Sonia Winner is the CEO of the Cleveland Museum of Natural History. In July 2018, she became the 10th director of the Museum in its more than 100-year history, dating back to 1920. Since then, she has spearheaded a $150 million reinvention of the institution—reimagining its campus and exhibits to highlight the interconnectedness of life on Earth.Under her leadership, the Museum continues its century-long legacy as one of the nation's top natural history institutions, stewarding over 12,000 acres of protected ecosystems and housing more than 5 million artifacts and specimens. This was a case that Allen round tabled with Ben's breakout medical malpractice group at the PSBR trial college in California last year. After the murder of George Floyd in 2020, many Americans felt a commitment that this time, things had to change. Protests and rallies packed cities, and promises were made to invest in the necessary steps to address inequities faced in Black communities. But for many Black Americans, this commitment rang hollow. According to the F.B.I., nearly 65 percent of the 8,052 reported hate crime incidents in 2020 were based on race, ethnicity, or ancestry bias. And within that category, Black Americans made up more than half of the victims, an increase from 2019. Then in May 2022, a mass shooting at a supermarket in Buffalo targeted a predominantly Black community and its residents. It was a stark reminder about the progress yet to be made against racism in this country, and what it means to be Black while doing exceedingly ordinary things, like grocery shopping. It begs us to ask what freedom, liberty, and justice for all actually looks like for Black Americans in the face of these constant threats and targeted violence.rnrnCrystal Bryant was named Executive Director of the NAACP Cleveland Branch in 2021, launching the organization into a new era of leadership during a critical time. Crystal is an East Cleveland native with strong community ties. Attorneys and professors in law David Snyder and Sarah Dadush join the podcast to discuss the role of contracting in ESG, how a conventional approach to writing contracts may not be the best choice, which issues are fixed, and how accountability should be on both the buyer and supplier. ▶️ Contracting for ESG with David Snyder and Sarah Dadush: Key points discussed in the episode: ✔️ Supply chains are doing enough for ESG compliance. David Snyder and Sarah Dadush aim to combat this with more effective measures. ✔️ Policies remain unimplemented if they aren't in the contract. Having a supplier code of conduct written with the assistance of a business lawyer isn't enough to create change. ✔️ Working at an oil refinery helped David Snyder learn the true culprit – organized crime. He wanted human and environmental efforts to be treated the same way as product manufacturing. ✔️ ESG can impact both consumer and investor decisions. The California Supply Chains Transparency Act pushed for full disclosure directed at the customers. ✔️ Focusing only on forced labor leaves out other problems. ✔️ Traditional approaches to contracting ESG don't work, Sarah Dadush says. Not only does it aggravate human rights risks but also increases the company's chances of legal violations. ✔️ David Snyder emphasizes the importance of risk as part of supply chain management and compliance obligations. Lawyers should also play their part in handling clients properly instead of resorting to risk shifting. ✔️ Contracts don't fix all supply chain issues. It all boils down to supply chain resilience. A weaker foundation puts companies in greater danger, especially in times of difficulty like the COVID-19 pandemic. ✔️ Buyers should be responsible when exiting contracts. Contracts have been misused at the height of the pandemic, and consumers are now urging businesses to be accountable for their shortcomings. David Snyder was appointed professor of law at the American University Washington College of Law in the fall of 2007 and was appointed director of the Business Law Program in 2008. During 2021-2022, he also holds a Fernand Braudel Senior Fellowship at the European University Institute (Florence). He graduated summa cum laude from Tulane University Law School in 1991, and he has been a professor of law at Tulane, Indiana (Bloomington), and Cleveland-Marshall College of Law. He has been a regular visiting professor at the law school of the University of Paris II (Panthéon-Assas) since 2012, and has also been a visiting professor at the University of Paris 10 (Nanterre La Défense), Boston University, and the College of William and Mary. In addition, he has taught summer courses at the University of Mainz (Germany). After graduating from law school, Professor Snyder served as a law clerk to the Honorable John M. Duhé Jr. of the United States Court of Appeals for the Fifth Circuit, and subsequently joined the D.C. firm of Hogan & Hartson (now Hogan Lovells). In 2014 Professor Snyder was awarded a MacCormick Fellowship during which he delivered the annual Wilson Memorial Lecture at the University of Edinburgh. Sarah Dadush's research lies at the intersection of business and human rights. Her scholarship explores various innovative legal mechanisms for improving the social and environmental performance of multinational corporations. The Ohio Supreme Court heard oral arguments on three challenges to the redistricting and gerrymandering of Ohio's legislative districts that would ensure the GOP keeps a veto-proof supermajority at the Statehouse. Curtis Jackson speaks in-depth with Steven Steinglass, professor emeritus from Cleveland-Marshall College of Law at Cleveland State University, to analyze the comments from the Ohio Supreme Court pertaining to drawing legislative districts and whether the plans were drawn within the confines of the Ohio Constitution.
