She sued him for defamation, and he successfully delayed the litigation through his presidency. Lately though, it appeared that lawyers were negotiating his deposition. The top U.S. military officer today defended the phone calls he made to his Chinese counterpart in the final months of Donald Trump's presidency, saying the conversations were in keeping with his duties as chairman of the Joint Chiefs of Staff. In a written statement, Gen. Mark Milley's spokesman, Col. Dave Butler, said Milley acted within his authority as the most senior uniformed adviser to the president and to the secretary of defense. "His calls with the Chinese and others in October and January were in keeping with these duties and responsibilities conveying reassurance in order to maintain strategic stability," Butler said. "All calls from the chairman to his counterparts, including those reported, are staffed, coordinated and communicated with the Department of Defense and the interagency."  Milley, the chairman of the Joint Chiefs of Staff and the president's top military aide, feared that Trump could "go rogue" after the Jan. 6 Capitol riot, and worried that he could stoke military conflict to cling to power and derail the peaceful transfer of power, Washington Post reporters Bob Woodward and Robert Costa write in "Peril."  Milley was not the only senior Trump administration official worried about Trump's behavior and the potential national security implications. CIA Director Gina Haspel also worried that Trump would attack Iran after he declined to rule out military action over its nuclear program in November, the authors wrote.

President Trump yesterday vetoed a measure that would have cut aid to Saudi Arabia’s war against Yemen, saying that it was an infringement on his authority as President. The Yemen bill passed with healthy majorities in both houses of Congress, but not by enough to override the veto. A redacted version of the Mueller report will be released tomorrow, but Democrats and their media allies already are downplaying the event. House Democrats announced that they will seek an unredacted version of the report on Friday. Meanwhile, CIA Director Gina Haspel apparently told the President that British intelligence officials told her that two children were injured and several ducks were killed in last year’s Novichok attack against a Russian dissident in the UK. There is no evidence, however, that this ever happened. Jim Kavanagh, the editor of thepolemicist.net, whose latest article on both Counterpunch and The Polemicist is "Investigation Nation: Mueller, Russiagate, and Fake Politics," joins the show. The FBI affidavit used to charge Wikileaks co-founder Julian Assange confirms that the US government targeted him for publishing information. Although he has not been charged with espionage, the affidavit, sworn by FBI agent Megan Brown, clearly accuses Assange of violating the Espionage Act and raises fears of a superseding indictment. Brian and John speak with Kevin Gosztola, a journalist for Shadowproof.com and host of the Podcast “Unauthorized Disclosure.” In a major reversal of US immigration and human rights policy, Attorney General Barr yesterday declared that detained asylum seekers who have shown that they have a credible fear of returning to their countries will no longer be able to ask a judge to grant them bail. The move will likely fill the country’s prisons and detention centers for refugees, even though they have been neither convicted of or even accused of a crime. Isabel Garcia, co-founder of Coalición de Derechos Humanos, joins the show. French President Emmanuel Macron yesterday gave a short and solemn speech in the aftermath of the fire that devastated the Cathedral of Notre Dame. He used the speech, however, to draw parallels between the fire and the Yellow Vest protests. Macron had planned the speech for Monday, and it was supposed to be exclusively about the political uprising that has shaken France for five months. Yesterday, Israeli President Reuven Rivlin tapped current Prime Minister Benjamin Netanyahu to form a governing coalition, after a majority of Knesset members supported him. The new government is expected to be the most right wing in Israeli history, and human rights advocates are sounding the alarm that even more restrictions on Palestinian citizens of Israel are imminent. Loud & Clear producer Nicole Roussell spent the week in Israel covering the election there. She had the opportunity to speak with Jonathan Kuttab, a leading human rights attorney in Israel and Palestine. He was born in West Jerusalem, but after the Six Day War, his family moved to the United States. Mohammad Marandi, an expert on American studies and postcolonial literature who teaches at the University of Tehran, joins the show.Venezuelan president Nicolas Maduro left for Moscow this morning, where he’ll meet with Russian president Vladimir Putin. There is a growing trend of people using a feature on the iPhone called AirDrop to send lewd pictures to unsuspecting strangers and its being called “cyber flashing.” It has become such a problem, that a bill was introduced last week by two members of the New York City Council that would punish people who send harassing and explicit photos with up to a year in jail or a $1000 fine. Issie Lapowsky, senior writer for Wired, joins us to discuss the AirDrop problem and how this law would even work. Next, CIA Director Gina Haspel has briefed Senators on their assessment that Saudia Arabia's Crown Prince ordered and monitored the killing of journalist Jamaal Khashoggi, and they were not happy. Sen. Bob Corker said that if the crown prince was in front of a jury, he would be convicted in about 30 minutes. Gregg Hellman, defense reporter for Politico, joins us to discuss how we know the crown prince probably ordered