The SmackDown on October 1st will now be held at the Royal Farms Arena in Baltimore. The Smoothie King Center's primary tenants, the NBA's New Orleans Pelicans, announced Monday that the arena had "minor exterior damage" from Ida...and “will be prepared to host games for the upcoming season without issue”. The Pelicans' only home preseason game is scheduled for October 6th. Tonight's NXT has Johnny Gargano vs. LA Knight...Tommaso Ciampa vs. Ridge Holland...Kyle O'Reilly vs. Duke Hudson...and Roderick Strong vs. Ikemen Jiro. On last night's Raw… Nia Jax pinned the Raw Women's Champion Charlotte Flair...in a match that frankly got a little ugly at one point. Earlier in the show, Jax laid out Rhea Ripley...after Ripley had beaten Shayna Baszler. The United States Champion Damian Priest held an open challenge...which led to a 3-Way against Sheamus and Drew McIntyre. Priest prevailed...pinning McIntyre with The Reckoning. The Raw Tag Team Champs Randy Orton & Riddle beat WWE Champ Bobby Lashley & MVP to retain their titles. Riddle pinned MVP with the Floating Bro. After the match, Lashley speared Riddle, but Orton retaliated with an RKO. Also last night, Omos pinned John Morrison. AJ Styles submitted Xavier Woods with the Calf Crusher. The Viking Raiders beat Jinder Mahal & Veer. Mahal took the pin. Plus, Karrion Kross submitted Humberto Carrillo with the Kross Jacket. Three matches promoted during last week's Raw did NOT happen on last night's show. A match between Eva Marie and Doudrop came the closest to happening. The proliferation of nuclear weapons during the Cold War in a way served as a deterrent for conflict between nations - the power of these weapons was so overwhelming and the potential consequences of any action so irreversible, it was possible to sustain a long period of détente. But as technology evolved, and micro-aggressions of state-sponsored hacking became the norm, the logic was flipped and we found ourselves with almost no restraint in terms of acts of cyber warfare among nations. Ben Buchanan, a professor at Georgetown University's School of Foreign Service, joins Robert Amsterdam on this episode of Departures to discuss his new book, "The Hacker and the State: Cyber Attacks and the New Normal of Geopolitics." Buchanan argues that we can see just how extensive the hacking wars have gone by examining the details. "If you are looking for scenarios of planes crashing and cities burning, you miss some of the activities that matter most," Buchanan says. "This is a book about the stories that actually happened, the events that have shaped global affairs over the last two decades where nations have hacked one another." Amsterdam and Buchanan discuss how the lack of policies, treaties, and law to regulate cyber warfare have created a Hobbesian chaotic environment in which unpredictable, dangerous, and costly outcomes become more and more likely. "I think every nation of a certain degree of sophistication looks at hacking tools right now, and says I can use these to advance my interests, I don't trust the other side not to use them, and you get into this dog-eat-dog world, in which everyone is continually struggling for advantage in trying to shape the environment, just a little bit every single day, into their favor," Buchanan says. "These events are extraordinary ones, but daily ones."

