Send us a textJoin Chuck and John this week as they go back to an episode from May 27, 2021 about the case that redefined what sexual harassment can look like in the workplace. ---In this episode, our hosts John and Chuck tell the behind the scenes story of Mechelle Vinson....a 19 year old Bank Teller and how she was coerced into having a sexual relationship with her boss in order to save her job.In May of 1975, Mr. Sidney Taylor, Branch Manager at a local bank takes his employee, Bank Teller Mechelle Vinson, out to dinner at a Chinese Restaurant after work. Years later, Michelle  recollected the story of the Chinese restaurant dinner with the Washington Post…in her own words…she said… ‘I don't want to go to bed with you,' And he says, ‘Just like I hired you, I'll fire you. Just like I made you, I'll break you, and if you don't do what I say then I'll have you killed.' … And that's how it started.”As we continue our HR Stories of Court Cases and Laws that made HR today we look at the very first case that eventually reaching the U.S. Supreme Court on June 19, 1986, Meritor Savings Bank v. Vinson. It was the first of its kind to redefine sexual harassment in the workplace. It established the standards for analyzing whether conduct was unlawful and when an employer would be liable. The court, ruled unanimously (9–0) that sexual harassment that results in a hostile work environment is a violation of Title VII of the Civil Rights Act of 1964, which bans sex discrimination by employers. The Court also established criteria for judging such claims. Visit TeamAtHRStories.com to see all of our workshops and offerings to help you feel confident in your HR decisions. Mike's Minute: The pay equity court case is a "show trial"

The Mike Hosking Breakfast

Play Episode Listen Later Aug 18, 2025 2:12 Transcription Available

If Grant Robertson thinks the Covid inquiry is a "show trial", then what is about to unfold at the High Court as of the end of this month can't be far behind. A bunch of unions are taking the Government to court over pay equity. They are having several stabs at it – the Bill of Rights is in play and the democratic process is up for debate. One of the things the unions claim may happen if they win, is a select committee would have to hear submissions and a debate in Parliament would have to take place. That's the "show trial" part. Select committees hear from the people you would expect to hear from: broadly, it's people opposed to whatever change of law is in play. And a debate in Parliament hears both sides, one for, one against, with the Government of the day prevailing, given it is they who have the numbers and indeed that is why they are the Government. Which is essentially why court is a waste of time, remembering of course the Government is the ultimate court and if they want to pass a law, they can. Making it complicated is the whole pay equity calculation is a mess. Secondary teachers, for example, were one of the many claimants putting an equity claim forward before the law was changed. To my eye being a high school teacher is not an equity issue. Men do it, women do it, there are lots of them and they aren't paid on gender. It's not a profession where 99% of them are women and because they are women, they are poorly paid. High school teachers are paid quite well. You could equally argue they are not paid as well as they could be because the union insists on them all being paid the same based on time in the classroom. If they got paid on merit it would be a different world. Kristine Bartlett's case became famous because we could all see the care industry was mainly female and the pay was poor. I would still argue the pay was poor because the work, although kind and worthy, is not of great numerical value. If it was, rest homes would pay more, charge residents more and we'd happily foot the bill. But we don't. Anyway, the upshot is the best the unions can hope for is a court win. The win can then be used to beat the Government about the head as big, bad meanies. But it will still not get them paid under an equity deal because the court is not the Government. #Bob #Emmanson #FAAN #IbomAir #Keyamo #Lagos #Police #Tinubu #Uyo ©August 13th, 2025 ®August 13, 2025 11:50 am Federal Government of Nigeria under the leadership of President Bola Ahmed Tinubu has ordered the Commissioner of Police in charge of Lagos Airport to withdraw the one sided and obviously biased court case the Nigeria Police Force may have wrongly instituted against an Ibom Air Passenger, Comfort Emmanson who was seen in viral videos retaliating and defending herself physically after a group of Ibom Air personnel and Lagos Airport team had attacked her and provoked her to action, the FG position on the issue was made known by the Nigeria Minister of Aviation, Festus Keyamo in a press release the Minister signed and made available few minutes ago, although Festus Keyamo reversed his self and acknowledged that the issue was a case of confrontation between the 26 years old passenger and the staff of Ibom Airlines who in the new press release admitted that the staff of Ibom Air and the Lagos Airport authority team acted wrongly, but, the Minister did not state how the attacked passenger would be compensated most especially when her chest sexual organs were seems to be deliberately exposed after a suspected Ibom Airline staff pulled off and tore the passenger shirt with obvious intention to expose the passenger's nakedness, the action of the Federal Government may eased the tension among millions of people who have accused the Nigeria Police Force of aiding and abetting the Ibom Airline company to continue to attack and oppress the offended passenger, Comfort Bob who is also identified as