One of the things that we find most rewarding about our own journeys in anti-racism, racial justice, and social justice is when we come across practitioners who come from a similar framework that we do (heart-centered, humanity first, believe people when they tell you their stories, and all of those things) but also challenge us to think more broadly, or more deeply, about these topics in powerful ways. Our guest today does all of that and more. Naomi Raquel Enright is a DEI practitioner, Ecuadorian and Jewish, a mother, sister, daughter, and so many more things - and all of these identities influence how she views the world, especially when she thinks about raising her son. It was an honor to be able to talk about raising multiethnic children with her today, especially with her clear focus on the systems that keep us trapped in a narrative about race that helps zero people in the end. The Wisconsin Institute for Law & Liberty (WILL) filed a lawsuit in federal court challenging allegedly unconstitutional race discrimination in the American Rescue Plan’s provision to offer loan forgiveness based on racial categories. The plaintiffs are twelve farmers and ranchers from Wisconsin, Minnesota, South Dakota, Ohio, Missouri, Iowa, Arkansas, Oregon, and Kentucky. Each plaintiff would be eligible for the federal loan forgiveness program, but for their race. In response, U.S. District Judge William Griesbach issued a temporary restraining order on June 10, 2021 halting payments. Other cases subsequently resulted in similar orders.These lawsuits challenge the extent to which the government can prefer one racial group over another based on allegations of generalized societal or industry discrimination. Prior litigation had addressed allegations of particularized discrimination by the government against black farmers but this more traditional focus on discrimination and tailored remedy was thought by the administration to be inadequate. We discuss how good intentioned rules can backfire and lead to litigation through the lens of the race discrimination case against the NFL and pending legislation regarding good cause eviction.
The Batson rule, prohibiting exclusions from jury based on race, is widely viewed as nearly impossible to enforce in practice. However, where Botson fails, do the Model Rules of Professional Conduct have anything to say?. The United States has a long history of racial discrimination in juries. In 1875, Congress passed the Civil Rights Act which prohibited race-based discrimination in jury service. Despite the federal law, states continued to remove prospective black jurors. Over time, techniques to exclude nonwhites shifted from vague requirements for jury service to excluding jurors using peremptory challenges. Despite the landmark case Batson v. Kentucky (1986) in which the Supreme Court held that the state may not use peremptory challenges to exclude jurors solely on the basis of race, the practice persists today. Legal ethics scholar, Prof. Peter Joy, explains the Batson standard and the ways in which the framework falls short. He discusses the legal ethics of racial discrimination in jury selection and considers alternatives to peremptory challenges to combat discrimination.

Race discrimination in the workplace is illegal under Title VII of the Civil Rights Act of 1964. Discrimination can be overt, such as failing to promote an individual because of their race, but race discrimination can also occur where the employer enacted policies that while not discriminatory in intent had a disparate negative impact on employees of a particular race. An employer also may be liable for race discrimination if an employee suffers harassment on the basis of race in the workplace. Defending a case of race discrimination or harassment is disruptive and expensive, even if the employer is ultimately found not to be liable. Prevention is the best way to avoid this situation. A well-crafted, rigorously enforced antidiscrimination policy, ongoing training and policy review, and a top-to-bottom commitment to creating and maintaining a workplace free from discrimination can offer substantial protection against race discrimination claims. We want officers to speak up against racist police practices and sexual harassment to help change the culture of policing. But when officers of color speak up against these unconstitutional practices they often experience discrimination and retaliation. For this Black History Month, we sat down with an African American officer, Lieutenant Sonya Zollicoffer, second vice president of the United Black Police Officers Association and with a Latino officer Retired Captain Joe Perez, president of the Hispanic National Law Enforcement Association. We talk about why they and over 10 other officers of color, decided to file a lawsuit against Prince George’s County Police Department challenging the department’s pattern and practice of unconstitutional conduct.
