Award winning sound designer Nevin Steinberg has made it to the pod! As interest rates rise, so has interest in pension risktransfer (PRT)—and litigation. Nevin & Fred take a look at what's underlying (and undermining) that focus, aswell as a new suit alleging aggressive participant marketing.Pension risk transfer is an aptly named process undertakenby an organization that wants to transfer its pension obligations to another entity, typically an insurance company. The process itself is a fiduciary decision requiring carefulconsideration of the entity to which those obligations are transferred—and therein lies the basis of a recent spate of litigation regarding those choices (and during a period of time in which PRT volumes have been setting records). For those not familiar with the underpinnings of the pensionrisk transfer (PRT—because we need another acronym), IB 95-1, issued by the Department of Labor in 1995 (in the wake of the Executive Life collapse), outlines the fiduciary standards to be used in selecting an annuity provider for a pension risk transfer. That includes considerations of the provider's investment portfolio, size relative to the annuity contract, level of capital and surplus, liability exposure andavailability of state government guaranty associations.In 2024, and in accordance with the provisions of the SECURE2.0 Act of 2022, the Labor Department basically concluded that while it was open to, and still considering, potential updates to Interpretive Bulletin 95-1, it felt that that document “continues to identify broad factors that are relevant to a fiduciary's prudent and loyal evaluation of an annuity provider's claims-paying ability and creditworthiness.” Additionally, EBSA found it “desirable for guidance in this area to remain principles based.” In this episode, Nevin (Adams) and Fred (Reish) talk about the trends and issues here. A “new” entrant to the forfeiture reallocation suit “suite”—and a decision in favor of fiduciary defendants. Nevin & Fred review the latest developments.Yet another 401(k) forfeiture fiduciary breach suit has beenfiled—but there are some key differences: The plaintiffs are represented by the law firm of Schlichter Bogard, LLC. The plan involved was the largest targeted by this type of litigation to date (nearly $8 billion). The plan document language prohibited use of forfeitures to offset employer contributions before offsetting administrative expenses (at least according to the suit).And then there is a case that has been through severalrounds of adjudication—and though winning, has had to keep going back to court. I've always been fascinated by post-apocalyptic worlds where humans are forced into these intense fight-or-flight situations. When I started writing Aftermath, I wanted to bring that vibe to life while still keeping it character-driven. The idea was to make the world feel bigger than what's shown in the short, like a teaser for something larger. With limited time and budget, I couldn't dive into elaborate effects or massive world-building, but I could hint at it. The goal was to test the waters for a story that could expand, maybe even into a series someday. I drew inspiration from I Am Legend, Hunger Games, and Squid Game, mixing the best elements to create a mysterious world that leaves the audience with questions, not about what's happening to the characters in the moment, but about the world itself. That's the kind of storytelling I love, where curiosity keeps people hooked. How did it feel to watch the audience feedback on your film? It made me smile. My goal is always to create something magical, and hearing people talk about the creativity in the shots or the direction was so rewarding. No film shoot goes perfectly, we had our share of issues, like reworking shots or cutting things in post. But seeing the audience still connect with the world we created and appreciate its originality was incredible. It's moments like that that make all the effort worth it. In episode 128: Born to Run; the guys sit down in studio with Nevin Sr., a retired truck driver and man of many hats! Nevin had been in and around trucks since he was 5 years old, and his dad would take him along to the butcher's. There Nevin would enjoy the old, beaten-up, truck behind the butcher's shop, pretending to shift gears and drive all over the world. From that point on he had a hankering for the open road. As time went on, he got a job on a farm and then graduated into longer distances. From Dallas to New England, Nevin covered thousands of miles and eventually was able to accomplish a dream of his, and own a farm. All of this didn't come without some unbelievable stories along the way. He's had failed brakes, Cabbage Patch nightmares, and even a wild hurricane experience. Needless to say, Nevin has seen it all, or at least more than most, and we enjoyed the time spent sitting down with him.
