This Day in Legal History: Fugitive Slave Act SignedOn September 18, 1850, U.S. President Millard Fillmore signed the Fugitive Slave Act into law, a key and highly controversial component of the Compromise of 1850 and a dark moment in American history – unfortunately, one among many in the 19th century. The Act required that escaped slaves, even if they had reached free states, be captured and returned to their enslavers. It also imposed heavy penalties on anyone who aided a fugitive slave, including fines and imprisonment. Disturbingly, the law authorized federal marshals and local law enforcement to arrest individuals based on little more than a slaveholder's claim, placing free Black men and women at risk of being falsely accused and sold into slavery.The Fugitive Slave Act enraged abolitionists and free states in the North, who viewed the law as a gross infringement on their legal sovereignty and moral principles. Northern citizens were now legally obligated to participate in the enforcement of slavery, a practice many detested. Conversely, slaveholders in the South celebrated the law as a victory, seeing it as essential for the preservation of their economic system. This deepened the divide between North and South, escalating tensions that would eventually lead to the Civil War. The Act's passage not only exposed the fragility of compromises between pro-slavery and anti-slavery factions but also galvanized the abolitionist movement. It showed how far the federal government was willing to go to protect the institution of slavery, making resistance increasingly inevitable.In a piece I wrote for Forbes, I weighed in to a tax policy proposed by former President Donald Trump. Floated by Trump at a rally in Arizona, the "No Tax on Overtime" policy aims to eliminate income tax on overtime pay, echoing a previous proposal to end taxes on tips. While the policy is presented as a way to relieve tax burdens on hourly workers, a closer analysis reveals several potential issues. By creating a tax-free incentive for overtime, the policy could favor workers able to put in extra hours, leaving others—like working parents—disadvantaged. This could deepen income inequality, as those unable to work overtime would continue paying taxes on their standard wages, while others benefit from a lighter tax burden. Additionally, employers may shift compensation structures to push for longer working hours, leading to lower base wages and a culture of overwork. Implementation of the policy would also create administrative challenges for employers and the IRS. Instead of targeted tax breaks, broader reforms like increasing the federal minimum wage might better address wage inequities without distorting the labor market.‘No Tax On Overtime' Policy Would Be Even Worse Than ‘No Tax On Tips'In the first 10 days of Kamala Harris's presidential campaign, lawyers contributed more to her than they did to Donald Trump's campaign over nearly two years, according to Federal Election Commission (FEC) data. Harris received nearly $8.3 million from around 26,000 contributions from individuals listing "attorney" or "lawyer" as their occupation after Joe Biden endorsed her in July 2024. In comparison, Trump's campaign, which began in November 2022, raised about $6.88 million from lawyers over that entire period. Lawyers have historically favored Democratic candidates, with Harris's and Biden's campaigns together raising significantly more from the legal profession than Trump's campaign. In previous elections, Democratic candidates like Barack Obama, Hillary Clinton, and Joe Biden have all received much more financial support from lawyers than their Republican counterparts. The data reflects a broader trend where large law firms and individual lawyers increasingly lean toward Democratic candidates.Lawyers Give More to Harris in 10 Days Than Trump in Entire RaceDonald Trump recently pledged to restore the state and local tax (SALT) deduction, a tax break he limited during his presidency as part of the 2017 Tax Cuts and Jobs Act. In a post on Truth Social, Trump promised to reverse the $10,000 cap on SALT deductions, which has disproportionately impacted residents in high-tax areas like New York, especially in suburban areas where property values are high. The cap was initially supported by Republicans as it helped balance tax cuts elsewhere in the law. Senate Majority Leader Chuck Schumer criticized Trump's reversal, pointing out that Trump himself had imposed the cap. Repealing the limit could add an estimated $1.2 trillion to the cost of extending the tax law. Trump's focus on this issue, particularly in Long Island, reflects the area's significance in ongoing battles for control of the U.S. House of Representatives.Trump Pledges to Restore SALT Write-Off, Tax Break He Curbed (1)Yesterday, on September 17, 2024, California Governor Gavin Newsom signed two bills designed to protect actors and performers from unauthorized use of their digital likenesses by artificial intelligence. One bill mandates that contracts specify when AI-generated replicas of a performer's voice or image will be used, requiring the performer to have professional representation in contract negotiations. The other bill prohibits the commercial use of digital replicas of deceased performers without consent from their estates. The first time I ever posited in public that his brain doesn't work right was in a piece and video I did for Vanity Fair in 2016 called Could Trump Pass A Sanity Test and I do NOT know what the next step DOWN is mentally or psychologically or intellectually from “no he could NOT pass a sanity test” but Trump has now reached it: one speech, five statements that in a previous century would have been examined as signs of possible tertiary syphilis. At Derry, New Hampshire he a) showed he believed he was the first person to ever realize the letters U and S could spell "us" AND "U.S;" b) revealed he didn't know why FDR "sat" while he spoke nor what the thing he sat in was called; c) confused Turkey's Erdogan and Hungary's Orban; d) claimed he was Nelson Mandela; and e) told his voters not to bother to vote. Trump is crazy. Those who opposed him shied away from this in 2016 and 2020. It needs to be mentioned hourly, because it's not only true and an existential danger - it's also perfect politics - the ideal answer to the slanders about Biden's age and acuity.  