After a criminal pays their debt to society, should they continue to suffer additional consequences for their crime for the rest of their life? Ricky Panayoty developed a deep passion for the law while serving a 10-year sentence for robbery, but really didn't know whether he could apply to college, let alone law school, after being released. Law students come from a multitude of backgrounds, but justice-impacted individuals like Ricky often have many more obstacles to overcome. Faculty host Todd Berger talks with host Chay Rodriguez about her interview with Ricky discussing his incarceration, the experiences that fueled his interest in law, and his circuitous path to law school. They also highlight the perspective a justice-impacted individual brings to the legal profession and examine policies and procedures that affect the future prospects of these individuals. Ricky Panayoty is a Juris Doctor candidate at Atlanta's John Marshall Law School and worked as a summer intern at Bryant Green & Associates.

The federal government had prohibited the disenrollment of Medicaid recipients for three years during the pandemic. Georgia began reassessing eligibility for Medicaid and PeachCare for Kids in June, resulting in 95,578 individuals losing coverage, while 64,423 were renewed. The majority lost coverage due to procedural termination caused by a lack of information. The state aims to complete the redetermination process for all Medicaid enrollees by May 2024 and has implemented an information campaign to assist recipients. ....……… Read more on this story at tribuneledgernews.com STORY 2: surplus Georgia tax collections in June 2023 dropped slightly compared to the previous year, but the state ended fiscal 2023 with a significant surplus for the third consecutive year. The Georgia Department of Revenue collected $2.84 billion in taxes in June, a 0.4% decrease from the same month in the previous year. However, the total revenue for the entire fiscal year reached $33.13 billion, surpassing Governor Brian Kemp's revenue estimate of $28.4 billion, resulting in a surplus of nearly $4.8 billion. While individual income taxes decreased by 12.6% due to increased refunds, net sales tax collections increased by 4%. Corporate income tax receipts declined by 14.7% due to higher refunds for businesses. The surplus will trigger a debate on how to allocate the funds, with Kemp advocating for a conservative approach and using the surplus to fund income tax cuts. Critics argue that these cuts primarily benefit the wealthy and that the state should prioritize funding public education, healthcare, and economic mobility. Story 3: canton A woman and her 13-year-old stepson were arrested in Canton for allegedly breaking into numerous cars in the area. The Canton Police Department responded to multiple reports of car break-ins, with a total of 26 incidents reported. Some cars were unlocked, while others were forcibly entered. Blood found inside the vehicles was collected as evidence. Witnesses saw a red vehicle leaving the area, and later, the woman and teenager were found unconscious in a red car in a shopping center parking lot. Stolen items and a firearm were discovered in the car. The woman, Brianna Rogers, faces charges of entering auto and possession of a firearm by a convicted felon, while the teenager faces similar charges. The investigation is ongoing, and more charges may be added. The city is seeking $685,000 in funding to create a safe connection with sidewalks and trail segments. They also authorized a supplemental proposal with Arcadis for the Paden Street Extension project and approved a contract for surveying the Market Street extension project. Additionally, the council approved an alcohol license request for H&M Food Mart, allowing the sale of wine and malt beverages at the convenience store. Story 5: ballinger Eric Ballinger, a lawyer from Canton, has been re-elected for a ninth term on the Board of Governors of the State Bar of Georgia. He will continue representing Cherokee County in the Blue Ridge Judicial Circuit, a position he has held since 2007. Ballinger is the founder of The Law Office of Eric A. Ballinger, focusing on family law, criminal defense, general litigation, and small business representation. He obtained his law degree from Atlanta's John Marshall Law School and has been a member of the State Bar of Georgia since 1993. Additionally, Ballinger serves as a part-time judge for the Magistrate Court of Cherokee County. The Board of Governors is responsible for policymaking and consists of 160 members representing each judicial circuit in Georgia. Story 6: ATM The Cherokee Sheriff's Office is seeking suspects involved in the theft of an undisclosed amount of money from an ATM machine at the Towne Lake Wells Fargo in Georgia. The incident occurred last week when the