The DOJ's annual report for 2023 revealed that the agency's Health Care Fraud Unit was its busiest criminal enforcement section, responsible for convicting more than $3.8 billion in False Claims Act and whistleblower claims. There has reportedly been an uptick in whistleblower work among law firms and a record number of whistleblower cases. Still, some healthcare providers and hospital systems tend to hide their heads in their scrubs after being served.  Today we're going to talk about how whistleblower cases come about, the benefits of rewarding whistleblowers, how things are done differently outside the U.S., what's driving the acceleration of this area of law, and best practices when your company is served.  Drawing on his background as both public servant and private practitioner, my guest, Justin M. Lugar, counsel with WoodsRogers in Roanoke, Virginia, is going to walk through these issues and others. Justin represents clients in all types of government investigations. He's obviously well suited for the task. Prior to WoodsRogers he was Assistant U.S. Attorney in the Western District of Virginia, where he led the Affirmative Civil Enforcement team managing dozens of fraud investigations, many of which had parallel criminal investigations under the False Claims Act and related state statutes. Justin served as the Department of Justice's Civil Health Care Fraud Coordinator, Affirmative Civil Enforcement Coordinator, and Civil Rights Coordinator for the Western District of Virginia. Justin was recently recognized by the Drug Enforcement Agency for his efforts enforcing the Controlled Substances Act, leading to the largest fine assessed against a hospital system in the United States at the time.  When he was a  federal prosecutor, Justin led investigations involving numerous state and federal agency partners, from the FBI to the IRS to the Department of Energy to the FDA and the Defense Department.  Justin started his career at a major global firm in London, conducting international investigations around the globe.  But my favorite part of his background is – when he was a religious studies major in college – he lived at a Tibetan Buddhist Monastery in Kathmandu, Nepal. Not to brag, but I just returned from Vermont. There is more to Justin's background, like his LLM in international dispute resolution, which he earned at the School of Oriental and African Studies at the University of London, his J.D. from Liberty University School of Law, and his B.A. from the University of Virginia.  *******This podcast is the audio companion to the Journal of Emerging Issues in Litigation. LaGard Smith was born in 1944 in Houston, Texas, thereafter living in Shawnee and Tulsa, Oklahoma, Lancaster, Texas, and Birmingham, Alabama, before heading off to college at Florida College, graduating from Willamette University with both an undergraduate and law degree. Smith was a District Attorney for Malheur County, Oregon for three years, served as an administrator for the Oregon State Bar in Portland for a year, then spent 27 years teaching at Pepperdine University School of Law in Malibu, California, focusing on Criminal Law, Criminal Procedure, Trial Practice, and Law and Morality. For five years, Smith was Scholar in Residence for Christian Studies at Lipscomb University in Nashville, Tennessee, then taught for two years at Liberty University School of Law and for four years at Faulkner University's Jones School of Law in Montgomery, Alabama, before retiring to write full time. Smith has written some 35 books--legal, social, doctrinal, and devotional. He is most widely known as the compiler and narrator of "The Daily Bible" (the NIV and NLT in chronological order). He and his wife Ruth live in Murfreesboro, Tennessee, and, for several months a year, at their cottage in the English Cotswolds, where he does much of his writing. Today, I'm in Roanoke Virginia and before we continue our study in Psalm 106, I want to share a special prayer request and take the time to honor and celebrate the life of a dear friend who went to be with the Lord. This afternoon I will be officiating the homegoing service of David Adam McKelvey. I had the privilege to be his pastor and friend over the last 15 plus years. Adam suddenly and unexpectedly passed away in his sleep this past Sunday morning at the age of 41.  Please be in prayer for his wife, Jackie and his two sons, Sam and Ben, also his parents, his brothers and countless other loved ones and friends. I will have much to say about my friend's life and legacy at his service today, but for now I believe his obituary summarizes his impactful life in a beautiful way from which I copied the following: “For all that didn't know Adam well, he was a loving husband and devoted father who always protected and provided for his family.  He was a committed Christian. He was raised Lutheran, faithfully attended Rainbow Forest Baptist Church and was a member of the Gideons. He read scripture every morning and read through the Bible several times in recent years. Adam was intelligent, driven and ambitious.  He was a member of the inaugural class of the Liberty University School of Law and a respected member of the Roanoke Bar.  He first worked as a prosecutor in Halifax County, Virginia and soon became an attorney at Crandall and Katt, where he remained employed until his passing.  He also found great joy in serving as legal counsel for the Transnational Association of Christian Colleges and Schools (TRACS). Adam had a servant's heart sacrificially helping others without prompting and always looked for the good in people. He enjoyed using his spiritual gift of edification to encourage others and seemed to know what to say and do in times of doubt.  He was one of the most loyal, forgiving, trustworthy and sincere people that I have ever known.  He kept a mental short list of friends that he was “working on” and continually prayed for their salvation.  Greatly impacted by his Liberty High School football coach, Scott Abell, Adam loved coaching football and basketball.  He viewed sports as a ministry, developing kids not only as players, but also as people. During practices and games, he often tried to teach them life lessons and character traits that would serve them well once they became adults.  He never hid his faith and hoped to be a Christian influence in his players' lives. Adam often recalled that one of his biggest compliments came from a Roanoke City youth that told him on a car ride home from football practice that he had watched Adam interact with preachers, business leaders, strangers and folks in ankle bracelets and he treated every person with the same respect and consideration regardless of their status.  Adam said that's how it should be, because it's not our status in this world or what we accomplish on the field or on the court that makes each person valuable.  A person's value is rooted in the fact that they are made in God's image and we are precious in His sight.  Adam worked tirelessly for the good of others and often said his biggest problem is that there just aren't enough hours in a day to accomplish all that he wanted.  Adam was indeed a dear friend to me and was always more than willing to help me or help someone else in whatever way he could. I have countless stories of how he used his legal skills to assist others without asking for anything in return. When I needed to form Pastor Mike Impact Ministries as a 501-C3 with the IRS, Adam immediately volunteered to do all the legal and paperwork that goes with it and would not charge me a dime.

