It's time to take a walk down 'Treaty Road'.While exploring his Métis ancestry, writer/director Saxon de Cocq discovered that his great grandfather (x4) was the Honorable James McKay, a prominent Métis from the Red River area. McKay was involved in many of the Numbered Treaty negotiations, eventually becoming a Treaty Commissioner. With mixed feelings, Saxon is driven to learn more... what was McKay's involvement, his motivations for playing a pivotal role in this part of history? Saxon enlists the help of his friend Erin Goodpipe, a community educator and researcher who has devoted years in building her knowledge around Aboriginal and Treaty Rights. A complex but truly important thing for anyone to see as it opens audiences to the treaties and how they've been used to exploit our First Nations peoples....and still are....We had the pleasure to sit down with Saxon and Erin to discuss the origins of the series, the why behind wanting to tell this story and so very much more.

Tribes in Central Oregon are fighting a county-approved plan to build a luxury resort on their ancestral lands, which could further deplete the region's shrinking groundwater supply. This week, an appeals court is hearing arguments over whether that development may violate treaty rights. Bennet Goldstein of Wisconsin Watch joined a fishing excursion in Lake Superior while reporting on the central role of fishing to the Red Cliff Band of Lake Superior Chippewa and other Ojibwe communities in the Upper Midwest. States spent a century disregarding or rejecting treaty rights — fining or arresting tribal citizens who exercised them, Goldstein reports. A series of court rulings, starting in 1971, would affirm their reserved rights within territory ceded to the United States, including the right to fish on Lake Superior. But pollution in the Great Lakes — including hazardous PFAS chemicals — encroaches on how Ojibwe communities exercise their treaty rights, scholars and environmental advocates told Goldstein. Tribes aim to fill regulatory vacuums through their own regulation and input they share on cross-government committees. They may get support from a U.S. Environmental Protection Agency proposal that elevates consideration of treaty rights when states set water quality regulations. Sometimes, we can make the mistake of thinking history only applies to things that happened long ago. But as Wisconsin-based beer historian and writer John Harry reminds us, events that happened in our lifetime can still resonate and help inform our collective understanding of yesterday, today, and tomorrow. In his piece titled “Racism in a Can' — How One Beer Epitomized the Native American Struggle for Treaty Rights,” which was published on April 14, 2022, John describes how one beer, which was inspired as a fundraiser for a white supremacist initiative against Native American rights, changed Wisconsin forever. That beer, known as Treaty Beer, ultimately lost money and steam, but the stain of its racist agenda is still felt in the area today. In fact, in our conversation, John reveals how hard it was to get anyone to speak with him for this story, how he came across Treaty Beer, and why he decided to research its place in regional history. We also talk about how in reality, cancel culture is actually just consequences and accountability, and why education is key to understanding fundamental human issues. John explains that despite a history of repeated oathbreaking by the United States government, especially towards its Indigenous population, any treaty made in good faith between two sovereign nations is just as legitimate as any other. Beer history is never just about the beer, and there's plenty of work to be done to continue questioning, fighting, and improving.

Today I am sitting with Spencer Greening La'goot, Indigenous scholar and Jesse Zeman, executive director of the BCWF to discuss a tough topic. The news of restrictions for resident hunters as a result of the BC Government losing the Yahey vs. British Columbia court case has the potential to cause polarizing views. Pitting resident hunters against Indigenous Nations in a perceived competition for “the right to hunt and conducting one's way of life” is not only dangerous in its potential for hindering reconciliation efforts, but it effectively takes the focus off the main issue: habitat loss. My guests provide the context of this court decision, share important insight into how it was interpreted by the BC Government when implementing the measures that were just announced, and together we explore alternative strategies to support reconciliation. The proposal from the BC Government is open for feedback until March 23 at midnight. In a much belated episode of Sequel Decay, Chris and Stefan look back on Frank Herbert's sci-fi masterpiece, the book's ecological and political implications, as well as the several adaptations that failed to or successfully came to be. Before the arrival of Europeans, the Ojibwe nation occupied much of the Lake Superior region, including what is now Ontario in Canada and Michigan, Wisconsin, and Minnesota in the United States. In 1850, President Zachary Taylor's administration, in response to demands from European Americans, planned to force the Ojibwe of Wisconsin west of the Mississippi in violation of signed treaties. They planned to bring the Ojibwe to Minnesota from Wisconsin in late fall so that they would have to stay for the winter, wearing down their resistance to relocation. Nearly 3000 Ojibwe men made the long journey to Sandy Lake, Minnesota, where they waited for weeks for a government agent to arrive and even longer for what turned out to be spoiled food and only a small portion of the payment and goods they were due. The conditions were so poor that 150 men died of disease, starvation, or freezing. On the treacherous return journey to Wisconsin another 200 men died. In 1852, Chief Buffalo, the principal chief of the Lake Superior Ojibwe, traveled to Washington, DC, by birchbark canoe with three other men, to press President Millard Fillmore to cancel the removal order. They managed to find an audience with Fillmore, who upon hearing about the broken treaty promises and the tragedy at Sandy Lake, agreed to cancel the removal order and work on a new treaty. The 1854 Treaty of LaPointe allowed the Ojibwe to stay in their traditional territories and created permanent reservations of land for many of the bands, including the Red Cliff. Under the treaties, the tribes reserved certain rights, including rights to hunt, fish, and gather on the lands that they ceded. In the more than 150 years since the 1854 Treaty of LaPointe, the sovereignty of the Ojibwe people has been threatened time and time again, and it's taken Ojibwe activism to protect the rights. On June 29, the BC Supreme Court ruled that the B.C. government had breached the treaty rights of the Blueberry River First Nations. In her ruling, Justice Burke said that the province has allowed so much development in their territory that they can no longer meaningfully exercise their rights under Treaty 8. Lawyers for the Blueberry River First Nations have called the ruling a ‘complete vindication' of the Nations' position. Lisa Glowacki is co-counsel for the Nations.

The Blueberry First Nation in northeastern B.C. has managed to stop the approval of all new energy projects in the region. That means no new pipelines, no new fracking wells, no new development without their say-so. Lawyer Chris Tollefson breaks down the landmark ruling.

Reflecting on the history and relationships that underpin two documentary films they made together, Dr. Sherry Pictou and Dr. Martha Stiegman discuss how the Mi'kmaq work to assert treaty rights over their land and fisheries in the face of colonialism and neoliberalism.
In this episode, Kiegan Irish and Alex Boos revisit and contemplate historical moments and trajectories that trace out certain facets of the encounter between Europeans and Indigenous peoples on Turtle Island. Taking a dual historical approach that blends Linda Tuhiwai Smith's decolonial methodology of Indigenizing discourse with a historical materialist analysis borrowed from Marxism, we consider some of the effects of the colonial dynamics of the European-Indigenous fur trade on both Indigenous and European societies and examine the structure and evolution of specific French trading companies to pinpoint their roles both as vanguards of European economic trading practices and as founding components to the Canadian settler colonial state. These accounts are followed by a look at the Treaty of Niagara and the Royal Proclamation of 1763, two significant historical events and documents that, had their principles been respected, could have changed the course of history in Indigenous-settler political relations.
