Marco is a University of Nebraska College of Law graduate and currently works as the Owner of Brown Family Law. This episode with Marco is full of amazing insights, and a ton of philosophical wisdom about work, life, and the Law! Marco and I start years before arriving at Law School. He would start at the University of Anchorage Alaska, and then head off to BYU, first majoring in Physics, then deciding to change to a psychology major, following in his grandmother's footsteps. With a degree in psychology, Marco would take 2 years would serve a mission for his church in Italy, as well as work with intellectually impaired individuals. Being too combative to be a psychologist, he decided Law School would be the next step in his journey. Marco and I would speak about his first year in Law School in which he described it as Learning to read Chinese, while writing a manual, in Chinese. He handled it gracefully with a firehouse of information and loved it immensely. We then went into the various internships and clerkships he had. Marco would key in on the fact that he wanted to be a criminal defense attorney but was not great at it, allowing him to narrow it down from his options. He suggests that Law Students try a wide range of experiences, and get good at what they enjoy. On top of going through his journey of Law School, Marco would give some of his critiques of Law School. We then moved to Marco hanging his shingle, opening up Brown Law LLC. Marco would describe the first years as walking blind through hell. Marco would describe the story of how he got into divorce law and spoke about the importance of reinventing yourself and solving those big problems, that lead to the solutions of 100s of small problems, or what he calls, an apex problem. Finally, Marco and I spoke about his love for Kafka, as well as his love for Pizza, one of the reasons why we know god loves us. Leon Circuit Judge Stephen Everett on Monday issued an order disqualifying Robert “Alex” Morris and Adam Komisar over actual and potential conflicts of interest. The order marked another twist in the murder of Dan Markel, the 41-year-old Florida State law professor and father of two who was fatally shot at his home on July 18, 2014. The two hired killers, an accomplice and Adelson's son, Charlie Adelson, have all been convicted on murder charges in the years since. #BestGuests: R. Earlier this month, a SpaceX mission called Polaris Dawn launched four civilians into outer space. The crew completed the first ever “commercial spacewalk” while floating more than 800 miles above the Earth's surface. But private companies aren't the only ones interested in exploring the stars. Militaries are increasingly using space for a comparative advantage, from Russia's plans to place a nuclear weapon into orbit to China's development of anti-satellite weapons for the final frontier. And while these “new space races” are full of emerging technology, the law that governs outer space is decades old and incomplete. Much of it was developed in the 1960s and 70s. It remains murky and the legal guardrails, where they exist, are largely untested. Recently, experts from academia, industry, and government have published the Woomera Manual on the International Law of Military Space Activities and Operations. The Manual is the first comprehensive and detailed articulation of how international law applies to military operations in outer space. What motivated the project of drafting the Manual, and how was it developed? How might it benefit the future development of space law and where do gaps remain? In January 2023, the FTC announced a proposed rule that would ban noncompete agreements across most of the U.S. economy – a move President Biden lauded in his recent State of the Union address. While noncompete clauses have existed for centuries and have traditionally been regulated under state law, they have also become a focal point for the executive and legislative branches of late. The FTC's proposed rule represents a recent effort to shift enforcement, both substantively and procedurally. The proposed rule purports to rely on the Commission's "unfair methods of competition" (UMC) authority under Section 5 of the FTC Act. This is the first time in decades the FTC has sought to engage in a UMC rulemaking, and only the second time it has ever done so.Questions are already beginning to arise as to not only the substantive benefits of such a ban, but also the FTC's underlying authority to enact this rule. As a threshold matter, the FTC's ability to engage in UMC rulemaking is somewhat unclear – the statutory basis for this authority is hotly disputed and very likely to be challenged. The FTC's assertion that the rule would supersede contradictory state laws is also likely to draw challenges. Moreover, many have raised concerns that the proposed rule – which the FTC argues would immediately impact about 20% of the U.S. workforce – runs afoul of the major questions and nondelegation doctrines. Additionally, there are questions regarding how such a rule would ultimately impact employees, employers, and