Send us a textHi everybody and welcome to Attendance Bias. I am your host Brian Weinstein. We are just past the mid-point of this Attendance Bias mini-series, in which we preview each venue Phish will play during their upcoming summer 2025 tour. We are coming off our visit to the Palmetto State for the North Charleston Coliseum, and today's episode is all about a venue that feels like it's been around forever in the Phish world: the Mann Music Center in Philadelphia, PA. I always group Philadelphia in with Merriweather Post, SPAC, and Jones Beach as part of the I-95 Corridor tour circuit, and while there is truth to that, there is a richer Phish history at The Mann than most venues. Today, I am joined by my friends Tom and Stephanie who have long-standing roots to Philadelphia and Tom especially has a long history with the Mann. While there may not be too much for northeast Phish fans to learn about Philadelphia, we do our best to offer recommendations, tips and tricks, and wallow in some good old nostalgia about past Phish shows in Philadelphia, as is our want here on Attendance Bias. So get pumped for July 15 and 16, as Tom, Stephanie, and I take a long look at the Mann Music Center in Philadelphia.

The Gilgo Beach Trial: One Case or Five Separate Trials? The suspected Gilgo Beach serial killer, Rex Heuermann, was back in a Suffolk County courtroom, and the debate over how his case should be tried took center stage. Prosecutors laid out their argument: all seven alleged murders should be handled in one trial. The defense? They want five separate trials. And if that wasn't enough legal wrangling, the battle over DNA evidence is just getting started. Prosecutors dropped a new piece of Heuermann's past into the mix—he spent about four summers in the 1980s working at Jones Beach. It's a detail that, on its own, might not seem like much, but when you consider that the remains of six of his alleged victims were found in that same area, it becomes a lot more relevant. DA Ray Tierney didn't mince words, calling Heuermann a “serial killer who meticulously and methodically hunted down and murdered seven women.” Heuermann's defense, led by attorney Michael Brown, has been working overtime to break the prosecution's case apart. Their latest move? Push for separate trials, presumably in an effort to dilute the impact of the evidence. The argument here is likely that trying all seven cases together could unfairly prejudice a jury. But prosecutors aren't budging—they want one trial, one jury, one verdict. And then there's the DNA evidence. It's a major factor in this case, with forensic testing linking hairs found on the victims to Heuermann. But here's the catch—the testing method used by the California lab has never been introduced in a New York courtroom before. That means the defense is arguing that the science is untested, unreliable, maybe even inadmissible. Tierney, however, is confident it will hold up. “This is sound science. It is the future of DNA analysis,” he said. “If the defense wants to call it magic, that's fine.” In other words, the DA isn't worried. For now, Heuermann remains behind bars, awaiting his trial. His attorney says he's being patient, aware of how crucial these pre-trial hearings are. The defense isn't in a rush, and neither, it seems, is the court. A hearing to determine whether the DNA evidence can be used is set for March 12, which means the trial itself still doesn't have a start date. Considering Heuermann was arrested in the summer of 2023, the wait continues. What did get decided? The trial will take place in Suffolk County. The defense, at least, seems satisfied with that outcome, believing that a jury from the local community is the best option for their client. Robert Moses had a vision for Jones Beach in the 1920s that included a theater to bring high quality entertainment to the people. That theater on Zachs Bay went through a number of iterations but reached its height from 1954-1977 when it was under the direction of Guy Lombardo. Along with his brothers Carmen and Lebert, the Canadian-born band leader/impresario brought Broadway shows and original productions to the beach. Their stage was an 8,200-seat amphitheater with a host of spectacular additions including icebergs, waterfalls, showboats, and floating mansions. Richard Arnold Beattie got more than a front row seat, performing as a child actor in The Sound of Music and The King and I at Zachs Bay in the early 1970s. Although he went on to a career that included journalism, songwriting, and audio production, he never forgot his time at the Jones Beach Theater. He has captured the experience in a