The main event is Kash Patel's defamation suit against The Atlantic and reporter Sarah Fitzpatrick. Joyce Vance laid out on her Substack why it goes badly for him regardless of outcome. Dismissal ends it. Survival opens discovery, and Patel filed, which means he answers document requests, interrogatories, and requests for admission, then sits for a deposition, along with however many FBI personnel The Atlantic wants. Fitzpatrick reported the story with 24 sources across the Bureau and the executive branch. Those incidents would generate records. The Atlantic has already asked the FBI and DOJ for documents and communications, and Patel's own defense depends on them. Judge Emmet Sullivan has the motion to dismiss. It is Patel's fifth suit against the media. The Downballot ran the numbers on 110 special elections since January 2025. Democrats are outrunning Kamala Harris's 2024 margins by 12.5 points on average and Joe Biden's 2020 numbers by 8.4. That implies a roughly 12 point environment in House and Senate races, slightly better than what the same measure showed heading into 2018, when Democrats gained 40 House seats. Brandon Dukes just flipped Pennsylvania's 12th, the 31st legislative flip of the cycle. Democrats have won every one. Ron Brownstein's piece for CNN gets at the other half. The risk to Republicans is subtraction rather than addition: low propensity Trump voters who turn out only when his name is on the ballot, and it will not be on one again. Meanwhile Democratic primary turnout is hitting numbers not seen in decades. Nearly 800,000 in Wisconsin, 1.5 million in Michigan, surges in Texas and Georgia. In Alaska's primary, Mary Peltola outpolled Dan Sullivan by four points. James Talarico's numbers in Texas are worth a look too. They let Trump back into the country, so it's Chaos Time again! Greg Dworkin came armed with the usual roundup. As we mentioned last week, we've moved from Special Election season straight into primary season. And we had one over the weekend. Who has primaries on the weekends? Smart people Weirdos! Like Louisianans! But there's more to come on Tuesday, and they're reading the early vote ballot selection tea leaves. Even when it's just a primary, it means something when the ratio of ballots selected shifts toward Democrats every single time. And Georgians have more than usual at stake in what will be, on Tuesday, a final and determinative general (but "non-partisan") election for their Supreme Court, concurrent with primaries for everything else. All of this takes place in the context of record, floor-shattering lows for Trump's own polling. He's losing ground with his base. He's losing ground with his coalition. He's losing ground on his issues. But there are still enough Republican primary voters to turn things his way in these early contests. Not that that doesn't cost him ground, too. Because yes, small though the number may be, recoverable Republicans are in fact changing their minds. The combination–mathematically–has got to be enough. So, about that weekend Chaos I mentioned: Jared Polis has done the dumb thing, and though defenses are being offered, it remains dumb. Also generally chaotic: we may soon be adding motor oil shortages to skyrocketing gas prices. And Kash Patel turns out to have probably literally pissed on the graves of our Pearl Harbor dead, thus proving that there is no bridge too far. Further proof: Trump is ordering the Treasury to fill a sack with taxpayer money and hand it over to him. And though that's pretty chaotic, it is actually OK, because he is demanding a patriotic number of dollars. U-S-A! We also caught up on some pre-weekend Chaos. First, the slow-leaking of Trump's humiliation in China, where he accomplished nothing. Second, more public lands shenanigans. By which I mean the ultra-wealthy grabbing still more public things from out of your hands, in order–mostly–to not even really put them in their own, private hands. They just own them in case they remember at some point that they actually have them, and might like to use them. (or not!) Instead of you.

The generic ballot still shows a six-point Democratic advantage. Since early last year, Democrats have outperformed Kamala Harris's 2024 numbers by 13 to 15 points across 32 special elections. Republican enthusiasm is low, the party is divided, and Donald Trump is not on the ballot this fall. Trump's approval on the economy, inflation, and immigration is worse than Joe Biden's numbers were at their lowest. The Iran war is historically unpopular, and with the Strait of Hormuz still closed, the worst economic pain — including potentially $10-per-gallon gas in California — has not yet hit. Eighty percent of Americans, in a strongly bipartisan poll, blame Trump and the Iran war for rising prices. That economic pain is expected to peak right before the midterms. On the gerrymandering front, Texas redrew its map to gain seats — but three of those new districts are heavily Hispanic and Latino, populations that shifted toward Trump in 2024. Those gains may evaporate, potentially turning into Democratic pickups. Hawk also speaks honestly about the racial dimension of these court decisions, reflecting on the experience of Black Americans who are not surprised by any of this — and what it means that the crowning achievement of the Civil Rights era has effectively been dismantled, rendering the votes of 26 million Black Americans in the South nearly meaningless. Today's Headlines: Trump announced a 10-day Lebanon-Israel ceasefire, claimed the Iran war is "going swimmingly," and said Iran agreed to hand over nuclear material — which Iran has not confirmed. The head of the International Energy Agency warned Europe has roughly six weeks of jet fuel left due to the Strait of Hormuz situation, with possible flight cancellations and energy shortages ahead. Congress failed for the third time to pass a War Powers resolution to curb the Iran war, this time losing 214-213. At $10 billion a week, the White House budget director refused to say how much the war will cost, explaining that costs "fluctuate." It was a full day of congressional hearings. RFK Jr. faced the first of seven back-to-back days of testimony. Trump nominated an actual doctor — a 24-year public health veteran — to lead the CDC, which is genuinely surprising. Army Secretary Dan Driscoll testified that he pushed back against Hegseth's general-firing spree, with Republicans on the committee taking his side. Pete Hegseth quoted Pulp Fiction instead of the Bible at a Pentagon prayer service. Budget director Russell Vought testified that DHS is "disintegrating." ICE deported 442,000 people last year, but only 38% had any kind of criminal record — pending charges included.Minnesota prosecutors charged a federal ICE agent with assault for pointing his gun at drivers on a state highway — the first case of its kind, with 17 more incidents under review. An 86-year-old French widow of an American military veteran has been in ICE detention since April 1st, after missing an immigration appointment while settling her late husband's estate — reportedly tipped off by his son over an inheritance dispute. A judge blocked above-ground construction on Trump's White House ballroom pending congressional authorization, though underground bunker work continues. His 250-foot DC arch cleared a federal design review despite massive public opposition. Spirit Airlines could liquidate as early as this week. United Airlines' CEO pitched Trump on merging with American Airlines — which would control nearly 40% of the global airline market. Democrats won New Jersey's special election by 59 points.