the workforce more broadly – in particular, whether such a ban is more likely to enhance or impair innovation. As a Fellow, Kevin worked in the Department of Homeland Security Countering Weapons of Mass Destruction (CWMD) and CISA. At CWMD, he advised the Department of Homeland Security's Securing the Cities, BioWatch, and Chemical Defense programs on intergovernmental agreements. At CISA, Kevin provided counsel for the CISA COVID Crisis Action Team and provided legal support on regulatory, intelligence, chemical security, cybersecurity, infrastructure security, legislative, unmanned aerial vehicle, and supply chain security issues. Kevin holds a Secret clearance and has previously worked on Top Secret and Sensitive Compartmentalized Information (TS//SCI) programs and projects across the federal enterprise. Kevin graduated cum laude from the University of Nebraska College of Law with Concentrated Areas of Study in Space, Cyber, and Telecommunications Law and International and National Security Law. After graduation, Kevin supported NASA Kennedy Space Center's Launch Services Program (LSP), where he assisted in providing legal advice to program officials. During his legal career, Tory has been a trial lawyer in private practice, served as a judge advocate in the U.S. Air Force, clerked for two federal judges on the U.S. Court of Appeals for the Eighth Circuit, published seventeen articles, and taught law at Creighton University School of Law, Stetson University College of Law, the University of Nebraska College of Law, and Liberty Law. Tory teaches Property, Federal Jurisdiction, and Disability Law. Tory received his B.A. degree, Magna Cum Laude, from Culver-Stockton College. He was the first person in his family to attend college, and he now serves on the Board of Trustees of that college. Wade. For 49 years a woman has had the right to an abortion in the United States because of this ruling, but within the past year this constitutional right has been significantly restricted at the state level. With the Supreme Court set to offer an opinion on Dobbs v. Jackson Women's Health Orgnanization, which is a Mississippi law banning nearly all abortions after 15 weeks' gestational age, proponents and opponents of the law are cautiously waiting to see how this might affect the future of abortions in the country. He received his B.A. with Honors in History from Brown University, and his J.D. from Columbia Law School, where he was a Kent Scholar and an Articles Editor on the Columbia Law Review. After law school, Professor Berger clerked for the Honorable Merrick B. Garland on the United States Court of Appeals for the District of Columbia Circuit. He then practiced in Jenner & Block's Washington, D.C. office, where he worked on litigation in several state and federal trial and appellate courts, including the United States Supreme Court. Professor Berger's matters there included cases involving lethal injection, same-sex marriage, the detention of foreign nationals at Guantanamo Bay, and internet obscenity. Professor Berger teaches Constitutional Law I (structure), Constitutional Law II (rights), Constitutional History, Federal Courts, First Amendment, and Statutory Interpretation. He also teaches a class for undergraduates on Legislation and Regulation. He has been voted Professor of the Year by the upperclass law students six times. He has also received the College Distinguished Teaching Award (in 2010), the Law Alumni Council Distinguished Faculty Award (in 2018), and the John H. Binning Award for Excellence (in 2019). Prior to building his deep knowledge of the midwestern commercial real estate market, Boomer was an investment analyst at Merrill Lynch, where he watched the credit market collapse in 2008. During this experience, he realized the value of wealth building with tangible investments in commercial real estate, joining Pinnacle Commercial Group shortly thereafter. We are discussing the projects in a series of one-on-one discussions. This endeavor was undertaken in conjunction with the Space, Cyber, and Telecommunications Law Program at the University of Nebraska College of Law. Since then Dr. Al and his wife Lisa have worked tirelessly to build a successful dental practice. Today they have four growing locations and a central administrative office. Alligator Dental employs almost 50 staff and sees over 30,000 patient encounters annually. Dr. Al is a hands-on owner but practices full time and has an amazing administrative team that helps him run his organization. In addition to his private practice. Al has been part-time faculty at the pediatric dental program at the University of Texas Health Science Center at San Antonio since 2009. He has taught pediatric practice management at numerous programs and spent time himself as a part-time associate doctor in his early years as his practice was growing. In addition to hiring many of his own associates, he has mentored and counseled hundreds of residents in the transition to private practice with advice on contracts, evaluation of work opportunities, and being a sounding board.
