Welcome to the American Railroading Podcast! In this episode our host Don Walsh is joined by guest Betsy Cantwell – President of GoRail. Together they discuss the legislation pending in DC that will impact the rail industry such as the Railway Safety Act and overall Surface Transportation Bill. They do a deep dive into the current and impressive safety record of the rail industry, review all the programs GoRail offers to foster local community-based rail advocacy such as Rail Champions, as well as their Rail Grant Hub, accessibility to freight rail policy and data, and much more! Tune in to this episode to gain valuable insights and broaden your understanding of American Railroading! You can find this episode and more on the American Railroading Podcast's official website at www.AmericanRailroading.net , and watch our YouTube Channel at the link below. Welcome aboard!KEY POINTS: The American Railroading Podcast remains in the Top 10% of all podcasts globally, now downloaded in 83 countries, nearly 50% of the world!Don announces the celebration of the podcast's 3-Year Anniversary! Time sure flies!Since joining GoRail in 2015, Betsy has led the organization's advocacy and communications strategy to build public and political support for freight rail, including earned media, digital campaigns, grassroots mobilization, and message development, aimed at making freight rail policy accessible and compelling to the communities it impacts the most.Per the GoRail website at www.GoRail.org, founded in 2004 on the principle that “all politics is local,” GoRail believes that direct input from constituents is the best way to communicate with elected officials. GoRail works with thousands of community leaders across the country to tell the local story of freight rail — stronger economies, more jobs and cleaner skies.Among all the data available on the GoRail Website is a link to “Check Data for Rail in Your State”, which not only provides the data and benefits of rail in your state, but also gives contact information for your state reps and each major railroad.Betsy gives her opinion on the potential pros and cons of the pending Railway Safety Act and Surface Transportation Act.2025 has been reported as the safest year on record for the rail industry, with improvements across almost every safety metric. According to the Association of American Railroads, Freight Rail Safety - Fact Sheet available at www.AAR.org , the overall train accident rate declined 14 percent year-over-year, while derailments, equipment caused accidents, and track caused accidents each fell to the lowest levels in the railroad industry's history. In a press conference from March 13, 2023, former STB Chairman, Marty Oberman stated in part regarding rail safety: “The Bureau of Transportation Statistics documented last year (2022) that 94% of all hazardous materials spills occurred on truck and only 1% occurred on rail. So if you were trying to make sure communities all over the country are safer, you would want to move more of this material by train, rather than by truck”.Don encourages everyone to follow him on his LinkedIn page at Don Walsh | LinkedIn , and to review his article he published 05/21/26 titled “Railroads Helped Build America & New Policy will Shape the Future of Railroading”. Despite a prolonged period of policy uncertainty in the U.S.—and the ripple effects across the global life sciences and healthcare industries—executives at health companies are still seeing opportunities amid the tumult. In many cases, they’re finding that the resilient business models they built through disruptions like the pandemic have positioned their companies not just to survive, but to thrive in a new normal for the industry. In this episode of “The Top Line,” Fierce Pharma’s Fraiser Kansteiner chats with Glenn Hunzinger, PwC’s U.S. health industries leader, about results from the firm’s recent survey on investor sentiment. Focusing on health companies, Hunzinger explains how many innovative drugmakers have managed to capitalize on the shifting environment. Still, he warns that a more uncertain landscape for U.S. innovation and continued tariff pressures on sectors such as medtech could pose challenges down the line. Send us a Positive Review! In this follow up episode on recent LDS news that women are now allowed to serve in Sunday School presidencies, Val & Nathan pivot to the peculiar part of the announcement prohibiting no "mixed-gender" presidencies and share the outcome of their exploration of this odd move. Upon deeper reflection, the move seems less about worries about slippery slopes towards sexual iniquity and possibly more about preserving another kind of slippery slope--the one that disrupts what some feel is the "natural order of the universe". If a female formally presides over a male in one realm of the LDS church, what could this possibly lead to? Listen in as we propose that moves of this nature is proof that ultimately an all male priesthood must be surrendered...even if excruciatingly slowly...if the LDS church is going to survive in the long run. THIS IS A REPUBLICATION OF THE SAME PODCAST AS THURSDAY 26 MARCH ON THE IOC FEMALE SPORT POLICYWith apologies for confusion, after we published our most recent podcast on the IOC's new policy for women's sport, we realized the original file had an issue with the syncing of the two audio streams. That was fixed on the day, but it has continued affected some listeners, and so we are just republishing it here, so that we can be sure that the issue is resolved for what we think is an important podcast, not one we want to be unlistenable because of that problem. Thanks for listening!Show notesThe International Olympic Committee, under its new President Kirsty Coventry, has announced new guidelines for eligibility in women's