Colorado set an ambitious goal to connect 99% of Colorado households to high-speed broadband by the end of 2027. While there are many methods for broadband expansion, microtrenching is a minimally invasive, rapid, cost efficient, and environmentally-friendly method to deploy fiber infrastructure across the state. Oversight of that spending can be spotty, whether from agencies themselves, from oversight bodies like inspector general offices or from Congress. Within the European Commission's ongoing review of the General Pharmaceutical Legislation and Orphan Medicinal Products (OMP) Regulation, there are several potentially controversial policy options that aim to enhance access to medicine and overcome unmet medical need, including launch conditionality. Under the proposed system, companies would only receive their full Regulatory Data Protection if they meet a number of predefined conditions. Two conditions under consideration are that companies must launch the product in most, if not all, EU Member States within a fixed timeframe and address a yet unspecified unmet medical need. Today's discussion focuses on the launch condition, which is far-reaching and creates additional risk for small and mid-sized companies to launch products – particularly orphan medicinal products (OMPs) – in the EU. Small and mid-sized companies are key drivers of biopharmaceutical innovation in Europe. They play an important role in the development of new and underserved medicines, so it is crucial that their needs and interests are looked after in order to reinforce an innovative and competitive biopharmaceutical ecosystem in Europe. The EU should avoid implementing policy that discourages innovation, disproportionally punishes small and mid-sized companies and might limit, not improve access. The ethics around this come into play when members of congress who control the Defense budget legislation also own stocks in the very publicly-traded companies that may benefit from that Pentagon budget. It created a legal framework for the patient's right to seek healthcare in another Member State and to be reimbursed. It also provided a legal basis for enhanced European cooperation in key areas of healthcare – including quality and safety, Health Technology Assessment and eHealth, and rare diseases. On May 12, the Commission published their long awaited evaluation of the Cross-Border Healthcare Directive. The report outlines several areas for improvement, but does not call for a reopening of the Directive, which would be a political decision as well. As more Advanced Therapy Medicinal Products (ATMPs) have become available across Member States, it is still unclear how the cross-border healthcare framework will make access to such transformative treatment abroad more accessible. After a private briefing for senators in January 2020 about the coronavirus crisis, North Carolina Sen. Richard Burr sold between $500,000 and $1.5 million in stock shortly before markets tanked. Former Senator Kelly Loeffler also sold millions in stock between the briefing and the market drop. Some public outrage surrounded the news about the Senators capitalizing on insider information, but the news cycle moved on. A few months ago in December, Colorado Senator John Hickenlooper disclosed that he had sold approximately four million dollars worth of stock, conveniently in advance of federal interest hikes. The news was mostly buried. Good government advocacy groups have been raising the volume recently on the call for legislation to prevent members of Congress trading individual stocks. More than a dozen groups signed onto a letter by the Project on Government Oversight sent to Senate leaders calling for Congressional action on insider trading that would be stronger than the 2012 STOCK Act. Today we discuss the sorry state of mental healthcare in the United States, and the impact Medicare for All would have for people who need it. Our guests today are Dr. Beverly Smith, President of the American Mental Health Counselors Association and Guila Todd, Government Affairs Manager at the American Counselor Association. Show Notes The mental healthcare situation is especially dismal for the Medicare population, people with long term disabilities and senior citizens, According to the Kaiser Family Foundation, one in four members of the Medicare population is suffering from a mental illness, yet access to mental health providers is severely limited to this patient population. The pandemic has only exacerbated mental health concerns. Medicare curently does not reimburse licensed professional counselors for their services, further limiting access to care for the Medicare population. Licensed Professional Counselors (LPCs) are trained to diagnose, conduct treatment planning, and provide treatment, similar to many other classifications of providers who are reimbursed by Medicare. These providers could ease the shortage of mental healthcare practitioners and improve access for the Medicare population. When a patient faces barriers to mental healthcare, their illness can be exacerbated. For the Medicare population, the shortage of providers can mean long waits for care, further exacerbating the situation. Mental health access under Medicaid has some similar challenges. While Medicaid coverage varies from state to state, and Licensed Counselors can be reimbursed in some cases, access is still a barrier. There is a bipartisan bill in Congress called the Mental Health Access Improvement Act, which would address some of the gaps in mental health coverage we've been talking about. The bill would reimburse Licensed Professional Counselors as well as Marriage and Family Therapists (MFTs) for care provided to Medicare beneficieries. This bill has been in the works for years, and last session there was a lot of momentum. It was reintroduced in January of this year, with 45 cosponsors in the House and 18 in the Senate. Advocates are encouraging people to ask their Representatives and Senators to co-sponsor the bill. One of the barriers to passage of this bill is the cost, $1.1 billion over ten years. The provider list for the Center for Medicare and Medicaid Services hasn't been updated since 