Amy Wax, a Professor at the University of Pennsylvania Carey School. Wax has been on Tucker Carleson, Pubslihed in the Wall St Journal and more. Professor Wax was banned from teaching required first-year courses. Dean Ruger has consistently said Wax cannot be fired because she is tenured due to his dismay. Campus free speech groups have said sanctioning Wax would violate the principles of academic freedom. This would set a new, president for professors & others alike. Though it is important to note that the right of freedom of expression is the cornerstone to the First Amendment for a reason. The founders believed that certain rights come from God. Even if you don't believe in God, and that is your right as protected by the First Amendment, the founders would tell you that your rights are natural rights, not man-made rights. They are innate desires and drives for every human being on earth and that it's not for man to deny them to others. The right to express yourself without punishment is one of the most important rights they cited. The right to gather in groups peacefully together without penalty. The right to worship your God without coercion or punishment. The right of a free press to report news and information without government control. History is ripe with examples of cases where these rights were used to spread hateful thoughts and ideas. At the same time, our country's short history is also full of cases where courts decided that the price for our First Amendment freedoms is tolerance for the spread of ideas that some may see as harmful, hateful or irresponsible. The principle is this. We must be willing to tolerate speech we don't like in exchange for the right to deliver speech that others may not like. In recent years, there has been a movement to try to control, prevent or stop the spread of speech and information some may feel are harmful. Their solution is to stifle the speech, de-platform the messenger. Or even de-platform the platform. Remove any opportunity for others to communicate if that communication does not meet accepted narratives. In other words, censorship. This has been the focus of Nadine Strossen's professional life. And with a resume that includes serving as the first woman national President of the ACLU, she has solid credentials on the issue of free speech and the battle against censorship, she has found allies from conservatives to progressives as well, making this an increasingly nonpartisan issue. It's easy to defend speech you agree with. But the fight for free speech truly begin when you support someone with whom you disagree. Which makes this conversation I had with professor Michael Phillips particularly significant. Michael Phillips is a history professor at Collin College in McKinney, Texas. He spoke out about the College's response to the pandemic on his personal social media. According to the Foundation for Individual Rights in Education (FIRE), "In reference to the College's decision to open for in-person learning in the fall of 2020, Phillips posted, '[T]hat feeling when your employer doesn't value your health and safety.' Phillips also publicly shared a slide in which College faculty were told they could not request, require, or recommend wearing masks at the beginning of the fall 2021 term. Phillips later recommended masking in a history course covering the history of pandemics and preventative measures. Ultimately, Collin College terminated Phillips, citing his speech." Professor Phillips is suing the college, with the help of FIRE, on the grounds that the college violated Professor Phillips' First Amendment right to free speech. Tolerance of different viewpoints and values is a key principle of a free society, and yet in classrooms and on campuses across the country, young people increasingly self-censor and self-silence to avoid speaking out against the dominant cultural narrative. In this special edition of the Academic Freedom Podcast, the AFA's Keith Whittington interviews Jeff McMahan, the Sekyra and White's Professor of Moral Philosophy at the University of Oxford, about the current controversy at SUNY Fredonia involving Professor Stephen Kershnar. An applied ethicist and distinguished teaching professor of philosophy, Prof. Kershnar has been placed under administrative review and barred from campus for conducting research and making statements in a YouTube interview about "adult-child sex."  The Academic Freedom Alliance sent a letter to SUNY Fredonia in defense of Prof. Kershnar's academic freedom and partnered with the Foundation for Individual Rights in Education (FIRE) to draft an open letter from philosophy faculty in support of his right to tackle difficult questions.   In this conversation, Whittington and McMahan explore not only the controversy itself, but also the larger questions surrounding what moral philosophers do, why they ask such controversial questions, and what value they bring to our understanding of society's most difficult issues.

