Speakers: Sean Fitzpatrick, after working for a few years as a prosecutor litigating felony and misdemeanor cases, started his firm FitzPatrick Law, LLC in 2016. FitzPatrick's current practice area is civil litigation focusing on insurance and injury law. FitzPatrick served on the Young Lawyers Division board for years as director and chair prior to his current term on the New Mexico Board of Bar Commissioners. It's a new era that American cities, counties, and states are now facing in how they can address homelessness in law and ordinance. A June ruling from the U.S. Supreme Court in the case of Grants Pass vs. Johnson cleared the way for cities nationwide to enforce bans on people sleeping outside in public places. The ruling generally gives local governments more latitude to address homeless encampments in public places. What does this mean for New Mexico? How are local leaders reacting to this Supreme Court decision?  This week on the podcast, Gabby and Chris are joined by returning guest, Professor Joshua Kastenberg of the UNM School of Law. Kastenberg provides an analysis of the SCOTUS decision and offers perspective on how larger cities are dealing with the issue.  We appreciate our listeners. His last guest from the AGE meeting is David Scieszka, a longevity entrepreneur with a unique background that includes work as a PsyOps specialist for the US Army. David is currently working on Vertical Longevity Pharma, a senolytics company that he spun out from his postdoctoral work. He previously lead multiomics efforts at the biotech startup Norvoc Biosciences. David holds a PhD in biomedical sciences from the University of New Mexico School of Medicine, which he did concurrently with an MBA at the UNM School of Management. In this episode, Dave and Matt give us a peek into the drug development process (TL;DR: it isn't straightforward or cheap), from facing investor skepticism to considering endpoints, dosage, and potential side effects to collecting rigorous preclinical data that will satisfy requirements for U.S. Food and Drug Administration (FDA) approval. They also chat about further opportunities for the drug's use in companion animals, a demographic that would also enable a potentially faster path to FDA approval. Sandra Engel: is a graduate Executive Coach who comes to the field with a background in the areas of law and leadership. She has recently retired from the bench as a criminal judge in Albuquerque, New Mexico where she served her community for over 16 years. She is also a licensed and active attorney, previously serving as an Assistant District Attorney for over ten years and has practiced law in the civil and criminal areas for over 25 years. During that time, she has served as supervisor over divisions/teams, and most recently served as Chief Judge of the Bernalillo County Metropolitan Court, managing a courthouse, and leading a C-Suite with over 350 employees. She has performed as a trainer, evaluator, and resource director for several court and community programs. She holds a Bachelor of Science in Marketing, and a Juris Doctor degree, both from the University of Alabama. She most recently completed her training with Coaching Out of the Box, an executive coaching program that is accredited and certified by the International Coaching Federation (ICF). She also received her certification from ICF as an Associate Certified Coach. She is a Certified Diversity coach, a member of ICF International and her local chapter, ICFNM, and serves on their board. She is involved in both the local coaching community and legal community in a variety of roles. She specializes in leadership/executive coaching, working with many business leaders and executives.Barbara J. Vigil: served on the New Mexico state judiciary for twenty-one years. For twelve years, she served as a District Court Judge in n the First Judicial District and for over nine years as a Justice on the New Mexico Supreme Court. Barbara stepped down from the Supreme Court on June 30, 2021. In August 2021 Barbara was appointed to serve as Cabinet Secretary of the New Mexico Children, Youth and Families Department. On May 1, she left that role to pursue other interests. As a District Court Judge, Barbara presided over the children and family court docket for over 10 years resolving over 16,000 cases. In 2010 she was chosen by her peers to serve for two years as Chief Judge of the First Judicial District Court. During her last two years on the trial court bench, she presided over the civil docket. In 2012, Barbara was elected as a Justice on the New Mexico Supreme Court, where she served as an Associate Justice, Chief Justice from 2014-2016 and as Senior Justice. Throughout her judicial career Barbara strived to improve court processes and procedures for children and families. She worked with community stakeholders to garner state and federal funding for programs designed to help children throughout the state. Barbara has served on numerous boards, commissions, and committees, including