Prior to her most recent role at Walgreens, Natalie was an Associate Attorney at Dentons US LLP, where she handled healthcare regulatory, tax-exempt bond finance, and M&A matters. She holds a bachelor's degree in political science from Benedictine University and a law degree from The John Marshall Law School. In this episode… New privacy laws, requirements, and expanding health data definitions require organizations to rethink and adjust their privacy programs accordingly. For companies like Walgreens, navigating these changes entails addressing both long-standing regulations, such as HIPAA, and emerging privacy laws that govern a broader scope of data. As businesses juggle diverse regulatory requirements, shifting data definitions, and operational demands, how can they create a privacy program that is effective and adaptable? Walgreens' approach to privacy exemplifies how businesses can adapt to an evolving regulatory landscape. Effective privacy programs start with understanding how shifting privacy requirements impact different business functions, from marketing to IT and analytics. With privacy regulations now extending beyond HIPAA to include other forms of personal information, companies need to develop tailored privacy strategies, provide ongoing education, and build strong relationships across departments to ensure privacy measures are integrated into everyday business operations. By making privacy a proactive and collaborative effort, companies can enhance compliance and reduce risks. This Day in Legal History: Pivotal LGBTQ+ Rights DecisionsOn this day, June 26th, in legal history, two pivotal Supreme Court decisions significantly advanced the cause of marriage equality in the United States. On June 26, 2013, the Supreme Court delivered its decision in United States v. Windsor. In a 5-4 ruling, the Court struck down Section 3 of the Defense of Marriage Act (DOMA), which had defined marriage for federal purposes as the union between a man and a woman. Edith Windsor, the plaintiff, had been denied a spousal tax exemption after her same-sex spouse's death, prompting her to challenge the law. The Court held that DOMA's definition of marriage was unconstitutional as it violated the principles of due process and equal protection guaranteed by the Fifth Amendment. This landmark decision allowed same-sex couples to receive the same federal benefits as heterosexual couples, marking a significant step forward for LGBTQ+ rights and equality. Two years later, on June 26, 2015, the Supreme Court issued another historic ruling in Obergefell v. Hodges. In another closely divided 5-4 decision, the Court declared that same-sex marriage is a constitutional right under the 14th Amendment. The case consolidated several challenges from same-sex couples who had been denied the right to marry or have their marriages recognized by their home states. Justice Anthony Kennedy, writing for the majority, stated that the right to marry is a fundamental right inherent in the liberty of the person, and under the Due Process and Equal Protection Clauses of the 14th Amendment, same-sex couples cannot be denied that right. This ruling effectively legalized same-sex marriage across the United States, ensuring that all states must perform and recognize marriages between individuals of the same sex. These decisions on June 26th were monumental in affirming the rights of same-sex couples and dismantling legal barriers to marriage equality, marking significant victories for the LGBTQ+ community and setting precedents for future civil rights advancements.Supreme Court Justice Ketanji Brown Jackson recently surprised defense attorneys with her unexpected votes against criminal defendants, despite her background as a former federal defender. In two cases decided at the end of the term, Jackson broke from her liberal colleagues. She joined the majority in a case broadening expert witness testimony and dissented in another that reinforced the right to a jury trial.President Joe Biden highlighted Jackson's unique experience as a public defender when nominating her in 2022. In Diaz v. United States, a 6-3 decision, the Court sided with prosecutors on expert witness testimony, allowing experts to discuss what most defendants generally know. Jackson joined Justice Clarence Thomas's majority opinion and wrote separately, suggesting the rule could benefit both prosecutors and defendants. In Erlinger v. United States, the Court ruled 6-3 to apply the Apprendi v. New Jersey precedent broadly, requiring juries to decide facts that could increase sentences. Jackson dissented, arguing that Apprendi limits legislative efforts to create fairer sentencing systems. She suggested overturning Apprendi, which surprised many in the defense community given its importance to defendants' rights. Some notable defense attorneys have expressed disappointment in her positions, though acknowledging that public defender views are not monolithic.Justice Jackson Takes Unexpected Positions in Criminal CasesA recent study by Georgetown University's Center on Education and Workforce revealed that law school graduates earn a median salary of $72,000 after debt payments four years into their careers. However, this figure varies significantly depending on the law school attended. Graduates from seven elite law schools, including Columbia, University of Pennsylvania, and Harvard, have