Dr. Bill Tortoriello graduated from the National University of Health Sciences (NUHS) in 2006 as a Chiropractic Physician. Soon after, Dr. Bill opened his own private practice in Chicago, Integrative Chiropractic, where he still treats patients today. From 2014 to 2020, and again in 2022, Dr. Bill served as adjunct faculty for the Clinical Sciences Department of NUHS, teaching Functional Rehabilitation, as well as Sports Medicine courses. In 2007, Dr. Bill attended his first course in Dynamic Neuromuscular Stabilization (DNS), a principled approach to physical medicine and rehabilitation that now serves as the basis for his treatment approach. In 2014, after completing hundreds of hours of continuing education, including a final 6-day rotation in the Physical Medicine Department of Motol Hospital in Prague, Czech Republic, Dr. Bill was officially certified as a DNS Practitioner. Furthermore, due to years of an additional, separate track of DNS coursework that he completed, Dr. Bill was also certified as a DNS Pediatric Practitioner, which enables him to perform a unique physical examination on infants and children, as well as provide conservative, functional treatment if necessary. Dr. Bill's pediatric expertise can serve as a useful, effective adjunct to the care provided by pediatricians. In 2019, Dr. Bill was honored to be invited by the Prague School of Rehabilitation to attend their DNS instructor certification course which only occurs every two years in Prague at Motol Hospital. Since then, Dr. Bill has had the pleasure of teaching a variety of DNS seminars to his colleagues and students across the country. In fact, the DNS program is responsible for educating thousands of healthcare practitioners around the world every year.

Welcome to your weekly UAS news update, we have 3 stories for you this week: Man sentenced after shooting down drone, SkyeBrowse Lite, and the AMA has gotten approval for temporary FRIAs. First up this week is an update on a story we've been covering since 2021... Back in 2021, a sheriff's drone looking for burglary suspects was shot down by a man who claimed the drone was “Harassing him”. The $30,000 Matrice 300 crashed onto a nearby building and caught on fire. The fire was quickly contained and no permanent damage occurred to the structure. Wendell Goney was identified as a person on interest and was contacted by police shortly after the crash. Goney claimed the drone was harassing him and admitted to shooting the drone with a .22 rifle. Deputies then arrested Goney for possessing a firearm as a convicted felon. This week, a US District judge gave the 29 time felon a 4 year prison sentence for the incident. We'll have to see if this sets a precedent for other courts to follow in drone shoot downs. https://dronexl.co/2024/02/23/florida-man-sentenced-four-years-shooting-down-sheriffs-drone/ Next up this week is our friends over at SkyeBrowse! SkyeBrowse released “Lite” this week, adding a monthly plan between free and enterprise! SkyeBrowse lite adds higher accuracy down to 2 inches and priority processing speeds for $49 a month. If you're unfamiliar with SkyeBrowse, it's an online processing software that uses videos to create 3D models. Videos can be from nearly any source and don't require GPS information. The approval is only applicable AMA events though we'll likely see similar approvals for the FTCA, FPVFC and Stem+C soon. NOTAMs will be required for these events, which won't help out the FAA's NOTAM system unless it gets a major overhaul. Welcome to your weekly news update, we have 4 stories for you this week, Amazon loses Head of Safety and Flight operations, FAA and NASA conduct UTM Field Test, Skyebrowse introduces pay-per-model, and the FPVFC releases a FRIA map. Your first story this week is Amazon, who keeps losing people. Sean Cassidy, the head of Safety, flight operations, and regulatory affairs has reportedly left the company. Cassidy, a former Alaska Airlines Pilot, joined Amazon in 2015 to assist Prime Air through the process of obtaining FAA approvals. Amazon received their Part 135 certificate in August of 2020, and deliveries began this year. Over the last year, amazon has had a number of lay-offs including one in January and has lost a number of key players. Amazon hasn't released any statement or status on their deliveries in the past few months, but we'll keep you updated if we see any updates. Next up this week is the FAA and NASA, who have conducted a UTM field test. If you're unfamiliar with the concept of unmanned traffic management, it's a system that allows a UAS operator to reserve a portion of the airspace for a particular time. These “reservations” would assist with deconfliction between UAS traveling at or below 400' in uncontrolled airspace. The test included flights of varying complexity levels, verifying standards, evaluating UTM systems, testing FAA integration with USS, and testing the real world