Comfort Emmanson by thus supporting the statement of Ibom Air management who in their first press release made statement that seems to have some level of deliberate falsehood and raising up a dead issue to win undue public sentiments, manipulate the Nigeria Police Force to help them secure detention holding charge from the Lagos State Magistrate Court to further oppress and intimidate the attacked passenger, specifically, Ibom Air stated in her first press release that, shortly after the plane landed at Lagos Airport, the passenger waited for every other passenger onboard the plane to disembark, and thereafter, without provocation, went to one of the Plane hostesses, Juliana Edward the Ibom Air Management described as Purser, “stepped on her, forcibly tore off her wig, removed her glasses and threw it to the floor, and used her footwear to assault her, She slapped her several times and when the other cabin crew member tried to intervene, she slapped her too, She then attempted to forcibly remove a fire extinguisher to use as a weapon, an act that could have damaged and grounded the aircraft”, soon after the Ibom Air Management released the statement on Monday, a video surfaced on the internet that probably invalidated the statement of the Ibom Air Management and stood out as an acceptable evidence that the Management of Ibom Air are people who maybe rightly described as pathological liars who probably believed in telling lies as a way of managing crisis and handling difficult customers relations, as seen in the viral video that surfaced the internet after the apparent falsehood of Ibom Air Management, the attacked passenger was seen politely telling the air hostess, Juliana Edward to leave the doorway so that she can disembark from the plane, the seemly aggressor in this matter, the Air Hostess Juliana Edward refused to yield to the appeal of the passenger, and Ibom Air Management in their first press release confirmed that the Air Hostess, Juliana Edward deliberately blocked the doorway to prevent the passenger from disembarking the aircraft, and in the viral video, the attached wig hair on the head of the air hostess was still seen on her head and intact while the passenger was telling her to leave the doorway so that she can pass, obviously, this is in contrary to the seemly deliberate falsehood painted and stated in black and white by the Ibom Air Management that the air hostess attached wig hair was destroyed by the passenger without provocation, also, the attached wig hair on the passenger head and the jacket she was putting on were still intact as at the time she was telling the apparent aggressor, the air hostess to leave the door, and another viral video later showed both the air hostess and the passenger dragging at the point of the plane divider cotten, and at this time as seen in the video, both the passenger and air hostess wig hair were pulled off including the passenger jacket she was putting on to cover her body completely, the natural hair on their heads could now be seen as they continued to drag each other at the plane doorway, and Ibom Air management in trying to seemly win undue public sentiments, raised up a dead issue of a minor quarrel the passenger had with the air hostess and co passenger over the passenger alleged initial refusal to switch off her phone during the plane take off at Uyo airport, the Ibom Air management in the press release confirmed that the minor quarrel the passenger had with the air hostess and co passenger over switching off phone at Uyo airport was already a dead issue and the action of the passenger never led to threat of aviation safety or violation of aviation safety procedures hence the passenger was not deplane at Uyo airport, but we don't know why the Management of Ibom Air decided to advertise and bring up the minor quarrel as a way to seemly win public sentiments to cover up the true picture of a separate event that occurred between the passenger and the air hostess when the plane landed at Lagos Air Port, and the Nigeria Police Force in the five count charges filed against the passenger at the Ikeja Magistrate court in Lagos State, did not state or even mention the event that occurred at Uyo airport before the plane took off. #OsazuwaAkonedoBecome a supporter of this podcast: TCW Podcast Episode 239 - Nintendo: Wii Were Struggling   Nintendo's struggle for cultural relevance in the lead-up to the Wii was marked by the N64's poor fit for Japanese homes and the GameCube's failure to outsell even the fledgling Xbox globally. Internally, a power struggle unfolded as Hiroshi Yamauchi prepared to retire. Former Sharp executive Atsushi Asada was brought in and became Executive Vice President and later Chairman of the Board. Satoru Iwata, whom Yamauchi saw great potential in, was appointed president of HAL Laboratory as part of a Yamauchi-backed bailout and ultimately succeeded Yamauchi as president of Nintendo. Minoru Arakawa was passed over, removed from the board, and after his retirement, replaced at Nintendo of America by Tatsumi Kimishima, who was later placed on the board himself, giving credence to the idea that Arakawa was pushed aside in favor of Iwata. We explore how, despite not facing financial collapse, Nintendo risked losing its creative identity after two struggling consoles and Sony's rising threat to its handheld dominance.   