masked suspects allegedly confronted an ATM technician servicing the drive-through ATM. They forced the technician away from the machine and stole cash from it before fleeing in a white vehicle. The authorities believe the incident was specifically targeted at the ATM and not the bank's customers. As of now, the suspects remain at large, and the investigation involves the Cherokee Sheriff's Office, with no involvement from the FBI. Anyone with information is urged to contact the Cherokee Sheriff's Office. The Braves will pay tribute to Aaron's impact as a player, executive, and entrepreneur with special pre-game and in-game content. Story 8: All Star Atlanta is being considered as a potential host for the 2025 All-Star Game, according to MLB Commissioner Rob Manfred. This comes after the city lost the opportunity to host the 2021 game due to controversy surrounding Georgia's voting laws. Truist Park, is being considered as a potential venue for the 2025 game. Other sites under consideration include Wrigley Field in Chicago and Fenway Park in Boston. Atlanta has previously hosted the All-Star Game in 1972 and 2000. The 2022 game will be hosted by the Texas Rangers, and the 2026 game will coincide with the 250th anniversary of the signing of the Declaration of Independence in Philadelphia. Former Atlanta Falcons player William Moore has been charged with multiple counts, including two counts of aggravated assault, after allegedly firing a gun at a vehicle with three people, including two children, inside. The incident occurred on Sunday in Alexander Park, Lawrenceville, and the vehicle was damaged, though it is unknown if anyone was injured. Moore played for the Falcons for seven seasons before retiring in 2015, and he was booked into the Gwinnett County jail on Sunday, where he remains held. A school bus caught fire outside Mulberry Elementary School in Gwinnett County, on Monday morning. The driver noticed increasing heat under the dashboard and pulled over before evacuating the students from the bus. Shortly after, the bus caught fire, but no one was injured in the incident. The fire department quickly extinguished the flames, and Georgia Milestones testing was suspended for the day. School officials have reassured parents that counselors are available for any students who may need support. The bus driver and monitor were praised for their quick response in ensuring the safety of the children. A student at Trickum Middle School will face disciplinary action and criminal charges after a search for marijuana led to the discovery of an unloaded handgun. A staff member had raised concerns about the student and alerted administrators. The student was brought to a "secure location" and their bag was searched, where marijuana and a handgun were found. The school's principal, Ryan Queen, praised the staff member who raised concerns and said that the incident demonstrated the "see something, say something" concept. The incident is the latest in a series of disciplinary incidents in Gwinnett County schools this year. The Suwanee Arts Festival is a two-day event showcasing art exhibits, stage performances, children's activities, and cuisine from around the world. The festival will take place at Suwanee Town Center and will focus on the visual arts, featuring more than 120 regional artisans selling their creations. There will also be onsite demonstrations by glassblower Kelly Robertson and woodworker Lee Bembry, as well as a Kid's Zone and Emerging Talent tent showcasing young artists. The festival will also feature entertainment on the Town Center Park Stage and a Writer's Tent highlighting literary arts. A variety of food options will be available, and the festival will conclude with the unveiling of "The Ultimate Participation Trophy Project," a temporary art piece made from donated trophies by artist Phil Proctor. John Melvin, former executive director of the Georgia Bureau of Investigation, has been sworn in as the managing assistant district attorney in Gwinnett County. Melvin, who resigned from his position at the GBI last month, has over 28 years of prosecution and legal experience, including five years at the GBI, where he served as chief of staff, assistant director, and executive director. Before joining the GBI, Melvin worked as a prosecutor in the Cobb County DA's Office and taught at Emory Law School and Atlanta's John Marshall Law School. In his Facebook post, Melvin expressed his excitement to return to the profession of law and serve as a managing district attorney in Gwinnett County, which has a population of one million and is one of the most diverse counties in the United States. GaPol_Trump This week on The Georgia Politics Podcast, Megan sits down with Chris Sandbach to discuss what we know and what we don't know about the Trump indictment related to hush