In Tuesday's episode of Gaslit Nation, titled Is the U.S. an Oligarchy?, Andrea opens with a discussion about the "Claims Adjuster Assassin." However, not all listeners were satisfied with the initial analysis. Many felt that something about the arrest of Luigi Mangione didn't add up and urged her to take a closer look. Always ready to dig deeper, Andrea takes on the challenge, offering a fresh perspective on the case. Is Luigi Mangione the shooter or, like so many across America with similar convictions and grievances, a superfan, one willing to sacrifice for what he sees as a greater cause?  You are free to scrutinize these points and join the conversation with your own analysis, feedback, and corrections. Is America an oligarchy? This debate between Andrea and Felix Salmon, author of The Phoenix Economy: Work, Life, and Money in the New Not Normal, took place over the summer, but was delayed due to Biden dropping out of the election and Kamala Harris taking his place. We're revisiting it this week to assess how well it has aged. America's twelve richest men are now worth a combined $2 trillion. One of them, Jeff Bezos, reportedly interfered with the independence of the Washington Post, triggering a mass exodus after he blocked the paper's endorsement of Kamala Harris in the 2024 election. Another, Elon Musk, is threatening Republicans in Congress—one of the last remaining checks on our political system—warning that they must submit to Trump's White House or face his warchest in the GOP primaries. Musk spent over a quarter of a billion dollars on Trump's election and has been rewarded by being a sidekick President, meeting with world leaders, including Trump's recent call with Zelensky. A report from the nonpartisan Congressional Budget Office this year revealed that “the top 10% of wealthy Americans now control 60% of the nation's wealth, while the poorer half of the country holds only 6%.” America braces for the impact of a second Trump White House, packed with billionaires and a PayPal mafia shadow presidency. Deregulation, monopolies, and tax cuts for the rich will exacerbate America's income inequality crisis and fuel further political unrest. Luigi Mangione, also known as the alleged Claims Adjuster assassin, sparked a national conversation this week in America. For a brief moment, Americans across the political spectrum set aside their differences and united around horror stories of insurance company greed. If we resist getting drawn into Republican-driven culture wars, we have the potential to unite with people from all sides of the political divide against a common enemy. Which of your defense counsel's characteristics really impress you? Could it be an executive summary at the start of a report? Picking up the phone to discuss an issue or ask a question? Better yet - what do they do that you absolutely loathe? We attorneys may not want to admit it, but alas, that list may be longer. It might even get so bad that you explore switching counsel. This episode of “The Defense Never Rests” is dedicated to discussing the “do's” and “don't's” of defense counsel from an adjuster's perspective. This week we are joined by Morgan Dooley, who very candidly shares her likes and dislikes. She holds nothing back and, frankly, it is refreshing. In fact, if you do not follow Morgan on LinkedIn, you should start. Like right now. She is very candid about her opinions on…well…everything. But particularly her assigned defense counsel. Given how much fun we had, we have to believe it will be the last time Morgan joins us on this podcast either! If you handle claims, we are sure you can weigh in on this subject and we would love to hear from you. Don't be afraid to share tips for defense counsel!

About The Duties of the Liability Claims Adjuster

Zalma on Insurance

Explaining the Need for Liability Claims Adjusters https://zalma.com/blog The insurance adjuster is seldom, if ever, mentioned in a policy of insurance. The strict wording of the third party liability policies set the obligation to prove a claim that entitles the insured to defense or indemnity of a claim against the insured by an injured third party. Over a century ago insurers determined that to properly deal fairly and in good faith with their insureds, an insurance claims professional was needed to thoroughly investigate claims made against the insured, work with the insured and a third party claimant to resolve claims without litigation, and properly protect the interests of the insured. Adjusting liability insurance claims requires skill, patience, knowledge of insurance, basic knowledge of tort and contract law, and knowledge and experience as an investigator. To properly and effectively perform the duties of a liability claims adjuster, he or she must be capable of effectively dealing with the following basic obligations: To understand the law of torts as applied in the state where the adjuster works. To understand the law of contracts as applied in the state where the adjuster works. To understand sufficient medical terminology to be able to evaluate claims of injury. To understand the costs to repair or replace damaged real or personal property. To understand how to read and apply the terms and conditions of a liability insurance policy to a particular fact situation developed by his or her investigation. To understand how to thoroughly investigate all claims assigned. To conduct an investigation of every claim assigned fairly and in good faith with an intent to find coverage for the loss presented by the insured. To be able to effectively, fairly and in good faith negotiate with claimants and lawyers to resolve bodily injury or property damage claims asserted against an insured. To ascertain that the insurer pays promptly all claims the insurer owes under the contract. To resist, and recommend against payment of all claims the insurer does not owe under the contract of insurance. In the United States, the average adjuster is a 22-year-old graduate of a liberal arts college who has little or no training sufficient to allow him or her to fulfill the obligations imposed on them as a representative of an insurer. --- Support this podcast: https://anchor.fm/barry-zalma/support

The Third-Party Liability Claim https://zalma.com/blog See the full video at https://youtu.be/Ia5UQlvS758 The investigation of a liability insurance claim is conducted to fulfill the promise made by the insurer to defend and indemnify the insured in the event of a contingent or unexpected loss resulting in the injury to person or property as a result of actions of the insured. To fulfill the promises made by the policy insurers must establish a professional group of insurance adjusters who are competent investigators and insurance claims people. The adjusters, at a bare minimum, with regard to third party liability claims, must be capable of fulfilling, at a minimum, each of the topics that follow. Read the Policy Establish Coverage Read the Loss Notice Meet with the Insured and Witnesses Once the adjuster has completed this basic preparation by confirming coverage, reading the policy and reviewing the loss notice, he or she should arrange to meet with the insured and witnesses. The adjuster should explain to the insured that the policy requires the insured to cooperate and assist the insurer in completing a thorough investigation of the claim being made against the insured. The explanation should include that the insurer, in order to provide the best service possible. It is the adjuster who acts in good faith on behalf of the insurer to its insureds. The insurer hired the adjuster to help the insured protect himself or herself from claims by the third party claiming injuries as a result of the negligence of the insured. The adjuster must also explain that he or she cannot provide the defense alone. The adjuster needs the assistance of the insured and is present to help the insured obtain the defense needed. --- Support this podcast: https://anchor.fm/barry-zalma/support