the Tribal State Judicial Consortium, the Children's Court Improvement Commission, and the New Mexico Board of Bar Examiners. Barbara was born in Albuquerque and grew up in Santa Fe, New Mexico. She received a bachelor's degree in accounting from New Mexico State University and a juris doctorate from the University of New Mexico School of Law. Barbara enjoys travelling abroad and using her free time to support youth and court improvements. Barbara travels extensively abroad. She maintains a lifelong commitment to public service and does all she can to improve the lives of children and families. Judge Shammara H. Henderson: was appointed to the Court of Appeals in 2020 by Governor Michelle Lujan Grisham. Born and raised in Albuquerque, NM, she graduated from Valley High School. She received a bachelor's degree from American University in Washington, D.C., where she received a full ride with the highly competitive Frederick Douglass Scholarship. She received her J.D. from the University of New Mexico School of Law where she received the W.E. Bondurant Scholarship and University of New Mexico Graduate Fellowship.After graduating from law school, she clerked for Justice Charles W. Daniels at the New Mexico Supreme Court. She started her career as a litigator with the Second Judicial District Attorney's Office. She later became the Associate General Counsel for the Office of Governor. In 2011, Judge Henderson joined the United States Attorney's Office for the District of New Mexico. She successfully tried criminal and civil cases in the United States District Court and appealed criminal cases in the Tenth Circuit. She developed and presented training and outreach programs across the state for law enforcement as well as community organizations and churches. In 2017, Judge Henderson co-founded her own law firm Henderson & Grohman, PC, which joined Freedman, Boyd, Hollander, Goldberg, Urias, & Ward, PA in October of 2018 where she represented clients in criminal, civil, and administrative matters in both state and federal courts at the trial and appellate level.Judge Henderson enjoys spending time with friends and family, traveling, barre, yoga, and rollershaking as well as community service.Judge Brett R. Loveless: Presiding Criminal Judge for the Second Judicial District Court (Bernalillo County) handling an exclusive docket of felony level criminal cases. Judge Loveless took the bench in 2012.Prior to that was a prosecutor in the Bernalillo County District Attorney's Office for approximately 12 yearsPracticed civil law for approximately five years, doing both plaintiff's work and civil defense.1995 graduate of UNM School of Law.

After the relatively wet years of the 1980s and ‘90s, New Mexico's reservoirs started dropping in the 2000s. In cooperation with the U.S. Bureau of Reclamation, two water districts — one in New Mexico and another in Texas — agreed in 2008 on new ways to share water stored in Elephant Butte Reservoir. But New Mexico's then-attorney general, Gary King, sued the federal government, saying too much of New Mexico's water was going to Texas. Texas disagreed and then sued New Mexico and Colorado, alleging that by allowing  farmers to pump groundwater connected to the river, New Mexico wasn't sending its fair share downstream. That landed all three states in the U.S. Supreme Court, where the federal government also weighed in on the issue.  Now, the three states say they've come up with a plan to move forward, and although the federal government hasn't agreed to the plan, federal Judge Michael Melloy, the case's special master, has recommended the Supreme Court approve a settlement. To help us understand what's going on, we invited water attorney Adrian Oglesby onto the show. NMiF Senior Producer Lou DiVizio introduces the podcast this week with headlines from around the state, including the federal government's decision to protect Chaco Canyon and a 10-mile buffer zone from mineral extraction. Gene Grant and The Line Opinion Panel react to the mayor's comments from our exclusive interview and to some of the larger themes from the state of the city address. First, the group responds to Mayor Keller's promises regarding the Gateway Center and his vision for growing the number of affordable housing units around the city. The panel also discusses the work done so far by the Albuquerque Community Safety Department and the mayor's plan to triangulate federal gun-free zones and enforce federal penalties across the city's downtown area.   