Our word of the day is derived from this adjective and has been around the English language since the early 16th century. Ambiguous Policy Wording Results in Adoption of Continuous Trigger of Coverage The United States Court of Appeals for the Fourth Circuit certified a question to the Supreme Court of Appeals of West Virginia asking: "[a]t what point in time does bodily injury occur to trigger insurance coverage for claims stemming from chemical exposure or other analogous harm that contributed to the development of a latent illness?" In Westfield Insurance Company v. Sistersville Tank Works, Inc.; et al, No. 22-848, Supreme Court of Appeals of West Virginia (November 8, 2023) the Court answered the question. The Supreme Court answered the question with the conclusion that a "continuous-trigger" theory applies to the policy, as the policy is ambiguous as to when coverage is triggered. OPINION The gateway to coverage under every standardized, commercial general liability (or "CGL") policy issued in the United States since 1966 is proof that a bodily injury or property damage has "occurred." FACTUAL BACKGROUND Sistersville Tank Works ("STW") has, since late 1984, been a family-owned and -operated West Virginia corporation. STW manufactures, installs, and repairs various types of tanks at industrial sites throughout world, including at several chemical plants in West Virginia. At different points in 2014, 2015, and 2016, three men were diagnosed with various forms of cancer. In 2016 and 2017, the "claimants" (the men with cancer and/or their spouses) sued STW in three separate lawsuits in West Virginia state courts. The claimants alleged the cancers were, in some part, caused by STW's tanks. STW asked Westfield to provide a defense and indemnification to the three lawsuits under its previously purchased CGL policies. Westfield denied coverage under its CGL policies for the three suits and, in June 2018, filed a complaint against STW for declaratory relief and after discovery, the parties filed competing motions for summary judgment. The Supreme Court had never addressed the question raised before the district court. Nevertheless, the district court calculated that this Court would apply the continuous-trigger theory to clarify the ambiguous language in Westfield's policy. DISCUSSION Occurrence-based CGL policies provide coverage if the event insured against takes place during the policy period, irrespective of when a claim is presented. The certified question raises a different, more complicated set of circumstances. Westfield contends that manifestation of a disease is the sole trigger of coverage under its occurrence-based CGL policies. The Policy Language Supports A Continuous Trigger The reasoning of the Supreme Court's recognition of the continuous trigger of coverage has the effect of spreading the risk of loss widely to all of the occurrence-based insurance policies in effect during the entire process of injury or damage. As one court said, the continuous trigger theory is the most efficient doctrine for allocation of liability amongst insurers for toxic waste cases, because it encourages all insurers to monitor risks and charge appropriate premiums. Therefore, an occurrence based CGL policy covers all injuries, sicknesses, or diseases that occur during coverage, not merely those that become manifest. s ZALMA OPINION It is axiomatic that when a court finds an ambiguity in an insurance policy it must be interpreted in favor of coverage for the insured. West Virginia found the policy was ambiguous as to trigger and therefore, overruling a strenuous dissent, and applied the continuous trigger expanding the coverages available to STW for the claims of the plaintiffs that STW was responsible for the illnesses because under the continuous-trigger theory of coverage every moment from the first exposure to the harmful chemicals up to and including the date of diagnosis would be covered by Westfield's policy. ‘Intersecting and contiguous identities in African narratives: ontological and anthropological perspectives' a talk by Dr Théophile Munyangeyo (TCD) as part of the School of Languages, Literatures and Cultural Studies Research Seminar Series in association with Trinity Long Room Hub. Socio-political and economic crises that many African societies have experienced are generally attributed to the absence of what could be the nation-states. When the main conception of identities and related attitudes and behaviours are primarily linked to tribal and ethnic constructs, it can inevitably contribute to mutual exclusions, with the possibility of leading to open conflicts. The tribal and ethnic identities in Africa have led to many serious consequences of social tensions and political violence. The question of such identities when presented as the societal references that drive social and political allegiance has indeed dominated many African writings through the lenses of fatalistic pessimism. Nevertheless, there are some writers who no longer see the tribal and ethnic affiliation as a determining factor for (un)democratic practices and (in)cohesive social interactions. By using a thematic and discourse analysis, this paper examines the representation of key concepts, such as identities, existence, being, becoming, cohabitation, value systems, myths, symbols, beliefs, social practices, historical and social reality. Through the cultural anthropology framework, with references to ontological perspectives, it concludes that many dynamics in the interpersonal and community relations can create a fruitful intersectionality of identities and ultimately triumph over a contiguous conception of social differences.