On the 12th episode of Immigration Today! we welcome Dulce Garcia, the Executive Director of Border Angels. Border Angels is a nonprofit organization that advocates for human rights at the U.S. Mexican Border. Their work focuses on attempting to reduce the number of fatalities at the border through direct action such as water drops at the desert to help immigrants battling dehydration along their journey into the U.S and direct humanitarian aid. Dulce Garcia was raised in San Diego and is an undocumented DACA recipient herself. She is a witness of the hardships many immigrants face but despite of this she graduated from UCSD with a bachelor's degree in Political Science and attended law school at Cleveland Marshall College of Law. Since then she opened her private practice in 2016 and has provided assistance to many low income immigrants. Dulce also sued Trump and the administration after the termination of DACA. As a result of those efforts, hundreds of thousands of DACA recipients are able to renew their DACA status. She has received the “Women of the Year” award by Assembly Woman Lorena S. Gonzalez. In this podcast, Dulce recounts her personal journey as an undocumented immigrant growing up near the border in San Diego. She is a business owner, property owner, an attorney, and she pays taxes. Even after 33 years she does not have a path to citizenship like thousands of other migrants in the U.S. She also tells us about her brother's deportation case and how she fought to bring him back. Anissa Patton is an attorney and Child Welfare Law Specialist with more than 19 years of experience providing effective legal representation and assistance to children and families. Anissa's legal career has been dedicated to public service. She has served as an Assistant Prosecuting Attorney, Public Defender, college professor, and advocate for children. Anissa received her J.D. from Cleveland-Marshall College of Law in 2001. While attending law school, Anissa worked as a Legal Intern with the Legal Aid Society of Cleveland and with Cleveland State's Employment Law Clinic. Anissa passed the Ohio bar in 2001, and briefly served as counsel to a burgeoning temporary employment agency.In 2002, Anissa joined the Lorain County Prosecutor's Office as an Assistant Prosecuting Attorney. As an Assistant Prosecuting Attorney, Anissa prosecuted adults and juvenile delinquents under Ohio's compulsory education laws and represented the Lorain County Department of Children Services until 2004.Anissa was admitted to the Georgia Bar in 2005. Shortly thereafter, Anissa joined the Office of the Griffin Judicial Circuit Public Defender and represented juveniles in criminal matters and parents/custodians in Dependency cases. Anissa joined the Office of the Child Attorney in 2006 as a Senior Attorney where she represents the legal interests of children in Dependency cases and on all collateral legal matters related to the dependency cases. In 2018, Anissa received the Hon. Willie J. Lovett, Jr. Award for Outstanding Service to Children and in 2019, Anissa received the Chief Justice P. Harris Hines Child Advocacy Award for Outstanding Attorney from the Georgia Supreme Court's Committee on Justice for Children. Most recently, Anissa was selected by the American Bar Association as the Fearless Children's Lawyer of the Month for October, 2020 because of her advocacy for LGBTQ+ youth in foster care. Anissa enjoys spending time with her family, volunteering in her community, and reading anything written by her favorite author, Stephen King in her spare time.
