As Deputy Secretary, Hargan is HSS’s Chief Operating Officer, responsible for overseeing the day-to-day operations and management of the department in addition to leading policy and strategy development. In Part II of our special series on Rural Economic and Community Development, produced in collaboration with and supported by Thomas USAF, Hargan discusses four important rural health priorities for the Administration: preventing death and disease, especially in the areas of the opioid crisis and maternal health; creating sustainable rural health care models, by reviewing systems that may not be appropriate for rural hospitals today; improving access through technology and innovation, including telehealth, remote patient monitoring, and improving broadband capability; and developing a robust and dedicated rural workforce, which can help provide health care support and sustain rural communities. Hargan also described how the Administration on May 1 allocated $10 billion in COVID-19 relief to rural providers in four categories: rural acute care hospitals; critical care hospitals; rural health clinics; and community health centers in rural areas. Hargan also specifically describes the efforts of the Rural Communities Response Program, which has distributed more than $157 million in the last two years to about 1,000 rural communities in 47 states. For the first time in more than 20 years, he points out, drug overdose deaths actually declined in the U.S, and there also was a rise in life expectancy after a three-year decline. Today's episode takes a deep dive into allegations of attorney misconduct. We begin with following investigative reporting concerning the involuntary bankruptcy of the Eagan Avenatti firm, and discover some potentially disturbing facts about the lawyer who's currently outfoxing the bad guys at every turn, Michael Avenatti. After that, we discuss the Supreme Court's recent unanimous per curiam decision in Azar v. Garza, the tragic case of the young woman denied her constitutional right to an abortion and subjected to harassment and "crisis pregnancy center" anti-abortion counseling until the D.C. Circuit Court of Appeal stepped in. So... why did the Supreme Court just vacate that opinion? It (potentially) has to do with attorney misconduct. Oh, and this story also tells you everything you needed to know about price ceilings on underwear in the 1940s. (Really!) Then, we examine the biggest example of attorney misconduct at the moment -- Donald Trump's ever-fluctuating team of lawyers defending the indefensible. Specifically, we take a look at the recently-leaked Dowd memorandum and its central claim that the President cannot obstruct justice with otherwise-legal behavior. (That's false.) Garza, a lawsuit filed by the ACLU on behalf of undocumented immigrantthat asks if the federal government can deny access to an abortion for pregnant undocumented teens. As of January 11, 2018, the Supreme Court was considering the case in private conference. Joining us to discuss this important question are two of America’s leading experts on constitutional and family law. Catherine Glenn Foster is President and CEO of Americans United for Life. She served as Counsel of Record for amicus curiae Alliance Defending Freedom’s Amicus Brief in Planned Parenthood v. Abbott, which defended Texas’ healthcare regulations around abortion clinics. Leah Litman is Assistant Professor of Law at the University of California, Irvine School of Law. She co-authored Petitioner’s Brief in Whole Women’s Health v. Hellerstedt case, which successfully challenged Texas’ healthcare regulations around abortion clinics. Jeffrey Rosen is the President and Chief Executive Officer of the National Constitution Center, the only institution in America chartered by Congress “to disseminate information about the United States Constitution on a nonpartisan basis.” He is also a professor at The George Washington University Law School, and a contributing editor for The Atlantic. On this week’s episode of Versus Trump, Jason and Charlie discuss a new lawsuit that forces courts to answer the question of whether the federal government needs a warrant to search people's cell phones and other electronic devices at the border, and they also [at 32:30] respond to a discussion on the Supreme Court podcast First Mondays regarding the government's recent filing in the Hargan v. Garza abortion case.First, Jason and Charlie tackle border searches of cell phones and laptops by discussing a new case filed by the ACLU and Electronic Frontier Foundation called Alasaad v. Duke. The case was recently filed in Boston on behalf of several individuals who had their electronic devices searched when they returned to the U.S. from oversees. As Jason and Charlie note, the policies authorizing border searches without a warrant, probable cause, or even reasonable suspicion of a crime were put in place in 2009 under President Obama—but the number of people whose electronic devices have been searched at the border has risen dramatically since President Trump took office. Jason and Charlie analyze whether the policy is constitutional and try to predict what rule a court might adopt to put some limits on these searches.After that [at 32:30], Jason and Charlie return to the noteworthy case of Hargan v. Garza. The federal government recently filed a much-discussed Supreme Court petition that accused the ACLU of misconduct in a case that ultimately resulted in an undocumented immigrant obtaining the abortion she sought. Jason and Charlie disagree with the view articulated in the most recent episode of First Mondays, in which the hosts said that the government's petition presented a potentially close case on the misconduct issue, and also argued that the lawyers who signed the petition must subjectively have thought there was serious attorney misconduct.