Iwata Asks Interviews: https://iwataasks.nintendo.com/ Simpsons all you can eat Court Case: https://www.youtube.com/watch?v=CqT-AvswCZo TCW 153 - Nintendo Playing with Cards: https://podcast.theycreateworlds.com/e/nintendo-playing-with-cards/ TCW 154 - Nintendo Playing with Controversy: https://podcast.theycreateworlds.com/e/nintendo-playing-with-controversy/ TCW 155 - Nintendo Playing with Toys: https://podcast.theycreateworlds.com/e/nintendo-playing-with-toys/ TCW 014 - Nintendo Playing with Power: https://podcast.theycreateworlds.com/e/nintendo-playing-with-power/ TCW 128 - Nintendo in 1985: https://podcast.theycreateworlds.com/e/nintendo-in-1985/?utm_source=chatgpt.com TCW 037 - Nintendo and Gumpei Yokoi: https://podcast.theycreateworlds.com/e/nintendo-and-gunpei-yokoi/ TCW 063 - Lawsuits for Nintendo: https://podcast.theycreateworlds.com/e/lawsuits-for-nintendo/ TCW 068 - SEGA vs Nintendo Round 1: https://podcast.theycreateworlds.com/e/sega-vs-nintendo-round-1/ TCW 069 - SEGA vs Nintendo Round 2: https://podcast.theycreateworlds.com/e/sega-vs-nintendo-round-2 TCW 070 - SEGA vs Nintendo Round 3: https://podcast.theycreateworlds.com/e/sega-vs-nintendo-round-3 TCW 198 - The History of Handheld Games Part 1: https://podcast.theycreateworlds.com/e/the-history-of-handheld-games-part-1/ TCW 199 - The History of Handheld Games Part 2: https://podcast.theycreateworlds.com/e/the-history-of-handheld-games-part-2/ TCW 200 - The History of Handheld Games Part 3: https://podcast.theycreateworlds.com/e/the-history-of-handheld-games-part-3/ Business Card CDs: https://www.youtube.com/watch?v=LS_QTo6L9dA GameCube Controller: https://en.wikipedia.org/wiki/GameCube_controller Kirby's Dreamland (NES): https://www.youtube.com/watch?v=rJXM4EPbPe0 Shmuplations - Satoru Iwata - 1999 Developer Interview: https://shmuplations.com/iwata/   New episodes are on the 1st and 15th of every month!   TCW Email: feedback@theycreateworlds.com  Twitter: @tcwpodcast Patreon: https://www.patreon.com/theycreateworlds Alex's Video Game History Blog: http://videogamehistorian.wordpress.com Alex's book, published Dec 2019, is available at CRC Press and at major on-line retailers: http://bit.ly/TCWBOOK1     Intro Music: Josh Woodward - Airplane Mode -  Music - "Airplane Mode" by Josh Woodward. The line between groundbreaking innovation and controversial ownership blurs when scientists begin creating life in laboratories. What happens when your invention isn't just a device or chemical formula, but a living, breathing, self-replicating organism that refuses to stay contained within traditional legal boundaries?Synthetic biology—the field where engineering meets genetics—has created a perfect storm for intellectual property law. Scientists can now design cells like software, program bacteria to clean oil spills, and edit genes with CRISPR technology. But who owns these inventions when they start reproducing themselves? From the landmark 1980 Chakrabarty decision that first allowed patents on genetically modified bacteria to the controversial Myriad Genetics case that determined human genes cannot be patented, we explore the fascinating legal battles that shaped biotech innovation. We journey through courtrooms worldwide where judges grappled with unprecedented questions: Can you patent a cloned sheep? Should farmers be allowed to replant patented seeds? Does traditional knowledge about medicinal plants deserve protection from corporate "biopiracy"?The legal landscape continues evolving, with a brand new WIPO treaty requiring disclosure of genetic resources' origins in patent applications. This represents a major shift toward transparency and fairness, especially for communities whose biodiversity and traditional knowledge have contributed to modern innovations.Whether you're a scientist, lawyer, entrepreneur, or simply curious about the legal frameworks governing emerging technologies, this episode offers crucial insights into how intellectual property systems are adapting to the brave new world where the line between invention and life itself becomes increasingly blurred. A new study published by the Centre for Ecology and Hydrology shows that nature-friendly farming is not currently as profitable as intensive food production. Its authors say the report is the first of its kind and shows that agroecology improves biodiversity and can boost crop yields. However, the cost of creating habitats and the loss of some productive land, they say, means lower profits. Dr Ben Woodcock led the four year study which studied 17 farms.More big food companies are paying producers who farm regeneratively a premium, encouraging them to improve soil health, increase on-farm biodiversity and reduce their carbon footprint. On week 8 of the trial, will the jury get the case this week to deliberate?Special Prosecutor, Hanke Brennan, asks Dr. Wolfe, the Director of Accident Reconstruction at ARCCA, about the appearance of holes on the back of Mr. O'Keefe's hoodie and whether these holes are consistent with road rash or other damage. He asked him if he'd ever consider if Mr. O'Keefe may have fallen or landed on his back. Dr. Wolf stated he did not consider whether Mr. O'Keefe had fallen or landed on his back. Defense Attorney, Robert Alessi, asked for a Mistrial with Prejudice due to Intentional Misconduct by the prosecution regarding questioning about the hoodie and its damage. The defense argued the prosecution intentionally left out evidence about the holes on the back of the hoodie being clippings from the crime lab. The judge did not grant a mistrial but agreed to instructed the jury to disregard the questions and give a strong admonishment about the prosecution. When it came time to it, the Judge did not give a strong admonishment or admit the pictures into evidence. At the end of the day, the defense said that they will address this the following day.A Voir Dire of Dr. Laposata was conducted and Judge Cannone ruled she cannot testify that the wounds on John O'Keefe's arm were from a dog, but she will be able to testify about the original opinions about the cause and manner of death.