We have a double-header of interviews this week with Marlene talking with Suffolk Law School's Gabe Teninbaum on his new book, Productizing Legal Work: Providing Legal Expertise at Scale. Greg talks with Lindsie Rank, Student Press Counsel at the Foundation for Individual Rights in Education (FIRE) about the new website to help journalists answer the question, "Can I Publish This?" Gabe Teninbaum's book discusses the variety of ways that processes can be productized, ranging from simple orientation tasks, to more complicated, but repetitive task which can be streamlined through technology, or even by just creating checklists or instructions. While the idea of taking task which we are used to performing and productizing them may be scary for some, it is necessary if we are going to move beyond repetitive tasks and work on processes that really benefit from our skillsets. Lindsie Rank's calls herself a 1st Amendment geek, and she and others at FIRE help defend student journalists in colleges across the country when their First Amendment rights are challenged. Surprisingly, the biggest threat to student journalists isn't the hyper-partisan environment we find ourselves in these days, but rather the threat to university or administrative reputations. In addition to protecting student journalist after the fact, FIRE productized the process that allows journalists to determine the risks before they publish when it comes to liable, intellectual property issues, or other potential risks from publishing stories. A group of scholars and journalists announced last month that they were founding the University of Austin on the belief that free speech is being stifled on college campuses across America.“The reality is that many universities no longer have an incentive to create an environment where intellectual dissent is protected and fashionable opinions are scrutinized,” wrote Pano Kanelos, the inaugural president, in the initial statement.But the news was followed by intense scrutiny and backlash on social media as part of a longstanding debate about the state of free speech on college campuses. From students boycotting controversial guest speakers to petitions demanding the resignation of faculty members with polarizing opinions, institutions of higher education have been hotbeds of a larger conversation around censorship of speech in the country.To debate the free speech crisis — or lack thereof — on campuses, Jane Coaston brought together Greg Lukianoff, the president and C.E.O. of the Foundation for Individual Rights in Education (FIRE), and Mark Copelovitch, a professor of political science and public affairs and the director of the Center for European Studies at the University of Wisconsin-Madison. Jason Kilborn is a professor the at University of Illinois, Chicago School of Law. He is a leading authority on the comparative law and policy of individual insolvency. Professor Kilborn teaches bankruptcy and civil procedure, among other courses. Professor Kilborn used a redacted reference to a slur on a final exam and subsequently faced an investigation from the university and petitions calling for his removal. Thanks to help from the Foundation for Individual Rights in Education (FIRE), Professor Kilborn reached a resolution with the university. Nadine Strossen is one of the preeminent constitutional law and civil liberties scholars in the United States. We consider challenges to free speech, such as cancel-culture and social media wars. Additionally we discuss essential practices of free speech, such as debate and discussion, listening, and creating opportunities for consensus building and change. Nico Perrino is Vice President of the Foundation for Individual Rights in Education (FIRE)'s Communications department, including FIRE's award-winning Newsdesk. He is also the creator and host of FIRE's So to Speak: The Free Speech Podcast. Nico began defending civil liberties on campus with FIRE in 2010 as a summer intern. He joined FIRE full time in 2012 as a Program Associate and Assistant to the President, later serving as a Communications Coordinator. His writing has been featured in USA Today, Politico, and The Guardian, and he regularly travels the country to speak about student and faculty rights on campus. As a documentarian, Nico was Co-Director and Senior Producer of “Mighty Ira: A Civil Liberties Story” , a feature-length film about the life and career of former ACLU Executive Director Ira Glasser. Previously, Nico served as Creative Consultant on “Can We Take a Joke?” , a film about censorship in stand up comedy. Nico graduated from Indiana University-Bloomington (IU) with a bachelor's degree in journalism and history. While at IU, he was a member of the track & field team and served as editor-in-chief for the Indiana Standard and as a reporter and columnist for the Indiana Daily Student. Nico was inducted into FIRE's Prometheus Society for his on-campus activism in defense of student and faculty rights. Nadine Strossen joins Tim to talk about how to fight “hate speech” or harmful speech without censorship. She’s a best-selling author and a Professor of Constitutional Law at New York Law School. Though it is important to note that the right of freedom of expression is the cornerstone to the First Amendment for a reason. The founders believed that certain rights come from God. Even if you don’t believe in God, and that is your right as protected by the First Amendment, the founders would tell you that your rights are natural rights, not man-made rights. They are innate desires and drives for every human being on earth and that it’s not for man to deny them to others. The right to express yourself without punishment is one of the most important rights they cited. The right to gather in groups peacefully together without penalty. The right to worship your God without coercion or punishment. The right of a free press to report news and information without government control. History is ripe with examples of cases where these rights were used to spread hateful thoughts and ideas. At the same time, our country’s short history is also full of cases where courts decided that the price for our First Amendment freedoms is tolerance for the spread of ideas that some may see as harmful, hateful or irresponsible. The principle is this. We must be willing to tolerate speech we don’t like in exchange for the right to deliver speech that others may not like. In recent years, there has been a movement to try to control, prevent or stop the spread of speech and information some may feel are harmful. Their solution is to stifle the speech, de-platform the messenger. Or even de-platform the platform. Remove any opportunity for others to communicate if that communication does not meet accepted narratives. In other words, censorship. This has been the focus of Nadine Strossen’s professional life. And with a resume that includes serving as the first woman national President of the ACLU, she has solid credentials on the issue of free speech and the battle against censorship, she has found allies from conservatives to progressives as well, making this an increasingly nonpartisan issue. Alice Dreger is a writer, historian and academic from New York. She is probably best well known for her book Galileo’s Middle Finger: Heretics, Activists, and one Scholar’s Search for Justice which was a New York Times editor’s