. I'm not going to get into the weeds arguing about the merits of SB 1047 - I stand by my analysis in the Guide to SB 1047, and the reasons I believe it is a good bill, sir. I do however look at the revised AB 3211. I was planning on letting that one go, but it turns out it has a key backer, and thus seems far more worthy of our attention. The Media I saw two major media positions taken, one pro and one anti. Neither worried itself about the details of the bill contents. The Los Angeles Times Editorial Board endorses SB 1047, since the Federal Government is not going to step up, and using an outside view and big picture analysis. I doubt they thought much about the bill's implementation details. The Economist is opposed, in a quite bad editorial calling belief in the possibility of a catastrophic harm 'quasi-religious' without argument, and uses that to dismiss the bill, instead calling for regulations that address mundane harms. That's actually it. OpenAI Opposes SB 1047 The first half of the story is that OpenAI came out publicly against SB 1047. They took four pages to state its only criticism in what could have and should have been a Tweet: That it is a state bill and they would prefer this be handled at the Federal level. To which, I say, okay, I agree that would have been first best and that is one of the best real criticisms. I strongly believe we should pass the bill anyway because I am a realist about Congress, do not expect them to act in similar fashion any time soon even if Harris wins and certainly if Trump wins, and if they pass a similar bill that supersedes this one I will be happily wrong. Except the letter is four pages long, so they can echo various industry talking points, and echo their echoes. In it, they say: Look at all the things we are doing to promote safety, and the bills before Congress, OpenAI says, as if to imply the situation is being handled. Once again, we see the argument 'this might prevent CBRN risks, but it is a state bill, so doing so would not only not be first bet, it would be bad, actually.' They say the bill would 'threaten competitiveness' but provide no evidence or argument for this. They echo, once again without offering any mechanism, reason or evidence, Rep. Lofgren's unsubstantiated claims that this risks companies leaving California. The same with 'stifle innovation.' In four pages, there is no mention of any specific provision that OpenAI thinks would have negative consequences. There is no suggestion of what the bill should have done differently, other than to leave the matter to the Feds. A duck, running after a person, asking for a mechanism. My challenge to OpenAI would be to ask: If SB 1047 was a Federal law, that left all responsibilities in the bill to the USA AISI and NIST and the Department of Justice, funding a national rather than state Compute fund, and was otherwise identical, would OpenAI then support? Would they say their position is Support if Federal? Or, would they admit that the only concrete objection is not their True Objection? I would also confront them with AB 3211, b...

My latest reporting went up in The Nation yesterday: It's about the tech industry's meltdown in response to SB 1047, a California bill that would be the country's first significant attempt to mandate safety measures from developers of AI models more powerful and expensive than any yet known. Rather than summarize that story, I've added context from some past reporting as well as new reporting on two big updates from yesterday: a congressional letter asking Newsom to veto the bill and a slate of amendments. The real AI divide After spending months on my January cover story in Jacobin on the AI existential risk debates, one of my strongest conclusions was that the AI ethics crowd (focused on the tech's immediate harms) and the x-risk crowd (focused on speculative, extreme risks) should recognize their shared interests in the face of a much more powerful enemy - the tech industry: According to one estimate, the amount of money moving into AI safety start-ups and nonprofits in 2022 quadrupled since 2020, reaching $144 million. It's difficult to find an equivalent figure for the AI ethics community. However, civil society from either camp is dwarfed by industry spending. In just the first quarter of 2023, OpenSecrets reported roughly $94 million was spent on AI lobbying in the United States. LobbyControl estimated tech firms spent €113 million this year lobbying the EU, and we'll recall that hundreds of billions of dollars are being invested in the AI industry as we speak. And here's how I ended that story: The debate playing out in the public square may lead you to believe that we have to choose between addressing AI's immediate harms and its inherently speculative existential risks. And there are certainly trade-offs that require careful consideration. But when you look at the material forces at play, a different