Brendan Banfield's trial is over. The conviction is in. Life without parole. But the legal fight continues — because when you're facing dying in prison, you appeal everything, challenge everything, exhaust every possible avenue. The question is whether any of it has a real chance of working.Today on True Crime Today, defense attorney Bob Motta explains what comes next for Banfield and what his appellate lawyers are going to argue. Appeals aren't about convincing a new jury. They're about finding legal errors — things the trial judge did that violated procedure or the defendant's rights. Banfield's team has several potential arguments, but each faces serious obstacles.The Juliana deal is one angle. Murder dropped to manslaughter, time served, she walks free after testifying. The defense will argue that's so coercive it taints her testimony. Bob explains why courts rarely buy that argument — as long as the jury knew about the deal, and this jury did, it's usually considered fair game.The digital forensics issue is potentially stronger. The prosecution's own investigator got pulled off the case when his findings didn't align with their theory. If evidence was withheld from the defense, that's a Brady violation — one of the few things that can overturn a conviction. But proving it is hard, and getting a new trial is harder.Bob also addresses the "harmless error" doctrine — the legal standard that lets courts acknowledge mistakes but say they wouldn't have changed the outcome anyway. Sentenced to fifty years in a maximum-security prison, a sixteen-year-old girl sat in solitary confinement. Due to her age, she remained separated from the other inmates. For nearly a year, she had no outside visitors. During an outreach and baptism held at the facility, the guards let a ministry leader enter the girl’s cell. She heard the gospel, surrendered her life to Jesus, and asked to be baptized. At first, the team considered using water bottles, but then the prison staff shut down the entire facility and led her to a portable baptismal pool. As God’s people prayed, she wept. Though God promises to judge those who reject Him, He also extends mercy to those who repent. He restores and protects those who trust in His name (Zephaniah 3:10-12). Repentance leads to redemption, because God Himself “has taken away” the punishment we deserve (v. 15). Hope resounds in the prophet Zephaniah’s words about God: “He will take great delight in you; in his love he will no longer rebuke you, but will rejoice over you with singing” (v. 17). So we can share the gospel with compassion and confidence, especially with those who may feel they’re too far from God. No matter where we are, what we’ve done, or how alone, forgotten, or unworthy we may feel, God loves and pursues us. Every person is within God’s reach.

Send us a textMarci Marie Simmons was from a good upbringing, and had a good job. She had made a few wrong turns along the way but was doing well. After realizing the company she was working for  was taking part in some not so above board accounting, Marci started doing some 'creative accounting' of her own. So, she had found a way to steal funds on a regular basis, and had become addicted to 'not getting caught'. She knew she had to stop, but couldn't. Listen to this amazing episode as we hear in detail about the day her world came crashing down. She was sentenced to 20 years in prison for in 2011 for stealing a total of $367k. Although a lot, the punishment did not ,match the crime,  and she was made an example of, even spending time in solitary confinement. She was released on parole in March 2021. Never a violent offender in or out of custody, she is now on a mission to help other female inmates who often suffer the same fate in the USA's corrupt and failed justice system. Wow. It was a great week for justice.

Eric Van Buren grew up in Washington, DC in a stable home with hardworking parents and a strong family foundation, but his life took a turn after high school when fighting and drug dealing pulled him into the streets. After being arrested on a state murder charge and beating the case, Eric thought the worst was behind him — until the federal government indicted him on a major drug conspiracy. The feds sentenced Eric to life in prison, and he went on to serve 19 years inside some of the most dangerous federal prisons in the country, fighting to survive both mentally and physically.
