A foundational principle of the U.S. Constitution is the idea that no one is above the law. And yet, the power of the presidential pardon, based on the embrace of the concepts of mercy and amnesty, essentially guarantees that, in fact, a select few are actually not held accountable for crimes they have been found guilty of. President Joe Biden's sweeping pardon of his son Hunter, after repeatedly promising he wouldn't do it, is a case in point. What can the historical use of this awesome power tell us about how we should judge this political inflection point? USA TODAY Justice Correspondent Bart Jansen joins The Excerpt to dig into this complex and politically fraught topic.See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.

Through her story, we unravel the systemic barriers that perpetuate poverty and the transformative power of education and community support. Dr. Beegle's insights challenge us to rethink our approach to poverty, highlighting the critical need for poverty-informed communities and improved communication across social classes.Join us as we explore the transformative power of language and empathy in dismantling poverty barriers. Through Dr. Beegle's work with the Poverty Immersion Institute and insights from successful initiatives like Amarillo College's poverty-informed mindset, we uncover strategies for fostering a culture of caring and empowerment. From training community leaders to equipping non-profits with evaluation skills, this episode provides actionable insights for creating supportive environments where individuals and communities can thrive.Guest BioDonna Beegle grew up in generational, migrant-labor poverty and was essentially homeless the first 26 years of her life. She is the only member of her family who has not been incarcerated. At 15, she left school to get married and start a family. She had six pregnancies and—with emergency rooms as her only access to health care—only two survived. At 26, she found herself with two children, no husband, little education, few marketable job skills, and no affordable housing. With the help of Community Action and a pilot project, she received stable housing and was able to achieve her GED and—10 years later—her doctorate in Educational Leadership—studying poverty, communication, and education. Dr. Beegle brings an insider perspective of poverty as a health determinant combined with 34 years of working with health providers in all 50 states to increase access to health services and break poverty barriers. Since 1989, Dr. Beegle has across the nation with people and organizations who want to assist people in moving out and staying out of the war zone of poverty.  As president of Communication Across Barriers, a consulting firm dedicated to building poverty-informed communities, Dr. Beegle has designed models and curriculum to directly impact people currently in poverty, as well as professionals who want to make a difference for our neighbors. She has authored four books and training curriculum kits, including See Poverty...Be the Difference, An Action Approach for Educating Students in Poverty, Breaking Poverty Barriers to Equal Justice, and If Not Me, Then Who? Send us a textCould society's reaction to Susan Smith's parole bid change how we view abortion?" In this episode of "More Than Medicine," my daughter Hannah Miller (the Host of The Hannah Miller Show Podcast) and I delve into the infamous 1994 case of Susan Smith. As Smith faces parole after 30 years in prison for the deaths of her two young sons, we dissect the public's heated response to her potential release. We then draw a controversial comparison to the actions of women who seek abortions, questioning why societal attitudes towards maternal responsibility differ so starkly in these cases.Next, we explore a provocative argument for equal justice for unborn children, advocating for their right to the same legal protections as any citizen. Using biblical and constitutional perspectives, we compare abortion to high-profile murder cases, proposing that those who perform abortions should face similar legal repercussions. We tackle complex objections, such as pregnancies resulting from rape, and emphasize the importance of a fair judicial system to navigate these sensitive issues, supported by scriptural affirmations of pre-born personhood.Lastly, we shine a spotlight on the inspiring journey of Allison Felix, whose advocacy for nursing mothers at the Olympics broke new ground. From her secretive training during pregnancy to securing landmark sponsorships, Felix's efforts led to crucial accommodations for female athletes. We reflect on the broader significance of her advocacy, celebrating her courage and the collective support from fellow athletes. This episode underscores the necessity of supporting women in sports during pregnancy and motherhood, while honoring Felix's pivotal role in challenging outdated norms. Robert L. Tsai is the author of Demand the Impossible: One Lawyer's Pursuit of Equal Justice for All and Professor of Law and Harry Elwood Warren Memorial Scholar at Boston University School of Law. We discuss the death penalty, legal representation for the indigent, and equality under law.   