median earnings of over $200,000 after debt. In contrast, graduates from 33 lower-ranking law schools earn $55,000 or less. The report, titled "A Law Degree Is No Sure Thing: Some Law School Graduates Earn Top Dollar, but Many Do Not," shows that law graduates typically leave school with a median debt of $118,500. Columbia Law School offers the highest return on investment with net median earnings of $253,800 after four years, followed by other top-tier schools. The bill, sponsored by Democratic Senator Maria Cantwell and Republican Representative Cathy McMorris Rodgers, aims to establish a national data privacy standard. This would allow individuals to access, delete, and opt out of their data being used for targeted advertising, and would create a national data broker registry. The U.S. has lagged behind other regions like the European Union, which implemented the General Data Protection Regulation (GDPR) in 2018. Industry groups, including the U.S. Chamber of Commerce and TechNet, argue that the bill lacks safeguards to prevent states from adding their own regulations, which could complicate compliance for businesses. They advocate for a unified national standard without additional state-level regulations.Privacy advocates, however, contend that the bill would hinder states from addressing new technological developments and responding to emerging privacy issues. They fear that federal pre-emption could stifle the progressive influence of states like California, which often leads in privacy regulations. Ashkan Soltani, from the California Privacy Protection Agency, warned against setting static regulations given the rapid pace of technological advancements.Democratic Representative Suzan DelBene supports the bill, citing the current "patchwork" of state laws as problematic for small businesses. The subscribers allege that Disney's agreements with rival streaming TV providers, which included access to ESPN content, restrained trade and led to higher prices. Judge Edward J. Davila of the US District Court for the Northern District of California found that the plaintiffs plausibly alleged Disney's conduct harmed competition in the streaming live pay TV market (SLPTV).The lawsuit claims Disney's agreements prevented other streamers from offering lower-priced bundles excluding ESPN, thus raising subscription costs and protecting Disney-owned Hulu from competition. Despite partially dismissing the initial complaint, the judge allowed an amended complaint to proceed, alleging violations of the federal Sherman Act and state antitrust laws. While the court dismissed claims for damages under the Sherman Act, limiting potential relief to an injunction, it allowed most state antitrust claims to continue, except for those under the Illinois Antitrust Act and Tennessee Trade Practices Act.The decision follows the Justice Department's plans to review a proposed new streaming service by Disney, Fox Corp., and Warner Bros. I don't say this lightly: this episode made me feel like I could go lift cars and kick through walls. I sat down to chat with incredible serial entrepreneur Luis Scott about his journey from aspiring pro baseball player to having three successful multimillion dollar businesses in different niches. The best part is hearing about all the businesses that DIDN'T succeed... Luis's approach will have you rethinking your definitions of "success" and "failure". Can't-Miss Moments from This Episode:"It makes no sense, let's give it a shot!" - how one simple phrase fueled several of Luis's business endeavors, including a multivitamin company, an online newspaper, and a company focused on increasing corn production. This one is wild... The real "million dollar secret" that most skeptics ignore (and it's simpler than you think, but it requires a huge mindset shift)...Why neither Luis nor I care about competing with Tony Robbins (and how it can improve your confidence when it comes to building your business)...One simple shift that will have you rethinking how much power you allow haters to have over you...Why it's OK to be an insecure entrepreneur and still achieve wild success (plus a few stories from me and Luis on anxieties that held us back)...WARNING: only listen to this episode if you're looking for a serious injection of inspiration.Luis's bio:Luis Scott is managing partner of Bader Scott Injury Lawyers, one of the thirty fastest-growing law firms in the US. Welcome to The Nonlinear Library, where we use Text-to-Speech software to convert the best writing from the Rationalist and EA communities into audio. This is: In memory of Steven M. Wise, published by Tyner on February 21, 2024 on The Effective Altruism Forum. LINK: https://everloved.com/life-of/steven-wise/obituary/ Renowned animal rights pioneer Steven M. Wise passed away on February 15th after a long illness. He was 73 years old. An innovative scholar and groundbreaking expert on animal law, Wise founded and served as president of the Nonhuman Rights Project (NhRP), the only nonprofit organization in the US dedicated solely to establishing legal rights for nonhuman animals. As the NhRP's lead attorney, he filed historic lawsuits demanding the right to liberty of captive chimpanzees and elephants, achieving widely recognized legal firsts for his clients. Most notably, under Wise's leadership the NhRP filed a habeas corpus petition on behalf of Happy, an