Claire Fox talks to Sall Grover and Katherine Deves about their fight in Australia to reassert in law that a woman is an adult human female. Sall Grover is the founder of the female-only app, Giggle for Girls and Katherine Deves is one of her legal team. Both have been visiting the UK from Australia to get support for their appeal of an important test-case decision on the definition of ‘woman', which Sall lost last year. It all began when then 54-year-old biological male Roxanne Tickle from New South Wales, who identifies as a woman, complained to the Australian Human Rights Commission when moderators withdrew his access to Giggle for Girls, because - well, to state the obvious - the app is exclusively for women. However, when the subsequent case (known as Tickle v Giggle) was tried at the Federal Court, Justice Robert Bromwich concluded that, according to Australian law, sex is ‘changeable and not necessarily binary'. The ruling effectively eradicated the category of sex in law. The decision set a dangerous legal precedent with international implications, summed up by Jo Bartosch's headline at the time: ‘Australia has abolished womanhood'. They talk about the case, the pros and cons of facial recognition (which the app used to determine who was a woman and who wasn't), lawfare, the #MeToo movement and how human rights NGOs have become enmeshed in trans ideology. They also discuss the real-world impact of this trend for the likes of Scottish nurse Sandie Peggie, who was suspended from Victoria Hospital in Kirkcaldy, Fife, in January 2024 after she objected to Dr ‘Beth' Upton (Theodore Upton) - who identifies as a woman but is a biological male - using the female staff changing facilities.

Le glissement du calendrier de la transition au delà de la date butoire du 31 décembre est source d'inquiétudes et la plateforme des Forces Vives, qui regroupe l'opposition et des organisations de la société civile a déjà annoncé qu'elle ne reconnaîtrait plus les autorités de transition à compter de ce mardi...Trois ans après la prise de pouvoir par les militaires - le 5 septembre 2021 - quelle est le bilan de la transition à ce jour ? Éléments de réponse avec Alseny Sall, chargé de communication pour l'organisation guineenne de défense des droits de l'homme et du citoyen, l'OGDH. Il est l'invité de Liza Fabbian. RFI : Cette prolongation de la transition au-delà du 31 décembre 2024 en Guinée, qu'est-ce que ça vous inspire ?Alseny Sall : Écoutez, pour nous, ce n'est pas une surprise. La durée de la transition devait être fixée de commun accord entre les Forces vives de la nation et le CNRD. Et malheureusement, vous le savez, que le CNRD l'a établi lui-même avec la Cédéao. Donc, c'est un accord qui a été fait sur le dos du peuple de Guinée, sur le dos des Forces vives. D'ailleurs, en Guinée, on ne parle plus de « transition », on parle plutôt de « refondation ». Et tout ça en violation de la Charte de la transition qui a été élaboré et promulgué par le CNRD, sans concertation avec le peuple. Donc, si le CNRD lui-même ne respecte pas ses engagements, ce n'est pas une surprise dans la mesure où il n'y a jamais eu une volonté de dialoguer au niveau national pour trouver un consensus sur le calendrier de la transition.Malheureusement, cela place notre pays dans une situation incertaine à partir de janvier.Le Président Doumbouya, au lendemain de sa prise de pouvoir, avait indiqué que « la justice serait la boussole de la transition ». Effectivement, il y a eu un procès du massacre du stade du 28 septembre 2009, ce verdict est-il une promesse tenue selon vous ?Quand même, il faut le reconnaître, c'est la première fois dans l'histoire de toute l'Afrique, qu'une juridiction nationale africaine juge des hauts dignitaires de l'État pour des crimes contre l'humanité, et les condamne pour leurs responsabilités sur des crimes de masse. Donc pour nous, c'est un point très positif, ça crée un précédent très très positif. Même si aujourd'hui, nous avons l'impression que la junte qui a organisé ce procès, n'en tire par les leçons elle-même. La situation générale des droits de l'Homme contraste avec ce procès. On a commencé par une interdiction systématique du droit de manifestation, parce qu'il n'y avait pas la volonté de dialoguer. Et deuxièmement, on a commencé à censurer les médias. Et de la censure, on est allé jusqu'à fermer les médias qui étaient jugés critiques ou qui donnaient la parole aux voix dissidentes. Aujourd'hui, nous assistons à des nouvelles formes de violation de droits de l'Homme, des kidnappings et des détentions dans des lieux secrets qui sont contraires aux engagements du 5 septembre.Oui, on a vu ces derniers mois une multiplication des disparitions forcées, notamment celles des leaders du FNDC Foniké Menguè et Billo Bah, il y a bientôt 6 mois ou juste la semaine dernière, celle de Aliou Bah. Peut-on parler d'un tour de vis répressif en Guinée ?Pour nous aujourd'hui, il y a une volonté systématique de taire toutes les voix dissonantes. Aliou, qui a été arrêté en dernier, faisait partie des voix les plus critiques de la transition. Mais il le faisait dans le respect des règles et des principes républicains, et donc il a été arrêté de manière irrégulière et jusqu'ici il reste en détention prolongée en dépit des protestations que nous avons faites pour dénoncer cette situation. En plus de Aliou Bah, il y a aussi évidemment les cas Foniké Menguè. Il y a le cas Saadou Nimaga, il y a le cas Habib Marouane Camara, et la justice aujourd'hui, elle est absente. Par exemple, Foniké Menguè et Billo Bah ont été arrêtés par des hommes en uniforme, mais jusqu'à présent, la justice dit qu'elle ne sait pas où se trouvent ces personnes. Et celles qui dénoncent aujourd'hui cette situation sont aussi poursuivies ou harcelées ou même kidnappées. La justice doit travailler non seulement à empêcher les violations des droits de l'Homme, mais aussi veiller à la protection des droits de tous les citoyens.Il y a un mois, la Guinée a été endeuillée par une bousculade mortelle au sein du stade de Nzérékoré. Mais pour l'instant, il n'y a aucune communication officielle sur les avancées de l'enquête, comment l'expliquez-vous ?Cette bousculade est intervenue à l'occasion d'une propagande politique dans le cadre des préparatifs d'une candidature du chef de la junte au pouvoir. Mamadi Doumbouya nous avait promis de lutter contre le culte de la personnalité, mais son système est en train de l'ériger en mode de gouvernance. Malheureusement, cet incident de Nzérékoré s'est passé à l'occasion d'une finale d'un tournoi qui a été organisé en son nom. On parle de plus d'une centaine de morts quand même. Mais jusqu'ici, il n'a pas fait une déclaration par rapport à cette situation. Le ministre de la Justice, dans sa dernière sortie, a dit que la Guinée n'est pas le seul pays qui a connu ce genre de drame. Il n'y a pas de volonté politique de travailler pour que des enquêtes sérieuses soient menées pour situer les responsabilités par rapport à ces événements.Et tout ça dans un contexte économique particulier, notamment depuis l'explosion du dépôt d'hydrocarbures de Kaloum et l'arrêt de certaines activités minières en Guinée, comment évaluez-vous aujourd'hui la situation économique des Guinéens ?On nous parle de refondation, on nous parle de progrès, mais je pense que le panier de la ménagère n'a pas du tout évolué en Guinée. Aujourd'hui à Conakry, il y a une pénurie de carburant. Les gens ont du mal à se déplacer. Donc dans un contexte de précarité, tout ça augure d'un avenir bien incertain. Ça crée un sentiment de peur, un sentiment d'insécurité dans un contexte de troubles.