By popular request, we've revisited a story we skipped last week to do a pretty deep dive on the decision (for now) that Capital One can't claim attorney-client work product privilege in a Mandiant intrusion response report prepared after its breach. Steptoe litigator Charles Michael and I talk about how IR firms and CISOs should respond to the decision, assuming it stands up on appeal. Maury Shenk notes the latest of about a hundred warnings, this time from Christopher Krebs, the director of DHS's cybersecurity agency and the head of Britain's GCHQ, that China's intelligence service—and every other intelligence service on the planet—seem to be targeting COVID-19 research. Maury takes us through the week in internet copyright fights. Ideological copyright enforcement meets the world's dumbest takedown bots as Twitter removes a Trump campaign video tribute to George Floyd due to a copyright claim. The video is still available on Trump's YouTube channel. We puzzle over Instagram's failure to provide a license to users of its embedding API. The announcement could come as an unwelcome surprise to users who believed that embedding images, rather than hosting them directly, provides insulation against copyright claims. Finally, much as I love Brewster Kahle, I'm afraid that Kahle's latest move marks his transition from internet hippie to “holy fool”—and maybe a broke one. His Internet Archive, the online library best known for maintaining the Internet Wayback Machine makes scanned copies of books available to the public on terms that resemble a library's. The setup was arguably legal—and no one was suing—until Kahle decided to let people download more books than his company had paid for. Now he faces an ugly copyright lawsuit. This Week in Working the Ref: Facebook and Mark Zuckerberg are facing criticism from users, competitors, civil rights organizations for failing to censor the people those groups hate. (Ars Technica, Politico). Meanwhile, Snap scores points by ending promotion of Trump's account after concluding his tweets incited violence. Where is Nate Jones when you need him? He would love this story: A Twitter user sacrificed a Twitter account to show that Trump is treated differently than others by the platform. Of course, the panel notes, that's pretty much what Twitter says it does. In quick hits, I serve notice that no one should be surprised if Justice brings an adtech antitrust suit against Google. The Israeli government announces an attack on its infrastructure so late that the press has already identified and attributed its retaliatory cyberattack on Iran's ports. Dr Ben Buchanan is a psychologist and Co-founder & Director of NovoPsych, an Australian healthtech company providing software for administering psychological, remote and online questionnaires to patients. As a trained clinical psychologist, Ben is passionate about clinicians evaluating their own practice through the use of routine outcome monitoring, which is why he created NovoPsych. In this episode, Ben explains why outcome measurements should focus on Australian requirements, and how the recent and sudden transformation towards telehealth can be easily adapted to using NovoPsych. Ben provides some guidance on what a telehealth workflow could look like, and how to implement automation with remote symptom monitoring of patients between visits or after treatment.   Key takeaways: In Australia, one of the most widely used assessments to measure mental health outcomes is called the K10 — also known as the ‘Kessler Psychological Distress Scale’. Australia regulations of mental health practitioners require some outcome monitoring to occur. NovoPsych has been tailored to fit the exact purpose that Australian mental health conditions need. Healthcare is a service industry, in which it’s just as important to provide a service that the client is happy with as it is to improve clinical outcomes. One of the number one predictors of treatment success for mental health patients is the ‘therapeutic alliance’, i.e. the relationship between the psychologist and the client. If the client trusts the psychologist then that is a serious predictor of later outcomes. Practitioners often have to rely on their intuition to get a sense about whether the client is benefitting from the treatment. However, the research evidence shows that trained professionals are terrible at using intuition to accurately measure how their clients are going. We interview Ben Buchanan about his new book, The Hacker and the State: Cyber Attacks and the New Normal of Geopolitics. This is Ben's second book and second interview on the podcast about international conflict and cyber weapons. It's safe to say that America's strategic posture hasn't improved since his first appearance. We face more adversaries with more tools and a considerably greater appetite for cyber adventurism. Ben recaps some of the stories that were undercovered in the US press when they occurred. The second large attack on Ukraine's grid, for example, was little noticed during the US election of 2016, but it appears more ominous after a recent analysis of the tools used, and perhaps most importantly, those available to the GRU but not used.  