picture emerges: in one corner are trillion-dollar companies trying to make AI models more powerful and profitable; in another, you find civil society groups trying to make AI reflect values that routinely clash with profit maximization. In short, it's capitalism versus humanity. This was true at the time I published it, but honestly, it felt like momentum was on the side of the AI safety crowd, despite its huge structural disadvantages (industry has way more money and armies of seasoned lobbyists). Since then, it's become increasingly clear that meaningful federal AI safety regulations aren't happening any time soon. The Republican Majority Leader Steve Scalise promised as much in June. But it turns out Democrats would have also likely blocked any national, binding AI safety legislation. The congressional letter Yesterday, eight Democratic California Members of Congress published a letter to Gavin Newsom, asking him to veto SB 1047 if it passes the state Assembly. There are serious problems with basically every part of this letter, which I picked apart here. (Spoiler: it's full of industry talking points repackaged under congressional letterhead). Many of the signers took lots of money from tech, so it shouldn't come as too much of a surprise. I'm most disappointed to see that Silicon Valley Representative Ro Khanna is one of the signatories. Khanna had stood out to me positively in the past (like when he Skyped into The Intercept's five year anniversary party). The top signatory is Zoe Lofgren, who I wrote about in The Nation story: SB 1047 has also acquired powerful enemies on Capitol Hill. Dr. Jess is a board certified functional neurologist, D.C., specializing in vestibular therapy, mind-body work, and root cause approach to health. Before obtaining her doctorate in chiropractic, she earned a Bachelor of Science, graduating cum laude, from Virginia Tech with a degree in Human Nutrition, Foods and Exercise. She graduated magna cum laude from Palmer College of Chiropractic and received both the Academic Excellence and Clinical Excellence Award. While in chiropractic school, she served as President of Functional Neurology Club, was a National Representative for the Motion Palpation Institute and an Executive Officer for Soft Tissue Club. She also worked as a teaching assistant for Activator Methods, where I earned my Level 1 certification in Activator Technique.  During her time in chiropractic school, she began her education in the field of Chiropractic Neurology with the Carrick Institute of Graduate Studies. Upon graduation, she received her Diplomate from the American Chiropractic Neurology Board and my Fellow from the American College of Functional Neurology. She now has over 800 hours in post-graduate education in Functional Neurology, including specialty training in Human Performance, Concussion, and Vestibular Disorders and have lectured to other doctors across the world on Clinical Neuroscience. Her passion for the study of human movement does not end in the field of chiropractic and medicine. She is also a certified 200-hour yoga teacher, allowing her to study human movement and the the effects of yoga on the nervous system and body from a unique perspective. On this week's Sustainability Now!, your host, Justin Mog, pulls up a chair by the hearth for a fireside chat with Alayna Lofgren, Program Manager at Project Warm. Learn about the amazing sustainability mutual aid work that Project Warm does to help some of Jefferson County's most vulnerable families stay warm each winter, while reducing their utility bills and our community's carbon footprint! This Wednesday, Oct. 18th is the first deadline to sign up for Project Warm's 41st annual Blitz! The Blitz utilizes volunteers to provide FREE weatherization supplies for elderly and disabled individuals across Jefferson County. This year, the Blitz will be taking place on Saturday, October 28th and Saturday, November 4th. Project Warm already has over 140 beneficiaries signed up to receive services during the Blitz, and they looking for many more to sign up by calling 502-636-9276. The Blitz relies on teams of volunteers to deliver weatherization kits and install plastic on participants windows, and that's where YOU come in! They are still looking for both individuals and teams to volunteer for the Blitz on both dates! On October 28th volunteers will be delivering weatherization kits to clients homes, while on November 4th volunteers will be installing plastic on windows for participants who cannot do it themselves. Volunteers are asked to arrive at the Project Warm office at YouthBuild's campus  in Smoketown between 9:00 and 10:00am, and the event is expected to run until about 2:00pm on both days. Breakfast will be provided courtesy of LG&E. Volunteer and participant sign-up DEADLINES are: October 18th for kit delivery and Oct. 31st for Installation Day. If you are interested in helping your community