choice. Her other books include Hermaphrodites and the Medical Invention of Sex and also One of Us: Conjoined Twins and the Future of Normal. She is the recipient of numerous awards for her writing and research and was the inaugural recipient of the Courage Award from the Heterodox Academy. She has written articles for the New York Times, Wall Street Journal, the Guardian, the Atlantic, WIRED, the Chronicle of Higher Education, and many other publications. When Bari Weiss wrote the article for the New York Times which popularised the term ‘Intellectual Dark Web’ back in 2018, Alice Dreger was to be one of the ‘renegade intellectuals’ originally set to be included in the piece but she herself asked to be left out of the piece. Nadine Strossen, the John Marshall Harlan II Professor of Law Emerita at New York Law School and the immediate past President of the American Civil Liberties Union (1991-2008), is a leading expert and frequent speaker/media commentator on constitutional law and civil liberties, who has testified before Congress on multiple occasions. She serves on the advisory boards of the ACLU, Electronic Privacy Information Center, Foundation for Individual Rights in Education (FIRE), Heterodox Academy, and National Coalition Against Censorship. The National Law Journal has named Strossen one of America’s "100 Most Influential Lawyers," and several other publications have named her one of the country’s most influential women. Her many honorary degrees and awards include the American Bar Association’s prestigious Margaret Brent Women Lawyers of Achievement Award (2017). At NYLS’s 2019 commencement, Strossen made history by receiving both the award for outstanding teaching and the award for the best book. VERMILLION, S.D. - “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”Those are the implications stated by the First Amendment. It’s a topic that gets discussed weekly by our country and has implications for college campuses. The Foundation for Individual Rights and Education (FIRE) is an advocacy group about free speech on campus, freedom of association, academic freedom, due process and freedom of conscious. Responding to hate speech is difficult because its definition remains unclear. However, the reiterated theme throughout the University of Delaware's conference on free speech was the importance of positive communication. The title of the second session was “Difficulties of Responding to Hate Speech on College and University Campuses.” Panelists were Timothy Shiell, Professor of Philosophy, University of Wisconsin – Stout; Rodney Smolla, Dean of Widener Law School; Samantha Harris, Foundation for Individual Rights in Education (FIRE) and Vice President of Policy Research; and Keith Whittington, William Nelson Cromwell Professor of Politics, Princeton University. UD's Communication Department hosted "Speech Limits in Public Life: At the Intersection of Free Speech and Hate" on March 14 to 15, 2019. Legal experts and free speech scholars from around the country discussed how to define hate speech and respond to it both digitally and on college campuses. Greg Lukianoff is an attorney, New York Times best-selling author, and the President and CEO of the Foundation for Individual Rights in Education (FIRE). Most recently, he co-authored The Coddling of the American Mind: How Good Intentions and Bad Ideas Are Setting Up a Generation for Failure with Jonathan Haidt. This New York Times best-seller expands on their September 2015 Atlantic cover story of the same name. He is also the author of Unlearning Liberty: Campus Censorship and the End of American Debate; Freedom From Speec; and FIRE’s Guide to Free Speech on Campus. Greg is also an Executive Producer of Can We Take a Joke?, a feature-length documentary that explores the collision between comedy, censorship, and outrage culture, both on and off campus. Greg received his law degree from Stanford University and has been published in The New York Times, The Wall Street Journal, The Washington Post, Los Angeles Times, The Boston Globe, and numerous other publications. He frequently appears on TV shows and radio programs, including the CBS Evening News, The Today Show, and NPR’s Morning Edition. In 2008, he became the first-ever recipient of the Playboy Foundation’s Freedom of Expression Award, and he has testified before both the U.S. Senate and the House of Representatives about free speech issues on America’s college campuses.

The University of Southern California (USC) was recently under fire due to a new policy that restricts students' freedom of speech. Last summer, the USC came up with a new policy requiring students to secure a permit two weeks prior to any demonstrations on campus. The policy also states that the university has the right to reschedule any demonstrations that do not have a permit. The Foundation for Individual Rights in Education (FIRE), a group that promotes civil rights in schools and universities in the United States, took notice of the USC's new policy. While reviewing the free speech policies of universities, FIRE noted that the USC's requirement for campus demonstrations infringes on the students' right to free speech. Consequently, the group gave the USC a red light rating, the lowest grade given to universities that restrict the said right. According to FIRE, this new policy opposes the First Amendment to the US Constitution, which protects people's right to free speech. The First Amendment allows universities to impose limits on demonstrations to prevent critically interrupting school operations. However, such restrictions should be within reason. With the new policy, the students' response to certain issues is hampered. FIRE believes that such a requirement is not justifiable as it discourages students from expressing their opinions publicly. In the university's defense, the vice president for student affairs emphasized that the policy's purpose is to ensure safety and avoid conflicts over reserving demonstration areas. Nonetheless, the USC promised to revise the policy. Getting a permit two weeks before a protest will no longer be required but will still be recommended.

Nationwide polls on support for free speech are full of contradictions. Research conducted by Gallup, the John S. and James L. Knight Foundation, and the Newseum Institute earlier this year found widespread support from college students for free speech in the abstract. However, the same poll also found tepid support when students were asked about specifics. According to the poll, a majority of respondents believed colleges should be able to restrict intentionally offensive speech and costumes that stereotype minorities. Another, more recent poll of the general population by the Newseum Institute and USA Today found a similar result. These studies, and others like them, have often confounded those of us in the free speech advocacy business. So, for this week’s show, we decided to send the inimitable Foundation for Individual Rights in Education (FIRE) summer interns to Independence Mall—adjacent to FIRE’s Philadelphia headquarters—to conduct an unscientific survey of tourists’ attitudes toward free speech and other First Amendment freedoms. Are the polls right? Do Americans generally support free speech ideals, and does that support fall off when, for example, it comes to college campuses and flag burning? If so, why?