new audio documentary called From Broadway to Jones Beach, streaming now on Spotify and planned to be repackaged as an audiobook. Hear more on today's episode about the development of the Jones Beach Marine Theater and its connections to Broadway history and the Lombardo family who lived in nearby Freeport. They started about ten minutes ago and we've—well, we've even been able to see a few, just the ghost of them really. We couldn't figure out why the hell fireworks of all things would be bleeding through and then we realized that it's the fourth of July. Not only that but, as Harry pointed out, the bicentennial is next year. She figures people are probably kicking off a whole year of celebration today.  One hundred and ninety nine years. That's how long America has been a country. I can't tell if that's a long time or a short time. Two hundred doesn't sound very long as the lifespan of a nation, but then when you think about everything America has done in that time…both the good and the bad… I mean, it's mostly bad, isn't it? I'm certainly not a poster child for the establishment, but I think we can all agree that America really made quite the impression in the last two centuries, including killing a lot of people. Which…I guess that's another case of throwing stones from a glass house.  But also…my grandparents came here from Scotland, Harry's came from Poland—everyone we know came from somewhere else. Living in New York was the best of this—all the different people you could meet, the different food you could eat, the languages you'd hear on the subway.  The last time I saw fourth of July fireworks with Harry was…sixty five or six, I think. The whole crew went out to Jones Beach with a case of beer and peanut butter and jelly sandwiches that Pete had thrown together for us. We'd just finished fencing the last item from a job a few months earlier and I think we were all feeling that sense of camaraderie particularly strongly. And I remember Pete saying “what a country we live in. A true haven for the crooked and criminal” and we all toasted to that. He was right. From the…Boston Tea Party to the wild west to us, what is America's legacy but one of outlawry? Including fireworks! Maybe not in every state, but there's something fitting about celebrating the country's birthday by enjoying an illegal activity.  All those memories now…thinking about Pete hadn't really hurt like this even after Harry first told me but knowing the details now, being unable to create a more forgiving narrative in my head… It just hurts to think about, that's all. I—I loved him, in my own way and I thought he—and I like to think that Harry was paranoid, that there's something about his old partner that we don't know that made Pete do what he did and that he'd never have hurt me but he— I think it's just the realization that I didn't really know him at all. And I knew that—I knew that he was a mystery to me, to everyone, but I thought I knew the way I didn't know him, if that makes sense. I thought I knew the important things. Hi everybody and welcome to today's episode of Attendance Bias. I am your host, Brian Weinstein. When I first began collecting tapes, I would always keep my eyes out for Phish shows at Jones Beach. Having grown up on Long Island, going to concerts at Jones Beach was a summer tradition. It didn't even matter who was playing–the venue was a 10 minute drive for me, and on a nice night, it's one of the best outdoor venues in New York. So you can imagine my reaction when I found out that my new favorite band had played there a number of times. It's with that genuine delight and natural curiosity that I approached today's guest, Jonathan Frederic, about his chosen show: July 23, 1993, Phish's first time headlining their own show at Jones Beach. 1993 was an amazing time to learn about Phish, as they were just dipping their toes in the water to jump from small theaters to larger amphitheaters, a transition that would continue for approximately the next two years. During that time, the band was introducing new music from Rift, beginning their craziest musical exploration and experimentation, and creating new ways to connect to the audience, as they couldn't maintain un-mic'd a capella performances and the Big Ball Jam in these sprawling arenas and amphitheaters.It was a pleasure to hear a first-person experience from someone who experienced all of these changes in ONE SHOW, especially at my one-time hometown venue. So let's join Jonathan to talk about when to eat carbohydrates, ending up front-row center at the venue, and The Pixies as we go over July 23, 1993 at the Jones Beach Amphitheater.