Gene the panel assess the feasibility and affordability of the economic development projects the mayor is planning. They also react to the mayor's response to the Gladiators turf situation and question whether he intentionally misused city dollars. Finally, the panelists look ahead to a City Council vote that could restructure power at the top of city government and they also grade the mayor's work through his six years in office. NMiF Senior Producer Lou DiVizio introduces this week's podcast with several state headlines, including the decision from prosecutors to drop the manslaughter charge against Alec Baldwin without prejudice. That means charges against the actor can still be refiled. Gene Grant and The Line Opinion Panel assess the first year of recreational cannabis sales in our state. The panelists respond to questions about equity in the cannabis market, tax revenue and industry regulation. Then, the panel dives into several pressing environmental issues impacting New Mexico. Those include a request to extend the license at the U.S. Department of Energy's Waste Isolation Plant, a pending decision that would create yet another nuclear waste dump and historic flooding in the Jemez River Valley.   Finally, Lou speaks with Dr. Larry Leeman from UNM Health Sciences about a new study he'll lead using MDMA to help new mothers break the cycle of opiod dependency. Right now, Dr. Leeman is the medical director at the University's Milagro program, which treats expectant mothers who are addicted. But, Dr. Leeman says methadone and buprenorphine treatments aren't always successful. SpeakersPamela Moore, MA, LPCC, currently serves as a Licensed Professional Clinical Counselor and Director of the State Bar of New Mexico's Professional Programs Group where she educates the legal community on positive health and well-being and assists in providing resources and services to any legal professional struggling with mental, emotional or behavioral issues.  Ms. Moore served as an advisory member to the National Commission on Lawyer Assistance Programs in 2019 and 2020 and is a current member of the Institute for Well Being In Law. Ms. Moore's professional career includes a BS in Industrial Engineering, Masters Certificate in Human Resources Management, Masters in Counseling, license as a Professional Clinical Counselor, and she is on track to become a Professional Certified Coach by the end of 2022.  She has over 10 years of study and experience in self-care and is passionate about assisting, guiding and supporting those that seek to get curious about their life and invite change. Justice David K. Thomson took the oath of office on February 4, 2019, following his selection by the nonpartisan Judicial Nominating Commission and his appointment by the Governor to the New Mexico Supreme Court. Since 2015, Justice Thomson had been serving Santa Fe, Rio Arriba, and Los Alamos Counties as a state trial judge in the First Judicial District.Justice Thomson was born and raised in Santa Fe, New Mexico, and is a graduate of Santa Fe High School. He has an undergraduate degree in Economics and Government from Wesleyan University in Middletown Connecticut. He worked for United States Senator Jeff Bingaman before attending the University of Denver Sturm College of Law and graduating in 1998. After receiving his law degree, Justice Thomson served as term law clerk for United States District Judge Bruce D. Black, District of New Mexico. In 1999 following his clerkship he joined the Office of the New Mexico Attorney General as a litigation attorney, eventually serving until 2010 as Deputy Attorney General. Prior to taking the bench in 2015, Justice Thomson was a sole practitioner admitted to appear in state and federal courts including the Tenth Circuit Court of Appeals and the United States Supreme Court.By New Mexico Supreme Court appointment, Justice Thomson has served on the Uniform Jury Instruction-Civil Committee as chair since January 2016, the Performance Measures Subcommittee of the Chief Judges Council since October 2017, and the Guardianship Reform Implementation Steering Committee since March 2018. Justice Thomson graduated from the National Judicial College in 2010. He teaches legal education courses to judges and attorneys on a number of topics including trial practice, civility, judicial ethics, evidence, and administrative appeals. Justice Thomson is a member of the Executive Committee of the American Bar Association Judicial Division and the American Bar Association Appellate Judges Conference and is the state delegate to the Judicial Division of the American Bar Association.Judge Shammara H. Henderson was appointed to the New Mexico Court of Appeals in February 2020 by Governor Michelle Lujan Grisham, and won her election in November of 2020, becoming the first Black appellate judge and Black woman to hold statewide office in New Mexico. Judge Henderson clerked for Justice Charles W. Daniels at the N.M. Supreme Court.  