money payments to Stormy Daniels. There have, of course, been plenty of news articles and commentary on what implications the indictment of Donald Trump could have for the country writ large and Donald Trump's political future, but we think what is needed is an explainer of exactly what the charges are, what evidence is presented by the Manhattan DA in the indictment, and what we can expect to learn in the next few months. Joining Megan on The Georgia Politics Podcast is attorney and former public defender, Chris Sandbach, to discuss the role of public defenders in our criminal justice system and what the appointment of Kentanji Brown Jackson means for the makeup of the Supreme Court. Public defenders are attorneys who represent people who have been charged with a crime and who cannot afford to pay for private counsel. They face the possibility of time behind bars if convicted. The 6th Amendment to the United States Constitution guarantees that if someone cannot afford private counsel, a judge will appoint a public defender to defend them in a court of law, for free. Chris, who spent over 6 years of his professional life as a public defender, talks with Megan about the ways in which our criminal justice system works, where it has room for improvement, and the role public defenders play in both. He also talks about the recently sworn in Justice Kentanji Brown Jackson and what her experience as a public defender brings to the court, for the first time in its existence. In this Onward Podcast episode, Joshua Ebalz talks about how he's survived trauma and is thriving forward. In the past few years, Joshua survived the unthinkable. Both of his brothers and his father passed away. Furthermore, Joshua shares his story and his belief that even through loss, after loss, after loss, after loss; there is still the chance for you to live your life in a healthy, constructive, hopeful way. Also, overcoming adversity has to come from within. It will not come from someone else. Finally, living your life in the NOW requires you to understand your past and the trauma that lives in it and what you hope to accomplish in the future. Happiness will lie in your NOW if you are able to understand your past and not focus incessantly on your future. As the clock keeps ticking toward the midterm elections, will the political parties change their strategy to maintain or assume control of the Congress? Do they understand the voters, or are they clueless or arrogant? Will the Durham investigation hurt or even sink the Democrats in the upcoming elections? Joining Blanquita to discuss all this and more is former Congressman Doug Collins (R-GA). Doug Collins is a “common-sense conservative” and host of “The Doug Collins Podcast” on the Salem Podcast Network. This week, your hosts Steve Lowry and Yvonne Godfrey interview Bill Stone, James Stone and Ryals Stone of The Stone Law Group (https://www.stonelaw.net/). Remember to rate and review GTP in iTunes: Click Here To Rate and Review New! Watch GTP on YouTube: https://www.youtube.com/channel/UCKdeO4IodggpSLyhWVdcWKw Episode Details: The Stone Law Group's trial team -- comprised of father Bill Stone and sons James Stone and Ryals Stone -- explain how they thoroughly investigated a fatal car accident and proved that their client, a promising 19-year-old University of Mississippi student, was not the proximate cause of his own tragic death, as law enforcement investigators initially concluded. In the early morning hours of March 29, 2013, University of Mississippi freshman Price Thornal was attempting to travel from Oxford, Mississippi to his hometown in Tallahassee, Florida to celebrate his father's birthday. Price's Honda Civic was hit head-on by the defendant, who was driving a Dodge Durango on the wrong side of the divided US Hwy 84. Trial lawyers Bill, James and Ryals Stone used the GPS system in Price's car to plot his trajectory and utilized the defendant's cell phone records as evidence of her negligence and opposing trajectory. In spite of the defendant's attempts to cast blame on Price, the Stone Law Group used basic physics as well as expert accident reconstruction to show the jury which car was traveling in the appropriate direction. In November 2021, after just 20 minutes of deliberation, an Early County, Georgia jury found the defendant's negligence to be the proximate cause of Price's death and awarded $26,141,628 in damages. Disaster Relief Moving Forward This week we had the chance to talk to Sascha, who is a community organizer in the triangle area of North Carolina, about ongoing organizing to help rebuild and continue to aid folks after the multiple hurricanes recently hit this region. This interview went in directions that we couldn't have predicted, and really went on a deep dive of how to conceptualize of disaster relief in our changing