People do see the flaws in the criminal justice system. They are often aware that aside from major metropolitan areas, public defenders are not well funded. Elsewhere, there is a patchwork of sub-par solutions. All of the discretion lies with the prosecutor, which renders the system unequal. Tsai argues that a public defender movement ought to be revived; racial justice acts need public support; and a lot of work can be done to end the death penalty. Trump trial and Wildwood, New Jersey…BOTH SUCCESSES FOR TRUMP in the same week!. On the trial…It's the END OF A NON-TRIAL TRIAL! If that's all the prosecution has, I wonder how fast Trump will file paperwork for recovery of his attorney fees. The prosecution DID NOT link Trump to any crime. We are about to see the unraveling of all other criminal charges in the broader sense. A pattern has developed that's is more significant. Mr. Biden has managed to SHIFT YOUR ATTENTION AGAIN, with alleged new tariffs against China for automobiles and other goods. However, it was only three + years ago when Biden CANCELLED TRUMP'S TARIFFIS against China, that were in place and working! Biden has used “Geno's 3-D's” again. Biden diverts, deflects, and distracts your attention off of Trump's success in this bogus court case by attempting an 11th hour ‘Hail Mary' by imposing the very same tariffs on China that were working under Trump! James Carville, a seasoned Democrat operative, says “Biden is stuck in a ditch.” How many illegal aliens have have been given Democrat voter registration forms when they illegally crossed the border, along with a debit card, cell phone and other provisions? Pearlette J. Ramos, Ph.D., J.D. is a lawyer, transformational leader, social justice advocate, and entrepreneur with more than 25 years' experience in activism, change and strategic management, and DEI consultation. Born in Youngstown, Ohio and raised in the housing projects, Pearlette's childhood home was poverty- stricken and riddled with substance abuse, domestic abuse and untreated mental illness. Due to the trauma, she fled her parents' home when she was 15 years old. Within twelve months she was pregnant, married and a high school dropout. During her 20s, she struggled as a single mom who worked three jobs at a time just to make ends meet. These challenges prompted her to attend college-then law school school—where she dreamt of changing the laws and systems that disproportionately impacted women and children. Dr. Ramos serves as the senior director for the Office of Justice and Civil Rights for the Washington Department of Social and Health Services, the largest state agency with more than 17,000 employees serving approximately 2 million clients. She also leads Pearlette Ramos LLC as well as Sisters Talk About Race, an Arizona nonprofit she co-founded, which is committed to connecting, educating, and activating women to end systemic racism and ensure justice. She is committed to breaking cycles of poverty, advocating for justice and strengthening the health and vitality of communities. Dr. Ramos is producing her first social impact film, Three (Extra)Ordinary Women, which explores the life stories of three women of color who collectively overcame poverty, abuse, systemic racism, and political occupation as they brave their biggest physical obstacle yet—climbing Mount Kilimanjaro. The documentary uses the imposing Mt. Kilimanjaro as both a physical structure and metaphor for conquering battles that seem insurmountable --like overcoming trauma, ending violence, and ensuring justice. See https://threeextraordinarywomen.com After graduating from Case Western Reserve University School of Law (1995), Dr. Ramos practiced law as a civil litigator prior to attending Saybrook University where she earned a doctorate degree in psychology. Her dissertation, Well-Being: A Study of Attorney Believes, Attitudes, and Perceptions (2012), takes a critical look at the factors that influence well-being among Arizona lawyers. When she isn't cherishing time spent with her two adult daughters, Dr. Ramos contributes her talents to various community organizations including serving as the president of the Arizona Black Bar, vice chairperson of OneAZ Credit Union, and member of the Avondale