In this session, we spoke with Colin Lachance, the Innovator in Residence at the Ontario Bar Association (OBA) and the Principal of law firm coaching and consulting business, PGYA Consulting. Colin has spent most of his career in the legal industry. He's worked in publishing, consulting, and legaltech development just to name a few. In all that he has done, and it's a lot, there's been a consistent theme – he's comfortable with challenging the status quo and doing things differently. He's been named one of the “Top 25 Most Influential Lawyers” by Canadian Lawyer Magazine, a “Legal Rebel” by the ABA Journal and is a member of the Fastcase 50 class of legal innovators and visionaries. Colin's amazing background both qualifies and recommends him for his role as Innovator in Residence at the OBA. It's a unique role for legal member organisations. It was launched in 2018. He previously served in leadership roles in the Asiana Airlines Crash Litigation, the Olympus Superbug CRE Litigation and DePuy ASR Hip Implant Litigation, among others. Most recently, Mr. Panish has been retained to represent the husband and son of Halyna Hutchins, a cinematographer who was fatally shot and killed by Alec Baldwin on the movie set of ‘Rust' in October 2021. Since 2011, Mr. Panish has obtained more than $500 million in verdicts including, among others, a $23,720,996 bench trial award for a Southern California man and his wife after the man suffered a lower leg amputation as a result of being struck by a 28-foot utility truck while riding his motorcycle, a $21,503,420.48 verdict for a man who suffered catastrophic injuries after a vehicle illegally exiting the 405 Freeway HOV lane struck his motorcycle, a landmark $53,745,374 verdict for two Southern California brothers who were severely injured following a head-on collision with CRST big rig, a $41,864,102 jury verdict and subsequent $46,000,000 settlement for a United States Air Force Captain who suffered catastrophic injuries after being struck from behind while on his motorcycle and then dragged the length of a football field and a half by a Southern California Gas Company truck, a $36.5 million jury verdict against Schneider National for a big-rig crash that left a woman with severe spinal cord injuries, a $34.5 million verdict for a man who suffered a below the knee amputation after being hit by a tractor trailer, a $21,503,420.48 jury verdict for a Southern California man who suffered catastrophic injuries after a vehicle illegally exiting the 405 Freeway HOV lane struck his motorcycle and sent him careening across three lanes of traffic and into a passing flatbed trailer, a $17.4 million verdict for a Ph.D. student who suffered brain and jaw injuries during a rear end chain collision accident, a $17 million jury verdict against the Los Angeles MTA in the wrongful death of a visually impaired passenger, a $17.845 million award in a wrongful death case involving four family members killed when a Marine jet crashed into their home, a $20 million jury verdict for a woman who suffered a brain injury in a hit-and-run accident involving a J.B. Hunt tractor trailer, a $17 million jury verdict for a 84-year old man hit by a bus resulting in a leg amputation, a $15.3 million jury verdict for a woman and her daughter after the woman was severely injured on a negligently driven Alameda Contra-Costa Transit District bus, a $10.45 million jury verdict for the family of a security guard killed on the CBS studio lot and a $8.3 million jury verdict in the first DePuy ASR Hip Implant case to go to trial. Because of his expertise in personal injury, wrongful death, mass tort and product liability cases, Mr. Panish has been appointed to serve on the Plaintiffs' Steering and Executive committees in numerous high profile mass torts and major disaster cases, including litigation involving train crashes (co-lead counsel in the the Chatsworth Metrolink disaster, the Glendale Metrolink crash, and the Placentia Metrolink collision), airplane disasters (Alaska Airlines Flight 261 and Singapore Airlines Flight 006 crashes), pharmaceuticals (Vioxx and diet drugs), and defective product cases (Welding Rods, DePuy ASR Hip Implant Litigation, and Toyota Unintended Acceleration cases.)  He is currently handling numerous cases involving the Asiana Flight 261 plane crash as well as serving as Plaintiffs Co-lead Trial Counsel, representing over 7,000 clients in the Porter Ranch Gas Leak litigation. Mr. Panish has been recognized by numerous publications and organizations as being among the top trial lawyers in the country. Marking the 10th anniversary of the foundational Supreme Court of Canada Club Resorts v Van Breda decision (written by the Honourable Louis Lebel on behalf of the Court) – which brought greater certainty to the question of when Canadian courts will assume civil jurisdiction, the guests discuss the positive nature of conflict of laws rules, the influence of civil law judges and the evolution of private international law in the internet age.The Honourable Louis LeBel was appointed a justice of the Quebec Court of Appeal in 1984, and was appointed to the Supreme Court of Canada in 2000, retiring in 2014. He is now counsel at Langlois in Montreal and Quebec City. He received an honorary doctorate of laws degree from Laval University in 2001 and from the University of Ottawa in 2010, was awarded both the Medal of the Quebec City Bar and the Medal of the Quebec Bar, and was named a Companion of the Order of Canada in 2017. He has been an honorary member of the American College of Trial Lawyers since 2004. Paul-Erik Veel is a partner at Lenczner Slaght in Toronto, where he practices commercial litigation with a focus on class actions. He appears regularly before Courts across the country, including at the Supreme Court of Canada.  