Taxes and wars go hand in hand. And as much as our current partisan politics suggest otherwise, it wasn't a Democratic U.S. president that ushered in the income tax. It was a Republican president - Honest Abe! And later, it was during another Republican president's term that the income tax became permanent - William Taft. The irony of it is that the poor masses and the progressive middle class pushed for the income tax to get the rich to pay their fair share. Now, the poor and the middle American families seem to shoulder most of the income tax burden. American labor unions have seen an incredible resurgence in recent years, which, suggests public historian Tom Goldscheider, “begs the question: why were they in decline in the first place?” In "At Sword's Point", Tom revisits a pivotal moment in American history, when the furious power of Joseph McCarthy's Red Scare found its first true target, and when the dismantling of American organized labor began. But this isn't a story of workers caving in the face of mass hysteria; this is the story of a rural town where, against all expectations, the workers fought back. Today's show is a documentary that recounts these dramatic events of the early 1950s – which still resonate today -- while also providing important context on the machine tool industry of Greenfield, Massachusetts — once a center of global innovation — as well as the origins of the United Electrical Workers Union, or UE. Tom Goldscheider is a public historian and working farrier based in western Massachusetts. His research on Greenfield labor history was published in the Historical Journal of Massachusetts and shared through a series of talks given at area venues. He has also published and spoken on the origins and significance of Shays' Rebellion, and developed an interactive curriculum on local abolitionist history for the David Ruggles Center for History and Education. This Day in Legal History: Articles of Confederation AdoptedOn November 15, 1777, the Continental Congress formally adopted the Articles of Confederation, establishing the first constitutional framework for the United States. Crafted during the Revolutionary War, the Articles aimed to unify the thirteen colonies under a single government while preserving their independence and sovereignty. This early governing document reflected deep fears of centralized authority, granting Congress limited powers such as conducting foreign diplomacy, declaring war, and managing relations with Native American tribes. However, it lacked crucial mechanisms for enforcement, taxation, and regulating interstate commerce. Under the Articles, each state retained significant autonomy, with Congress functioning as a weak central body unable to compel states to contribute financially or militarily. Unanimous consent from all states was required to amend the Articles, which proved a significant obstacle to addressing its shortcomings. These limitations became increasingly evident in the post-war period, as the fledgling nation struggled with economic disarray, unpaid war debts, and internal unrest such as Shays' Rebellion.The Articles served as a critical stepping stone in American constitutional development, highlighting the need for a more robust federal system. In 1787, the Constitutional Convention convened to replace the Articles, ultimately resulting in the U.S. Constitution, which created a stronger, more balanced federal government. Despite its shortcomings, the Articles of Confederation represented a bold experiment in democratic governance and the principle of federalism that continues to shape the nation's identity.Continuing the procession of unqualified and ill-equipped appointees, President-elect Donald Trump has nominated members of his criminal defense team for key positions in the Justice Department, including Todd Blanche as deputy attorney general. Blanche, a former Cadwalader attorney, is currently defending Trump in federal cases related to attempts to overturn the 2020 election and the mishandling of classified documents. Prior to representing Trump, Blanche was best known for defending Paul Manafort, Trump's former campaign chairman, who was convicted of tax and bank fraud in connection with consulting work for pro-Russian Ukrainian politicians. Blanche's nomination marks a significant appointment, as the deputy attorney general oversees the Justice Department's daily operations and investigative agencies like the FBI. In addition to this settlement, the city plans to allocate $21 million toward housing and small business initiatives aimed at supporting the affected residents and their descendants. The Section 14 neighborhood also housed Latino families and other immigrants, many of whom have long sought recognition and compensation for their forced displacement. The settlement will provide payments to over 1,200 former residents and descendants, amounting to approximately $4,000 per person after legal fees. As part of the agreement, recipients must sign waivers releasing further claims against the city.Palm Springs Mayor Jeffrey Bernstein acknowledged the limits of financial restitution, describing the reparations as a symbolic step toward addressing past injustices. B.W. argued that from grades 8 through 10, he faced harassment, including being called "Whitey" by a teacher, having a meme made of him as a Ku Klux Klansman, and being ostracized for his political and religious beliefs. He claimed the school district violated Title VI of the Civil Rights Act of 1964, which prohibits racial discrimination in federally funded education programs.A prior panel had ruled that B.W.'s allegations were primarily tied to his ideological beliefs, which Title VI does not cover, and the evenly split rehearing reaffirmed this. Conservative judges, including Trump appointee James Ho, dissented, asserting that B.W. plausibly faced severe racial harassment because of his whiteness. However, the majority of judges noted that ideological bullying does not qualify as racial discrimination under Title VI. President-elect Donald Trump's plan to eliminate the $7,500 EV tax credit threatens significant setbacks for the U.S. automotive industry, innovation, and environmental goals. The credit has played a vital role