Judge David Tatel served on the United States Court of Appeals for the District of Columbia Circuit from 1994 to 2023. Prior to that, his three-decade career as a civil rights lawyer included private and government positions, and focused heavily on equal educational opportunity and access to justice. He served as Director of the Chicago Lawyers' Committee for Civil Rights Under Law and then Director of the National Committee. He was the Director of the Office for Civil Rights of the U.S. Department of Health, Education and Welfare during the Carter Administration. When he returned to private practice in 1979, Judge Tatel joined Hogan & Hartson, where he founded and headed the firm's education practice until his appointment to the D.C. Circuit. Judge Tatel also co-chaired the National Academy of Sciences' Committee on Science, Technology and Law. Judge Tatel joins me in The Back Room for a riveting conversation about his illustrious life and career, his terrific book Vision: A Memoir of Blindness and Justice, and the controversies involving the current United States Supreme Court. As a club Celtic were still coming to terms with the loss of the great Henrik Larsson just 12 months prior and now the man who had dragged Celtic into the modern era was also departing. Into the bargain the club were now downsizing financially and the big money moves that brought key figures like Sutton, Hartson, Lennon would also become a thing of the past. That Strachan then went on to be quite as successful as he was at Celtic Park is all the more admirable. But it certainly wasn't plain sailing. Far from it. And we don't know whether any of them are already on that list of possible witnesses Smith may call in the documents trial. The New York Post had a throwaway reference last night: “Two of the people Trump speaks to in the audio are believed to be Kate Hartson and Louise Burke, who had started All Seasons Press, a conservative publishing company…” You do not have to have a hyperactive imagination to wonder: if the Post is right and it was both of them that as Ms. Burke and Ms. Hartson left Bedminster that day two years ago next month one of them realized that they had just been shown top secrets and had it within their power to get Trump indicted for not keeping top secrets SECRET and it put the fear of God into them. Hell, Kid Rock says Trump did it with HIM and even HE was smart enough to get frightened. Did they go to the FBI? Meanwhile Trump really DID change HIS story three times yesterday. When he got burned by Bret Baier on Fox last week, Trump insisted about the document referred to in the transcript of the recording, quote “there was no document.” Yesterday he posted only that he was covered by the Presidential Records Act. Then in New Hampshire he insisted he had kind of told Baier there WAS a document. Then to reporters on his plane he said no, he never had a document, just building plans. And golf course plans. And a newspaper story about Iran. And he was showing off. All in one day. Plus Walt Nauta didn't testify because his lawyer decided he needed lots more money to take THIS case. But Rudy Giuliani reportedly pre-testified in an interview with the Special Counsel's staff. Dr. Elizabeth Fowler, Ph.D., J.D., (https://www.cms.gov/about-cms/leadership/center-medicare-medicaid-innovation) is the Deputy Administrator and Director of the Center for Medicare and Medicaid Innovation, at the Centers for Medicare & Medicaid Services (CMS), a federal agency within the United States Department of Health and Human Services (HHS) that administers the Medicare program and works in partnership with state governments to administer Medicaid, the Children's Health Insurance Program (CHIP), and health insurance portability standards. Dr. Fowler has over 25 years of experience in both health policy and health services research. She previously served as Executive Vice President of programs at The Commonwealth Fund and Vice President for Global Health Policy at Johnson & Johnson, where she focused on health care delivery system and payment reform in the U.S. and health care systems and reform in emerging markets. She was also special assistant to President Obama on health care and economic policy at the National Economic Council. In 2008-2010, Dr. Fowler was Chief Health Counsel to Senate Finance Committee Chair, Senator Max Baucus (D-MT), where she played a critical role developing the Senate version of the Affordable Care Act. She also played a key role drafting the 2003 Medicare Prescription Drug, Improvement and Modernization Act (MMA). She also served as Vice President of Public Policy and External Affairs for WellPoint, Inc. (now Anthem), as an attorney with the Washington law firm Hogan & Hartson, and five years as a health services researcher with Park Nicollet Foundation in Minnesota. Dr. Fowler earned her bachelor's degree from the University of Pennsylvania, where she studied the History and Philosophy of Science and Technology, a Ph.D. from the Johns Hopkins Bloomberg School of Public Health, where her research focused on risk adjustment, and a law degree (J.D.) from the University of Minnesota. She is admitted to the bar in Maryland, the District of Columbia, and the U.S. Supreme Court. Dr. Fowler is a Fellow of the inaugural class of the Aspen Health Innovators Fellowship and a member of the Aspen Global Leadership Network.