the hit. Finally, microblogging site Tumblr has decided that it will delete all adult content from its platform and it has caused an uproar with the users who flocked to the site for its art positive and sex positive platform. This comes at a time when Tumblr has been removed from the Apple App store for some child pornography found on the service. Zack, Jenn, and Alex discuss the Senate’s historic War Powers vote on Wednesday, the first step toward reining in US participation in Saudi Arabia’s war in Yemen. The US has been supporting Saudi Arabia with weapons and intelligence for years, but the Senate just took a major — unprecedented, in fact — step toward stopping it. On Elsewhere, they run through the UK’s deal with the EU on the terms of Brexit and why Parliament might end up rejecting the deal in December. Zack does a terrible British accent, Jenn manages to repeatedly work the word “omnishambles” into the conversation, and Alex talks about a “garden of unicorns.” References: Alex Ward wrote a great explainer on the recent Senate vote. Jenn paraphrased Sen. Chris Murphy’s reaction to the Senate vote, but his direct quote is here: "I’ve been at this for 3 years, and I am blown away by this.” Zack interviewed Murphy in 2015 and he discussed similar themes. A top Saudi Arabia expert told the New York Times that the Senate vote was an “unprecedented setback” for the US-Saudi alliance. A little nuance to add to Jenn’s point about Germany’s support of the war in Yemen. Directly after Jamal Khashoggi’s death, Germany announced that it would stop exporting arms to Saudi Arabia, but then approved an arms sale anyway. Jenn mentioned that other Western countries support the Saudi-led war in Yemen, including the UK, Germany, and France. Alex mentioned that the senators wanted to hear from CIA Director Gina Haspel before their vote, but couldn’t. Here’s some backstory on that. Jenn walked through a couple of things that did not push us to break our relationship with Saudi Arabia, including  Saudi involvement in 9/11 and the Saudi coalition bombings of school buses. She also offered Vox’s Brian Resnick’s piece about psychic numbing as a possible explanation for the impact that Khashoggi’s murder has had. Senator Cindy Hyde-Smith, a Mississippi Republican, won the special runoff election yesterday, defeating the Democratic candidate, Mike Espy, who was trying become the state's first black senator since Reconstruction. Hyde-Smith will serve out the final two years of Thad Cochran's term and make history as the first woman elected to Congress from Mississippi. This sets the Republican majority in the Senate chamber at 53 to 47 once the new Congress is sworn in, a net pickup of two seats. Do the results in Mississippi provide any additional information about the American political landscape? If so, what? House Democrats chose their leadership today. House Minority Leader Nancy Pelosi carried the vote to be the Democrat nominee for House Speaker, the position she previously held from 2007 to 2011, the last time Democrats held a majority in the chamber. In the upcoming January vote, she must win the support of at least 218 House members. Earlier today, nine Democrats from the so-called Problem Solvers Caucus reached an agreement with Pelosi on rules reforms to advance bipartisan legislation. Those members will now support her bid for speaker. The phony left, represented by the likes of Alexandria Ocasio-Cortez, mouth the right words but then sign on to Pelosi and the rest of the discredited gang. Are Ocasio-Cortez and some of the others engaging in realpolitik or rolling over? Her connection to Bernie Sanders is tainted by his sheep dogging for the Democrats.Opponents of the war in Yemen have picked up momentum heading into a critical Senate vote today on the Yemen amendment, which would end US support for the Saudi-led coalition. In a procedural vote, the Senate voted 55-44 against a similar measure in March, with 10 Democrats voting against it. But five Republicans voted in favor at the time. What's brought about the change in the Senate? It's Friday: that means it's panel time. We'll turn to them to get analysis on the important stories of this week!Federal authorities made an arrest on Friday in connection with the nationwide bombing campaign against outspoken critics of President Trump. The suspect is Cesar Sayoc Jr., 56, of Aventura, Fla. It was not clear whether the authorities were seeking other suspects, or if they believed Mr. Sayoc acted alone. The details surrounding this event are being fairly clearly hashed out. Sayoc has been charged in Manhattan with five federal crimes, including the interstate transportation of an explosive, illegal mailing of explosives, making threats against former presidents, threatening interstate communication and assaulting former and current federal officers. With that said, why is Sayoc not being charged with terrorism? Is US President Donald Trump an aberration, an outlier or the culmination of a history of anger and vitriol?President Trump is considering a major speech on Tuesday to announce a broad crackdown on the southern border. He is expected to use the remarks to outline his plans to fortify the border, including executive actions he is considering to deny entry to Central American migrants and asylum-seekers, and the deployment of hundreds of United States Army troops to aid in the effort. It is being reported that he plans to invoke broad presidential powers to bar foreigners from entering the country for national security reasons — under the same section of immigration law that underpinned the travel ban — to block Central American migrants from crossing the southern border. Trump reportedly plans to put in place new rules that would disqualify migrants who cross the border in between ports of entry from