Phish played an incredible show at the Sphere in Las Vegas. It even made Price is Right host Drew Carey consider swearing off sex. Cypress Hill and The Pharcyde played the Fillmore in Detroit and set a record for the most marijuana consumed in one building in one night. The NFL Draft is finally here and taking over all of downtown Detroit.  Trudi pushes hard for everyone to take the bus to the draft. The Heisman Trust is returning their 2005 Heisman Trophy to Reggie Bush. Michael Michaels (great name) made one of the worst bets in trying to secure Reggie as a client. Former NFL TE Rob Gronkowski's girlfriend Camille Kostek is Maxim's new cover model. In other news, Maxim is still a thing. Ted Lasso star Sam Richardson is back in town for the NFL Draft. We may never know why The Detroiters hate the old Drew and Mike WRIF show. Our audience really responded to Woke Dad and his made up stories. Thankfully, he has some new whoppers. It looks like there's no way to stop the protests at Columbia University. Is the term "Genocide" played out? Some people are saying that the new "Detroit" sign has been defaced with dongs. The FTC declares noncompete clauses to be what we all thought they were- total BS. Some salary employees are about to make some overtime pay. Google fired 50 employees that protested their own companies' products for "helping" Israel. Joe Biden still has trouble reading his teleprompter. Brandon The Plant Guy does not want TikTok banned. Jeff  Provenzano is an American professional skydiver, wingsuit flyer, BASE jumper, HALO jumper and stuntman. He is a member of the Red Bull Air Force, and is considered to be a pioneer of the skydiving discipline of swooping.  ⁣ Provenzano started skydiving in 1995. In 2009, he joined the Red Bull Air Force, Red Bull's official aerial sports team. He has invented several acrobatic skydiving moves, the best known of which is The Miracle Man. As of October 2016, he has over 17,000 jumps logged. As a member of the Red Bull Air Force, Provenzano participated in and helped organize a wingsuit flight over Manhattan to promote the 2014 Bethpage Air Show at Jones Beach on Long Island. ⁣ After jumping off a plane 7,500 feet above Manhattan, they traveled two miles in two minutes, from the Financial District to the Hudson River, flying up to 120 mph in their wingsuits. Other notable jumps include: on August 27, 2013, Provenzano and fellow Red Bull Air Force member Miles Daisher BASE jumped off the 45-story Four Seasons Hotel Denver; Skydive Chicago in 2015, where Provenzano was part of a team of 164 linked skydivers flying in a predetermined formation at speeds up to 175 mph to set a new vertical freefly world record; and on February 29, 2016, the Red Bull team skydived out of a helicopter, with Provenzano and Jon Devore performing aerial tricks before landing in the middle of the lawn in front of the National World War I Museum and Memorial in Kansas City, Missouri.

Toga! Toga! We're heading to upstate New York to cover Pearl Jam's last show to date at the Saratoga Performing Arts Center, aka SPAC. It's a widely popular venue, one in which jam bands such as Phish and Dave Matthews Band have frequented, and as Ed would mention in this show, it was an early Lollapalooza tour venue back in 1992 when they played alongside Soundgarden. Glad he kept the shirt. This show comes right off the heels of a major turning point from the Binaural tour - The Jones Beach shows. The legendary Daughter performance with the It's OK tag, forever enshrined on the Touring Band 2000 DVD, marked as a healing moment for the band during the toughest period in their history. This show getting off to a hot start was a sign that the band was starting to loosen up and learn how to have a little fun on stage again. Breakerfall, Whipping, Spin The Black Circle, Hail, Hail, Corduroy and In My Tree are the first six songs of the night, and they absolutely do not disappoint. Add in an experimental Rearviewmirror to close the main set and a combination of Black/Yellow Ledbetter to this night, there are a lot of signature moments that make this show stand out. Oh yeah, and the nudist lava lamp inventor... him too. We'll hear stories from our Patron, Andrew Famulare, as well as Patrick and Brian from Hallucinogenic Recipe who were both at this show in the same section, but didn't know each other at the time. They'll share their hilarious memory from this show from both perspectives. And our Gear Guru segments this week look into Stone's Rickenbacker impact on Breakerfall, an interesting octave change in the Spin The Black Circle chorus, and why the combo of Black and Ledbetter worked so well, including love for the Nobody's Fault But Mine Led Zepplin tag.
