What can plan sponsors (and advisors) learn from litigation?  As it turns out, a lot – even if you aren't responsible for a billion-dollar plan.There are, of course, things to be learned from litigation.  We've learned that the plaintiffs' bar doesn't (always) knowhow to calculate fees (they rely on Form 5500), doesn't know how to calculate performance, and doesn't appreciate important distinctions in target-date fund glidepaths.  Though some do, of course. But the lessons drawn from litigation can serve as a reminder that fiduciaries should never assume, and never take anything for granted.  Particularly not only what the law allows, but what the plandocument permits.In a special edition of the Nevin & Fred podcast (or, if you prefer, a special edition of Prime Capital's The Reish Brief), Nevin (Adams) and Fred (Reish) cover a wide range of topics with plenty of lessons to learn.  We're talking about things like:1. For better or worse, Millennials and Gen Z have received a tremendous amount of attention and public scrutiny from professionals and social media influencers. Ahead of Patrick Nevin's release from prison, we speak to one of his victims who we are calling “Zara” who tells us her story. Listener discretion is advised.

Hundreds of years ago, a group of Native Americans living along the lower Susquehanna River made an indelible mark on the valley. At what is now known as Safe Harbor, they made hundreds of carvings into the rocks found in the middle of the river.Animals, bird and animal tracks, directional symbols, teaching or storytelling images, humans and anthropomorphic images, spiritual symbols and geometric and abstract designs were painstakingly carved into the boulder strewn landscape of the river. From the banks of the river, the sites look like any of the rocks found in the river. But up close, these stunning petroglyphs offer a window into a fascinating culture that we still know very little about. Despite Native Americans being driven from their homes, villages and hunting grounds. Despite countless floods. Despite dam construction. Despite pollution. Despite industry. And despite man's constant need to exert his will over the river, these magnificent petroglyphs remain.Big Indian Rock. Little Indian Rock. Circle Rock. Turkey Track Rock. Eagle Rock and Conestoga Rock.Right in the middle of the Susquehanna River, as they have for hundreds of years. These sites are sacred spaces for Native Americans. The Safe Harbor Petroglyphs are a rare, direct connection to Indigenous peoples who lived along the Susquehanna River long before European contact.For many Native communities, these carvings are not just historical artifacts but living cultural expressions—messages left by ancestors that carry spiritual meaning. Their location along the river, a vital life-giving force, further reinforces their sacred nature as places of reverence, storytelling and ancestral presence.And unlike many pieces of indigenous rock art, they are accessible to the public. But that accessibility comes with a responsibility. These carvings are irreplaceable cultural and spiritual expressions created by Indigenous peoples, and even small actions—touching the rock, climbing on it, or disturbing the surrounding area—can cause permanent damage.Visitors also have a responsibility to listen and learn. Approaching the petroglyphs with humility means acknowledging that this site holds meaning far deeper than what we may fully understand, and that it represents living cultures whose histories and voices have too often been ignored or erased.On this episode, I speak with Paul Nevin. ‘Tis the season for “best of,” “most,” and of course, “naughty and nice” list making.  In this episode Nevin (Adams) and Fred (Reish) share theirs with regard to retirement plans.In that holiday classic “Santa Claus is Coming to Town,”Santa is said to be “making a list and checking it twice…” all with the purpose of finding out “who's naughty and nice.” Well, in this special holiday-inspired episode, Nevin and Fred share their lists.  So, who/what is going to wind up with a lump of coal in their stocking?Here are our lists:Naughty 1. Surveys that promote bogus data to generate business for themselves.  Scare techniques generally, including by those who use surveys and studies to do that.2. Frivolous lawsuits - given multiple chances to make their claim(s) - the forfeiture suits primarily (note:  some of that comes from apparent conflicts in the laws and regulations…for example, the IRS says that using forfeitures to offset contributions is possible, but the DOL says that, if left to discretion, it is a fiduciary duty that must be in the best interest of participants.3. Social Security looming shortfalls left unaddressed - and everyone says it won't be a problem.  4. The lack of any integrated fiduciary/institutional answer to retirement income. In today's episode of Psych Talk I chat with Dr. Will Dobud, social worker, research, and senior lecturer about youth mental health. Will defines the "Kids these days" effect, which is also the title of his recent book with co-author Dr. Nevin Harper. Will discusses what inspired Nevin and him to write the book, as well as how it stands apart from other books on youth mental health. Will discusses the current state of youth mental health and various factors that are contributing to the current state of youth mental health. We discuss how Nevin and Will take a critical approach in the book, challenging their own and mainstream ideas about youth mental health and acknowledging the fact that, despite more therapists, awareness of mental health, and interventions, the research continues to show youth mental health is continuing to decline. Will also points out the cyclical nature of history and how many things we are discussing today with youth mental health have been discussed historically. On September 15, the IRS/Treasury announced the much-anticipated final regulations on SECURE 2.0's new limits on catch-up contributions.  In this episode Nevin & Fred talk about what lies ahead.These final regulations apply to retirement plans thatpermit participants who have attained age 50 to make additional elective deferrals that are catch-up contributions—which will now be restricted to Roth for individuals making $145,000 or more (adjusted for inflation), effective in January. A recent Plan Sponsor Council of America survey found thatfewer than 5% of plan sponsors said they were “ready to go” with these changes, while more than 4 in 10 were “struggling with payroll logistics.”  On the other hand, nearly as many (40.2%) said they expected to be ready by January 1. Award winning sound designer Nevin Steinberg has made it to the pod! Nevin is such a captivating storyteller and everything he talks about is infused with gorgeous detail and a palpable feeling of both awe and gratitude. You know how they say "how can you not be romantic about baseball?" How can you not be romantic about sound design?! That's what I say, anyway. In his first episode, Nevin walks us through his early career from working all night editing reel to reel tape with nothing but the ghost light and a healthy fear of the shadows (This is so fascinating and cinematic!! He can still taste the metal of the razor! That will make sense when you listen, I promise! I love it so much!) to dinner theatre and Sunset Boulevard and eventually a chance meeting on 42nd Street when he heard about a project called In the Heights.  Nevin has the most beautiful things to say about his experience working on Hamilton, including how it saved his career and reinstalled his faith in art and the people he gets to make it with.  Plus, Nevin explains audio details in songs like "Wait For It", "My Shot", "Yorktown", and "Satisfied" including how they changed from the workshops to what you hear on stage today (no matter where you see the show).