claiming asylum. Exceptions would be made for people facing torture at home. According to American immigration law, people arriving at ports of entry on the United States border have the right to seek asylum, and, if they demonstrate a “credible fear” of returning home, to have their claims processed with the possibility of eventually being granted legal status to stay. Those who do not go to a checkpoint but are apprehended crossing the border without authorization can also make such a claim and must, under the law, be afforded a chance to have their cases heard.CIA Director Gina Haspel, or “Bloody Gina,” as she is affectionately known, briefed President Trump yesterday about her trip this week to Turkey, where she listened to audio purportedly capturing the killing of Jamal Khashoggi, as Saudi Arabia has acknowledged that its agents murdered the dissident Saudi journalist in what Saudi public prosecutors called a “premeditated” operation. That was another change in the Saudis' story. Crown Prince Mohammad bin Salman and his father, King Salman, have both repeatedly assured Trump and Secretary of State Mike Pompeo, who traveled to Saudi Arabia last week, that they had no knowledge of a plot to kill Khashoggi. Trump initially described the Saudi explanation last Saturday as credible. But in recent days he has expressed doubt, calling it “the worst cover-up ever,” although he has not directly pointed the finger at the Saudi leadership. Instead, Pompeo announced that visas held by the Saudis arrested in connection with the case were being revoked, and the White House on Monday dispatched Haspel to Turkey.Megyn Kelly will not return to her 9 a.m. program on NBC, the network said today, as the beleaguered host remains in negotiations over a likely exit from the NBC airwaves. After her time at Fox News, wherein 2013 she argued, "Jesus was a white man, too. It's like we have- he's a historical figure; that's a verifiable fact. As is Santa. I just want kids to know that. How do you revise it in the middle of the legacy in the story and change Santa from white to black?," she then went to NBC and was confused this week about why wearing blackface at Halloween is no longer in vogue. "But what is racist? You truly do get in trouble if you are a white person who puts on blackface at Halloween or a black person who puts on whiteface for Halloween … That was OK when I was a kid, as long as you were dressing as a character," Kelly said.Molly Ball writes at TIME: "Michael Avenatti, the lawyer and possible presidential candidate, caused a stir with his contention that there's only one type of candidate who can beat President Trump. In an interview with TIME published Thursday, Avenatti said the Democrats' 2020 nominee 'better be a white male,' because society affords more credibility to white men than it does others.” Here's another quote from the longer interview piece from Thursday, written by Ball and Alana Abramson: “A run for President would thrust Avenatti into the middle of the party's identity crisis. The Democrats have not been this powerless since the 1920s, and their members have responded by nominating a historic number of women and people of color for the office. But when it comes to the party's presidential nominee in 2020, Avenatti thinks in different terms. 'I think it better be a white male,' he says. He hastens to add that he wishes it weren't so, but it's undeniable that people listen to white men more than they do others; it's why he's been successful representing [Stormy] Daniels and immigrant mothers, he says. 'When you have a white male making the arguments, they carry more weight,' he says. 'Should they carry more weight? Absolutely not. But do they? Yes.'" This week's show opens with Jay's thoughts on the life and presidency of George H.W. Bush. Mike, who like Jay greatly admired Bush, adds that it wasn't long after Bush left office that the GOP took a decisive turn toward a nastier, more in-your-face approach to politics that he thinks was a wrong turn for the party and the country. After that comes a discussion of alleged absentee ballot vote fraud in North Carolina. Both Mike and Jay have concerns about it, with Mike pointing out that this isn't the sort of fraud targeted by all of the Republican anti vote fraud measures of recent years. Mike argues that that's because absentee voting tends to favor Republicans, and the whole vote fraud crackdown has been a cover for suppressing Democratic turnout. Jay disagrees, arguing that in-person fraud has been the initial focus because it's easier to address. He adds that there should be less voting by mail, a position Mike strongly disagrees with, over concerns with unfair barriers to participation. Then it's a look at actions taken by the Wisconsin and Michigan lame duck Republican legislatures to limit the power of incoming Democratic officials. Mike says that this sort of kneecapping of the other party, while done by both sides, is done more by Republicans. Jay isn't so sure, and doesn't really buy Mike's argument that this violates an important political norm. Next is discussion of CIA Director Gina Haspel's briefing to Senators about the involvement of Saudi Crown Prince Mohammed bin Salman in the killing of journalist Jamal Khashoggi. Mike and Jay agree that the evidence seems compelling, but they disagree about what the consequences should be. Mike argues for cutting off all military aid and weapons sales to the Saudis, at least for a while, whereas Jay thinks that might be too damaging to the important US / Saudi Arabia relationship. The show closes with the U.S. / China trade war. Once again, it seems that President Trump has overstated what he accomplished, with Jay pointing out that Trump's injection of so much uncertainty into the trade relationship has been tough on businesses.