Attorneys and professors in law David Snyder and Sarah Dadush join the podcast to discuss the role of contracting in ESG, how a conventional approach to writing contracts may not be the best choice, which issues are fixed, and how accountability should be on both the buyer and supplier. ▶️ Contracting for ESG with David Snyder and Sarah Dadush: Key points discussed in the episode: ✔️ Supply chains are doing enough for ESG compliance. David Snyder and Sarah Dadush aim to combat this with more effective measures. ✔️ Policies remain unimplemented if they aren't in the contract. Having a supplier code of conduct written with the assistance of a business lawyer isn't enough to create change. ✔️ Working at an oil refinery helped David Snyder learn the true culprit – organized crime. He wanted human and environmental efforts to be treated the same way as product manufacturing. ✔️ ESG can impact both consumer and investor decisions. The California Supply Chains Transparency Act pushed for full disclosure directed at the customers. ✔️ Focusing only on forced labor leaves out other problems. ✔️ Traditional approaches to contracting ESG don't work, Sarah Dadush says. Not only does it aggravate human rights risks but also increases the company's chances of legal violations. ✔️ David Snyder emphasizes the importance of risk as part of supply chain management and compliance obligations. Lawyers should also play their part in handling clients properly instead of resorting to risk shifting. ✔️ Contracts don't fix all supply chain issues. It all boils down to supply chain resilience. A weaker foundation puts companies in greater danger, especially in times of difficulty like the COVID-19 pandemic. ✔️ Buyers should be responsible when exiting contracts. Contracts have been misused at the height of the pandemic, and consumers are now urging businesses to be accountable for their shortcomings. David Snyder was appointed professor of law at the American University Washington College of Law in the fall of 2007 and was appointed director of the Business Law Program in 2008. During 2021-2022, he also holds a Fernand Braudel Senior Fellowship at the European University Institute (Florence). He graduated summa cum laude from Tulane University Law School in 1991, and he has been a professor of law at Tulane, Indiana (Bloomington), and Cleveland-Marshall College of Law. He has been a regular visiting professor at the law school of the University of Paris II (Panthéon-Assas) since 2012, and has also been a visiting professor at the University of Paris 10 (Nanterre La Défense), Boston University, and the College of William and Mary. In addition, he has taught summer courses at the University of Mainz (Germany). After graduating from law school, Professor Snyder served as a law clerk to the Honorable John M. Duhé Jr. of the United States Court of Appeals for the Fifth Circuit, and subsequently joined the D.C. firm of Hogan & Hartson (now Hogan Lovells). In 2014 Professor Snyder was awarded a MacCormick Fellowship during which he delivered the annual Wilson Memorial Lecture at the University of Edinburgh. Sarah Dadush's research lies at the intersection of business and human rights. Her scholarship explores various innovative legal mechanisms for improving the social and environmental performance of multinational corporations. "There are a few people in the world you can say you’ve known for over 50 years and Donald Dell is one of them." says Our Town host Andy Ockershausen. Donald Dell, Tennis Icon Andy reads a description of Donald Dell from a Washington Post article that pretty much sums up who he is: Arguably the most powerful man in his sport, Dell is a political animal. He was an advance man for Robert Kennedy in 1966 and in RFK's presidential campaign in 1968, and in style and substance he remains a Kennedy man, equally idealistic and well-versed in practical politics. He has Establishment credentials - Landon School '56, Yale '60, Virginia Law '64 - but can wear brass sknuckles with his Ivy League suit. He is polished, sometimes charming, but not bashful about using strong-arm tactics. As a sports agent and founder of ProServ (now known as SFX), he’s represented some of the biggest names in sports such as Michael Jordan, Arthur Ashe, Moses Malone, Stan Smith, James Worthy, and John Lucas . . .In 1972, Jack Kramer and Donald Dell founded the Association of Tennis Professionals (ATP). The bylaws were written in Dell's offices, and he was the first Executive Director. He