Paul-Erik is known for his groundbreaking use of legal data analytics to inform the practice of litigation, for which he was named one of the Top 25 Most Influential Lawyers of 2022 by Canadian Lawyer Magazine. In addition to his many activities, he also lectures in private international law at the University of Toronto. Paul-Erik clerked at the Supreme Court of Canada from 2009 to 2010 for the Honourable Louise Charron. Gabriel Poliquin is counsel at Olthuis van Ert based in Ottawa. He focuses his practice on all aspects of civil and commercial litigation but with a special focus on public law including proceedings against the Crown. Mr. Poliquin is a trained mediator and offers alternative dispute resolution services in civil and commercial matters. When not acting in public or commercial law matters, Gabriel teaches private international law as a lecturer at the University of Ottawa's Faculty of Law. Based on his research and public speaking, Professor Henderson was included on the National Law Journal's list of The 100 Most Influential Lawyers in America (complied every ten years).  In 2015 and 2016, he was named the Most Influential Person in Legal Education by The National Jurist magazine. Recognized as one of Canada's disability leaders, Lorin has made many aware of the challenges faced by Canadians with disabilities during COVID-19, in addition to her human rights and accessibility presentations.  For the past three years, Lorin has been a nominee for Canadian Lawyer magazine's Top 25 Most Influential Lawyers in the Human Rights category, named to the list in 2021. Also last year, the Women's Executive Network included Lorin as one of Canada's Most Powerful Women: Top 100. In May 2022, the Law Society of Ontario bestowed upon Lorin the Law Society Medal, its highest honour, for outstanding service in recognition of her work to make the profession more accessible and inclusive.

Julie F. Kay has spent decades on the front lines of the legal fight to advance gender equality and religious freedom in the U.S. and internationally. After starting her career in law as a staff attorney at the Center for Reproductive Rights , she has since helped pave the way for the legalization of abortion in Ireland, fought to protect the parenting rights of people leaving ultra-religious communities, and served as a founding president of Women's Link Worldwide.  In Controlling Women, Kolbert and Kay offer a comprehensive account of the struggle to safeguard the protections of Roe v. Wade and preserve women's fundamental reproductive rights in the face of nearly 50 years of legal battles. Dorothy Roberts is a professor at the University of Pennsylvania Carey Law School. She is also founding director of the Penn Program on Race, Science & Society in the Center for Africana Studies and the author of several books that focus on health, social justice, and bioethics. One of Mona's most challenging deals was during COVID because it involved companies from three continents that couldn't meet in person, but Mona is an expert at making a deal work and negotiated it successfully. She is unique because she not only counsels clients on legal aspects of business but also on the commercial and economic aspects. The future of clean energy The need for clean energy is accelerating, driven by COVID and the Biden administration, as well as an increase in decarbonization goals from many utilities and businesses. Renewable energy has been focused heavily on solar and wind, but other technologies, including advanced battery storage, offshore wind, and hydrogen are moving toward commercialization. Mona has seen a lot of deal activity across the value chain, with many different stakeholders consolidating positions. Major oil and gas companies and governments are also setting ambitious climate goals, and there's more federal support here in the U.S. and globally. Some countries have mandates or stimulus and tax incentives to capture more renewable energy deals, especially in the power, oil, and gas utility industries.  