sport. The central decision is clear: the boundaries around women's sport will be protected, with no males — whether they identify as transgender or are athletes with specified differences of sex development (DSDs) — eligible to compete in the women's category. Women's sport is now female only. This is a strong, unified position. The policy mandates the eligibility requirement across all Member Federations, establishing a central global standard that should help bring an end to the fragmentation that has affected the sporting landscape in recent years. It also sets out a clear process for determining eligibility: screening for the presence of the SRY gene, followed by further testing where needed to confirm the specific diagnosis, and then a decision on inclusion or exclusion. specifies that eligibility for women's sport must be confirmed through a process involving screening for a gene (SRY), followed by testing to diagnose the specific question, and then inclusion or exclusion. This represents a significant moment for women's sport. It reverses generations of policies that allowed males into women's competition, often at the expense of fairness and safety. In this short podcast, we examine the finer details of the new policy, what remains unclear, how we arrived at this point, and what the changes may mean for sport and for female athletes going forward.LinksThe IOC policyThe IOC's statement accompanying the policy Hosted on Acast. In this episode, Tom Fox welcomes back Hughes Hubbard partner Mike DeBernardis to discuss the Southern District of New York's new corporate enforcement voluntary self-disclosure program for financial crimes and why SDNY leadership, including Jay Clayton, likely issued it: to encourage self-disclosure that saves enforcement resources and supports DOJ's focus on individual accountability. They compare the policy to the (former) DOJ's Corporate Enforcement Policy, highlighting notable distinctions such as SDNY's narrower scope (financial/market integrity offenses) and a revised approach to aggravating factors that excludes common CEP considerations like seriousness, pervasiveness, and senior management involvement, while carving out categories including foreign bribery and sanctions evasion, potentially reducing forum shopping. They also examine a “conditional declination” within two to three weeks, its implications for investigation speed and timeliness, and added pressure from whistleblower programs and compressed internal triage timelines. Peter & Phil explore a question many people are feeling but rarely say out loud: when did fear become a tool of governance? They reflect on recent violence, government accountability, and the growing presence of force, while examining what happens when citizens feel managed instead of protected. The conversation dives into civil rights, civic responsibility, and whether resistance (including open dialogue and even a tax revolt) is a valid response to government overreach. They don't aim to agree on everything, but to create space for honest discussion. Join us for another courageous conversation!

This week on the award-winning Consumer Finance Monitor Podcast, host Alan Kaplinsky is joined by Senior Counsel Mark Levin and special guest Professor Mohsen Manesh for a powerful roundtable on one of today's most consequential topics: the SEC's new position on mandatory arbitration in corporate governance documents and how state law and market realities are shaping the future for consumer financial services companies, investors, and legal counsel. Meet the Speakers: Alan Kaplinsky - Host and Senior Counsel at Ballard Spahr's Consumer Financial Services Group, Alan brings decades of expertise in arbitration and class action waivers to the table. Mark Levin - A leading authority on arbitration provisions and regulatory compliance, Mark (now retired) was a seasoned attorney at Ballard Spahr and long-time collaborator with Alan. Mohsen Manesh - The L.L. Stewart Professor of Business Law at the University of Oregon, Mohsen is a nationally recognized legal scholar and co-author of a widely cited NYU Law Review article on shareholder arbitration clauses. In This Episode, the Panel Explores: The SEC's Policy Shift: Why the SEC now allows mandatory arbitration provisions in registration statements, and how the focus has moved to disclosure, not the substance, of arbitration clauses. State Law Challenges: How Delaware's SB 95 (DGCL 115(c)) bans arbitration provisions for federal securities law claims in corporate charters, and the legislative backstory behind this move. Federal vs. State Authority: The panel debates whether states like Delaware can lawfully prohibit shareholder arbitration in corporate charters without being preempted by the Federal Arbitration Act (FAA). Practical Guidance for Issuers: The importance for issuers of providing clear, plain-language disclosures about arbitration clauses and drafting these provisions conservatively while preserving statutory remedies to address current legal and regulatory challenges. Market Realities and Investor Response: Despite ongoing legal debates, public companies thus far have shown little interest in reincorporating elsewhere to enable arbitration provisions, as both shareholder demand for mandatory arbitration and management support for such proposals remain limited. Issuer and Investor Impact: While arbitration can offer faster, more efficient, and confidential dispute resolution and reduce costly class actions, it may also limit options for class-wide remedies and restrict investor recourse. What's Next? With the SEC's new stance and ongoing uncertainty about the interplay with state laws, the landscape for shareholder arbitration is in flux—and this episode breaks down the key issues you need to watch. Whether you're