ran the ATV and was the general counsel for eight year. Donald Dell as a Tennis Player, Advance Man for RFK and Lawyer As the youngest captain ever of the US Davis Cup Team, Donald talks about the early years and how he got started in tennis. He was fortunate to have lived across the street in Bethesda from Edgemoor Tennis Club. “I lived about 50 yards away from the club and I’d play all day long, all summer long.” Andy added that Edgemoor was a hotbed of good players like Fred McNair and Fred Kovaleski. One of the great things about Edgemoor was that they had a rule, if you were a good player - highly ranked, you could get right in without having to wait, so that great players wanted to play there and Donald got the benefit of playing with the best in the sport. Playing championship tennis opened the world up to Donald to associate with movers and shakers which allowed him to take advantage of opportunities he wouldn't have otherwise. He tells a funny story about his experiences as a player in Russia, over the course of 4 years, Donald went to Russia 8 times. He was approached by the CIA to help with the defection of two top Russian players. Just as he was about to close the deal to help one of the players defect, his Russian player came home to find his beautiful wife in bed with the gym teacher. The player pulled a gun out of the night stand and shot the teacher dead. The Russian was sentence to 8 years in jail. The late Robert Kennedy was a very dear friend of Donald's. Kennedy hired Donald as his advance man of his 1968 presidential campaign. Donald was responsible for hiring Rosie Greer and other football players as part of his security detail. Bobby and his wife Ethel loved tennis and Donald played with them on a regular basis and taught him how to hit a backhand. Andy asked about Donald’s decision to go out on his own after his former law firm invited him to set up shop at Hogan & Hartson representing top tennis players. Donald said, “I decided to do my own thing with one other person." "I was really ironically the first tennis agent anywhere in the world January 1970, when I retired from the Davis Cup. . . what really helped me the most was having been a player, and being a winning captain on the Davis Cup Team." Gonzales v. Pasarell, Wooden Tennis Rackets Andy and Donald swap stories about the two day, no tie breaker Wimbeldon match between 41 year old Pancho Gonzales and a much younger Charlie Pasarell. At the time it was the longest match in history of Wimbledon. Donald and Andy continue to discuss the way tennis has changed in the past 40 years. Donald remarked that the game was all different then - equipment, surface, and how the players play, are the difference. The matches were also much shorter.

The explosively talented Welsh footballer John Hartson enjoyed success with Arsenal and West Ham before becoming a striker for Celtic, where he scored more than 100 goals in a glorious five year period. But following his retirement in 2008 he was diagnosed with testicular cancer and was rushed to hospital. Hartson's memoir interweaves the story of his professional success, his harrowing personal battle and the perspective of his pregnant wife when he became ill. Christine Varney rejoined Hogan & Hartson in 1997, after five years in government service, to head the firm's Internet practice group. This practice provides full service assistance to companies doing business globally, including providing advice on antitrust, privacy, business planning and corporate governance, intellectual property, and general liability issues. Christine also provides antitrust, competition policy, and regulatory advice to a variety of companies. Her clients have included such companies as eBay, DoubleClick, Washingtonpost.Newsweek Interactive, Dow Jones & Company, AOL, Synopsys, Compaq Computer, Gateway, Netscape, The Liberty Alliance, and Real Networks. Prior to becoming a federal trade commissioner, Christine was an assistant to the president and secretary to the Cabinet. She was the primary point of contact for the 20-member Cabinet. She was responsible for the overall coordination of several major issues and initiatives between the White House and various agencies. Before joining the Clinton Administration, Christine practiced law with Hogan & Hartson. In addition, she served as chief counsel to the Clinton/Gore Campaign, general counsel to the 1992 Presidential Inaugural Committee, and general counsel to the Democratic National Committee from 1989 to 1992.