She then joined the Second Judicial District Attorney's Office. Afterward, she became the Associate General Counsel for the Office of Governor. Later, she joined the United States Attorney's Office for the District of New Mexico, where she successfully litigated criminal and civil cases and appealed criminal cases. Judge Henderson then co-founded her own law firm Henderson & Grohman, which later joined Freedman, Boyd, et al., where she represented clients in criminal, civil, and administrative matters in both state and federal courts at the trial and appellate level. Judge Henderson has also been an adjunct professor at UNM School of Law since 2019. Her hobbies include yoga, barre, roller skating, hiking, and reading.Judge David Murphy graduated from the University of New Mexico School of Law in 2008. In his career as an attorney, he worked for the Public Defender's Office, District Attorney's Office and Attorney General's Office. He was appointed by Governor Lujan Grisham to the Metropolitan Court in 2019, and to the District Court in 2022. He currently serves in the Second Judicial District Court's Criminal Division, where he also presides over the Veterans Court program. Judge Murphy is a member of the Supreme Court's Equity & Justice Commission, and works as Adjunct Faculty for the Law School's Evidence & Trial Practice class. In 2021, he received the Promise Award from the University of New Mexico School of Law's Alumni Association for his service with the YLD and with the Department of Health during the COVID pandemic. Speakers:Annette DeBois graduated from the UNM School of Law in 1982, and immediately joined a small private firm, Paskind Lynch and Dow, where she stayed for 18 years.  She then became the staff attorney for the Chapter 13 Bankruptcy Trustee and worked in the federal system for 11 years.  Her last five years of practice were as an Administrative Hearing Officer for the NM Taxation and Revenue Department.  After retiring in 2013, Annette discovered the joys of free time, and takes advantage of that by travelling, volunteer work, and enjoying the beautiful NM outdoorsJocelyn M. Torres, Attorney at Law: Jocelyn is from New Mexico and has been a licensed attorney, litigator, and mediator in this state for forty years. She is also a proficient writer and has conducted extensive legal and mediation training for the ABA, State Bar, and several other organizations. Jocelyn obtained her BA cum laude in Psychology, MA with distinction in Public Administration/Energy Management and Juris Doctorate Degrees from UNM. Since retirement, she has also worked with the state Judiciary, Legislature, and the City of Albuquerque.Peter Chestnut, Attorney and Counselor at Law: Peter moved to New Mexico after college and became a licensed lawyer over forty-five years ago.  Beginning as a sole practitioner, his practice emphasized Indian Affairs and Water Rights. He served as legal counsel for some Pueblo governments and organizations for decades. He sees lawyers as working to help weave the fabric of society.  His practice accomplishments include work to re-acquire of some Pueblo ancestral lands, negotiate tribal-state gaming compacts, establish laws, negotiate a Pueblo water rights settlement with multiple governments and many other parties, and support Pueblo oversight of federal nuclear waste disposal and monitoring at Los Alamos. His firm has included numerous Pueblo member lawyers for many years, part of his interest in expanding understanding and respect for Pueblo perspective in our larger society. Sen. Martin Heinrich talks with correspondent Laura Paskus about New Mexico's wildfire season, what the future might hold, and the need to professionalize the country's federal wildland firefighting workforce. In the Gila National Forest, the Black Fire ignited on May 13—and has already grown into the state's third largest wildfire in history. Fire behavior analyst Arthur Gonzales, with the Southwest Incident Management Team #5 talks about the conditions fueling the giant fire. "I started this business in 1995, and I've seen a lot of large fires,” he tells correspondent Laura Paskus. “But it is surprising, Laura. It's surprising. And it should surprise everybody. These are unprecedented conditions.” Gonzales also talks about the fire's footprint, the varying levels of fire severity within the perimeter, and what people might expect to happen in the Gila this summer. The Line Opinion Panel reacts to the U.S. Forest Service's decision to pause all prescribed burns for at least 90 days. This week on New Mexico in Focus, The Line opinion panel looks at recent outcomes for big ticket taxpayer items. This past weekend saw the long-awaited first successful suborbital flight by Virgin Galactic. Launched from New Mexico’s Spaceport America, the flight brings the promise of space tourism one step closer. It’s a more than $200 million gamble made by then-Gov. Bill Richardson years ago. Businesses have paid millions into the state’s unemployment insurance fund, which was completely depleted during the pandemic. Now, a legislative report says the state’s Workforce Solutions Department overpaid up to $250 million dollars in unemployment benefits. Even if it’s a much lower number floated by the administration – around $105 million – it’s a stunning amount. The Line debates the problem and the governor’s reaction. The group also discusses a new report that suggests New Mexico is asking oil and gas producers for far too little when it comes to securing money needed to