application of all these systems working with ones another. Data collected from the UTM field test is expected to be used by policymakers to enable low-altitude operations, particularly those that will operate beyond line of sight. If you'd like to read the full report, we'll add a link in the description! Third up this week is Skyebrowse, who is now offering a pay-per model version of their software! Models start at just $3 per model and vary based on the size of the video file. Pay per models will allow you to unlock features, such as download or measurements, that are not available in the “freemium” subscription plan. This works with older models, and we were able to use a model from 2021 and access these tools! Alright, and last up this week is a map of FRIAs! Due to the UAS Facility maps not containing information about FRIA, Alex Suarez has created a map that contains the locations of approved FRIAs. The map is color coded to differentiate between the 4 CBOs, and for FPVFC, FTCA, and STEMC FRIAs, has precise boundaries. Great job Alex! John is the Senior Vice President for Public Policy and Advocacy for the American Chiropractic Association (ACA) located in Arlington Virginia and is responsible for monitoring legislation, formulating policy, and carrying out the overall political strategy for the organization. Before coming to ACA, John was the Director of Government Affairs for the Rubber Manufacturers Association. Prior to that, John spent ten years as a senior assistant to two members of the House of Representatives. He followed that with a master's Fellowship in Clinical Research at the Palmer Center for Chiropractic Research, where he attained his MS degree in 2010. In 2012, Dr. Anderson joined his wife, Dr. Stacy Hallgren, in her practice in Grand Forks, ND, and they continue to operate Performance Chiropractic together. In 2018, Dr. Anderson began work with Valley Community Health Center, now Spectra Health, a Federally Qualified Health Center (FQHC) and Patient-Centered Medical Home (PCMH), to add chiropractic services to their scope of practice. He became their first DC, splitting his time between private practice and Spectra Health. In his role with Spectra Health, he continues seeking new treatment pathways for underserved communities, those who typically lack access to chiropractic services, and especially those in non-traditional living environments or treatment programs for substance use or other disorders.Beyond patient care, Dr. Anderson serves the chiropractic profession in multiple other ways. He has been a board member of the ND Chiropractic Association (NDCA), including serving as president from 2019-2021, and continues to represent the NDCA in various ways as the Insurance Liaison. He was honored as the NDCA Chiropractor of the Year in 2019. Dr. Anderson has twice served on the State of ND Board of Chiropractic Examiners' subcommittees to draft rules and regulations for the Chiropractic Practice Act, once for dry needling and the other for certified chiropractic clinical assistants. Additionally, Dr. Anderson has been a member of the Clinical Compass Board since 2018, now serving as Vice-Chair. Since 2019, Dr. Anderson has represented the ACA as the Advisor for the American Medical Association (AMA)/Specialty Society Relative Value Scale Update Committee (RUC) Healthcare Professionals Advisory Committee (HCPAC). His experience in health policy has led to opportunities to represent the profession at national meetings convened by organizations such as CMS and PCORI. He currently serves as Vice-Chair of the ACA Health Policy and Advocacy Commission and serves multiple subcommittees as either chair or member. He became the House of Delegates Alternate Delegate for ND in 2022 and is a member of the ACA Governors Advisory Cabinet (GAC) and the ACA-PAC Capitol Club. In addition to the NDCA, Clinical Compass, and ACA, Dr. Anderson is a member of the World Federation of Chiropractic (WFC), the North American Spine Society (NASS), the American Public Health Association (APHA), and the National Strength and Conditioning Association (NSCA) where he maintains an active supporting credential as a Certified Strength and Conditioning Specialist (CSCS). He is also a Certified Medical Examiner.Dr. Anderson's commitment to research has followed him from his fellowship into his practice setting. He maintains an ongoing collaboration with colleagues at multiple chiropractic institutions, which has resulted in multiple publications and posters at research conferences. Respondent Robert Boule owns a bed-and-breakfast—the Smuggler's Inn—in Blaine, Washington. The inn abuts the international border between Canada and the United States. Boule at times helped federal agents identify and apprehend persons engaged in unlawful cross-border activity on or near his property. But Boule also would provide transportation and lodging to illegal border crossers. Often, Boule would