elephant held alone in captivity at the Bronx Zoo. Happy's case, which historian Jill Lepore has called "the most important animal-rights case of the 21st-century," reached the New York Court of Appeals in 2022. The Court of Appeals then became the highest court of an English-speaking jurisdiction to hear arguments calling for a legal right for an animal. Although the Court ultimately denied Happy's petition, two judges wrote historic dissents refuting the idea that only humans can have rights. Under Wise's leadership, the NhRP also helped develop and pass the first animal rights law in the country in 2023-an ordinance that protects elephants' right to liberty. Wise said he decided to become a lawyer after developing a deep commitment to social justice as a result of his involvement in the anti-Vietnam War movement while an undergraduate at the College of William and Mary. He graduated from Boston University Law School in 1976 and began his legal career as a criminal defense lawyer. Several years later, Peter Singer's book Animal Liberation inspired Wise to become an animal protection lawyer. From 1985 to 1995, Wise was president of the Animal Legal Defense Fund. As Wise told The New York Times Magazine, his litigation work during this time led him to conclude that the rightlessness of animals was the fundamental barrier to humans vindicating animals' interests. This is because, under animal welfare laws, lawyers must make the case for how a human has been harmed by the animal's treatment or situation; as Wise elaborated in his writings and talks, legal injuries to animals do not matter in court because animals are unjustly considered legal "things" with no rights, legally equivalent to inanimate objects, their intrinsic interests essentially invisible to judges. In 1995, Wise launched the Nonhuman Rights Project to address this core issue facing all animals and their advocates. After more than a decade of preparation, the NhRP filed first-of-their-kind lawsuits in 2013, demanding rights for four captive chimpanzees in New York State. A year and a half later, two of the NhRP's clients became the first animals in legal history to have habeas corpus hearings to determine the lawfulness of their imprisonment. Wise was also a leading force in the development of animal law as a distinct academic curriculum, teaching the first-ever animal law course offered at Harvard University in 2000. He remained committed to educating the next generation of animal rights lawyers throughout his career, teaching animal rights jurisprudence at law schools around the world, including Stanford Law School, the University of Miami Law School, St. Thomas University Law School, John Marshall Law School, Lewis and Clark Law School, Vermont Law School, Tel Aviv University, and the Autonomous University of Barcelona. Wise is the author of four books: Rattling the Cage: Toward Legal Rights for Animals (2000); Drawing the Line: Science and the Case for Animal Rights (2002); Though the Heavens May Fall: T...

Law students come from a multitude of backgrounds, but justice-impacted individuals like Ricky often have many more obstacles to overcome. Faculty host Todd Berger talks with host Chay Rodriguez about her interview with Ricky discussing his incarceration, the experiences that fueled his interest in law, and his circuitous path to law school. They also highlight the perspective a justice-impacted individual brings to the legal profession and examine policies and procedures that affect the future prospects of these individuals.    Ricky Panayoty is a Juris Doctor candidate at Atlanta's John Marshall Law School and worked as a summer intern at Bryant Green & Associates.

Legal Grounds | Conversations on Life, Leadership & Law

There has been no shortage of headlines about the devastating impact that ransomware can have on an organization – big or small.  And if you're a fellow Texan, there's a good chance you heard about the recent, and massive attack that essentially crippled the city of Dallas. And yet when it comes to the world of technology, so many leaders, often older, are either aware of or worse, actively dismissive of the potential threats floating in the digital ether. And so while my guest and I will be looking at cyber security through the lenses of the justice system, I would argue that if you own a small business, or work with technology (so basically anyone), there's a lot to be learned from today's conversation. Daniel Cotter has been working on privacy and cybersecurity issues since 1996, including development of terms and conditions and disclaimers on Fortune 500 websites in the late 1990s.  Over his nearly 3 decades of practicing law, Dan has dealt with complex insurance regulatory issues and transactions, reorganizations of holding company systems and has substantial experience with internal investigations and employment-related issues. A past President of the Chicago Bar Association and an Adjunct Professor at the John Marshall Law School, Dan is also a prolific author of news and legal articles as well as the book, “The Chief Justices” an in-depth look at the 17 men who sat at the center seat.   Our conversation deals heavily with cyber security and the law, but we also touch on topics ranging from tips for young law students to Supreme Court history.  It was a fascinating conversation and I hope you'll join us. Enjoy the show!

