Hosts: Leah Murray and Greg Skordas  Utah’s involvement in a lawsuit over disability protections  17 states – including Utah – are involved in a lawsuit against the federal government over Section 504 of the Rehabilitation Act. This section defines what constitutes a disability. It was updated during the Biden Administration, changing the definition of a disability to include gender dysphoria. The lawsuit’s been confusing some people because it says the gender dysphoria part is unconstitutional, but also that the whole section is unconstitutional. Utah Attorney General Derek Brown joins Inside Sources to explain more about the lawsuit and how he sees it. He also talks about protecting Section 504 as a whole.    On the Hill 2025: Transparency vs. privacy with signatures gathered in an election  During the primary and general elections last year, there was quite a bit of controversy and discussion over the privacy of signatures gathered for candidates to get on the ballot. Some folks wanted them to be public – in the name of transparency – while others wanted them to stay hidden in the name of privacy. The Inside Sources give their analysis on House Bill 374.    On the Hill 2025: Banning political flags from government, educational spaces  The importance of political neutrality in government spaces versus the importance of free speech from people who work in those government spaces – it's part of the basis of a bill working its way through the state legislature. The Representative was chair of the Select Committee on the Modernization of Congress - sometimes called the “Fix Congress Committee” - from 2019 to 2023. He’s also the former chair of the New Democrat Coalition - a caucus of centrist democrats with a pro-businesses, moderate approach to fiscal issues. In other words - he’s a guy who spent a lot of time trying to figure out ways to make things work in the House, and how to get members to work across the aisle. Now, Kilmer is moving on to the Rockefeller Foundation in the new year as Senior Vice President for the organizations newly created U.S. Program & Policy team. Rep. Brad Schneider (D-Ill.) likes to be prepared. Schneider and fellow House Democrats are getting behind-the-scenes briefings that started this summer to bone up on their tax policy knowledge ahead of what's likely to become a big battle in 2025. The Illinois Democrat is a member of the tax-writing Ways and Means Committee and he's running to lead the influential New Democrat Coalition. The hope, he said, is to find agreement on tax policy that will be permanent so lawmakers don't once again find themselves addressing provisions such as pieces of the 2017 GOP-led tax law that expire next year. Schneider, a critic of the state and local tax deduction cap, said he's optimistic that lawmakers can come together on policy areas ranging from global tax to the child tax credit. On this edition of Talking Tax podcast, Bloomberg Tax reporter Chris Cioffi talks with Schneider about the upcoming talks over expiring provisions in that 2017 tax overhaul and other priorities. Tim Scott (R-S.C.), short on money, follows former vice president Mike Pence in exiting the race. In a signal to the “normal” GOP crowd, both endorse her. Haley finishes second in Iowa and/or New Hampshire, chasing out former New Jersey governor Chris Christie and making it impossible (if he is still in the race) for DeSantis to continue. She then gets to be the single alternative to Trump. (There is no sign that Virginia Gov. Glenn Youngkin or Georgia Gov. Brian Kemp are going to wage a campaign.)And then? Well, Rubin writes, “that's where things get murky, to say the least. Simply being better than all the clumsy, weak, unprepared and obnoxious alternatives still leaves Haley facing the overwhelming favorite of the GOP base. This is not 2016, when Trump could get by with winning 35 percent or so of the early primary electorate to beat back a crowded field. This time, he's got roughly a 30 percent lead in Iowa in the Des Moines Register poll and about the same in CNN's South Carolina poll.”New Biden Dem Challenger: Minnesota Rep. Dean Phillips has announced that he's challenging Biden for the Democratic presidential nomination, saying that the party needs to look to the future, and, of course, Phillips, 54, would like to be that future. Who is this guy, anyway?(He's a 54-year-old, third-term congressman from Minnesota, where he represents the suburbs west of Minneapolis. The millionaire Phillips was heir to his family's distilling company, and he also led the gelato manufacturer Talenti. He's Jewish, and he's argued in the wake of the Israel-Hamas conflict that the U.S. needs to support Israel, although he backs a two-state solution long-term. In Congress, Phillips has been a fairly moderate member of the House Democratic caucus. He falls to the right of about 80 percent of his party colleagues in VoteView.com's ideological data, and he belongs to the center-left, business-oriented New Democrat Coalition and the bipartisan Problem Solvers Caucus.) Stalking horse for somebody else who might have a better chance? Carson, now in his 6th full term in the U.S. House of Representatives, has established himself as an influential leader and respected public servant, fighting for good paying jobs, economic growth, and safer communities for Indiana's working families. Congressman Carson consistently fights for the middle class, securing hundreds of millions for investments in public safety, education, infrastructure, and the creation and protection of thousands of good paying jobs. On today’s show, we focus on the question: Can the president suspend the elections? The short answer: No. But while the law is clear, President Trump’s efforts to delay the elections, sow distrust in our democratic processes, and wreak havoc on the U.S. electoral process are already well underway. On July 30, President Trump tweeted mail-in voting will make this year’s elections “the most inaccurate and fraudulent election in history.” (In reality, mail-in voter fraud averages 0.0025 percent.) This, just months after he and others dismissed as ridiculous Democratic presidential nominee Joseph Biden’s warnings in April that Trump might “try to kick back the election somehow” or “come up with some rationale why it can’t be held.” The president’s tweets and public comments raise serious questions about the integrity of the upcoming elections. For example, what are the ramifications of Trump suggestions that we suspend the election? Will access to mail-in ballots (or lack thereof) impact voter turnout? Can Trump invoke martial law if he loses the election? What are the possible threats to our democracy come November? Helping us to sort out these questions are special guests:Karen J. Greenberg, the director of the Center on National Security at Fordham Law and a permanent member of the Council on Foreign Relations, specializing in the intersection between national security policy, the rule of law and human rights. She is the host of "Vital Interests Podcast," the editor-in-chief of three online publications and has written and edited numerous books including: "Rogue Justice: The Making of the Security State.” Prof. Rick Hasen, chancellor’s professor of law and political science at the University of California, Irvine and a nationally recognized expert in election law and campaign finance regulation. He is a CNN election 2020 analyst and co-author of leading casebooks in election law. He has authored over 100 articles on election law issues, published in numerous journals including the Harvard Law Review, Stanford Law Review and Supreme Court Review. Rep. Mikie Sherrill represents New Jersey’s 11th Congressional District. Congresswoman Sherrill serves as freshman whip for the New Democrat Coalition and sits on the House Armed Services Committee and the House Science, Space and Technology Committee. She is the chairwoman of the Environment Subcommittee for the Science, Space and Technology Committee. Prof. Stephen Vladeck, the A. Dalton Cross professor in law at the University of Texas School of Law and a nationally recognized expert on the federal courts, constitutional law, national security law and military justice.