1989, so the bill would address decades of neglect of mental health services. Yet covering treatment by counselors would come with savings for the Medicare system; addressing mental health issues earlier would help keep patients out of the hospital, a much more expensive way to receive care. Congress is in the midst of negotiations about government funding, as the legislative branch holds the power of the purse. But, the executive branch has some budgeting tools at its disposal, including one that is supposed to produce more efficient management of public funds. The Office of Management and Budget holds this tool, called apportionment, and it is often used to circumvent Congress' budget authority and is increasingly opaque. Having created historical context for the pipeline in two previous podcasts, In Site now explores the pipeline itself. Jane Whalen, board member of Conserve Southwest Utah and Coordinator of the Lake Powell Pipeline Coalition, was the primary architect of their collective, incredibly thorough and detailed one hundred and eighty-six page objection to the pipeline (see link below). Quite simply, nobody involved with the pipeline understands it better than Jane. We focused on the pipeline because the Zion Canyon Mesa intends to actively participate in critical issues directly facing our home here in Washington County. In these strange, unmoored and disturbing times, it seems that part of the problem is we simmer too long in disconnected online ethers, then break into reality off kilter, and with increasing violence. We believe that rooting firmly in our chosen landscapes and communities will provide an immediate level of stability and sanity, and suggest a path forward as well.We prioritized the pipeline issue because it was one of about sixty projects nationwide that the Trump administration placed on their Fast Track. This greatly compressed some review processes and outright dismissed others; approval seemed imminent. However, that suddenly and utterly changed when the six other states of the Colorado River Compact (see the previous podcast with Eric Kuhn) submitted a joint letter to Utah threatening lawsuits, saying there were any number of Compact issues needing resolution before even entering a Fast Track. Utah’s two pipeline proponents, the Utah Department of Natural Resources and the WCWCD, responded by immediately withdrawing for at least two years to address the Compact concerns. To Jane’s credit, the issues she helped raise in the Coalition review match those expressed by the other Compact states, so our review here will touch on these comprehensive concerns.Finally, we want to act as an honest broker for respectful dialogue about such issues. As such, this podcast was originally going to feature a dialogue between Jane and WCWCD representatives Zach Renstrom, General Manager, and Karry Rathje, their Communications & Government Affairs Manager. We want to really thank them for their willingness to participate in this discussion. However, recent events allow us all to step back and take a deep breath. We hope that Zach and Karry will join us soon so they can speak for themselves. The state of New York recently passed legislation mandating fertility treatment. Since then, hope has sprung up that nationwide mandating of reproductive medicine may not be too far off. However, resistance to universal coverage, for both heterosexual and same-sex couples, continues to be present both at insurance companies and in state legislatures. The giant is now awake!” - Jessica Wahl While it’s easy to be overwhelmed with all of the uncertainties in our turbulent political climate, this week’s guest brings some light to all of the positive things that are in motion that affect our lands and industry. I sat down with Jessica Wahl, the Government Affairs Manager at the Outdoor Industry Association (OIA) who’s on the front lines in DC making a difference at the policy level. Jessica fell in love with the outdoors when she saw how it changed lives and improved communities through her previous work with the Office of the Secretary on external affairs and youth engagement in the outdoors. Jessica got to work closely with companies like Patagonia, KEEN and The North Face, so joining the ranks at OIA seemed like the perfect next step for her. When Jessica first came to OIA, more of her focus was on conservation but recently that focus has widened to anything and everything that gets people outside. The lines are blurring between the traditional “man powered” outdoor industry and opening up to the whole supply chain including motor powered recreationists, hunters and more. Bulletpoints: OIA was founded in 1989 by visionary outdoor industry leaders who realized that “outdoor” could be much more than a passing consumer trend. Today, OIA is the leading trade association and voice of the outdoor recreation industry. The Recreations Economic Contributions Act (REC Act) has been signed by President Obama, ensuring that the outdoor recreation economy, including outdoor industry jobs and our economic impact, are measured by the federal government and accounted for as part of the national Gross Domestic Product. Using the momentum from the REC Act, OIA is educating new members of congress and other admin on the importance of this Act and how it touches every district and state. It would be a huge benefit to appoint a Director of Outdoor Recreation, like Luis Benitez, in every state’s governor’s office. With these positions in place, each state can have a point person to take charge with land issues and to look out for outdoor business and recreation. In 2017 OIA wants to make sure there aren’t many rollbacks in recreation assets, public lands and climate policy. The much talked about Infrastructure and Transportation package should benefit trails, protected bike lanes, public lands, roads and bridges in parks. The National Park Service Centennial Act (H.R. 4680) addresses the $12 billion in needed repairs to park infrastructure, such as unmaintained trails and deteriorating buildings and structures that are in danger of falling apart. President-elect Trump does see value in the outdoor recreation economy and the jobs it creates.