CTL Script/ Top Stories of July 15 Saturday Publish Date: July 14 Friday   Henssler :15 From the Ingles Studio Welcome to the Award Winning Cherokee Tribune Ledger Podcast    Today is Saturday, July 15th, and happy 67th birthday to guitarist Joe Satriani ***Satriani***     I'm Brian Giffin and here are the stories Cherokee is talking about, presented by Credit Union of Georgia Start of eligibility ‘redetermination' knocks almost 100,000 Georgians off Medicaid Georgia reports giant budget surplus despite June revenue drop And a Canton woman and teen charged with string of car break-ins     We'll have all this and more coming up on the Cherokee Tribune-Ledger Podcast      Commercial:  CU of GA   Story 1. charges   Since the expiration of the federal public health emergency in April, nearly 100,000 people in Georgia have lost their Medicaid coverage, according to the Department of Community Health. The federal government had prohibited the disenrollment of Medicaid recipients for three years during the pandemic. Georgia began reassessing eligibility for Medicaid and PeachCare for Kids in June, resulting in 95,578 individuals losing coverage, while 64,423 were renewed. The majority lost coverage due to procedural termination caused by a lack of information. The state aims to complete the redetermination process for all Medicaid enrollees by May 2024 and has implemented an information campaign to assist recipients.   ....……… Read more on this story at tribuneledgernews.com STORY 2: surplus   Georgia tax collections in June 2023 dropped slightly compared to the previous year, but the state ended fiscal 2023 with a significant surplus for the third consecutive year. The Georgia Department of Revenue collected $2.84 billion in taxes in June, a 0.4% decrease from the same month in the previous year. However, the total revenue for the entire fiscal year reached $33.13 billion, surpassing Governor Brian Kemp's revenue estimate of $28.4 billion, resulting in a surplus of nearly $4.8 billion. While individual income taxes decreased by 12.6% due to increased refunds, net sales tax collections increased by 4%. Corporate income tax receipts declined by 14.7% due to higher refunds for businesses. The surplus will trigger a debate on how to allocate the funds, with Kemp advocating for a conservative approach and using the surplus to fund income tax cuts. Critics argue that these cuts primarily benefit the wealthy and that the state should prioritize funding public education, healthcare, and economic mobility.   Story 3: canton   A woman and her 13-year-old stepson were arrested in Canton for allegedly breaking into numerous cars in the area. The Canton Police Department responded to multiple reports of car break-ins, with a total of 26 incidents reported. Some cars were unlocked, while others were forcibly entered. Blood found inside the vehicles was collected as evidence. Witnesses saw a red vehicle leaving the area, and later, the woman and teenager were found unconscious in a red car in a shopping center parking lot. Stolen items and a firearm were discovered in the car. The woman, Brianna Rogers, faces charges of entering auto and possession of a firearm by a convicted felon, while the teenager faces similar charges. The investigation is ongoing, and more charges may be added.   Back in a moment   Break:  ESOG - Drake – Ingles 8   STORY 4: woodstock   The Woodstock City Council made several votes during a meeting aimed at improving the city's infrastructure. They adopted a resolution to apply for federal Community Development Block Grant funding from Cherokee County for the Dupree Road connection project. The city is seeking $685,000 in funding to create a safe connection with sidewalks and trail segments. They also authorized a supplemental proposal with Arcadis for the Paden Street Extension project and approved a contract for surveying the Market Street extension project. Additionally, the council approved an alcohol license request for H&M Food Mart, allowing the sale of wine and malt beverages at the convenience store.   Story 5: ballinger   Eric Ballinger, a lawyer from Canton, has been re-elected for a ninth term on the Board of Governors of the State Bar of Georgia. He will continue representing Cherokee County in the Blue Ridge Judicial Circuit, a position he has held since 2007. Ballinger is the founder of The Law Office of Eric A. Ballinger, focusing on family law, criminal defense, general litigation, and small business representation. He obtained his law degree from Atlanta's John Marshall Law School and has been a member of the State Bar of Georgia since 1993. Additionally, Ballinger serves as a part-time judge for the Magistrate Court of Cherokee County. The Board of Governors is responsible for policymaking and consists of 160 members representing each judicial circuit in Georgia.   