In this episode's Animal Advocate Interview, I chatted with Olivia Walter a conservation biologist and the Executive Director of Wildlife Vets International. WVI is a British charity which has been providing critical veterinary support to international wildlife and conservation projects since 2004. There is a vital medical aspect conservation which is all too often forgotten and so WVI sponsor top veterinary specialists to help conservationists and local vets work to save endangered species worldwide. Olivia and I talked about why some species are in real danger of becoming extinct and how WVI vets are helping to save them. We also discussed the wider difficulties of wildlife conservation and why humans are both the problem and the solution. Different vineyards have different proportions of limestone, marl, clay, loam, Portlandian limestone – younger, harder, no fossils. Background: To report an unplanned interim analysis of a prospective, one-armed, single center phase I/II trial (NCT01566123). Methods: Between 2007 and 2013, 27 patients (pts) with primary/recurrent retroperitoneal sarcomas (size > 5 cm, M0, at least marginally resectable) were enrolled. The protocol attempted neoadjuvant IMRT using an integrated boost with doses of 45-50 Gy to PTV and 50-56 Gy to GTV in 25 fractions, followed by surgery and IOERT (10-12 Gy). Primary endpoint was 5-year-LC, secondary endpoints included PFS, OS, resectability, and acute/late toxicity. The majority of patients showed high grade lesions (FNCLCC G1:18%, G2:52%, G3:30%), predominantly liposarcomas (70%). Median tumor size was 15 cm (6-31). Results: Median follow-up was 33 months (5-75). Neoadjuvant IMRT was performed as planned (median dose 50 Gy, 26-55) in all except 2 pts (93%). Gross total resection was feasible in all except one patient. Final margin status was R0 in 6 (22%) and R1 in 20 pts (74%). Contiguous-organ resection was needed in all grossly resected patients. IOERT was performed in 23 pts (85%) with a median dose of 12 Gy (10-20 Gy). We observed 7 local recurrences, transferring into estimated 3- and 5-year-LC rates of 72%. Two were located outside the EBRT area and two were observed after more than 5 years. Locally recurrent situation had a significantly negative impact on local control. Distant failure was found in 8 pts, resulting in 3-and 5-year-DC rates of 63%. Patients with leiomyosarcoma had a significantly increased risk of distant failure. Estimated 3-and 5-year-rates were 40% for PFS and 74% for OS. Severe acute toxicity (grade 3) was present in 4 pts (15%). Severe postoperative complications were found in 9 pts (33%), of whom 2 finally died after multiple re-interventions. Severe late toxicity (grade 3) was scored in 6% of surviving patients after 1 year and none after 2 years. Conclusion: Combination of neoadjuvant IMRT, surgery and IOERT is feasible with acceptable toxicity and yields good results in terms of LC and OS in patients with high-risk retroperitoneal sarcomas. Long term follow-up seems mandatory given the observation of late recurrences. Accrual of patients will be continued with extended follow-up.

The migration of interstitial cells was analyzed during the growth of stem cell clones in vivo. The spatial distribution of cloned cells was analyzed at a time by which extensive migration of interstitial cells could have occurred. All interstitial cell clones were found to form large contiguous patches of cells. The results indicate that there is little migration of large interstitial cells in undisturbed tissue during normal growth. This finding is surprising since numerous grafting experiments have shown extensive migration of these cells. The implications of finding nonrandomly distributed stem cells are discussed.
