Send us a textToday, we're going to talk about formality and how it's keeping your funding stuck and it's keeping your superfans from even finding you in the first place. Very often organizations come to me with a growth goal, whether it's revenue growth, whether it's programmatic, whether it's talking to the same donors and same followers online – and I often find that their efforts feel very stale and engagement is very low. When I audit their current efforts, I look at what they are doing and notice time and time again that it's often very formulaic, very safe and very similar to other organizations. It falls in the bucket of what we call “best practices.” Sometimes formality feels like a necessity, but what it does is create a barrier between you and your supporters. They're not seeing that you're for them so they're not magnetically attracted to your stories, to your fundraisers, to your events, because it just seems kind of bleh. This is a huge symptom of you being in what I call the Zone of Indifference. ACE American, in which a Delaware court held 3M could not credit $372 million it paid in defense costs against self-insured retentions in legacy CGL policies issued to its subsidiary, Aero Technologies, before its aquisition. The hosts discuss the implications of non-market language included in those policies – which specified that the self-insured retention could not be satisfied by payments made on Aearo's behalf – and steps the insured might have taken to avoid this hyper-technical coverage defense that seemingly ignored the reality of corporate structuring and would have required 3M to engage in the “pointless formality” of transferring money to an Aearo bank account in order to satisfy its self-insured retentions. I've been—well, the whole point of doing these transmissions on my own is that it's my time, my words, my choice to tell you what I want. By that nature, I've been wanting…privacy, I guess. Which is silly, maybe. Wanting privacy from one person so I can speak to the whole world, whatever's left of it. But it—well, it doesn't have to make sense for me to feel it.  And even if it so often feels like I'm just talking to myself, that I'm just speaking thoughts out loud and no one hears them, maybe there's something to be said for actually saying these things to people. For letting some of those inside thoughts out.  Harry told me—well, that she's started to enjoy being called Harry. How's that for a surprise? Over months of hearing my transmissions, she felt like—she said it felt like forgiveness, every time I called her that. Like I must be important to her still if I was bothering to give her a nickname, to give her some space in my head as someone unique.  “Some space”—like she doesn't know she's consumed entire sections of my thoughts. And for once, I turned the question back on her—why she always calls be Abigail instead of Abi if nicknames are supposed to be a sign of affection. Seems like maybe she was just being hopeful in assuming what it meant for me, given that she doesn't seem to abide by that rule.  Except, well, turns out it was just another way of keeping her distance. Formality as the bricks in the wall between us.  She's started calling me Abi since she got here. She's even called me Whiskey a few times. I'm not sure what to do with that.  [click, static]

Aussies are a casual people.  They prefer informality and being chilled, to stiff interactions in business or otherwise.  They can't handle silence and always feel the need to inject something to break the tension.  Imagine the cultural divide when they are trying to sell to Japanese buyers.  Japan is a country which loves formality, ceremony, uniforms, silence and seriousness.  Two worlds collide in commerce when these buyers and sellers meet.  My job, when I worked for Austrade in Japan, was to connect Aussie sellers with Japanese buyers.  I would find the buyers and then try to find the Aussie suppliers.  I noticed some distinct cultural differences in the sales process. It was always better when the Japanese buyers didn't speak English.  This stripped out the ability of the Aussies to directly communicate with the Japanese buyers.  You would think that was a disadvantage, but in fact it was the saviour in a lot of cases.  Unable to access their own language in direct communication with the Japanese buyer, they were forced to give up on some mainstream linguistic idiosyncrasies of Aussie interactions. Formality is a given in business in Japan and when, as the seller, you are forced to communicate through an interpreter, you are reduced to a staccato flow of thoughts and ideas.  There is a delay in the communication and the Aussies had to sit there and wait to hear what the buyer said. They were forced into a more formal style of interaction which prevented them from free styling.  This was good, because the Japanese buyers prefer the more formal approach. When the buyers could speak some English, the Aussies ran riot.  They were freed from the chains of formality and immediately lapsed into casual interactions, with which they felt more comfortable.  Humour is a big part of the Aussie male culture and they bring it with them wherever they go, including to the very much stiffer, buttoned up Japanese business world. The problem is you have to be another Aussie to get in sync with the humour.  Self-depreciation is part of Japanese culture too and here it is more about being humble rather than putting yourself down.  Aussies are also pretty humble people and self-depreciation is a male signal to other males that you are not trying to get above everyone else and that we are all equal.  This reaction against the English class system in Australia has made fairness and equality basic building blocks of the culture down under. The problem is self-depreciation is very hard to translate.  