Neighborhood and Family Services Commission, Arizona Lawyers for Equal Justice, State Bar of Arizona's Council on Minorities and Women in the Law, Phoenix Rotary 100, and the Arizona Center for Civil Leadership (Flinn Brown). ---------- Guiding Growth: Conversations with Community Leaders Join our hosts, Sarah Watts and Ben Kalkman, as we explore the human journey of leaders - their stories of humility, triumph, roadblocks, and lessons learned - as they reflect on how they became who they are today and share stories of inspiration and hope with listeners. The Perilous Fight equips us to understand: — The hard data behind the breakdown of the family and its effects on our society, including poverty, crime, and deteriorating education. — The core biblical beliefs that led our nation into unprecedented freedom and prosperity--and why abandoning those beliefs led to the social decline we see today. — The fresh ideas and public policy options that could reverse negative trends impacting the family while maintaining a balance between constitutional freedoms and governmental involvement. The American Cornerstone Institute (ACI) was founded by world-renowned neurosurgeon and 17th Secretary of the Department of Housing and Urban Development, Dr. Ben Carson. After serving our nation and the American people faithfully for four years, Dr. Carson is ensuring there is an organization fighting for the principles that have guided him through life, and that make this country great: Faith, Liberty, Community, and Life. Dr. Carson has proven through his example and policy making that solutions guided by the principles of faith, liberty, community, and life are effective, and will point our nation toward the common good. Throughout his life, Dr. Carson has broken through barriers and has paved major roads in our political arena, both in Washington, D.C. and in communities across the country, and he's not stopping now. Tsai visited the UW Law Faculty Colloquium to discuss his forthcoming (and fourth) book, Demand the Impossible: One Lawyer's Pursuit of Equal Justice, a historical thriller about the decline of the death penalty adjacent to the career of attorney Stephen Bright, executive director of the Southern Center for Human Rights. Bright argued four Supreme Court cases following the McCleskey v. Kemp ruling in 1987. The ruling declared that, even if the death penalty has a racially disproportionate impact in a state, it does not violate the Eighth Amendment of the U.S. Constitution unless a racially discriminatory purpose can be proved. The disappointing ruling mobilized a group of civil rights advocates, led by Bright, to actually double down on their efforts to fight the death penalty and tough-on-crime policies through the courts. Tsai, who attended Yale Law School, grew up in Port Townsend, Washington, and is now a Law Alumni Scholar at Boston University. Pleasure Muse: Rosa Parks    Tantalizing Trivia  Her future husband took her on a first date to a rally for the “Scottsboro Boys”, nine Black men who were wrongly accused of rape. From that rally she became compelled to activism.  She was educated on civil disobedience during her days at the famed Highlander School in Tennessee under the guidance of the legendary Septima Clark. Later she attended a leadership training run by the famed Ella Baker.  She was a staunch supporter of the labor movement and managed the office of E. D. Nixon the director of the Brotherhood of Sleeping Car Porters and President of the NAACP. Rosa Parks became the secretary of the NAACP in Alabama in 1948.  She functioned as an investigator for the NAACP and helped for the Committee for Equal Justice. She was also the youth advisor.  She learned “daily stretching” from her mother as a child and would later in her 50's develop a daily  yoga practice that she shared with her nieces and nephews.   In the mid 90's she was attacked by an assailant in her home. When the media began reporting this as a failing of the Black community, she pushed back hard by offering that the attack was endemic of the systematic problems she spent her life working on and not that of Black people.  She lived to be 92 years old. Flags across the country flew at half-staff on the day of Park's funeral.    Mirror Work: Find a quiet place to sit. Get comfortable. Let the chair do the work of holding you. Plan to be here for 10 minutes. In that time observe your breath without judgment. Is it shallow? Is it deep? What areas of your body does it flow too? Where could you use more breath? Breathe deeply into those spaces. Luxuriate in the fact that you do not  have to stand, do not have to move. You have been given this moment to sit still and just be. Thank God for that.  