Justice David W. Ellis has served on the Illinois Appellate Court for the 1st District for nearly 10 years. But readers may know him better as author David Ellis, writer of more than a dozen legal thrillers. Ellis had enjoyed creative writing as a youth, he tells the ABA Journal's Lee Rawles in this episode of The Modern Law Library. But during his college and law school years, he was focused solely on his legal career path. It wasn't until he had been in practice for a few years that this changed. During a vacation at the beach, he suddenly decided that he was going to write a novel—and once that goal was set, he worked relentlessly towards it. And in 2002, he won a prestigious Edgar Award from the Mystery Writers of America for that first novel, Line of Vision.  Both branches of Ellis's career have seen tremendous returns. He made national news in 2009 as the prosecutor of the impeachment of Illinois Gov. Rod Blagojevich before the state senate. He was the youngest-serving justice in 2014 when he joined the Illinois Appellate Court for the 1st District, which serves Chicago and Cook County. And along the way, he published 11 novels, including the four-book Jason Kolarich series. He was a finalist for the ABA Journal-sponsored Harper Lee Prize for Legal Fiction in 2012 and 2013. He has also co-written nine books with James Patterson, the latest of which (Lies He Told Me) will be released in September. In this episode, Ellis and Rawles discuss his July release, The Best Lies. The germ of an idea that became The Best Lies started off with the notion of a main character who was a diagnosed pathological liar. When the book opens, Leo Balanoff, a criminal defense attorney in Chicago, has just been arrested for murder. Police have collected DNA and fingerprints at the scene that are a match for a college-era bar fight Leo was charged for, and the victim had an ugly history with one of Leo's clients. Over the course of The Best Lies, twists and turns across multiple timelines and through multiple points of view begin to reveal what really happened. Ellis weaves a tale combining corporate espionage, violin concertos, police corruption and the Estonian mob.  Ellis also discusses his writing process, his 3:30 a.m. wake-up time, the similarities in his creative and legal writing, and how his judicial ethics concerns sometimes impact his editorial decisions.

Natural persons are such as the God of nature formed us; artificial are such as are created and devised by human laws, for the purposes of society and government, which are called corporations or bodies politic. 1 Bl. Com. 123. What's in a name? Or more specifically your surname, which has actually only existed for a few hundred years. So how did people survive for tens of thousands of years only their first name...their Christ name—but no last name? And why did it all change around the 1500's, which not so coincidentally also happened to be the same period in which the banking oligarchies began to expand their presence across Europe. Could it be that our Surname is not real our name at all, but the name of something artificial. A legal construct, so to speak, that can be taxed, fined, drafted and made responsible for the trillions of dollars of DEBT that the banksters have loaned into existence. In Episode 52 we dive into the rabbit hole once more to uncover what the all caps last name really means and how we can to posses it. In part one we cover the history of the surname and make sense of why it was introduced to begin with. Then in part 2 we reveal how it is being used to turn the natural living person into an artificial legal fiction, and how we unwittingly accept this through the adoption of the Roman Cognoman...aka, the Surname. This might be my most personal conversation to date.  In this episode, I sit down with Attica Locke. In case you don't know, she is the author of five books; her latest novel, Heaven, My Home, is the sequel to her Edgar Award-Winning Bluebird, Bluebird, and it is also a New York Times Bestseller. Her novel Pleasantville was a winner of the Harper Lee prize for Legal Ficton, her second book, The Cutting Season, was the winner of the Ernest Gaines Award for Literary Excellence, and Black Water Rising, her debut novel, was nominated for an Edgar Award, an NAACP Image Award, an LA Times Book Prize, and was shortlisted for the Women's Prize for Fiction. Attica is also a screenwriter and TV producer, with credits including Empire, When They See Us, and Little Fires Everywhere, for which she won an NAACP Image Award for screenwriting. She also happens to be my sister. Together, we co-created and adapted From Scratch, but it was her role as showrunner and as sister that made our whole series happen. Guest Bio: A former fellow at the Sundance Institute's Feature Filmmaker's Lab, Attica Locke is an author, showrunner, screenwriter and producer, with credits that include Empire, When They See Us and the Emmy-nominated Little Fires Everywhere, for which she won an NAACP Image award for television writing.   Most recently, she served as showrunner, an executive producer, and co-creator, alongside her sister Tembi, for the Netflix series From Scratch. I've seen people trying all sorts of things but never have it accepted they just get ignored.My response:Could this be because the system can only recognise its own creation, the legal fiction, and thus dead things? Do you need the dead system to recognise you as a living being? Could the dead system be convinced somehow that its fiction, its creation, is now actually alive?  If the legal fiction, the person, can only ever be a legal fiction (owned by them), is the answer not in trying to insist it should never have been created nor trying to claim that it is yours, but instead in learning how to use it as little as possible and interact with the system that requires its use as little as possible, as hard and challenging as that may be? If the system created the dead legal fiction are you obligated to use it 24/7? Or just in transactions with the enormous dead system?  There is a price to pay for using their name, their person in their system, and the price is getting bigger all the time. Would you eventually be able to look for and find a growing number of ways to conduct yourself outside the dead system, just living your life interacting with other living beings?  Helping to educate others who are open to the idea?  Can you learn how to notice when you find it necessary to, or get coerced into, using your person with the interactions you feel you must make with the system that works with persons? The writing of the SB 8 abortion law that allows for private citizen enforcement works around the 11th Amendment and the 1908 Ex Parte Young case and brings to question who can challenge a law and whether there can be federal intervention here. For certainly it is a truth commonly overlooked that the fiction is “a disease or affection of language." 26 Ihering expresses in this fashion the exaggerated respect shown by early law for the written and spoken word. "Among all primitive peoples the word appears as something mysterious; a naive faith ascribes to the word a supernatural Power" (II2,441). Anyone who has thought about the legal fiction must be aware that it presents an illustration of the all-pervading power of the word. That a statement which is disbelieved by both its author and his audience can have any significance at all is evidence enough that we are here in contact with the mysterious influence exercised by names and symbols. In that sense the fiction is a linguistic phenomenon. What Is a Legal Fiction? - Pages 4-5 The influence of the fiction extends to every department of the jurist's activities. Yet it cannot be said that this circumstance has ever caused the legal profession much embarrassment. Laymen frequently complain of the law: they very seldom complain that it is founded upon fictions.

The Secret of Magic is a book within a book. It is both the title of Deborah Johnson’s 2015 Harper Lee Prize for Legal Fiction-winning novel, and (in the world of that novel) a reclusive writer’s scandalous 1920s children’s book, which dared to feature black and white playmates solving mysteries together in a magical forest. The protagonist of The Secret of Magic, Regina Robichard, is a young black lawyer in 1946, working for Thurgood Marshall and the NAACP Legal Defense Fund. Raised in the north, Regina travels to Mississippi for the first time to investigate the mysterious death of a returning World War II veteran. She discovers that she has been summoned by the reclusive author M. P. Calhoun, a white woman who wrote a single inflammatory book–The Secret of Magic–and has never published again. What Regina uncovers in the small southern town of Revere is a morass of conflicting social and racial ties, in which the real mystery is not who killed the young black soldier–but whether justice of any type will be possible to achieve by legal means. Author Deborah Johnson joined the ABA Journal’s Lee Rawles to discuss the personal experiences which led her to write this book; the historical influences she drew upon; her thoughts on winning the Harper Lee Prize; and her opinion of Harper Lee’s To Kill a Mockingbird and Go Set a Watchman.
