We have an interesting “this day in legal history” for today – its Benjamin Cardozo's birthday. If he were alive today he'd be 153 years old and thus very dead. Who is he? Well…Benjamin Cardozo, born on May 24, 1870, in New York City, was an influential associate justice of the United States Supreme Court from 1932 to 1938. He was known for his creative approach to common-law judging and legal essay writing, which played a significant role in modernizing legal principles and promoting greater involvement with public policy in American appellate judging. While generally considered a liberal, Cardozo's focus was more on the nature of the judicial process than ideology. His most notable contributions were made during his time on the New York Court of Appeals, where he served from 1914 to 1932, including as chief judge from 1926. Cardozo came from a distinguished Sephardic Jewish family and had a stellar personal reputation. As a lawyer, he achieved great success in the courtroom despite his reserved demeanor. Cardozo's decisions in landmark cases such as MacPherson v. Buick Motor Company (1916) and Palsgraf v. Long Island Railroad Co. (1928) reshaped legal concepts in the United States. In 1932, he was appointed to the U.S. Supreme Court by President Herbert Hoover. During the New Deal era, Cardozo generally aligned with liberal justices and wrote significant opinions, including the majority opinion in Helvering v. Davis (1937), upholding the Social Security program. His ruling in Palko v. Connecticut (1937) introduced a test for incorporating provisions of the Bill of Rights into state law, which remained in use until 1969. Cardozo's jurisprudential work, particularly his book "The Nature of the Judicial Process" (1921), and his involvement with the American Law Institute further solidify his lasting impact on American law. Benjamin Cardozo's contributions as a jurist continue to shape legal thinking and practice to this day.Jabari Wamble, a federal prosecutor and nominee for a federal trial court judge in the District of Kansas, has requested the White House to withdraw his nomination. In a letter to President Joe Biden, Wamble cited his decision to continue his work at the United States Attorney's Office in the District of Kansas. Initially nominated for a seat on the US Court of Appeals for the Tenth Circuit last year, Wamble did not receive a hearing or a rating from the American Bar Association (ABA), which is customary for federal judicial nominees. Subsequently, Biden nominated him for the trial court judgeship in February, but his confirmation process once again stalled without a hearing. The ABA has not yet rated Wamble's qualifications for the district court position. It was anticipated that he would receive a "not qualified" rating from the ABA. This withdrawal follows another recent withdrawal by Michael Delaney, who asked to withdraw his nomination for a judge on the First Circuit due to bipartisan concerns surrounding his prior representation in a sex assault litigation case.US District Court Nominee Wamble Withdraws from Consideration (1)Chief Justice John Roberts has expressed his commitment to upholding the highest standards of conduct in the Supreme Court. Speaking at an awards ceremony hosted by the American Law Institute, Roberts assured the public and Congress of his dedication to maintaining the court's integrity. He acknowledged the ongoing scrutiny faced by some justices and emphasized the court's efforts to explore practical measures to ensure ethical standards. Roberts's comments come as Congress investigates the conduct of Justice Clarence Thomas and considers legislation for a code of conduct for the high court. The court has recently faced ethical controversies, including questions surrounding vacations and benefits received by Thomas from a Republican donor and his involvement in cases related to the January 6 Capitol attack. Calls for a binding code of conduct for the Supreme Court have been amplified by these controversies. Despite the challenges, Roberts has remained mostly silent, declining to testify on ethics reform and attaching a statement signed by all nine justices that reiterates the court's existing ethics practices. Roberts also mentioned the difficulties faced by the court, such as protests outside the homes of justices and the need for round-the-clock marshal protection. The Supreme Court has undergone significant changes with the appointment of three conservative justices under former President Donald Trump, leading to key decisions on abortion rights, gun regulations, religious rights, and federal regulatory power. Judy Chu (D-Calif.) and Mike Carey (R-Ohio) have introduced the Simplify Automatic Filing Extensions Act, a bipartisan proposal aimed at helping taxpayers qualify for extensions on their federal tax returns. The bill seeks to change the rules regarding tax return deadlines, allowing taxpayers to make a payment of 125% of their prior year's tax liability to qualify for a six-month extension. Currently, taxpayers requesting an extension must estimate and make a payment based on their current year's tax liability. The lawmakers argue that simplifying the process will reduce stress, improve taxpayer compliance, and allow the government to continue providing essential services. Part I - Talk Interview - The Life & Musical Career of Blues Music legend, Luther Guitar Junior Johnson (1939-2022) In January 2020, we were blessed to spend some time with Luther, who was always a gracious & honored guest at the home of BRI's Audrey Michelle & Michael Wolf.In this part 1 of 2 Luther tells us about his life, starting from the beginning in Mississippi. At the age of 13 he received his first guitar from his parents who were fans of Muddy Waters, not knowing that later in his life he would go on to play guitar in the Muddy Waters Band. He learned how to play guitar from his uncle, who he paid 15 cents for lessons. Making his way to Chicago in the 1950's where he played in pop up basement juke joints with players like, Robert Nighthawk, Howlin' Wolf, Lil' Walter, Elmore James & many others. (You can only imagine what that scene was like!) The story goes on from there so, you will just have