Most classical Christian educators talk about truth and goodness. But when it comes to beauty it seems as though it's not as critical or practical. At most, it's an excuse to put some nice artwork on the wall. Yet, when properly understood, beauty can be an antidote to much of the rising anxiety so prevalent in our culture. Even more, it is the door to understand truth and goodness. If we want to raise a generation to love what God loves then we need to figure out where beauty fits in to everyday life. Nick Duncan, a former professional chef and the 10th Grade Humanities Instructor at the Ambrose School in Meridan, Idaho, shares some of his own discoveries about beauty that will transform your school and home.-----BiographyNick Duncan received a BBA in Entrepreneurship Management from Boise State University in 2012 and an MDiv in Global Studies from Liberty University School of Divinity in 2016. He previously taught at the College of Western Idaho for four years. Most recently, he taught Greek I at The Ambrose School in  2017-2018 and currently is their 10th Grade Humanities. A major focus of study for him in Divinity school was how the New Testament authors, specifically Paul, were partially influenced by Greco-Roman philosophers, literature, and rhetoric. As such, he is able to teach his students about the ancient Greek and Roman philosophers and literature from a biblical perspective. Even if Scott is a tech guy and his family is inevitably hooked on their own gadgets, they still make it a point to put their technology down and spend time together, take a hike, or enjoy sometime unplugged – "and not make it the center of our lives," says Scott. That said, Scott says, technology in itself is not bad – there are just people who do bad things with it. In fact, we can do major good with the technology we have. Technology and platforms should be tools for you to use. You should not be a slave to it. Empower your kids to use these platforms for good using these tools. Scott suggests not allowing kids to have technology in their own rooms. Make sure that the technology is in a common area and there are no secrets. Encourage a healthy use of technology. Let your kids know that they are not being given restrictions because you are treating them like children. They should understand that these precautions are meant to protect them and it is for the whole family's safety. Technology can be dangerous, so as parents, really sit down with your family and have a serious conversation about how you are going to use technology. Ray Jones began to serve in the local church ministry in 1975, on a full-time basis. In 1981 Radiance Ministries was launched. Ray is the President and Founder of Radiance Ministries. The purpose of this ministry is to help the church get outside the walls of its buildings sharing Christ and helping people understand true worship of Jesus. Ray has traveled extensively nationally and internationally to Mexico, Russia (Moldova), Haiti and Central America to share Christ and teach the church about worship. During his time there, the church grew from 230 people in worship to over 20,000 in worship. The issue of election is perhaps the most controversial topic of discussion in all of theological discourse. One of the key questions in the election debate pertains to the level of freedom that people hold. Do people have the freedom to respond to the grace of God or is everything predetermined? Our guest today approaches the issue from a different and important perspective. Dr. Chad Thornhill examines the issue of election from the understanding of Second Temple Judaism in his book The Chosen People: Paul, Election, and Second Temple Judaism. Second Temple Judaism influenced the understanding of the New Testament writers, thus such a perspective is critical to our understanding of the issue. Today, Dr. Thornhill discusses some of his findings in his book. He will also talk about the importance of possessing a working knowledge of New Testament Greek in preparation for his latest book's release Greek for Everyone: Introductory Greek for Bible Study and Application. Dr. Chad Thornhill received his Ph.D. in Theology and Apologetics from Liberty University School of Divinity in 2012, his M.Div. and M.A. in Religion also from Liberty University School of Divinity.