In 1954 Marilyn Reese Sheppard was brutally murdered in her home in Bay Village, Ohio an upscale suburb of Cleveland. If you take the media’s word for it, her killer was none other than her husband, Sam Sheppard. But the case isn’t as simple as it seems, and even three trials spanning 50 years weren’t able to come to a definite conclusion. In the early months of the COVID-19 pandemic, digital technology was touted as a potential savior. In particular, there was a burst of enthusiasm around so-called digital contact tracing apps, which would track people's movements and interactions and notify them if they had been exposed to COVID. Apple and Google, which together control the operating systems for virtually the entire smartphone market, joined forces and created a standard to help researchers, private entities and governments create contact tracing apps. But despite the early hype, enthusiasm about these apps quickly fizzled, and even today, they remain underdeveloped and rarely used. As part of Lawfare's ongoing Digital Social Contract research paper series, law professors Jane Bambauer from the University of Arizona and Brian Ray from the Cleveland-Marshall College of Law, published a paper titled, "COVID-19 Apps Are Terrible—They Didn't Have to Be." Alan Rozenshtein sat down with Jane and Brian to talk about why contact tracing never played more than a marginal role in managing the pandemic.

On October 20, 2020, the Department of Justice (DOJ) filed its much-anticipated lawsuit against Google. The case is the most high-profile antitrust challenge since the Microsoft case more than 20 years ago. The Ohio Legislature recently passed an innovative cybersecurity law that provides an important opportunity for companies doing business in the state. The Ohio Data Protection Act (ODPA) (S.B. 220) grants an affirmative defense against data breach tort claims to those businesses that bring their cybersecurity frameworks up to an industry standard. Other states’ cybersecurity laws focus on requirements or penalties. The Ohio statute uses an affirmative defense to incentivize companies to improve their cybersecurity practices. There are many open questions about this first-of-its-kind law. Are the industry standards it identifies sufficiently protective? Will the new affirmative defense actually convince companies to enhance their cybersecurity programs? How can businesses qualify for the affirmative defense? How will the ODPA affect data breach tort litigation in the state? Ian Friedman is one of the most sought after criminal defense lawyers in the country, and a partner at the Cleveland based firm Friedman and Nemecek. He joins the show to talk with Rob about the diverse nature of cases that he takes on, including criminal, cyber crimes and white collar manners. He talks about the law needing to catch up with the new crimes we are presently dealing with, and how sexually based charges fall within one of the toughest areas of law. Ian discusses how he and his clients deal with the potential major stigmas and penalties attached, and resources available to people who want to discover more. TAKEAWAYS: [1:04] Based in Cleveland, Ohio, Ian Friedman has served as chief legal counsel on behalf of individuals and entities from coast to coast and as far as Europe, Asia, and South America. In addition to his legal work, he is also an Adjunct Professor of Law at the Cleveland-Marshall College of Law teaching Computers & Criminal Law. [2:38] Despite handling countless murder cases, people look at those that are merely charged with offenses with a hefty amount of judgement and paint the term “sex offenders” with a very wide stroke. To Ian, a sex offender can be many things on a broad spectrum. For example, it can be at 19 year old engaging in a sexual relationship with a girlfriend that is 16, or as far as people exploiting children, or engaging in non consensual physical acts with adults or minors. [4:37] Ian has taught about cyber crime since 2006, and it all changes so fast that it is necessary to talk about present cases in order to even catch up. Cyber crime examples can be online exploitation, hacking, third party intrusions, crypto currency offenses, online stalking and any sort of online financial crimes. He teaches his students to be able to both educate while still showing respect for the bench. [7:49] The Fourth Amendment touches about people’s right to privacy and prohibits unreasonable searches and seizures. This has also shifted and expanded a great deal as more and more cases deal with uncovering things within a people’s computer and search history. [9:53] Misdemeanors could (all jurisdictions are different) be anything from soliciting prostitutes, exhibisionism, etc. These carry very harsh consequences of embarrassment, loss of relationships and work. [13:02] Our laws are not caught up to technology, and we are using dated laws to fit new offenses in. There is a lack of understanding, and Ian believes it’s not