Episode 42: First Choice Women's Resource Centers v. PlatkinFirst Choice Women's Resource Centers v. Platkin, argued before the Supreme Court of the United States on December 2, 2025. Argued by Erin Morrow Hawley, Alliance Defending Freedom, and Vivek Suri, Assistant Solicitor General (on behalf of First Choice Women's Resource Centers), and Sundeep Subramanian Iyer, Chief Counsel to the Attorney General of New Jersey (on behalf of the state of New Jersey).  Case Background, from the Institute for Free Speech case page: First Choice Women's Resource Centers is a Christian medical nonprofit serving pregnant women, new mothers, and fathers. The Attorney General of New Jersey has specifically singled out this organization due to its religious beliefs and pro-life stance. New Jersey thus issued a sweeping and unjustified subpoena, demanding extensive documentation from the nonprofit. This places a heavy burden on the organization, forcing it to allocate its limited resources to comply or face legal consequences. Despite this, the Attorney General has not provided any concrete evidence of wrongdoing to warrant such intrusive measures. Question Presented, from the Supreme Court docket: New Jersey's Attorney General served an investigatory subpoena on First Choice Women's Resource Centers, Inc., a faith-based pregnancy center, demanding that it turn over most of its donors' names. First Choice challenged the Subpoena under 42 U.S.C. 1983 in federal court, and the Attorney General filed a subsequent suit to enforce it in state court. The state court granted the Attorney General's motion to enforce the Subpoena but expressly did not decide First Choice's federal constitutional challenges. The Attorney General then moved in state court to sanction First Choice. Meanwhile, the district court held that First Choice's constitutional claims were not ripe in federal court. The Third Circuit affirmed in a divided per curiam decision. Judge Bibas would have held the action ripe as indistinguishable from. Americans for Prosperity Foundation v. Banta, 594 U.S. 595, 618-19 (2021). But the majority concluded First Choice's claims were not yet ripe because First Choice could litigate its constitutional claims in state court. In doing so, the majority followed the rule of the Fifth Circuit and split from the Ninth Circuit. It did not address the likely loss of a federal forum once the state court rules on the federal constitutional issues. The question presented is: Where the subject of a state investigatory demand has established a reasonably objective chill of its First Amendment rights, is a federal court in a first-filed action deprived of jurisdiction because those rights must be adjudicated in state court?Resources:   Brief for Petitioner First Choice Women's Resource Center Brief for Respondent Matthew Platkin Institute for Free Speech Amicus Brief Supreme Court Docket The Institute for Free Speech promotes and defends the political speech rights to freely speak, assemble, publish, and petition the government guaranteed by the First Amendment.

What happens when senior executives step into a room and speak with radical candor? In this episode of Leveraging Thought Leadership, host Peter Winick sits down with Ken Banta, Founder and CEO of the Vanguard Network, to explore how real leaders grow stronger through dialogue—not monologues. Ken doesn't just advise on leadership—he builds ecosystems where executives learn directly from each other. The Vanguard Network creates peer-to-peer forums where GCs, CEOs, and senior leaders share their toughest challenges and unfiltered lessons. The power comes not from lectures or PowerPoint, but from raw, honest conversation. Members of his network walk away with two powerful outcomes. First, practical insights they can use immediately—solutions drawn from peers who've been there before. Second, the relief of knowing they're not alone. When a board chair demands instant answers, having the confidence that others face the same issues is invaluable. These conversations create resilience, credibility, and a stronger sense of leadership presence. Ken also shows how these networks spark new thought leadership. Dialogue around real problems fuels fresh ideas, posts, and even books like his "Seeing Around Corners". This isn't theory—it's leadership in action, captured and shared for broader impact. The results are tangible. Leaders leave with new strategies, new allies, and sometimes even new career opportunities. One member walked peers through a cyberattack disaster, openly admitting mistakes and lessons. Another two struck a career-changing deal over dinner. This is thought leadership at its highest level—intimate, applied, and deeply human. If you want to see how conversation transforms into influence, this episode is for you. Three Key Takeaways: • Dialogue beats monologue. Executives gain more from candid peer conversations than from lectures or presentations. • Leaders don't stand alone. Sharing challenges in trusted forums provides reassurance and practical solutions. • Conversations spark influence. Real stories and exchanges fuel new thought leadership, stronger presence, and fresh opportunities. If you found Ken Banta's episode insightful, you'll want to keep the momentum going with Karen Leland's conversation on the performance of thought leadership. Ken showed how peer-to-peer dialogue fuels fresh insights and builds executive presence. Karen takes it a step further, exploring how leaders can deliver their ideas with clarity, confidence, and authenticity so they truly land with an audience. Together, these two episodes connect the what and the how of thought leadership: Ken highlights the power of conversations that spark ideas, while Karen shows you how to perform those ideas so they inspire action. Listen to Karen's episode to learn practical strategies for elevating your communication, amplifying your presence, and making your thought leadership unforgettable.

In today's world, many people struggle with weight gain, a slow metabolism, brain fog, and difficulty building muscle, despite healthy diets and exercise. Health expert Sarah Banta says the cause is often in thyroid and liver health. Her insights, shared on a podcast with Wade Lightheart, highlight how these organs regulate metabolism, fat burning, and muscle building. When these organs are not working well due to toxins, stress, or poor nutrition, the body may have trouble losing fat and gaining muscle. Thyroid: Metabolic Master Switch The thyroid controls how the body makes energy. It affects our metabolism, body temperature, fat burning, mental clarity, mood, and hormone balance. Sarah notes that many people might have thyroid issues, even if tests look normal. Symptoms of a struggling thyroid include slow metabolism, fat gain, cold hands and feet, brain fog, fatigue, and muscle loss. Thyroid issues can prevent effective fat burning, no matter the diet or exercise. Liver: Metabolic Role The thyroid and liver work together. The liver converts inactive thyroid hormone (T4) to the active form (T3). If the liver is slow or congested, this conversion suffers, slowing down the thyroid. Modern lifestyles burden the liver with toxins, processed foods, and stress. This can lead to fat gain, slow metabolism, and hormonal imbalances. Liver stress can reduce thyroid and overall metabolic function. Iodine's Essential Role Iodine is important for thyroid function and every cell in the body. Many people are iodine deficient due to depleted soils, microplastics in salt, and competition from other chemicals. Iodine helps produce thyroid hormones, supports brain function, cellular energy, immune defense, and hormonal balance. It also helps detoxify heavy metals. Optimal iodine dosing is needed to overcome deficiency and remove toxins. Liver Detox for Results An overloaded liver can block fat burning, impair thyroid conversion, cause insulin resistance, and interfere with protein absorption. Sarah's approach uses herbs to stimulate bile flow, support detox, break down fatty liver, and optimize metabolism. Key ingredients include Milk Thistle and other herbs that help with liver health. A healthy liver allows the body to burn fat and build muscle safely. In this podcast you'll learn... Why iodine deficiency is a true health crisis. What are the causes of unexplained weight gain are. What the hidden causes of Insulin Resistance are. If you can burn fat and build muscle at the same time. How the spike protein affected our health. How thyroid health affects mental health.   EPISODE RESOURCES: Website Instagram LinkedIn
