Hennepin Fest is a free festival sponsored by the Hennepin Historical Museum. The event presents a roster of local women musicians: Connie Evingson, Annie Mack, Maria Isa and None Above. Co-hosts Mike O'Donnell and Bethany Abele welcomed to the podcast special guest John Crowley, New Jersey State Counsel for Stewart Title Guaranty Company. Among other things, John tracks legislative developments and case law affecting the title arena for Stewart Title, acting as liaison between all business units. He is also head of Stewart Title's CLE programming. John provided several nuggets of advice for title agents and potential insureds, including: Involve underwriting counsel early and often, as document review can take time depending on the transaction's complexity. Include all related files and documents to underwriting counsel and advise as to what the potential issue/concern is. Be flexible with expectations and open to compromise. He also identified some of the key challenges for underwriters, and New Jersey specific challenges, including (i) tax sale foreclosure issues, which have been nationally impacted by the Hennepin case and in New Jersey the Roberto case, both of which dictate how tax sale foreclosures are handled; (ii) New Jersey Tidelands issues; (iii) foreclosure and bankruptcy proceedings; (iv) complex corporate structures, and the underwriting complexities that may result when foreign entities are involved; and (v) various types of fraud. John shared some interesting war stories, including attempts by “train pirates” to gum up big development deals by claiming abandoned railroads are not actually abandoned, seeking payoffs to go away. John is also President of the New Jersey Land Title Association, and explained the role of the New Jersey Title Insurance Rating Bureau, setting rates for title insurance and creating approved forms for transactions. The Association works to protect and advance the multi-billion dollar title industry in New Jersey by monitoring cases and legislation that could impact the industry, working with bill sponsors, lobbyists and county clerks' offices. Mike then interviewed Riker Danzig associate Kori Pruett about a recent case in the Southern District of Florida, where two land parcels were fraudulently transferred by three unidentified individuals. In Tek Grubu Gayrimenkul Franchising Pazarlama ic ve dis Ticaret Anonim Sirketi v. Coretitle LLC, No. 1:23-cv-21026-LEIBOWITZ/LOUIS, 2024 U.S. Dist. LEXIS 181682, at *11 (S.D. Fla. Oct. 3, 2024), Coretitle served as the agent, and was sued for negligence. In the case, the Court looked closely at procedural posture and admonished both parties for failing to adhere to local rules. Key takeaways from this case are: The court emphasized the importance of compliance with local procedural rules, as failure to do so limited the court's ability to assess the facts. Parties moving for summary judgment bear the burden of demonstrating that no genuine issue of material fact exists. In this case, both parties failed to meet this standard due to insufficient evidence and unclear legal arguments. A lack of record evidence and case law to support arguments can result in denial of motions. Properly identifying standards of care and citing relevant law are critical in disputes involving professional duties. This case underscores the need for practitioners to present clear, comprehensive arguments that incorporate relevant legal standards and factual details to enable effective judicial review.

Then we go over the Saddles 100 and 50 mile races in Prescott, AZ where two of our friends and favorite Ohio trail runners Chad Trumbo and Jay Smithberger competed in those races and did very well. We also discuss race resultrs from Cuyamaca 100K, Spooner's Cove 50K, DC Peaks 50, Hennepin 100, Shawnee 50/50, Arkansas Traveller 100, and Yankee Springs Fall 50K. There is a new self-supported FKT on the 1,444 mile Buckeye trail. We take a look at Nedd Brockman from Australia who is trying to break Yiannis Kouros's long standing 1,000 mile record of 10 days 10 hours 30 minutes and 36 seconds. Nedd is 6 days in and 900K deep so he has some ground to make up in the next 4 days. We end the show talking about the Taco Bell 50K race in Denver that Sage Canaday participated in recently. Sounds like you need an iron stomach to get that done. Johnny revisits a 50K that he did with some friends in Columbus where they stopped at multiple breweries throughout the run. There's a young girl from Minneapolis who remains in critical condition Tuesday after being shot over the weekend along with three other children. The minors in question are between the ages of 11 and 13 and were shot while joyriding in a stolen car. The case renews the question about what to do when kids that young are committing serious crimes. The Hennepin County Attorney's Office wants police to refer cases to their office, and says that when there isn't enough evidence to charge, the child could instead be referred to their Youth Auto Theft Early Intervention Initiative. But Minneapolis Police Chief Brian O'Hara says he wants to see those kids arrested and charged.The specifics of this case are unclear, due to privacy laws for children in the juvenile system. But it has renewed an argument between agencies about the best approach to stopping kids from committing serious crimes. To explain, two people from the organization Restorative Justice Community Action, which provides services to youth who have committed crimes in Hennepin and Ramsey counties, joined Minnesota Now. Cynthia Prosek is their executive director and Kara Beckman is University of Minnesota Researcher who works with the organization.

Tim Walz as Kamala Harris' vice presidential candidate, the Minnesota delegation will get preferred seating and a lot more attention than it otherwise would. And Hennepin County Commissioners are planning to take a vote Tuesday on a more modest pay increase after public criticism of its previously proposed 49 percent pay bump. The rise of community violence has become an alarming issue in many areas, impacting the daily lives of residents, law enforcement, hospital personnel, and the overall health of neighborhoods. As these incidents increase, they bring with them a host of health (and life) problems that extend beyond immediate safety concerns. Understanding the causes and effects is crucial for developing effective strategies to restoring peace and stability, and breaking the cycle of community violence. Minnesota senators failed to advance a motion to eventually expel the DFL lawmaker charged with a felony over an alleged burglary this week. The senator charged, Nicole Mitchell of Woodbury, did not appear at the Capitol today. And school board members governing Minnesota's largest district have reached an agreement to avoid disrupting the annual budget process. Three out of six Anoka Hennepin school board members had said they could not vote in favor of a budget that funded things like culturally responsive teaching and equity initiatives.Those stories and more in today's evening update. Anoka-Hennepin school board members reached an agreement early Wednesday to avoid a budget showdown over objections raised by one board member about district equity initiatives. “The budget needed approval so we can keep the basic, fundamental core operations happening,” said Cory McIntyre, the district superintendent. He said the board agreed to consider equity initiatives separately from the budgeting process. Anoka-Hennepin students walk out, defend diversity measures Board treasurer Matt Audette had vowed to vote down the district's 2024-25 budget. In a Facebook post from April 12, he said he and members Zach Arco and Linda Hoekman could not “in good conscience” vote in favor of a budget that funded culturally responsive teaching, social-emotional learning, restorative justice practices and equity initiatives.“It is time to put a stop to the spreading of divisive, one-sided views, training and learning that go against the values and beliefs of many families, students and staff in our community,” Audette wrote.But after meeting more than five hours, McIntyre said board members in the state's largest school district agreed to “decouple” the budget process from the process of evaluating the policies Audette objected to. Instead they will funnel questions about curriculum, programming and policies through committees dedicated to evaluating them.“They're complex topics. They're not easily solved. That takes more conversation and discussion,” McIntyre said. “I think they have a commitment to do it well, and they've kind of, they've delinked it or decoupled that from the actual budget that we need to stay open.”Minnesota districts are required to adopt an annual budget by July 1. This comes after a school board member backed by a conservative parents rights group said he plans to force a budget showdown if the district does not scrap all programs aimed at racial and gender equity. A lawsuit filed Wednesday against Hennepin County says it failed to protect its employees and take action against former sheriff Dave Hutchinson. Current and former employees of the Hennepin County sheriff's office blasted Hutchinson in the lawsuit, alleging he regularly made bigoted comments, and threatened employees' jobs and personal safety.