Affirmation: I can sit and rest. No need to rush.  I am where God wants to be. I am open to where God wants to take me.  I give grace freely. I receive grace daily.  Give Grace:  A Playlist  In Her Own Words:  “You must never be fearful about what you are doing when it is right.”  “Each person must live their life as a model for others.”  “I would like to be remembered as a person who wanted to be free…so other people would also be free.”  “I knew someone had to take the first step and I made up my mind not to move.” Didn't catch the live recording of today's episode? The truth forces growth and shines bright light into dark spaces, holding people in power to account. At the release of this episode, we hear on every channel discussion regarding “when will the trial of former President Donald J. Trump take place”?Raise your hand if you know a lot about your 6th Amendment constitutional rights. We examine this crucial constitutional amendment, which confers rights that aren't often discussed outside of a courtroom, yet they are of vital importance in defending, protecting and preserving cherished liberties in everyday society.Ratified on December 15th, 1791, the 6th Amendment guarantees a cluster of rights designed to make criminal prosecutions more accurate, fair and legitimate.Rights such as:♦ a speedy and public trial♦ an impartial jury consisting of jurors from the state and district in which the crime was alleged to have been committed♦ to be informed of the charges♦ to confront and call witnesses♦ and to have an attorney present with you. Did you know that it wasn't until 1967 in Klopfer v North Carolina that the U.S. Supreme Court held that the speedy trial clause was applicable to the states through the 14th Amendment?Certainly, all of your rights are important, but the 6th Amendment is crucial, especially should you find yourself thrusted into the midst of the criminal justice system having to defend your life and liberty. The 6th Amendment has been described as the central feature of our adversarial system, but because the Supreme Court has so rarely articulated its meaning, the definition of a “speedy trial” has almost entirely been left to lower courts. Our learning objectives will be to define, discuss and think critically as we dissect the elements that form the foundation of the 6th Amendment, with a special focus on the right to a speedy trial. We shine our investigative journalistic spotlight on:♦ The verbatim language of the 6th Amendment♦ The Federal Speedy Trial Act of 1974♦ Guideposts, milestones and time limits set by the Act♦ As Ter'Rion Dunn celebrated a recent birthday, again, incarcerated, reaching the milestone of 1,281 days held in pre-trial detention, we re-focus the light of the truth on Alabama v Ter'Rion Dunn and the tragic story of Kalif Browder in the state of New York.♦ Rule 48 (b) of the Federal Rules of Criminal ProcedureAnd we are very excited to be able to share exclusive audio from the U.S. Supreme Court in the case of Barker v Wingo, 407 U.S. 514 (1972) with Chief Justice Earl Warren presiding.Much of our listenership comes from people just like yourself who know the value of fact-based, well-researched reporting that demands transparency from the most powerful people and institutions in our country. You can enjoy our podcast at work, home or at play. Charlie welcomes Michael Pack, writer/producer/director of "Created Equal: Clarence Thomas in His Own Words" along with Mark Paoletta who served in the White House as Assistant Counsel to President George H.W. Bush and played a key role in the successful confirmation effort of Justice Thomas—to discuss their new book all about the life and story of one of the truly great Supreme Court Justices in American history. After Michael Pack spent 30+ hours interviewing Justice Thomas and his wife, Ginni, for the documentary that goes by the same name as the book, Pack and Paoletta took those transcripts, and using 95% of new content that is only found in the book, the two detailed Justice Thomas' unparalleled and controversial confirmation process, his positions on precedent, abortion, and how he has become the de facto leader on the Supreme Court to this day. Next up, Charlie welcomes Justin Olson who is running for Senate in Arizona. Olson lays out his case to Arizona voters on immigration, inflation, and runaway spending. In one of the most important races in the country, Olson explains exactly why Sen. Mark Kelly has been hiding in plain sight, allowing Sinema to take the heat for him in hopes that he can remain uncontroversial and unscathed in his attempt to retake the office.  Support the show: http://www.charliekirk.com/support See omnystudio.com/listener for privacy information.