Story 6:  ATM   The Cherokee Sheriff's Office is seeking suspects involved in the theft of an undisclosed amount of money from an ATM machine at the Towne Lake Wells Fargo in Georgia. The incident occurred last week when the masked suspects allegedly confronted an ATM technician servicing the drive-through ATM. They forced the technician away from the machine and stole cash from it before fleeing in a white vehicle. The authorities believe the incident was specifically targeted at the ATM and not the bank's customers. As of now, the suspects remain at large, and the investigation involves the Cherokee Sheriff's Office, with no involvement from the FBI. Anyone with information is urged to contact the Cherokee Sheriff's Office. See some pictures at tribuneledgernews.com   Back with more after this   Commercial: Elon – Dayco - Story 7: Aaron   The Atlanta Braves will honor the late Hank Aaron during Hank Aaron Week, which will take place from July 25-30. The week will feature community-building initiatives and culminate in celebrations at Truist Park during the Braves' game against the Milwaukee Brewers on July 28. Additionally, the Hank Aaron Invitational showcase game will be held on July 30, featuring the top 200 high school-aged players from across the United States. The Braves will pay tribute to Aaron's impact as a player, executive, and entrepreneur with special pre-game and in-game content. Proceeds from the Atlanta Braves Foundation's 50/50 Raffle during the weekend series will support the Henry Louis Aaron Fund, promoting diversity in baseball.   Story 8:  All Star   Atlanta is being considered as a potential host for the 2025 All-Star Game, according to MLB Commissioner Rob Manfred. This comes after the city lost the opportunity to host the 2021 game due to controversy surrounding Georgia's voting laws. Truist Park, is being considered as a potential venue for the 2025 game. Other sites under consideration include Wrigley Field in Chicago and Fenway Park in Boston. Atlanta has previously hosted the All-Star Game in 1972 and 2000. The 2022 game will be hosted by the Texas Rangers, and the 2026 game will coincide with the 250th anniversary of the signing of the Declaration of Independence in Philadelphia. Atlanta previously hosted All-Star Games in 1972 and 2000.   Story 9: BB Update   In an update on Cherokee ballplayers in the pros, Brennan Milone, a 2022 MLB draftee from Woodstock, has been promoted to the Lansing Lugnuts, the High-A affiliate of the Oakland Athletics. Milone has been performing well across multiple teams, hitting .303 with 70 hits, 11 home runs, and 43 RBIs. Etowah alum Drew Waters of the Kansas City Royals has a season average of .239 with 27 hits and three home runs. Hunter Gaddis, a Sequoyah alum in the Cleveland Guardians' organization, has struggled with a 7.12 ERA in Triple-A. Justin Wrobleski, a former Chiefs pitcher, has a 4-3 record and a 3.27 ERA with the Great Lakes Loons. Connor Pavolony, a catcher and former River Ridge standout, has been reinstated from the injured list by the Bowie Baysox, a Double-A affiliate of the Baltimore Orioles.   Final thoughts after this   Henssler 60   Thanks again for spending time with us listening to today's Cherokee Tribune Ledger podcast. A school bus caught fire outside Mulberry Elementary School in Gwinnett County, on Monday morning. The driver noticed increasing heat under the dashboard and pulled over before evacuating the students from the bus. Shortly after, the bus caught fire, but no one was injured in the incident. The fire department quickly extinguished the flames, and Georgia Milestones testing was suspended for the day. School officials have reassured parents that counselors are available for any students who may need support. The bus driver and monitor were praised for their quick response in ensuring the safety of the children. A student at Trickum Middle School will face disciplinary action and criminal charges after a search for marijuana led to the discovery of an unloaded handgun. A staff member had raised concerns about the student and alerted administrators. The student was brought to a "secure location" and their bag was searched, where marijuana and a handgun were found. The school's principal, Ryan Queen, praised the staff member who raised concerns and said that the incident demonstrated the "see something, say something" concept. The incident is the latest in a series of disciplinary incidents in Gwinnett County schools this year. Furthermore, Joshua shares his story and his belief that even through loss, after loss, after loss, after loss; there is still the chance for you to live your life in a healthy, constructive, hopeful way.  Also, overcoming adversity has to come from within. It will not come from someone else. Finally, living your life in the NOW requires you to understand your past and the trauma that lives in it and what you hope to accomplish in the future. Happiness will lie in your NOW if you are able to understand your past and not focus incessantly on your future.