The potential of hydrogen Hydrogen has been around for over 100 years. Many industry stakeholders are currently considering hydrogen production and storage projects, in addition to wind and solar, as part of their decarbonization strategy. The reason it's taking off now, at least from a domestic standpoint, is because of the push for decarbonization, particularly net-zero goals. Mona has been working on hydrogen in Europe for a while, but in the past year has recently been working in the United States with blending hydrogen and natural gas to support utilities, pipelines, and oil and gas majors' decarbonization efforts. While clean hydrogen is expensive now, it can be equated to what solar was 15 or 20 years ago. When a country promotes hydrogen strategies with incentives, there will be a proliferation of deals. Mona is currently working on deals that combine renewables and hydrogen, as combining many different contributing elements creates a hydrogen hub, which is a favorite pathway for how clean hydrogen usage will develop. Nadine Strossen, the John Marshall Harlan II Professor of Law Emerita at New York Law School and the immediate past President of the American Civil Liberties Union (1991-2008), is a leading expert and frequent speaker/media commentator on constitutional law and civil liberties, who has testified before Congress on multiple occasions. She serves on the advisory boards of the ACLU, Electronic Privacy Information Center, Foundation for Individual Rights in Education (FIRE), Heterodox Academy, and National Coalition Against Censorship. The National Law Journal has named Strossen one of America’s "100 Most Influential Lawyers," and several other publications have named her one of the country’s most influential women. Her many honorary degrees and awards include the American Bar Association’s prestigious Margaret Brent Women Lawyers of Achievement Award (2017). At NYLS’s 2019 commencement, Strossen made history by receiving both the award for outstanding teaching and the award for the best book. When Strossen stepped down as ACLU President, three (ideologically diverse) Supreme Court Justices participated in her farewell/tribute luncheon: Ruth Bader Ginsburg, Antonin Scalia, and David Souter. There is nothing more inspiring than hearing about someone who has been there and done that.  In today’s episode we feature Kris Robidoux who was involved in the first two anti-bribery cases in Canada and led the way for those after her. Kris is a decorated Legal and Compliance professional with the title of Queen’s Counsel to her name as well as being named one of the Top 100 Women in Investigations by Global Investigations Review and One of Canada’s Top 25 Most Influential Lawyers by Canadian Lawyer Magazine. Mary was introduced to Kris by Compliance colleagues Jay Rosen and Jonathan Armstrong.  It was the beginning of a wonderful friendship.  Kris, Jonathan and Mary would go on to work together as panelists at conferences sharing global Compliance updates with able assistance from Jay who facilitated the interactive aspects of their sessions.  Throughout her time knowing Kris, Mary has considered her to be one of her Compliance role models and knows that she will always be received with a warm smile and words of wisdom when meeting Kris. Anthony Morgan is a lawyer and the Training & Development Consultant in the City of Toronto's Confronting Anti-Black Racism Unit. Through coordination and delivery of strategic learning and education sessions to City of Toronto staff, he is responsible for the implementation of the anti-Black racism training and development curriculum based on the Toronto Action Plan to Confront Anti-Black Racism. Prior to joining the City of Toronto, Anthony was an Associate at Falconers LLP, specializing in the areas of civil, constitutional and criminal state accountability litigation. He has a special interest in anti-racist human rights advocacy, particularly in the area of anti-Black racism. He has appeared at various levels of court, including the Supreme Court of Canada, and has also represented the interests of African Canadians before United Nations human rights treaty bodies. In both 2016 and 2017, Anthony was nominated as one of Canada's Top 25 Most Influential Lawyers by Canadian Lawyer Magazine. Anthony is a frequent legal, social and public affairs commentator on issues concerning race and racism, critical multiculturalism and critical race theory in Canada. His comments on these issues have been featured in the Globe and Mail, National Post, Toronto Star, Ricochet, Huffington Post Canada, and other major newspapers and broadcast outlets, including CNN. Should legal ethics rules be changed to allow non-lawyer ownership of legal services providers? So controversial is the question that it was major news in July when the State Bar of California voted to appoint a task force to study and make recommendations on the issue. What spurred the bar to take this action was the Legal Market Landscape Report it commissioned from William D. Henderson, professor at Indiana University Maurer School of Law, who is Bob Ambrogi’s guest on today’s episode to discuss his findings and recommendations. Henderson’s report makes the case that the legal profession is failing in its core mission of serving those who need legal services. The situation has brought the profession to an inflection point that requires action by regulators, Henderson says. The