climate, in addition to more practical topics. We hope you enjoy it! To get in touch with the project that our guest is talking about, and if you have extra monie$ to spare, you can visit maddistronc.org for ways to donate or drop by to 800 Henderson Street in Durham if you're in the area. To hear the interview that we referenced about halfway through, you can go to our website and search “Indigenous Activist”, it should be the first item in the search results. You can also hear a 10 minute edit of this interview with Vanessa on how to be better accomplices to Lumbee folks in Lumberton NC in the October episode of B(A)D News, Angry Voices From Around the World which you can find both at our website or at aradio.blogsport.de. B(A)D News is a monthly news collaboration between projects in the A-Radio Network, which includes anarchist radio from Chile, various places in Eastern and Western Europe, and right here on Turtle Island. Keep your eyes peeled to our feed for when this show updates! Announcements If you're in the Asheville area this week, Blue Ridge Anarchist Black Cross has two upcoming events. TROUBLE on J20 On Friday, November 2nd at 6:30pm at Firestorm Books & Coffee, BRABC will be airing the latest episode of Trouble, the mini-documentary series by sub.Media. This month's episode is focused on the J20 inauguration conspiracy case that ended some months back. This'll be followed by a brief chat about the film and the case. This event happens the same time, same place, on the first Friday of every month and is a great way to start of your weekend. Political Prisoner Letter Writing On Sunday, November 4th at 5pm, just a little after next week's episode of our show of this show, BRABC will also be hosting their monthly Political Prisoner letter writing night at, you guessed it, Firestorm! ABC will be bringing info on prisoners whose birthdays are upcoming or who are facing repression or coming up on parole, will provide the materials and a friendly atmosphere and help in writing letters to prisoners. If you've ever thought of writing someone in prison before but been overwhelmed by the prospect of it, this is a great way to get started. Recent Violence from the Far Right We don't frequently comment on this show about ongoing events we aren't either announcing or featuring on the episode, but this is a rare example. This last week saw a couple of racist attacks that we want to mention in case you missed them, in order to point to the continued and intensifying need for anti-racist and anti-fascist organizing, research and street presence. On October 24th, a white man named Gregory Bush allegedly failed to break into a black church in Louisville, KY, and instead decided to shoot a black man (Maurice E. Stallard) inside of a Kroger and a black woman (Vickie Lee Jones) in the parking lot, killing them both. The shooter told a witness “Whites don't shoot whites.” Yesterday, on Saturday October 27th during shabbat services, a gunman with white nationalist ties named Robert D. Bowers, entered the Tree of Life Congregation Synagogue in Pittsburgh, PA, and killed 11 congregants while wielding an AR-15 and two handguns, injuring 3 more congregants. These are just two recent examples of white rage acting out against others, a visible trend and not out of sync with the settler-colonial and anti-black violence of the United States, yet undeniably horrendous. The victims families are in our hearts, as are all of the many unmentioned victims of reactionary violence. On this note, we're including a couple of anti-racist announcements folks can join in on if they care to. Jewish Anti-Fascist & Anti-Racist Call To literally steal a line from the latest Hotwire episode from crimethInc, “To mark the 80th anniversary of Kristallnacht and to push back against the uptick in anti-Semitism, Islamophobia, and xenophobic violence around the world, there's a Jewish call for International Days against fascism and anti-Semitism.” The call reads: “On November 8–11, we will sing out and celebrate the survival of our peoples. We will say Kaddish for those who gave their lives in the fight against fascism. We will engage in acts of Kherem and ritually excommunicate those Jews who aid and abet the fascists of our time. And we will march on the institutions, the political parties, and the private businesses that collaborate with their genocidal agenda. At the same time, we will show the world that the real threat to our security as Jews isn't our Muslim neighbors, but “Western Chauvinists,” Christian supremacists, and white nationalists – the would-be pogromists of our day. Starting now and continuing through [the year] 5779 and beyond, we will (re)build an international network of anti-fascist Jews and our allies. From the streets where we live to the places we work and play, we will organize