In the news, Nick Weaver, Gus Hurwitz, and I take a quick pass at the Internet content regulation problem and Section 230 of the Communications Decency Act. I've written that Section 230 needs to be reconsidered, and I predict that the Justice Department, which held a workshop on Section 230 last week, will propose reforms. Gus and I offer two different takes on Facebook's recent white paper about content moderation. Gus is more a fan of Twitter's approach. And Nick reminds us that there are some communities on the Internet whose content causes real harm, including to innocent children. The debate in the US is taking a distinctly European turn, I suggest, which makes Europe's determination to regulate its way to digital innovation a little less implausible than usual. Maury Shenk outlines the very tentative (and almost certainly out of date before it's launched) plan for building a European data lake to foster a European AI and digital economy. Speaking of AI regulation, Elon Musk hasn't given up on his concerns about the technology's risks. But the real action in media circles is attacking fairly simple machine learning tools as used by law enforcement and the justice system. I think the attack is wrongheaded and will either result in abandoning tools that can discipline true outliers. Nick thinks the institutionalization of bias is bad enough that giving up such tools may be the better course. In quick hits, Nick explains how Google's effort to stamp out ad click fraud can generate a secondary form of criminal extortion. Maury explains the latest flap over Australia's encryption law; the tl;dr is that nothing is likely to change soon. Gus makes a down payment on an emerging issue: Whether ISPs can defeat Internet privacy laws that affect them by pleading their First Amendment rights. Nick calls BS on the simplest forms of “anonymization” for credit card data now being sold. I highlight a ransomware attack on a US natural gas operator that actually affected operations and is thus a forerunner of future attacks. Nick reminds us that Julian Assange is in court to stop a US extradition bid. And Europe's data protection advisor is questioning Google's acquisition of Fitbit. Download the 301st Episode (mp3). With the increasing frequency, complexity and sophistication of cyber attacks - such as Stuxnet, the Sony Hack - how is attribution done? This podcast is an interview with Ben Buchanan about a paper he recently published with Thomas Rid, Professor of Security Studies at Kings College, London on Attributing Cyber Attacks The paper can be found in the Journal of Strategic Studies. This podcast was produced and is hosted by Adriene Lilly.   Adriene Lilly: With the increasing frequency of cyber attacks in the media I think it's worth taking a few minutes to try and understand how attribution is done - how do we find out who is doing it, why, how, and where from.  What exactly is attribution in the cyber context, why do we try to attribute attacks? How is it different than it's offline equivalent in criminal investigations? Where does data and forensic evidence come from? And who – be it the government or private companies – is actually involved in the process of attribution? Today I'm talking to Ben Buchanan.... Ben Buchanan: good to be with you Adriene. So I'm Ben Buchanan, I'm a PHD Candidate at Kings College London. AL: He's recently published a paper with Thomas Rid in the Journal of Strategic Studies called “Attributing Cyber Attacks” their paper attempts to get to the essence of attribution in cyber crime and sets up a model that they hope can help streamline the process. Before we begin though, there are a number of major cyber attacks that have popped up in the media over the past couple of years. So just in case you're like me and may need a refresher, let's start with a few of those stories. Let's begin back in 2010 with the discovery of Stuxnet. Stuxnet was a piece of malware – or malicious software – that is generally cited as being one of the most if not they most sophisticated computer viruses to date. And while no one has officially taken credit for it, best guesses it's a product of the US and Israeli governments. The software was specifically designed to target a uranium enrichment facility in Iran by subtly changing how some of the mechanical structures in the facility operated. Specifically the spinning speed of a number of centrifuges. Stuxnet was designed to sabotage the Iranian nuclear program. It's significant for a number of reasons, but the one that I want to emphasize here is the complexity and sophistication of the operation.. here's Ben.. AL: Ok, now your brought up the centrifuges in Iran so I'm assuming you're talking about Stuxnet.. BB: Sure, so Stuxnet was a long cyber operation against Iranian centrifuges that by some reports involved building a replica of the Iranian nuclear facility and testing the code against this model before it was deployed against Iran. That's an operation that probably cost hundreds of millions of dollars when you consider all the physical expenses. It's believed to have been conduced by the US, likely working in partnership with Israel, and it had the effect of manipulating the centrifuges in a number of ways over a number of years in an attempt to slow down the Iranian nuclear program. AL: Who discovered it and who did it? BB: So the tech side of the operation was discovered by researches who were alerted when a computer in Iran kept restarting for unknown reasons. They looked in the code and they discovered that it was what looked like a cyber weapon against the Iranian nuclear facility. People immediately assumed, or guessed, that it was the US or Israel but there was no concrete proof for quite awhile. And in that case, what is today the most credible attribution of the Stuxnet attack came from a reporter, came from David Sanger at the New York Times who working inside the beltway of sources found out that it was in fact likely a US or Israeli operation and then further reporting seems to indicate that's the case,