Also: Judge Michael Luttig is back with another Constitutional answer to a Trump lie. If you don't know about the Presidential Vesting Clause in Article 2, it's why Trump does NOT have "absolute immunity" for trying to overturn an election while president. Luttig and 23 other former Republican officeholders filed a brief with the court saying this was a threat to the integrity of all future elections. Trump continues to dare a judge to jail him for violating his various gag orders; he's caught in a bald-faced lie about whether or not Sidney Powell ever worked for him; the essence of the Jack Smith case against him is proved by Kenneth Chesebro taking a plea deal; and is the Republican Civil War over the Speaker of the House (now extended to Trump pretending he's not trying to sabotage Tom Emmer) enough to send five Republicans to form their own third party and get one of their group elected by the Democrats as the new Speaker? Is the GOP about to re-enact what destroyed the Whig Party in 1852? On this day in legal history, September 28, 1850, President Millard Fillmore signed an appropriations bill that abolished flogging as a punishment in the Navy. Flogging, carried out with a cat-o-nine-tails—a whip made of nine knotted ropes—was a common method for maintaining discipline on naval ships. The move to end flogging was influenced by public opinion, which had been galvanized by two significant publications: "Two Years Before the Mast" by Richard Henry Dana, Jr. in 1840, and "White-Jacket" by Herman Melville in 1850. Between December 1849 and June 1850, the Senate received 271 petitions from citizens urging the end of this cruel practice.Democratic Senator John P. Hale of New Hampshire had previously attempted to abolish flogging but found success only when the public mood shifted. When Congress ended flogging, it did not immediately suggest alternative disciplinary methods. Naval officers experimented with various forms of punishment, including tattooing, branding, and confinement in irons on bread and water. However, long-term confinement was generally avoided as it took sailors away from their duties, increasing the workload for others.In 1853, President Millard Fillmore issued a "System of Orders and Instructions" to guide naval discipline, but this was deemed unconstitutional as it infringed on Congress's power to set rules for the Navy. Finally, in 1855, Congress established a new disciplinary system based on rewards and punishments. Despite these reforms, some harsh practices like branding with a hot iron or tattooing were not completely outlawed until 1872.Abraham Lincoln advocated for flogging as judicial punishment for men found guilty of spousal abuse, a crime then-referred to as “wife-beating.” It remained on the books in many states as a punishment for that crime well in to the 20th century, with the last recorded instance of it being meted out occurring in Delaware in 1951. The future of mobile sports betting in Florida is uncertain as local casinos have challenged a $2.5 billion deal between Governor Ron DeSantis and the Seminole Tribe of Florida. The casinos filed a petition in the Florida Supreme Court, alleging that the 2021 agreement allowing the tribe to operate "off-reservation" mobile sports betting violates the state constitution. According to the casinos, the constitution would need to be amended to permit expanded tribal gaming beyond tribal lands. The complaint accuses the Governor and the state Legislature of circumventing the constitution by deeming online bets placed anywhere in the state as having occurred "exclusively" on tribal lands.This legal challenge is the latest development in an ongoing saga that will determine the future of sports betting in Florida, a state with a strong following for both professional and college sports. The casinos had previously lost a federal Administrative Procedure Act challenge in a federal appeals court in June. However, the court explicitly stated that it was not ruling on the constitutionality of the pact under Florida law, leaving that question for the state's courts to decide. An attempt to implement the Fugitive Slave Clause of the Constitution, the act, at best, had serious constitutional issues. In response, as had been done under the previous act, states passed Personal Liberty Laws which nullified the federal act in practice and effect. Treaty Rights of the Red Cliff Band of Lake Superior Ojibwe

Before the arrival of Europeans, the Ojibwe nation occupied much of the Lake Superior region, including what is now Ontario in Canada and Michigan, Wisconsin, and Minnesota in the United States. In 1850, President Zachary Taylor's administration, in response to demands from European Americans, planned to force the Ojibwe of Wisconsin west of the Mississippi in violation of signed treaties. They planned to bring the Ojibwe to Minnesota from Wisconsin in late fall so that they would have to stay for the winter, wearing down their resistance to relocation. Nearly 3000 Ojibwe men made the long journey to Sandy Lake, Minnesota, where they waited for weeks for a government agent to arrive and even longer for what turned out to be spoiled food and only a small portion of the payment and goods they were due. The conditions were so poor that 150 men died of disease, starvation, or freezing. On the treacherous return journey to Wisconsin another 200 men died. In 1852, Chief Buffalo, the principal chief of the Lake Superior Ojibwe, traveled to Washington, DC, by birchbark canoe with three other men, to press President Millard Fillmore to cancel the removal order. They managed to find an audience with Fillmore, who upon hearing about the broken treaty promises and the tragedy at Sandy Lake, agreed to cancel the removal order and work on a new treaty. The 1854 Treaty of LaPointe allowed the Ojibwe to stay in their traditional territories and created permanent reservations of land for many of the bands, including the Red Cliff. Under the treaties, the tribes reserved certain rights, including rights to hunt, fish, and gather on the lands that they ceded. In the more than 150 years since the 1854 Treaty of LaPointe, the sovereignty of the Ojibwe people has been threatened time and time again, and it's taken Ojibwe activism to protect the rights. Joining me to help us learn more about the Red Cliff Ojibwe, the importance of treaties, and the Native activism needed to defend them is Dr. Katrina Phillips, an enrolled member of the Red Cliff Band of Lake Superior Ojibwe, Assistant Professor of Native American History at Macalester College, and author of Staging Indigeneity: Salvage Tourism and the Performance of Native American History.