clean up abandoned wells and their infrastructure. This time on New Mexico in Focus, Sen. Ben Ray Lujan joins the program from Washington, D.C. to talk about the federal government’s plans to pay for and expand access to broadband internet service. It’s been a major challenge in New Mexico. Correspondent and Axios reporter Russ Contreras also speaks with the senator about the immigration crisis at the southern border. In March, the pueblos of Jemez and Laguna sued the U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers over a 2020 rule that weakens or eliminates protections for ephemeral or intermittent waterways. The pueblos are represented by the University of New Mexico Clinical Law Program, and according to the complaint, the Trump-era rule “ignores the U.S. Government’s trust responsibilities to Indian tribes and violates the Administrative Procedure Act and intent of the Clean Water Act.” It would also make it harder for pueblos to regulate upstream polluters. Medical mask wearing has a long history that can be traced back as far as the 17th century. During the Flu Pandemic of 1918, cities around the world passed mandatory mask-wearing orders to help prevent spread and protect doctors and nurses from contagious patients. Historians suggest that Americans widely embraced mask wearing as an “emblem of public spiritedness and discipline.” Even our pop culture icons like Batman and the Lone Ranger were celebrated mask wearers…..OK, that’s a bit of a stretch, but you get the point.So, how did wearing a mask during the COVID-19 pandemic become so controversial? Ok, I think we know the reason for this too. So, maybe the better question is: what does the science tell us about wearing a mask? In this episode, Dr. Jennifer Phillips from the UNM School of Family and Community Medicine and Bridget Llanes from Bernalillo County Community Health Council join Dr. Frank to discuss the importance of wearing a mask, the types of masks that are most effective in preventing spread, how often you should clean your mask, and most importantly, what do scientists who study this have to say about wearing a mask to mitigate the spread of COVID-19?

Founder and director, Dr. Sanjeev Arora, makes the distinction so we don’t miss what’s groundbreaking about Project ECHO’s approach. While telemedicine focuses on bridging geographic divides that can separate patients from needed specialists, Project ECHO is on a mission to bridge divides within the provider community itself that prevent medical expertise from being shared and distributed more widely.   With Project ECHO, primary care doctors and others working in underserved, isolated, or small community settings use videoconferencing to advance their skills and ability to handle complex cases because of what they learn from specialists some distance away. The goal is both simple and profound: a “democratization of knowledge” so that patients anywhere can receive the best care from the doctor or health care practitioner they have easiest access to, not the one they don’t.    What began in 2003 as a process for improving access to treatment for people in New Mexico suffering from Hepatitis C, now offers support and learning for 30 different diseases and conditions, impacting patients in some 22 states. A lot of observers believe Project ECHO’s approach to expanding access to specialty care is disruptive in the best sense. UNM graduate student Sam Markwell explores the political, economic and cultural conditions in which the Middle Rio Grande Conservancy District (MRGCD) was established. Markwell focuses on how it has affected pueblo and acequia communities and their claims to water rights within the larger context of change shaping the twentieth century. This lecture explores how the “Conservancy Project” became and remained the MGCSD through the long and ongoing processes of negotiation, contestation and incorporation among rural and urban communities, financial institutions, municipalities and state and federal government agencies. Markwell is a graduate of the UNM School of Anthropology and is expanding on work he did during his time as an undergraduate. Currently his studies focus on the cultural politics of water in the South Valley area of Albuquerque with a special interest in environmental justice. The lecture was cosponsored by the Office of the State Historian Scholars Program, the Historical Society of New Mexico and the Center for Southwest Research.

At the University of New Mexico School of Medicine, his clinical research team discovered the first known function of melatonin in humans.Between 1990-95, he performed the first new US clinical research with psychedelic drugs in a generation.From 1995-2008, Strassman practiced general psychiatry in community mental health and private sectors. He has authored or coauthored nearly 50 peer-reviewed papers, has served as guest editor and reviewer for numerous scientific journals, and consulted to various government, nonprofit, and for-profit entities.