always law itself but the sentencing of that law. [17:55] Charges on sexual offending also have one of the highest rates of false allegations because there can be ulterior motives. This stresses the importance of taking into account the motivations behind an accusation. [21:17] When Ian meets with a client for the first time, they are often terrified and mortified. Ian lets them know there is no judgement. He also has set up a network of former clients and family members to help support the new client. Treatment and rehab are not the final step, but more like an important step in the right direction. [30:11] Due to the strong stigma and penalties associated with accusations of this nature, it is so critical to work with people who have expertise in this particular area of the law. Season 2 of The Future of Resolution Podcast kicks off with former American Bar Association president Linda Klein. In this episode, Klein touches on a range of important issues impacting the practice of law, including the importance of diversity in alternative dispute resolution; judicial independence; and attorney wellness initiatives. Klein is a senior managing shareholder at Baker Donelson and a past president for the American Bar Association (ABA), the world's largest voluntary professional association. She previously served as chair of the ABA's House of Delegates, the association's policymaking body. She has also served as chair of the Tort Trial and Insurance Practice Section, chair of the Committee on Rules and Calendar of the House of Delegates, chair of the Coalition for Justice, and chair of ABA Day, the Association's Congressional outreach effort. She is a recent member of the Council of the ABA Section of International Law and also served as a columnist and on the Board of Editors of Law Practice Management Magazine. In 2013, Klein had the honor of being a McGlothlin fellow on the campuses of William and Mary's Business and Law Schools. She delivered the commencement addresses at Atlanta's John Marshall College of Law (2018), Georgia State University College of Law (2017), Cleveland-Marshall College of Law (2017), Pepperdine University School of Law (2016), and Washington and Lee University School of Law (2012). In 2009, Klein was honored with the Randolph Thrower Award for Lifetime Achievement and was named to the YWCA Academy of Women Achievers. In 2004, the American Bar Association honored Ms. Klein with the prestigious Margaret Brent Achievement Award.
Traditional nuisance ordinances are environmental regulations that prohibit things like piling trash in a yard or making loud noises at night. But some ordinances prohibit frequent 911 calls and allow the city to fine the property owner when 911 is called too many times to a certain property. These laws have dire consequences for victims of domestic violence, and they can lead to these victims becoming homeless. When Apollo 11 astronaut Neil Armstrong declared "We came in peace for all mankind" while standing on the moon in July 1969, he wasn't just expressing his personal sentiment. As our guest on this episode of the Sauropodcast will explain, it’s an expression of international space law. The 1967 agreement known as the Outer Space Treaty, signed by the United States, the Soviet Union and more than 100 other nations, requires that the moon and other celestial bodies only be used for peaceful, non-military purposes. The treaty also forbids any government from laying claim to a moon or planet, and says that space exploration must be done to benefit all countries. A lot’s changed since 1960s. Multiple nations, and now commercial companies, are launching spacecraft. More than 1,400 satellites currently orbit Earth. Space tourism, asteroid mining, and lunar and Mars outposts are all on the horizon. All of those activities need regulation, and sometimes the mediation of conflicts. That’s where the field of space law comes in. Our guest, Mark Sundahl, is an international scholar, lecturer and educator on the subject. He’s an Associate Professor of Law at Cleveland State University’s Cleveland-Marshall College of Law. Professor Sundahl serves on various space law advisory and policy-making groups, including the U.S. delegation to the United Nations Committee on the Peaceful Uses of Outer Space, and the Federal Aviation Administration's International Space Policy Working Group. Professor Sundahl also is director of Cleveland State University’s new Global Space Law Center. The center will help train the next generation of space lawyers, formulate laws and policies that promote the peaceful use of space, and assist the growth of the commercial space industry.

Article V of the United States Constitution permits state legislatures to call a constitutional convention to consider amendments to the Constitution. State legislatures have never utilized this procedure. Calls for an Article V Convention have increased in recent years in response to the growth of the federal government.