When we speak foreign languages, we are constantly translating what is being said in the other language into our own.  Japanese buyers always had trouble trying to get the point of the self-depreciative attempts at humour by the Aussies.  When it bombed, did the Aussies regroup and go in a different direction?  No.  They just doubled down harder to try to make the point, which meant they just kept digging a deeper hole for themselves.  Hint to the wise, when selling in Japan be humble, but don't make self-depreciative remarks about yourself – it won't land the way you want it to land. Sardonic humour is a close cousin to the self-depreciative remarks.  We Aussies got this from the English, because they love sardonic humour too.  Again, it is very hard to translate and for Japanese to understand.  Japanese communication is rather circular and vague. Sardonic humour is angular.  You make comments at an angle to what had been said and hit hard on that angle to make a dark point, which is witty. Japanese buyers are fabulous at never making a direct point if they can avoid it, so no angles to leverage off.  I notice this with my Japanese wife when I say something sardonic and it just goes absolutely nowhere.  They don't have that angle in their own language, so it is a hard one to grasp in a foreign language.  Hint number two: forget attempting sardonic humour, because only you will get the joke. Sarcasm is a close relative to the sardonic humour category. Aussie male culture means growing up under a constant barrage of sarcastic remarks and one-upmanship.  You have to learn how to be tough and take it and how to hand it out, to defend yourself.  The speed of the riposte and the lacerative edge to the comment are being judged as a sign of wit and intelligence.  No one gets sarcasm in Japan, in my experience.  Trust me, I have tried it many times, only to see it fall as flat as a pancake. Hint number three: remove all efforts at sarcasm with Japanese buyers, they simply will have no idea what you are talking about. Irony is another Aussie favourite in the humour stakes.  Like sarcasm, we males grow up navigating our way through ocean waves of irony smashing into us all the time.  It requires a very high level of understanding of the language and the cultural context.  Most Japanese buyers just don't have strong enough English to even get close to understanding the point of the ironic comment. There is also an edge, a sharp blade attached to the irony too, which is usually used to wound others in Aussie male culture.  Japan is about harmony and getting on together, so there is no need for irony in their culture, so it is a totally alien concept.  It sounds like a mean comment to a Japanese person and doesn't create a good impression.  Aussie males may salute the cleverness of the biting ironic comment and brush it off as a flesh wound when on the receiving end, because they have grown up with this verbal street fighting. However, for Japanese it doesn't come across well.  Hint number four: no ironic comments to the Japanese buyer because you will look like a mean, nasty person. If you want to be humorous, become a professional comedian.  If you want to sell something to Japanese buyers, be charming, nice, cooperative, considerate and honest.  You will do much better that way.

How much religion among many members of churches consists of nothing but church rituals! They belong to their church. They are baptized, married, buried in at the church, and preached to on Sundays by her ministers, but the great doctrines of truth have no place in their hearts and only a little influence on their lives. Is the religion of these people real Christianity? No, it is Churchianity – and nothing more! If your religion is real and has been given by the Holy Spirit, it must be in your heart. It must sway the affections. It must lead the will. It must direct the tastes. It must influence the choices and decisions. It must fill the deepest, lowest, inmost seat in your soul. Is this your Christianity? Real Christianity will cause a person to glory in Christ as the Redeemer, the Deliverer, the Priest, and the Friend – without whom he would have no hope at all. It will produce confidence in Him, love toward Him, delight in Him, and comfort in Him as the Mediator, the Food, the Light, the Life, and the Peace of the soul. This Christianity will produce in the person who has it repentance, faith, hope, love, humility, spirituality, kindness, self-denial, unselfishness, forgiveness, temperance, truthfulness, brotherly kindness, patience, and forbearance. Is this your religion? About the Author John Charles Ryle (1816-1900) graduated from Eton and Oxford and then pursued a career in politics, but due to lack of funds, he entered the clergy of the Church of England. He was a contemporary of Spurgeon, Moody, Mueller, and Taylor and read the great theologians like Wesley, Bunyan, Knox, Calvin, and Luther. These all influenced Ryle's understanding and theology. Ryle began his writing career with a tract following the Great Yarmouth suspension bridge tragedy, where more than a hundred people drowned. He gained a reputation for straightforward preaching and evangelism. He travelled, preached, and wrote more than 300 pamphlets, tracts, and books, including Expository Thoughts on the Gospels, Principles for Churchmen, and Christian Leaders of the Eighteenth Century. Ryle used the royalties from his writing to pay his father's debts, but he also felt indebted to that ruin for changing the direction of his life. He was recommended by Prime Minister Benjamin Disraeli to be Bishop of Liverpool where he ended his career in 1900.