to defend all of our communities from those who would exterminate us. We invite you to join us in the fight: For a world without pogroms. For a future without fascism.” The call is using the hashtags #AntiFascistFall, #CancelThem, and #OutliveThem. More info at outlivethem.wordpress.com. https://itsgoingdown.org/international-days-of-action-for-a-world-without-pogroms-for-a-future-without-fascism/” Call for solidarity from Atlanta Atlanta Antifascists are asking folks to contact Atlanta's John Marshall Law School about one of it's students, Casey Jordan Cooper. Cooper has made explicit lynching threats against black students, has organized Alt-Right efforts around the school and has documented connections to white nationalists like Sam Dickson. Alongside a bunch of really amazing research that AFAinATL has done, you can find more about Casey Jordan Cooper, including a video and 500+ page dossier on him, the request for a call-in on Monday, October 29th to the University and a script up at atlantaantifa.org. We don't need anymore nazi lawyers and this school should be ashamed to continue to hold Cooper as a student considering it's lip service to the importance of it's students providing non-prejudicial service to their clients. WNC anti-racists undermine local Patriot Front A big ups to comrades in WNC who, very carefully and soberly, infiltrated a new chapter of the white nationalist grouping Patriot Front and were able to disrupt their activities during an attempted banner drop. This sort of high level of engagement is dangerous and not to be taken lightly, but can be quite effective at gaining intelligence on the enemy and ruining their days. More info on this can be found on this IGD post! Support Malik and Rashid! In prisoner news, two affiliates of the New Afrikan Black Panther Party Prison Chapter are in the news. Keith “Malik” Washington, whose supporters we've had on the show before, shared that he's on a hunger strike at the McConnell Administrative Segregation Unit in protest against his continued repression and repeated medical endangerment. More info can be found at comrademalike.com. Also Kevin “Rashid” Johnson who we spoke to in September. He has been refused medical aid by guards at Sussex II, denied the ability to send or receive mail, including legal mail. He has been threatened with dogs while chained up, kept in his cell 24/7 and other terrible circumstances. Visit rashidmod.com for more details and the numbers and officials that you can call to protest on his behalf. . ... . .. Playlist here.
In its landmark 1963 decision Gideon v. Wainwright, the Supreme Court mandated the right to counsel in federal and state criminal proceedings. Fifty-one years after that unanimous decision, some question whether Gideon's promise has been fulfilled, as public defenders struggle against heavy caseloads, limited resources and low pay. On this episode of Lawyer2Lawyer, hosts Bob Ambrogi and J. Craig Williams interview Jonathan Rapping, founder of the Atlanta-based public defender training program Gideon's Promise, and Dawn Porter, director and producer of the documentary Gideon's Army. Together they discuss the daily rigors faced by public defenders in the south, their personal beliefs about unequal access to justice, and their ideas about how to better deliver on the promise of Gideon. Jonathan Rapping is the president and founder of Gideon's Promise, a training and support group for public defenders in the south aimed at creating greater access to justice for indigent defendants. He is also the director of the Honors Program in Criminal Justice at Atlanta's John Marshall Law School, where he teaches criminal law and criminal procedure. Rapping is the former director of public defender training programs in the District of Columbia, Georgia, and Louisiana. He is the recipient of the Lincoln Leadership Award from Kentucky's Department of Public Advocacy, the Sentencing Project Award from the National Association of Sentencing Advocates and Mitigation Specialists, and the Gideon's Promise Award from the Southern Center for Human Rights. Dawn Porter is a lawyer and the founder of Trilogy Films. She was the director and producer of the award-winning Gideon's Army, a documentary about public defenders associated with Gideon's Promise, which premiered at the 2013 Sundance Film Festival and aired on HBO Documentary Films. Prior to beginning her film and television career, Porter worked as an attorney at Baker and Hostetler and ABC Television Network. Among her many projects, she directed "Spies of Mississippi," a documentary on PBS about celebrity Chef Alexandra Guarnaschelli; produced "Serious Moonlight" starring Meg Ryan and Timothy Hutton; and produced "The Green," an independent feature starring Cheyenne Jackson (from 30 Rock) and Emmy-winning actress Julia Ormond.
