First Choice Women's Resource Centers v. Platkin | 12/02/25 | Docket #: 24-781 24-781 FIRST CHOICE WOMEN'S RESOURCE CENTERS, INC. V. PLATKIN DECISION BELOW: 2024 WL 5088105 CERT. GRANTED 6/16/2025 QUESTION PRESENTED: New Jersey's Attorney General served an investigatory subpoena on First Choice Women's Resource Centers, Inc., a faith-based pregnancy center, demanding that it turn over most of its donors' names. First Choice challenged the Subpoena under 42 U.S.C. 1983 in federal court, and the Attorney General filed a subsequent suit to enforce it in state court. The state court granted the Attorney General's motion to enforce the Subpoena but expressly did not decide First Choice's federal constitutional challenges. The Attorney General then moved in state court to sanction First Choice. Meanwhile, the district court held that First Choice's constitutional claims were not ripe in federal court. The Third Circuit affirmed in a divided per curiam decision. Judge Bibas would have held the action ripe as indistinguishable from . Americans for Prosperity Foundation v. Banta , 594 U.S. 595, 618-19 (2021). But the majority concluded First Choice's claims were not yet ripe because First Choice could litigate its constitutional claims in state court. In doing so, the majority followed the rule of the Fifth Circuit and split from the Ninth Circuit. It did not address the likely loss of a federal forum once the state court rules on the federal constitutional issues. The question presented is: Where the subject of a state investigatory demand has established a reasonably objective chill of its First Amendment rights, is a federal court in a first-filed action deprived of jurisdiction because those rights must be adjudicated in state court? M-am născut fără tibie la ambele picioare, există practic - cum văd eu - două opțiuni: ori să rămânem blocați în aceste limitări, ori mergem mai departe și vedem ce putem face” - Gabriela Bantaș, componentă a lotului național. Gabi și-a dorit tot timpul să își depășească limitele. Și face niște lucruri care până și pentru un om normal sunt dificile: „Îmi place și să merg pe role. Am mers pe role chiar și cu ortezele, port aceste dispozitive medicale să mă ajute să merg” - Gabriela Bantaș, componentă a lotului național. Atunci când nu e la antrenamente și la concursuri, ea nu are timp să se plictisească: „Predau limba română străinilor, dar și engleză românilor care vor să învețe. Mai și consiliez elevi care vor să aplice în străinătate” Vede doar 1% și e campion mondial la paraescaladă! Un alt sportiv paralimpic care are o poveste de viață uluitoare este Răzvan Nedu, cel mai medaliat român la para escaladă sportul în care este și căpitanul echipei naționale. Răzvan și-a mai trecut în palmares o medalie strălucitoare: aurul la Campionatul Mondial de la Seul, acolo unde România s-a clasat pe locul 5 din 29 de țări. „Titlu de campion mondial este doar o încununare a muncii de aproape 9 ani jumate de când m-am apucat de cățărat și de antrenamente, de multe ore de antrenament”, spune el. Răzvan Nedu practică de aproape 20 de ani paraescalada și când s-a apucat de acest sport și-a făcut o promisiune! Să i se cânte Imnul României! „Când l-am ascultat, am simțit efectiv o relaxare în tot corpul și o bucurie și acel fior, acea emoție, care nu poate fi descrisă, dar care apare atunci când ascult imnul țării mele” La Campionatul Mondial de la Seul, România a terminat pe locul 5 din 29 de țări! „A fost ceva ce nici măcar nu ne-am propus sau nu visam! Secretul e să muncești pentru că degeaba ai condiții dacă nu ai sportiv” Răzvan va fi și el prezent la Los Angeles în 2028 la Jocurile Paralimpice. Acum el are 29 de ani și nu știe cum arată lumea pentru că s-a născut cu o deficiență majoră de vedere. „Medicii spun că văd undeva aproximativ 1%. Este din naștere. Folosesc bastonul alb atunci când merg” Răzvan nu doar concurează, ci și antrenează! „Mă antrenez de la 9 la 13, iar apoi de la 13 la 9 lucrez. In today's world, many people struggle with weight gain, a slow metabolism, brain fog, and difficulty building muscle, despite healthy diets and exercise. Health expert Sarah Banta says the cause is often in thyroid and liver health. Her insights, shared on a podcast with Wade Lightheart, highlight how these organs regulate metabolism, fat burning, and muscle building. When these organs are not working well due to toxins, stress, or poor nutrition, the body may have trouble losing fat and gaining muscle. Thyroid: Metabolic Master Switch The thyroid controls how the body makes energy. It affects our metabolism, body temperature, fat burning, mental clarity, mood, and hormone balance. Sarah notes that many people might have thyroid issues, even if tests look normal. Symptoms of a struggling thyroid include slow metabolism, fat gain, cold hands and feet, brain fog, fatigue, and muscle loss. We have had a rash of KY "Republicans" not being very conservative this past week. I'll go over who the offenders are and what they have done. In this episode I cover Kim' Banta's new gun control bill. In one part I quoted her talking about if a 15 year old shoots a cow while hunting. In the show I wasn't as clear as I wanted to be on current hunting laws. The fact Banta was referencing shooting a cow I believe she was talking about hunting big game (like a deer). In KY it is not legal for a 15 year old to hunt a deer with a rifle on their own, a fact I call her out for not knowing despite making laws on the subject.