to listen to hear the rest of Luther's incredible life story. You will hear jokes & lots of playful laughter which was always in abundance when you were in Luther's company.Luther "Guitar Jr." Johnson, who hails from Itta Bena Mississippi (also the birthplace of B.B. King) A West Side Chicago guitarist, had a storied career, including a stint with The Muddy Waters Band. In 2004, he produced and starred in the feature film Last of the Romantics, again working alongside his brother. He also appeared in the feature film, The World's Fastest Indian opposite Sir Anthony Hopkins.Chris has had guest-starring and recurring roles on several prime-time series including Numb3rs, Prison Break, Castle, Southland, NCIS and NCIS: Los Angeles, ABC's Family Tools, MTV's Awkward and ABC Family's The Fosters. Chris teamed up with his cousin, Vohn Regensburger, to produce and star in the feature film, A Remarkable Life (2016), in which he and Dylan played actual brothers for the first time. That's right, we're diving into the niche genre of Groundhog Day inspired time loop movies of which there is no better example than the underrated Tom Cruise and Emily Blunt sci-fi outing, Edge of Tomorrow. Or Live Die Repeat. The name of the movie is wildly inconsistent across all viewing platforms, it's very confusing. Mike shares a new game pinpointing scenes from different time loop movies, we end up talking about Rise of Skywalker again of course, and in an unintentional meta turn, Mike and Josiah manage to echo many of the exact thoughts they shared in the Groundhog Day episode, much to DeLaney's chagrin. What is Mono. What is kbps mean? What bitrate should I use? Here are some things to know To figure out how much space you need, you need to know: 1. How often you will publish 2. How long your shows will be 3. What format The formats have some general numbers you can use. For example: If you publish at 128 kbps stereo, your file will take up (roughly) 1M minute If you publish at 64 kbps mono, your file will take up (roughly) .5 M a minute (and sound the "same" but won't have stereo separation). So if you do a weekly show that is 30 minutes long that is 30 minutes multiplied by four weeks. So monthly you create 120 minutes of content. At 128 kbps Stereo, you would need 120 Megabytes per month. If you went 64 kbps mono you would need 64 megabytes per month (roughly on all of these estimates). In today's show, we listen to files encoded both ways as well as mp3 files encoded using the LAME encoder and the Fraunhofer and see if there truly is a difference? Need a Media Host? I currently use Spectrum and I have 162 Mbps down, and 23.78 Mbps Up. I rarely have a serious skype issue. It' is typically myself and one other person, but I have been on chats with five people and no issues. What About Squadcast.fm, Zencastr.com, and all the other options? While it's true these devices record local, so if there is a weird audio glitch, in theory, they don't record the glitch. Something Zencastr states you need at least 1.5 Down, but recommend 5 mbps see more For the record, I've use Zencasr and Squadcast and never had an issue with either. I've also used Ringr which is a cool app for your phone Free Tips For Making Your Guests Sound Good On Skype This comes from Kim from www.toastmasters101.net who explains if someone is going to use their built-in microphone on a laptop, she will have them download skype to their phone and use it over wi-fi. I like this idea, and here is a twist to make it easier. All it takes to create a free Skype account is an email address. You can create a free Gmail account, sign up at skype.com and make a second account. You provide the login and password to your guest, now they don't have to create a skype account. You don't have to ask for their skype ID (as it's yours). Afte the conversation have your guest I Need to Move if I Want Free TV I tried using a digital over the air antenna to receive free channels. I've tried three different versions of these. Most of them you sparking pictures of TV stations that are involved with shopping and/or Jesus. Couldn't I get NBC? Why because I live in Akron (about 50-60 miles from the nearest NBC signal). So any solution that starts with, "get an HDTV Antanea isn't going to work because of where I live. So Skype may not work for you because you Internet blows. Swapping to a new system (much like switch antennas for me) didn't help. Michael Delaney from Baby Mountain Radio (Care Giving for Dementia) let me know about Silicon Dust about the HD Home Run ($66) but it requires an HDTV Antanea and then allows you to stream that signal to any device. It's cool, and inexpensive (you can have a DVR for something like $35/year) at least from what I've seen I still need an HDTV Antanea. Stargate Pioneer told me about Tablo DUAL OTA DVR for Cord Cutters - 64 GB with WiFi - For use with HDTV Antennas that again requires an HDTV Antanea (they do make Outdoor HDTV Antenna), but living in an apartment, I didn't want to go there) How I Saved MySelf $44 and Got Faster Internet Want to see a popular topic? Start talking about cutting off your cable television, or "cord cutting." Oofah! I just mentioned it on a live podcast that hasn't been released and I got two replies (with really good information. I was spending at one point over $200 on cable but got it down to around $176, but I don't watch a ton of TV. So I contacted my Cable Company (Formerly Time Warner Cable - Now Spectrum) and found out that while I was on TWC fastest internet there was faster Cable available. So I downgraded my cable to $109 which now includes a much faster Internet. But I lose the ability to record anything (and you know us podcasters we love to time shift). After some comparisons of YouTube Live, Sling, and Hulu, I went with Hulu with the Live TV streaming for $44. So my now faster cable and channels is $153. This week I'm going to shut off my basic channels (and cut the cable tv completely) which should make my total expense $133. So I went from $176 to $133. I come down and ask Alexa to play Hulu which fires up my TV and tunes it to Hulu. This is going to be a fun space to watch as different companies (Googe is now rolling out YouTube Live).