If there's any part of my overall vibe, and of season 4 of OMG in particular, that you find a bit annoying or immature or naïve or whatever, I bet it's that I've got this general optimism that the business of corporate leadership can be more fun and less formal. Actually, it's not just that it CAN be more fun and less formal, but also that it SHOULD be! As in, the formality of the status quo is working against good governance. I really, sincerely believe it. Trust me, I'm not trying to undermine the seriousness of the jobs of executives and directors. This is not a joke to me, and there are very real and important consequences to doing the job poorly. But honestly, that just makes me more confident that we're on to something here. We have absolutely no evidence suggesting that the typical solemn formality of boardrooms is any good. And we have plenty of evidence from the science of decision-making that we should be experimenting and socializing and finding ways to create space for a diversity of approaches and perspectives. So, I suppose what I'm saying is that a defining characteristic of a great board is its willingness to let go of formality – even in the environment of a regular board meeting – when doing so will serve the decisions at hand. Do me a favour, start thinking now about how you might cultivate the conditions for a bit of play or wonder or experimentation at your next board meeting, even just for a few minutes.

Though you have received an anointing from the Holy One, this will not lead you to abandon assembling with the Lord's people to where they lie down in the green pasture of life where there is no spirit of dead “formality”.  Your form of godliness will be accompanied with power, you who have received the ingrafted Word. The spirit of dead formality can assume a form of sound words and plainness, etc., and, under this disguise, effect much evil and deceive many. This evil spirit of deceit, hypocrisy and formality has done more mischief against the Truth than all open opposition and persecution could ever do. This is the way and work of the spirit of deceit. If he cannot prevail by direct opposition and persecution, he will use the words and profession of truth, and appear and work under that form. Thus, he causes many to conclude that Friends are just like others, and their way is just like other ways. We see evil among them even under the very form of godliness. This has caused many to take up a latitudinarian and relativistic spirit and say that all men are liars, and that all religion is a cheat. Those who once knew the way of the Lord and then gave way to the spirit of deceit, hypocrisy and formality are more abominable in the sight of the Lord than pagans or profane unbelievers. False brethren are most dangerous, and hypocrites are most odious in the sight of God and all good men. So, my dear Friends, this one thing I would have you establish as a foundation in your mind and fully understand that the spirit of satan working under the form of godliness is that which has been, is, and will in the form of godliness, be the greatest destroyer and opposer of the power of God. With dead formality and under the form of godliness, the destroying form of apostasy entered into early Christianity, and soon obscured the light of the glorious gospel. And the old adversary effected the apostasy by turning into a professor of Christianity which he could not bring to pass with bloody persecutions and open opposition. Chapter 6: Writing and Formality Requirements. Statute of Frauds. The Statute of Frauds is a legal principle that requires certain types of contracts to be in writing to be enforceable. Law students should explore the Statute of Frauds and its various requirements: a) Covered Contracts: The Statute of Frauds typically applies to contracts for the sale of real property, contracts that cannot be performed within one year, contracts for the sale of goods over a certain value, and promises to answer for the debt of another. b) Writing Requirements: Contracts subject to the Statute of Frauds must be in writing or evidenced by a written memorandum that includes essential terms and is signed by the party to be charged. c) Exceptions: Certain contracts, such as those fully performed, admissions in court, and part performance of oral real estate contracts, may be exceptions to the Statute of Frauds. Exceptions to the Statute of Frauds. Law students should be aware of situations where contracts can be enforceable despite the Statute of Frauds: a) Partial Performance: In some jurisdictions, part performance of an oral contract for the sale of real property can remove the contract from the Statute of Frauds if it demonstrates a clear and substantial commitment to the contract. b) Admission: An admission by a party in court or in writing acknowledging the existence of an oral contract can remove the contract from the Statute of Frauds. c) Promissory Estoppel: In certain cases, the doctrine of promissory estoppel can make an oral contract enforceable if one party reasonably relied on the promise to their detriment. Parol Evidence Rule. The parol evidence rule limits the admissibility of extrinsic evidence to modify, contradict, or add to the terms of a fully integrated written contract. Law students should explore this rule and its implications: a) Integration: Contracts are either fully integrated (intended to be the complete and final expression of the parties' agreement) or partially integrated (allowing for supplementary terms). b) Exceptions: The parol evidence rule does not apply to evidence related to fraud, illegality, duress, mistake, or conditions precedent. Landmark Case: Masterson v. Sine (1968). The case of Masterson v. Sine provides insight into the parol evidence rule. In this case, the court held that the parol evidence rule did not prevent the introduction of extrinsic evidence when the contract was partially integrated and the evidence related to a condition precedent. Conclusion. Understanding the Statute of Frauds and the parol evidence rule is crucial for law students to interpret and enforce contracts effectively.
