Jackson Women's Health Organization, various political scientists and policymakers have been sounding an alarm about our democracy. To make sense out of what is going on with the Supreme Court and how their opinions relate to democracy and the rule of law, I chat with Michael Romano, Associate Professor of political science at Shenandoah University in Winchester, Virginia. His research focuses on how politicians communicate with the public - including how judges write decisions and influence public debate around policy issues. He is the co-author of the book "Creating the Law; State Supreme Court Opinions and the Effect of Audience," and is currently studying how state governments impact the strength of democracy and adherence to democratic norms in the United States nationally.

Today on Legalese we will be discussing the consequences of this leaked Supreme Court Opinion in their upcoming case Dobbs v Whole Women's Health of Jackson. The leaked draft written by Samuel Alito allegedly shows a majority opinion to essentially overturn Roe. This leak should not necessarily be taken as the Court's final opinion. In light of the monumental Supreme Court case Jackson v. Whole Women's Health, it was about time that Anthony dedicated an entire show to the most fundamental of all natural unalienable rights: the right to life. To open the show, Anthony unveils an extraordinary business opportunity for perhaps one of his listeners to pursue (hint: PPP). Then after both a full breakdown of the case & some of the oral arguments, in addition to high praise specifically for Justice Clarence Thomas, Anthony goes on to explain how the Founding Fathers almost certainly believed in the right to life, and how they probably never imagined a time when lives could be ended before birth. What a joy to sit beside Camesha Jones, LCSW, at Sista Afya Community Mental Wellness, her gorgeous social enterprise located in Chicago's South Shore neighborhood. Founded in 2017, Sista Afya is dedicated to providing low- to no-cost mental wellness services that center the experiences of Black women. Let's chat about why centers like it are important––and, believe me, there aren't many places like Sista Afya, sadly. “Sometimes people keep saying this BS that Black people don't want to engage in therapy,” says Camesha. Ah, yes, the narrative about which communities are and aren't receptive to supportive healing, created by those outside the community to stigmatize and keep critical infrastructure like therapy from reaching those who need it. Camesha flatly refutes the trope. Camesha has built a center that's community focused down to its core. The name, for instance, combines sista, a term of endearment used between Black women, and afya, a Swahili word that means to be healthy, free from psychological and physical illness. In her own life, Camesha takes continual care to address challenges inherent to living with bi-polar disorder. She offers hope to folks, including fellow therapists, with similar experiences, modelling self-awareness and practicing sustainable self-care while running a successful business. “I go to therapy. I go to my psychiatrist. I take my meds. I do all the things [ ] and that's part of why I call myself a mental illness survivor,” she says, adding, “we're dealing with some of the same things, we're all dealing with some of the same things. In this episode, Marva Sadler talks about her path to working in abortion care, what keeps her going to work every day, and reflects how her own abortion experience has shaped how she provides abortion care. Marva has worked with for 13 years and in abortion healthcare for over 16 years. She was born in Detroit, and, since the age of three, raised and educated in Waco, Texas. Marva's passion for women's reproductive healthcare began on her first day of work in abortion care in 2005, when she was greeted by two abortion protestors. She believes that these people simply can not win. They convinced Marva that she had to fight for the rights of women. As an abortion provider in Texas, Marva is proud to have been an active part of the continued fight against the State of Texas' outrageous legislation and, currently, . Marva has also served on the Board of Directors. Marva is married and is a mother of five sons, one daughter, and one puppy, Marley. On Monday, the Supreme Court heard oral arguments in two cases challenging Texas' ban on abortion after six weeks of pregnancy known as SB 8 -- one case brought by the ACLU and our partner organizations on behalf of abortion providers, Whole Women's Health v. Jackson, and a separate case brought by the Department of Justice, United States v. Texas. The rulings will determine whether or not abortion providers and the Department of Justice are entitled to challenge SB 8 as the law was written purposefully to skirt federal judicial review. Earlier this year, the Supreme Court declined to rule on an emergency request to block SB 8, allowing the ban to take effect on September 1st. Since then, the majority of Texans seeking abortions have been unable to access them in the state. What does this all mean for the future of SB 8 and abortion access in the U.S. at large? That remains to be seen. There are so many unanswered questions. Brigitte Amiri, Deputy Director of the ACLU's Reproductive Freedom Project joins us to help break it all down. Abortion clinics in Texas rushed to abort as many babies as they could prior to the deadline for a recently enacted fetal heartbeat bill. According to far-left media outlet 19thnews.org, a Whole Women's Health clinic in Fort Worth last week had a waiting room packed with expecting mothers who wanted to terminate their unwanted pregnancies. The bill passed last month bans abortions after 6 weeks, or after a fetal heartbeat is detected. The 19th gave a sympathetic depiction of the abortionists who ended the babies' lives: It was 8 p.m. on Tuesday when Marva Sadler looked at the patients waiting in the lobby, at the list of patients waiting to return, at even more patients waiting outside in cars surrounded by protesters — and realized they might not get to everyone. In four hours, a near-total ban on abortions in Texas was set to take effect, and two dozen people were still waiting for the procedure at Whole Woman's Health in Fort Worth, one of the largest abortion care clinics in the state. On August 31st, Marva Sadler stood outside the Whole Women's Health abortion clinic in Fort Worth, Texas, and vowed to help as many people as she could before the end of the day. Along with a small staff, Sadler and a physician performed 67 abortions before midnight. The next day, the nation's strictest abortion ban went into effect. The law, known as SB-8, bans nearly all abortions after fetal cardiac activity is detected, typically around the sixth week of pregnancy, before most people know they are carrying. SB-8 is facing multiple legal challenges, but its authors designed it to stand up to a challenge before the Supreme Court, by moving the enforcement from the state to private citizens, who can sue anyone who “aids or abets” an abortion procedure. So far, the bet has paid off. The Supreme Court let the law take effect in September, and while there's been recent legal back and forth over the law, it's still in effect today. In the past six weeks, many pregnant people have sought to get around the ban by crossing state lines or seeking abortion pills online.On this episode of Into America, Marva Sadler, the clinical director for the Whole Women's Health network, tells Trymaine Lee that this law will have greater consequences for Black people, who already face higher face higher rates of maternal mortality in Texas. Russo that Louisiana could not require abortion providers to have admitting privileges at a local hospital. The ruling upholds an earlier Supreme Court decision, Whole Women's Health v. Reminder: the June decision on HB2 will either strengthen Roe, uphold it, or decimate it — which will affect the entire country. If the primary reason people self-induce is that they couldn’t access wanted/preferred clinic-based care, imagine what would happen with even fewer clinics should SCOTUS uphold the law.
