The Court of Appeal begins a second appeal into the Scott Watson murder case, today. Friends Ben Smart and Olivia Hope were last seen getting off a water taxi onto a yacht in the Marlborough Sounds on New Year's Eve more than 26 years ago. Watson was convicted of double-murder in 1999 following a three-month jury trial in the High Court in Wellington. It's accepted the pair met their deaths after boarding a stranger's yacht with a man -- the Crown says that man was Watson. Watson's always denied killing or even meeting them. This appeal is of his conviction -- and Watson's team can include new expert evidence about the reliability of forensic evidence. Criminal defence lawyer John Munro told Mike Hosking “Transference of DNZ is much more understandable now, so is hairs.” Munro said the key issue is whether he's had a fair trial. Andi continues the tale of Olivia Hope and Ben Smart. Andi takes Ayla on a two-parter, covering the disappearances of Ben Smart and Olivia Hope. The two friends were celebrating the New Year of 1998 at Furneaux Lodge in Marlborough Sounds, and went back to their yacht in the early morning. With no place onboard to sleep, they were picked up again around 3.30am where they were offered a place by a stranger. They were dropped with the stranger between 4 and 5am, and have not been seen since. A boat was seized shortly after that found hairs on board matching Olivia. Scott Watson was found to be the stranger and was sentenced to life imprisonment. This is despite there being no evidence for the two-trip theory, which meant Scott had to leave his yacht and come back to shore before hopping on the water taxi with Ben and Olivia. It has led many to think this was a case of wrongful imprisonment. What do you think? It's New Year's Eve, 1997, and 17-year-old Olivia Hope is getting ready for a party at Furneaux Lodge, a beautiful old residence that sits at the head of one of the bays and coves that make up The Marlborough Sounds. A picturesque holiday spot on the northern end of New Zealand's south island where the bush meets the sea. The lodge is only accessible by boat, so Olivia, her older sister, and their friends have booked a chartered yacht called Tamarack that will deliver them to the celebrations after an afternoon basking in the sun. Furneaux is the place to be on New Years and the local teenagers are getting ready to dance away the night with 15-hundred other partygoers. Over in Punga Cove, just across the inlet, Ben Smart is partying the afternoon away with mates. He too has plans to join the fun at Furno and hitches a ride over on a boat as the party gets started. But what happens to Ben and Olivia after the clock strikes midnight, will become one of the most high-profile and hotly contested murder investigations New Zealand has ever seen. It was supposed to be a night of celebration, ringing in New Year's 1998 with good friends in an ideal location. Ben Smart and Olivia Hope were celebrating in Marlborough Sounds, New Zealand. But when the bunk on their rental yacht was taken by other party-goers, they accepted an offer by a charming stranger to sleep aboard his boat. Ben and Olivia were a couple of friends looking to make the most out of their New Year's celebration together. They had plans to attend a party at a lodge and then spend the night on a yacht—but when they finally arrived at the yacht on a water taxi, they were shocked to learn that the yacht was full. A fellow passenger aboard the water taxi would offer them a place to sleep—on his own yacht—and they would happily accept. This decision would make the end of their tale. The duo was never seen again, but someone is in prison for their murders.

The 50-year-old was sentenced to life in prison in 1998 with a minimum non parole period of 17 years. He has always protested his innocence, and his father says today's ruling is frustrating. Olivia LoRusso was diagnosed with Acute Myeloid Leukemia when she was 11 years old. Her mother Shelley will talk about her very difficult battle with this disease which led to her passing in April of 2017. Since that time Shelley started the Olivia Hope Foundation which is focused on both research and in helping families that are going through the very unfortunate experience that Shelley, her husband Rob, and her daughters Gia and Sabrina, (Olivia's twin) had to endure while watching this disease take hold of their beloved Olivia.

This episode does not take place in Nashville. It's about as far, geographically, as you can get from Music City. But it is a FASCINATING case, and even though it doesn't deal with my adoptive hometown, I hope that you'll enjoy it, just the same. In the early morning hours of January 1, 1998, Ben Smart and Olivia Hope went missing after attending a lake party near a site called Furneaux Lodge. It's one of the most famous true crime cases in all of New Zealand's history. I won't spoil any of the other details, but just know it's a story worth checking out! After a night of celebrating the new year of 1998 in the Marlborough Sounds in New Zealand, Ben Smart and Olivia Hope were offered a place to crash for the night by a stranger they met on a water taxi. The three were dropped off at the man’s sailboat, and unfortunately Ben and Olivia were never seen again. Investigators claimed this unknown third man was 26 year old Scott Watson. He was arrested and put on trial for the murders of Ben and Olivia. But was there enough evidence to find him guilty of these crimes? Was Scott Watson truly the man responsible for their disappearances, or was he targeted for other reasons?
Oliva Hope & Ben Smart had a wonderful start to the new year. Upon taking a water taxi back to the yacht they were supposed to stay on, they found out that all the beds had been taken. Getting back on the water taxi they were offered a place to sleep by an unknown male. Double-killer Scott Watson has been told more work lies ahead of him to improve his chances of release.The 49-year-old's third bid for parole was declined this morning, at Canterbury's Rolleston Prison.Watson still maintains he's innocent, having spent more than 22 years behind bars.He was convicted for the 1998 murders of Olivia Hope and Ben Smart in the Marlborough Sounds.Parole Board convenor Sir Ron Young says Watson needs treatment to address risks raised in psychiatric reports before parole can be granted.Watson has told the panel he's willing to do this, but programmes demand he confesses to a crime he didn't commit.His dad, Chris Watson, told Heather Du Plessis Allan they're caught in a circular argument.He says corrections requires an admission of guilt before Watson is allowed to do the courses required to be granted parole.An appeal hearing is set for mid next year, after concerns were raised about the forensic evidence used in the conviction.LISTEN ABOVE