a legal professional, corporate executive, or investor, this episode delivers sharp insight and practical takeaways on regulatory trends that could reshape the field of consumer financial services. Consumer Finance Monitor is hosted by Alan Kaplinsky, Senior Counsel at Ballard Spahr, and the founder and former chair of the firm's Consumer Financial Services Group. We encourage listeners to subscribe to the podcast on their preferred platform for weekly insights into developments in the consumer finance industry. Following this episode, Professor Mohsen Manesh released a new article, The Past, Present, and Likely Future of Shareholder Arbitration, which builds directly on the insights he shared on the podcast. The holidays are fast approaching. And for many of us, I've been spending more time in big box stores and shopping malls than we'd prefer. Many businesses continue to struggle. First, they dealt with the effects of the pandemic a few years ago. But since then, the economy has been up and down, which has people worried. One store, Target, has a new policy that it believes will boost its business and get it back on track. Their new CEO thinks Customer service is the key. And he thinks he's come up with an idea that'll help deliver exceptional service. And well, that may matter to some people, but for many, it's all about saving money... One early adopter of the no-phones policy was Georgetown Day School in Tenleytown. Back in June we talked to their head of school, Russell Shaw, about why and what results they've seen because of it. It's Hump Day! Sam speaks with Tariq Habash, former senior official at the Dept. of Education under President Biden, founder & director of the organization A New Policy, to discuss the Trump administration's actions taken regarding student loans. Then, he speaks with Dr. MarkAlain Dery, infectious disease specialist, founder of community radio station 102.3 WHIV-FM, and creator of the NoiseFilter podcast, to discuss the recent measles outbreaks in Texas & New Mexico. First, Sam runs through updates on Europe's retaliatory tariffs, public backlash to Trump's handling of the economy, the House's passage of a Continuing Resolution as the fight moves to the Senate, Trump's slashing of the DOE, Trump's $100m Tesla deal, Trump's disappearing of Columbia student and permanent US resident Mahmoud Khalil, Ukraine's support for a ceasefire, the DOJ's public corruption unit, and cuts to NOAA and the EPA, before expanding on the insane debate over the GOP's “clean” Continuing Resolution, and why Senate Democrats are so willing to hand over the US government to Elon Musk. Tariq Habash then joins, first stepping back to walk through his experience working in Biden's DOE before leaving in protest at the start of last year over the President's support of Israel's ethnic cleansing of Gaza, and unpack why the internal barriers to policy work so pushed him to establishing “A New Policy.” Moving forward, Habash explores why, despite Democrats' desires, the issue of the ethnic cleansing of Gaza will not go away under Trump, with his dreams to fully redevelop the Gaza strip in his own immaged backed by his revamping of Israel's assault and a domestic crackdown (including full-on dissappearings) of pro-Palestinian activism, with the recent abduction of Mahmoud Khalil working as Trump's perfect crime to wage war on the rights of Black and Brown permanant residents – capitalizing on Democratic Leadership's commitment to genocide to minimize dissent from the opposition. Shifting to the domestic policy side of things, Tariq brings Sam through Trump's attack on the DOE, walking through the department's long history as a Civil Rights agency, before diving deep into Trump's attack on the student loan and debt relief programs, which explicitly seek to target public service workers, and folks that work with trans folks, immigrants, or Palestinians. Wrapping up, Habash looks to the devastating impact Trump's DOE cuts will have on special education in the US, and what to make of our major educational institutions fully acquiesing to the regime. Dr. MarkAlain Dery then jumps right into a clear assessment of RFK's myriad destructive actions since being named HHS Secretary, from his lack of awareness about the ongoing measles crisis, to his cancelling of ACIP, and his backing of the all-around shutdown of any federal public health communications and much of its funding. After expanding on the fundamental problem with focusing on mitigating rather than preventative care, Dr. Dery walks Sam through the importance of a public health regime when it comes to addressing large-scale health issues facing the American public, pulling from his own recent work in New Orleans, before looking toward the biggest threats he sees facing the US' weakened public health infrastructure, including the threat of an ever-mutating bird flu, and the recent bubblings of hantavirus. Wrapping up, Dr. MarkAlain Dery reemphasizes that we have the capacity to fight against these threats, despite doubts about the current administration. And in the Fun Half: Sam dives into the outcome of the Democratic Party and mainstream media's complete acquiesence to the right wing's transphobic fearmongering, with Trump's regime implementing a full scale erasure and attack on trans identity and community, looking to Rep. Keating's complete takedown of Rep. Keith Self's blantant and direct misgendering of Rep. Sarah McBride. After expanding on Trump's recent $100m commercial deal with Tesla, and diving deep into Krystal Ball's coverage of Tesla's fraud allegations out of Canada, Sam and the MR Team dive deep into Sam's debate over social security on Jubilee. Tabatha from Central Mass calls in to unpack what trans care for your child actually looks like, plus, your calls and IMs!