stay warm this year, sign up to volunteer - find the link at http://www.projectwarm.org Starting this week, Project Warm is also offering Energy Management Workshops which are free and open to the public. From October through January, Project Warm puts on Energy Management workshops for communities across Jefferson County. These workshops provide tips and tools for people to lower their utility bills and save money! Each participant receives a free weatherization kit upon completion of the workshop. My guest today often has photos on Nextdoor of amazing, exotic animals from all over the world! And if you're like me, you've wondered where in the world does she take those photos and how does she get them? Leigh Lofgren is going to answer those questions for us on the show today. But what I didn't know was the amazing life Leigh has led, before she even started taking those photo shots! Growing up in Sydney Australia, Leigh had a love for swimming, or should I say competitive swimming. At 16, she was the second fastest female swimmer in the world, in the 400 and the 800-meter events! Subsequently, she was drawn into television production, at a time when it was a male dominated field. She worked on some of the best-known live television shows in Australia, and later in England, becoming the first female director of Good Morning Britain! Leigh has met more celebrities than she can recall, including Richard Gere, Tom Cruise, Michael Douglas & Mick Jagger. We'll talk about a few of those on the show. After moving to New York with her husband Bob, she directed shows on the Food Network and shares her memories, and a couple stories, of Emeril Lagasse, yes the “Bam” guy! If there's one thing I wish my younger self knew, it's this: Pleasure is a practice. I wish the younger me knew, you're not intrinsically deficient in your lack of pleasure.  I would whisper, ‘always having something to unravel & heal' isn't necessarily going to bring you more pleasure, so don't go over the top down that path. Yes, it's necessary to master the skills of discomfort, vulnerability & tenderness. But this is just half the spectrum.  The other half is desire, joy, blessing, and radiance. This, too is a practice & skill to tolerate, allow in and embody.   I would tell myself to practice pleasure. Not by having lots of orgasms, but by the little moments of sunshine on my face at 10 am when the sun peeks through my living room window just so.  Practice pleasure in the sweet wishes I whisper as I light the candles on my family altar at dinner time.  Cultivating the skill of sensuous living is a practice of magic. In a tweet he released this morning blackface Trudeau said this:  “This morning, I tested positive for COVID-19. I'm feeling fine – and I'll continue to work remotely this week while following public health guidelines. Everyone, please get vaccinated and get boosted.” You can't help those who actively want to remain stubborn and ignorant.  Earlier today, my friend Alex Barendregt, was on the ground in Ottawa, and here is what he had to say about what happened this past weekend and what is going on this morning. Roll Clilp.  Apple is lobbying against a bill aimed at stopping forced labor in China https://www.washingtonpost.com/technology/2020/11/20/apple-uighur/ According to WaPo: “Apple lobbyists are trying to weaken a bill aimed at preventing forced labor in China, according to two congressional staffers familiar with the matter, highlighting the clash between its business imperatives and its official stance on human rights. The Uyghur Forced Labor Prevention Act would require U.S. companies to guarantee they do not use imprisoned or coerced workers from the predominantly Muslim region of Xinjiang, where academic researchers estimate the Chinese government has placed more than 1 million people into internment camps. Apple is heavily dependent on Chinese manufacturing, and human rights reports have identified instances in which alleged forced Uighur labor has been used in Apple's supply chain. The staffers, who spoke on the condition of anonymity because the talks with the company took place in private meetings, said Apple was one of many U.S. companies that oppose the bill as it's written. They declined to disclose details on the specific provisions Apple was trying to knock down or change because they feared providing that knowledge would identify them to Apple. But they both characterized Apple's effort as an attempt to water down the bill.” Now there are a couple of things going on here. First you have anonymous sources here, two congressional staffers to be exact, and so it is hard to trust this information. Secondly, we do know that Apple, Nike, and various high profile American corporations are very dependent on China. For example: Apple's Tim Cook made secret deal with China worth $275B in 2016. According to Fox, “Apple received legal exemptions from regulatory action.