Olivia was a happy healthy 11 year old girl. She loved baking and playing with her twin sister, she loved late night slumber parties with her older sister Gia. Olivia was all about family. Her favorite place to be was in the Hamptons with her family, cousins and close friends. She looked forward to summers and beach days. She loved animals, especially her cat Milo. She played the flute and was the only one in her school band that played the flute and she loved that. Olivia always wanted to make everyone around her happy, whether it was by baking them something sweet to eat or just telling them how much she loved them. She truly had a servants heart. We all deeply miss her. While she was going through her cancer treatments she decided she wanted become a pediatric oncologist because she wanted to help find a cure for pediatric cancers. This is why the Olivia Hope Foundation was born. In this episode, Joel interviews Olivia’s mother - Shelley Lorusso. She is the President and Founder (and mother) of The Olivia Hope Foundation. Olivia Hope Foundation was created in 2018 to honor Shelley's daughter dying wish to fight for a better world for kids with cancer. Shelley's daughter Olivia was diagnosed with Acute Myeloid Leukemia (AML) at the age of 11. She went through a series of treatments, including chemotherapy and a bone marrow transplant (her twin sister Sabrina was her donor). After 15 months of battling Leukemia, Olivia passed away on April 16, 2017 at the age of only 12. The foundation today has raised hundred's of thousands of dollars in her honor and even celebrities such as Stranger Thing's actress Millie Bobby Brown are big contributors to the foundation. Kelly attended a party at Pat’s Bar, a pub close to the docks. He was in the bar with friends but decided to stay behind after they left. Kelly was seen talking to other customers at the bar and left around 7:10 P.M. After he left, he was never seen again. 4. Sam Todd Samuel Todd and his brother, Adam, decided to greet the New Year’s Eve of 1984 by attending several parties around Manhattan, New York. After jumping from one party to the next, at 1:30 A.M., Sam and a group of friends went to another party at 271 Mulberry Street. By this time, Samuel Todd was intoxicated and complained that his head was spinning. 3. Katrin Konert Like any 15-year old, Katrin Konert from Waddewitz, Germany, had her secrets. For her, it was a secret older boyfriend named Joachim. The man was twice her age, late 20s. Although she never told her parents about her boyfriend, his sisters and friends did know about him. 2. Benjamin Coffey On New Year’s Day of 2012, Benjamin Coffey attended a gathering with friends to celebrate the New Year at Gloucester, Virginia. He spoke to a friend around dinner time and soon after, told a friend he was going home because he was tired. The following day, Virginia State Police discovered Benjamin’s abandoned van at Tappahannock, Virginia - an hour away from where he was last seen. 1. We have a guest on the show today who's written a lovely book called “How To Walk A Dog”. It's about dogs. New Zealand dogs. It's about playing with dogs, it's about the people we meet through dogs, it's about working with dogs. It's a funny and affectionate and heart-breaking book about dogs and the human pets they keep.It's written by a guy from Wellington called Mike White. Turns out that Mike is quite some journalist. He's covered wars like Afghanistan, Pakistan and Iraq. He's written another book called “Who Killed Scott Guy?”. For North and South he knows the Lundy case inside out. His story was part of international experts coming on board and forcing a second trial for Lundy.He's not afraid to shake things up.He covered the Ben Smart and Olivia Hope case in the Sounds and received an invitation from Scott Watson to interview him in jail. A request that the Department of Corrections denied and which Mike White then fought all the way to the High Court. After a year he won the right which he said was a win for journalism. He then brokered a meeting between Watson and Olivia Hope's Dad, which he also covered.He's done a great job and he's had very supportive employers and supporters. Journalism is about getting all the story including the bits that some won't agree with. And he has waded though detail and sat through months of courtroom testimony and then agonised about writing the story in the right way.To various degrees this is what journalists do. Some cover the bare facts of a story of the day and tell that story. Others cover a story until a punctuation mark. A few cover stories to the bitter and. They're all important in telling the rest of us what the full story is.One of the more disappointing things about modern life is hearing journalists be vilified by too many people. And those people have skin in the game. There is part of the story that they are part of that they don't want told. They want to control whatever the truth is.Politicians calling journalists liars is the richest kettle calling the pot black game there can ever be. It's got so bad some people charged with telling the story claim others telling the story are wrong. The number of people in the mainstream media dissing the mainstream media is astounding. It's a delusion for favour. No matter what Fox News tells you. They are in fact mainstream media.Of course I say this as we stand on the brink of losing another newsroom. Say what you will about the Newshub newsroom. Newsrooms are important and the possible loss of one will only be celebrated by people who often lie for a living. To find the real truth you need as many point of views as you can get. No-one should ever think a loss of a point of view is a good thing.But the wonderful thing about Mike White is that while wading through murders and disambiguation he still lives a normal life and loves his dog Cooper and he has written THE book on dogs. And people.His book made me cry. I have a dog. Saffi. Named after a dragon in a kids book. We got Saffi nearly 15 years ago because we finally bought a dog friendly house. 3 weeks ago we sold that house as we downsize. The kids are moving on. Mike reminded me that soon the dog will be moving on. And it broke my heart. He is a great writer and journalist.

They located a water taxi still operating and got in. Sharing the ride was a man who learned that they had nowhere to sleep and offered to let them stay on his boat. As this was their only real option they accepted and the taxi took them to the man's ketch. The two friends, Olivia Hope and Ben Smart, were never seen again. The police conducted an investigation and despite a number of witnesses describing the same man and the same two masted sailing boat, they focused on a man with a smaller vessel named Scott Watson.