agree to help illegal border crossers enter or exit the United States, only to later call federal agents to report the unlawful activity. In 2014, Boule informed petitioner Erik Egbert, a U. S. Border Patrol agent, that a Turkish national, arriving in Seattle by way of New York, had scheduled transportation to Smuggler's Inn. When Agent Egbert observed one of Boule's vehicles returning to the inn, he suspected that the Turkish national was a passenger and followed the vehicle to the inn. On Boule's account, Boule asked Egbert to leave, but Egbert refused, became violent, and threw Boule first against the vehicle and then to the ground. Egbert then checked the immigration paperwork for Boule's guest and left after finding everything in order. The Turkish guest unlawfully entered Canada later that evening. Boule filed a grievance with Agent Egbert's supervisors and an administrative claim with Border Patrol pursuant to the Federal Tort Claims Act (FTCA). Egbert allegedly retaliated against Boule by reporting Boule's “SMUGLER” license plate to the Washington Department of Licensing for referencing illegal activity, and by contacting the Internal Revenue Service and prompting an audit of Boule's tax returns. Boule's FTCA claim was ultimately denied, and Border Patrol took no action against Egbert for his use of force or alleged acts of retaliation. Boule then sued Egbert in Federal District Court, alleging a Fourth Amendment violation for excessive use of force and a First Amendment violation for unlawful retaliation. Invoking Bivens v. Six Unknown Fed. Narcotics Agents, 403 U.S. 388, Boule asked the District Court to recognize a damages action for each alleged constitutional violation. The District Court declined to extend Bivens as requested, but the Court of Appeals reversed. Held: Bivens does not extend to create causes of action for Boule's Fourth Amendment excessive-force claim and First Amendment retaliation claim. In Brownback v. King, the Court addressed the Federal Tort Claims Act, (FTCA) which waives Federal sovereign immunity to allow plaintiffs to sue the United States for certain torts committed by Federal employees. The FTCA includes a judgment bar which precludes a plaintiff from suing a federal employee on a cause of action arising from the same subject matter as his FTCA claim. Following a violent encounter with two undercover FBI agents, King sued alleging an FTCA cause of action and an implied Bivens claim. The District Court dismissed both claims. Then the Sixth Circuit reversed, finding the District Court’s dismissal of King’s FTCA claims did not invoke the FTCA judgment bar because it had not reached the merits so King’s Bivens claim should be able to go forward. In a 9-0 opinion written by Justice Thomas, the Court reversed the Sixth Circuit holding the District Court’s decision reached the merits and implicated the FTCA judgment bar. January 6, 2021.  A day that will go down as one of the darkest in American history.  Thousands of supporters of President Trump assembled outside the U.S. Capitol in Washington, DC to object to Congress' certification of Senator Biden's electoral college victory and stop what they view as a stolen election.  What happens next is heartbreaking.  Breaching security, supporters of the President storm the building and invade the Capitol itself until, outside the rotunda, they are met by armed guards.  In the melee that follows, one of the protesters, 35-year-old Ashli Babbitt, who had flown all the way from California to join the protests, is shot in the neck as she attempts to climb through a broken window.In this episode of The Blame Game, we will try to answer the question of who is responsible, if anyone, for Ms. Babbitt's tragic death.  And to help us answer it, we turn to respected CNN legal analyst, Paul Callan.  A former prosecutor and deputy chief of homicide in the Brooklyn DA's office, Mr. Callan is best known for representing the estate of Nicole Brown Simpson in the O.J. Simpson civil litigation.  He now focuses his practice on civil actions involving wrongful imprisonment, wrongful convictions, and sexual abuse.

The judgment bar provision of the FTCA provides that the judgment in an FTCA action “shall constitute a complete bar to any action by the claimant, by reason of the same subject matter, against the employee of the government whose act or omission gave rise to the claim.” The question before the Court is whether this judgment bar provision is triggered in an action with both FTCA and constitutional claims, when an FTCA claim is dismissed for lack of subject matter jurisdiction. The FTCA also imposes a judgment bar, which provides that "[t]he judgment in an action under section 1346(b) of this title shall constitute a complete bar to any action by the claimant, by reason of the same subject matter, against the employee of the government whose act or omission gave rise to the claim." 28 U.S.C. 2676.