This episode answers the common questions behind the pay of an auto damage appraiser or independent auto claims adjuster. Today's episode is brought to you by Badger Mapping. Check it out HERE The Independent Truth Behind an Independent Appraiser or Claims Adjuster Salary Earning a living, making the cash, bringing home the bacon, and making it rain are all different ways to say, "making money." It's why we do what we do or why we are interested in doing something different. People want to know before they get involved in a new career, job, or even helping out a buddy, "what will I get paid?"  In this post I'm going to walk you through the “independent truth about the pay of an auto damage appraiser and independent auto claims adjuster.” AVG per year of a Claims Adjuster $63,000 The average per year is in the ballpark of sixty-three thousand dollars a year, which is a good income for most adjusters, but this is the average and not where you will start out. Also. the big thing to realize about being an independent adjuster or auto damage appraiser is that you own your own business. To many adjusters this may be a realization, but it is an essential realization to have. You, as an IA, are a freelancer, and you are payed in the same manner as a freelancer, per piece. There is no salary and no guarantees. Pay Type – Per File (or per piece) There are exceptions, such as catastrophic per day pay, but for the most part we are paid on a per file basis. Just like a graphic designer is paid on a per piece or per project basis, independent adjusters and appraisers are paid the same way. Pay Amount - $20-$80 per file Currently, the per file basis is on a scale and starts at $20, for photo's only working for companies like WeGoLook, and goes to $80 working for high end independent auto damage appraiser companies like, IA Net. The responsibilities and expectation raise with the pay. Starting out you can expect to make $20-$60 per file, depending on whether you are completing the industry standard estimate, or just taking photos. What You Are Getting Paid For The major tasks you must complete to get paid on a file are, Setting an Appointment with an Owner of a Vehicle Inspecting the Damage Vehicle Driving to the Owners Chosen Location Documenting Damage with Photos (get the Guidelines for Required Photos HERE) Documenting Damage with Notes Create an Industry Standard Estimate using Audatex, CCC One, or Mitchell Software Upload Estimate, Photos, Notes, and Estimate Data to Company Portal Complete Any Revisions or Supplements that May Arise Supplements are a request from a repair facility for supplemental or additional repair operations and parts that were not included on the first estimate. As an auto damage appraiser you must reconcile these supplement requests and complete a second upload. Under most circumstances you are not paid for supplements and there are times you must re-inspect a vehicle a second time once it goes to a repair facility due to questionable damages without getting paid. Delay in Pay One of the least likeable things about being an IA, is the delay in pay. What you complete in a month, is then typically paid to you on the 15th of the next month. I've had worse pay schedules, but that now seems to be the normal pay cycle. That's 45 days from first claim to getting paid. If you are working full time during those 45 days it can be a lot of expenses you may need to compensate for. Some IA companies shorten the pay cycle, but this is the typical pay period. Just be aware that is how this operates. Pay Hasn't Changed in Decades Another bummer is that this industry pay is stagnant. As inflation has skyrocketed in the past 20 or so years, the pay per file and per year has barely risen for the IA, in fact its slid backwards. The industry pay hasn't climbed, but the expectations of the tasks that must be completed has gradually risen. With technological changes in the industry, the price will seemingly continue to go down and the skill needed to complete a claim will be easily acquired. This is a negative and a positive. The big negative is the industry HAS NOT admitted that they need to adjust their expectations. What was once a highly skilled career is now an entry level position. These factors are chasing out the skilled appraiser's due to frustration of higher expectations, less pay, more technology, and for some age. This is a positive for a newcomer, if the industry comes to accept that this is an entry level position (based on the pay) and therefore should be entry level expectations with minimal experience requirements. The opportunities are immediate and HUGE for newcomers to the scene who can quickly adapt and survive in a changing insurance environment. But the obstacles sometimes feel equally as huge to people who have not acquired any experience. Is It Worth It? My Numbers and Experience I have done many different things in auto damage appraising and adjuster, but at the peak of my local claims career I earned over $80,000 doing local claims only. This was me busting it 5 (possibly 6 days a week) and putting 80,000 miles on vehicle that year. My taxable “income” was less than $40,000 thanks to the mileage and other deductions. (I'm not good at taxes don't get advice from me, but I missed a lot of deductions I highly recommend using MileIQ or a similar app for mileage tracking.) I earned a solid living, running my own appraisal company, fed my family. Was it worth it? I believe it was. I believe the average income of $60,000 is the right mark, can you get rich by doing local, daily claims? NOPE. Can you have a job and earn a living while enjoying life? YUP. Obviously, you can do things to increase your income as you get experience, catastrophic adjusting, heavy equipment, property etc. but you can earn $60,000 within a few years of starting your career as an auto damage appraiser. How I see it, it's quicker and cheaper than taking four years of college and hoping to find a job. It's not guaranteed, but it just might be worth for you if it's something you want to pursue. That's my independent truth behind the pay of an auto damage appraiser. Have more questions? Email me Chris@IAPath.com Want training on how to do the job I described above?