most effective regulatory action would be to ease rules on non-lawyer investment in order to allow lawyers to more closely collaborate with professionals from other disciplines, such as technology, process design, data analytics, accounting, marketing and finance. “By modifying the ethics rules to facilitate this close collaboration,” Henderson writes in his report, “the legal profession will accelerate the development of one-to-many productized legal solutions that will drive down overall costs; improve access for the poor, working and middle class; improve the predictability and transparency of legal services; aid the growth of new businesses; and elevate the stature and reputation of the legal profession as one serving the broader needs of society.” At Maurer, Henderson holds the Stephen F. Burns Chair on the Legal Profession. In 2017, he founded Legal Evolution, an online publication that chronicles successful innovation within the legal industry. A prolific author and speaker, he focuses primarily on the empirical analysis of the legal profession. Among his honors, he was named by the ABA Journal as a Legal Rebel, included on the National Law Journal’s list of The 100 Most Influential Lawyers in America, and in both 2015 and 2016 named the Most Influential Person in Legal Education by The National Jurist magazine. HBS 035 Interview w_ Robbie Kaplan -Then Comes Marriage_ United States v. Windsor and the Defeat of DOMA Roberta A. "Robbie" Kaplan is an American lawyer. She is the founding partner of Kaplan & Company, LLP, a law firm dedicated to commercial litigation and public interest matters, and an adjunct professor of law at Columbia University Law School. Until July 2017, she was a partner in the Litigation Department of Paul, Weiss, Rifkind, Wharton & Garrison. Kaplan successfully argued before the Supreme Court of the United States on behalf of her client, Edith Windsor, in United States v. Windsor (2013). This resulted in a landmark decision that invalidated a section of the 1996 Defense of Marriage Act (DOMA), thus requiring the federal government to recognize same-sex marriages. Windsor led to the 2015 Supreme Court ruling in Obergefell v. Hodges, which struck down all remaining state and federal laws against same-sex marriage across the United States. United States v. Windsor In 2009, Kaplan agreed to represent Edie Windsor pro bono. Windsor's wife, Thea Spyer, had died two years after they wed in Canada, leaving Windsor her sole heir. But because their marriage was not recognized under existing U. S. federal law, Windsor received an estate tax bill of $363,053. Windsor went to gay rights advocates seeking redress but could find no one to take her case. She was referred to Kaplan, who later recalled, "When I heard her story, it took me about five seconds, maybe less, to agree to represent her." Kaplan had been co-counsel on the unsuccessful bid for marriage equality in New York state in 2006. In a spirited exchange between Kaplan and Chief Justice John Roberts during oral arguments for the case, Roberts alleged that politicians were "falling all over themselves" to support her case. Kaplan responded, "The fact of the matter is, Mr. Chief Justice, is that no other group in recent history has been subjected to popular referenda to take away rights that have already been given or exclude those rights, the way gay people have." On June 26, 2013, the U.S. Supreme Court issued a 5-4 decision declaring Section 3 of DOMA to be unconstitutional. Edith Windsor declared, "Robbie Kaplan said, as Martin Luther King said before her, there is no wrong time to seek justice." Roberta (Robbie) Kaplan, the founding partner at Kaplan & Company, LLP, one of the few women-led elite boutique litigation law firms has been described as a “powerhouse corporate litigator” and “pressure junkie” who “thrives on looking at the big picture” whether “in the gay-marriage legal fight or high-profile corporate scandals.”  She has been selected as one of “The 100 Most Influential Lawyers” in the United States, as a “Litigator of the Year” by The American Lawyer, and as a “Lawyer of the Year” by Above the Law. In addition to representing large institutional and corporate clients like Fitch Ratings, Airbnb, Columbia University and T-Mobile,  Robbie book “Then Comes Marriage: United States v. Windsor and the Defeat of DOMA” (W.W. Norton 2015),  was chosen by the L.A. Times and Ms. Magazine as one of the top 10 books of 2015.  In commenting on the book, President Bill Clinton called Robbie an “American hero.” Robbie has received numerous recognitions for her legal accomplishments and charitable activities, including the New York Law Journal Lifetime Achievement Award;  Financial Times Legal Innovator of the Year; the Columbia Law School Medal of Excellence; as well as an honorary doctorate from the Jewish Theological Seminary.   Kaplan wrote about United States v. She was the Chief Adviser to the National Bankruptcy Review Commission and was appointed by Chief Justice Rehnquist as the first academic member of the Federal Judicial Education Committee.