in making EVs affordable and driving their adoption, helping U.S. automakers remain competitive in a global market heavily supported by subsidies in countries like China and the EU. Without it, American automakers could struggle to compete against lower-cost foreign EVs while managing the high expenses of research and development.The policy could exacerbate issues already created by recent changes to R&D tax rules, which have limited immediate expensing for innovation costs. Combined, these moves could raise EV prices, reduce demand, and stifle the momentum of U.S. automakers like Ford and GM as they work to electrify their fleets. Now, Hogeland steps back to the inception of the US, and the central role Hamilton played in establishing a financial system that centered on the use of national debt to leverage the economic ambitions of the capitalist class in favor of a nationalist project by allowing them massive ownership stakes, while additionally reinforcing the elitist and anti-democratic makeup of the political class that Hamilton desired. After expanding on Hamilton's relationship to the US Constitution, including unpacking the relatively subdued role that the Federalist Papers played in the actual ratification, Hogeland walks Sam and Emma through the backlashed faced by the US Federal government due to Hamilton's wildly anti-democratic financial scheme, looking to both Shays' Rebellion in 1786 and the Whiskey Rebellion in 1791 as clear cut examples of a coherent dissent and attack on Hamilton's system of debt and regressive taxation, demanding follow through on the demand of “no taxation without representation” that Americans had fought for, also briefly touching on the greater makeup of this pro-democracy labor movement led by folks with Herman Husband and Thomas Payne. Next, Hogeland looks back to the enemies Hamilton had inside of the US political structures, from State Sovereigntists during the framing of the Constitution, to the Jeffersonian attempts to undermine and overturn his financial system throughout the start of the 19th Century, before wrapping up with the redemption of Hamilton's legacy over the last few decades, and the particular role his thought played in the US' response to the 2008 Financial crisis. The early American republic is not discussed much in American history, at least not in high school. You might get some of that time period in a college history class, but it doesn't seem to be a big topic in popular history. Why is that? Maybe because it's easy to see how the Founding Generation didn't live up to their high-minded ideals and pretty rhetoric. Or maybe it's because early United States history is fraught with rebellions, tax revolts, uprisings and the like.Either way, it's a very fascinating period and some of the events then played a major role in shaping the country that would grow to be the biggest empire the world has ever seen, that went from the smallest government on the planet to the biggest government in human history. Shays' Rebellion is one of those events that provoked a reaction and enabled the machinations of characters like Alexander Hamilton. It even helped push George Washington out of retirement, and played a part in the push for a stronger central government. It's also a great story in and of itself, teaching us a lot about the people that founded this country, known and unknown, and it also teaches us a lot about America's true relationship with the men that fight its wars.However, to understand Shays' Rebellion, you can't just look at the events starting in June of 1786; instead you have to understand the economic situation at the time, and also the roots of the Continental Army and the direction it pushed the American Revolution in. We are having a bit of fun with the title of this podcast because it poses a trick question? You see... if Mr. Biden was president in 1821... aside from the fact that there was no "Democratic" political party then, he would have another issue on his hand: there were no corporate or income taxes back then either. And no! As much as our current political skirmishes suggest, it wasn't a Democratic US President that ushered in the income tax. It was a Republican president - Honest Abe! And later, it was during another Republican President's term that the income tax became permanent - William Taft. The irony of it is that the poor masses and the progressive middle class pushed for the income tax to get the rich to pay their fair share. Now, the poor and the middle American families seem to shoulder most of the income tax burden. So this begs the following question: how did the federal government pay for itself all these years before the income tax? How and why did it grow so large, needing ever more income to pay for its many programs? So that we better understand our present, we spoke with Mr. David Thomson, an assistant professor of American history at Sacred Heart University in Connecticut (link to the academic homepage: https://www.sacredheart.edu/phonebook/david-thomson.php). In his research, Professor Thomson focuses on the Civil War period, including the financing of that war through the sale of government bonds. He recently received a grant from the National Endowment for the Humanities. He is the recipient of numerous fellowships and has won many awards and honors. Before entering politics, Chris Shays served in the Peace Corps in Fiji along with his wife Betsi from 1968 to 1970. At the age of 29, he ran and won a seat in the Connecticut House of Representatives as a Republican in 1975. Twelve years later, he won a seat in Congress, where he represented the 4th congressional district for 21 years, from 1987 through 2008. When he lost his seat in 2008, he was last Republican serving in any state in New England. In this episode, Congressman Shays shares some amazing stories from his time with the Peace Corps in Fiji. He also talks about the time he spent a week in jail as a congressman as a result of protesting judicial corruption, and about the time he stayed overnight in the notorious Cabrini Green housing projects in Chicago to understand the reality there before a Congressional hearing. He ends the interview by sharing his thoughts on the current state of our politics.
