Last week, Bee Moorhead joined the program to talk about the House passing the Voucher bill, and it seemed like immediately after, we began to see a TON of bad bills start to move... and a few good ones.    One of the issue areas that was particularly in focus this week has been the return of anti-trans legislation, so we are going to welcome to the program for the first time, Texas Impact's Policy Consultant, Rev. Prosecution Laches: No Good Deed Goes Unpunished!

Prosecution laches is an infrequently used equitable doctrine that bars enforcement of a patent when the patentee has unreasonably delayed prosecution in a way that prejudices others. It is most commonly used by accused infringers as a defense in patent litigation, although the USPTO can also use it as a basis for refusing allowance. Regardless, it is most often used against the backdrop of multiple continuation applications.Continuation applications are applications which all follow from (i.e., claim priority to) a single earlier application. Creating “families” of patent applications in this way is a very common practice and allows the patent owner to claim different embodiments of the original invention in response to changes in marketplace and/or technological evolution. In Sonos Inc. v. Google LLC, currently on appeal to the Federal Circuit, the district court, following a jury verdict in favor of the patentee, found Sonos’ patents unenforceable due to prosecution laches, despite Sonos diligently prosecuting continuation applications for 13 years, serially filing a continuation with each allowance. If upheld, the ruling will represent a notable change to patent practice with far-reaching effects for U.S. innovators of all stripes including, independent innovators, corporate innovators, and universities.This FedSoc forum will use the Sonos v. What happens when First Nations take the lead in shaping the future of clean energy and infrastructure in Indigenous communities? In this episode, we hear from Mark Podlasly, CEO of the First Nations Major Projects Coalition (FNMPC) and member of the Nlaka'pamux Nation in British Columbia. He speaks with Sinead Teevan from the OECD about how the coalition is helping First Nations secure ownership in major energy and infrastructure projects. The FNMPC, now representing 175 communities across Canada, focuses on the economic, environmental, and public policy interests of its members. Together, they explore the power of Indigenous consent, the importance of equitable partnerships, and why integrating Indigenous values into policy and investment decisions isn't just the right thing to do, it's essential for reaching climate goals and long-term prosperity. With real-world examples, from clean energy projects to revenue-sharing agreements, this conversation highlights how economic reconciliation is not only possible, but already underway in Canada. Some Intellectual Property experts contend that American patent reliability has been in decline for 20 years. They point to the threat of inter partes review, the misuse of march-in rights under the Bayh-Dole Act, the imposition of reasonable or reference price clauses, direct government price-setting, and, most importantly, an inability to obtain an injunction after a finding of infringement. In fact, since the Supreme Court decided eBay v. MercExchange in 2006, injunctions have declined precipitously - some studies have shown as much as a 91% reduction.Are current patent owners and their licensees taking a risk in believing that their patents will accomplish their raison d’être… affecting the right to exclude? Is it true that patent owners cannot count on their patents to prevent copycat products from entering the market or to allow patent owners or their licensees to charge market prices for their goods? Should injunctive relief be more readily available in patent cases?This FedSoc forum will explore the history of injunctive relief in patent cases and explain the eBay opinion and how it is currently being applied by the trial courts. My guest played a huge role in my development as an advocate for any group that is marginalized. Inga Gibson is the President and Policy Director of Pono Advocacy. I met her in 2008, as I was exploring my beliefs regarding humane dog breeding. Inga mentored me in all aspects of animal protection policy changes and is an expert in human-animal and environmental conflict resolution. She has coordinated numerous campaigns and projects including directing political and grassroots organizing and community coalition-building efforts. Her work has led to the passage of more than 30 state legislative measures, numerous regulatory changes, and significant corporate reforms that have advanced animal protection and human-wildlife coexistence in Hawaii, the Pacific, and Northwest US. As the Policy Director of Pono Advocacy, Inga provides policy-legislative consulting for non-profit and governmental organizations, facilitates multi-stakeholder discussions on complex and often controversial issues, advises organizations and agencies on strategic media, public education, and communications initiatives. As the former Senior State Director for The Humane Society of the United States and the Pacific Islands Policy Coordinator for Humane Society International, Inga collaborated extensively with the county, state, and federal government agencies and policymakers. Over recent months, the number of Central American migrants apprehended at the U.S.-Mexico border has surged, presenting a critical challenge in the relationship between the two neighboring countries. President Trump has accused Mexico of doing nothing to stop illegal migration, while the Mexican government is emphasizing the need to address root causes in Central America driving human movement. After President Trump’s threat to “close the border” if the Mexican government did not do more, tensions between the two countries appeared to subside. However, these tensions—and the rising number of unauthorized crossings at the border and of asylum seekers in both countries—has put the issue of migration front and center in the relationship between the two countries again. In fact, migration patterns between the two countries have changed dramatically over the past decade. While there is still considerable legal migration from Mexico to the United States, illegal immigration has dropped to a fraction of what it was only 15 years ago, and the overall number of Mexicans living in the United States is actually dropping. Meanwhile, the number of Americans living in Mexico continues to rise and may well be over 1 million, making it by far the largest U.S.-citizen community anywhere in the world. The two countries face shared migration flows from Central America, Venezuela, and other parts of the world, which they increasingly need to find ways of managing in collaborative ways, and both face important challenges for integrating immigrants into the labor market, schools, and society at large. Can Mexico and the United States find common cause around migration or are the perspectives and interests of the two countries too different to make cooperation possible? How will the two governments respond to the current change in migration flows from Central America? And what creative thinking is possible in the future? This discussion of the current trends and future possibilities—with experts from a Study Group on U.S.-Mexico Migration convened by El Colegio de México and the Migration Policy Institute (MPI)—examines migration from the Northern Triangle of Central America and other regions, as well as ways to improve U.S. and Mexican asylum systems, create new approaches to labor migration, address smuggling networks, and modernize border management. Her main service, to support government ministries and agencies like the Union for International Cancer Control in bringing global attention for funding to pandemics and preventable diseases like cervical cancer, affecting poor and developing nations. In this episode, she talks about her journey into the field. I’m super proud of her and admire her strength of character. Listen to her story, her sense of humanity might just give you a little jolt of inspiration. Healthcare is an issue close to my heart and should be for all of you. Our pre-existing condition is being born. For now, here is one of my favorite people, proud to call her a sister, an advocate of all of us and we both agree that healthcare is a human right.

Today on NCIA Audrey is Joined by Emmett Reistroffer, Policy Consultant for Denver Relief Consulting. Emmett’s professional roots and passion run deep in cannabis activism, stemming from his first call to action at 19 years old when he volunteered to help multiple sclerosis patients testify at the South Dakota State Capital. From there, Emmett quickly worked his way up into a position of leadership for the local movement by speaking to the press, raising money, and inspiring volunteers. Facing some of the nation’s harshest drug laws, Emmett was able to form a non-profit organization, South Dakota Compassion, and partner with the former chairman of the National Multiple Sclerosis Society to organize a coalition of patients and advocates in support of medical marijuana. They talk about him speaking on a panel at our upcoming Cannabis Biz Summit to discuss the social use campaign, so people can learn more about his efforts. Also Emmett gives advice he has for others who want to launch a similar campaign in their region.

Given North Koreas possession of missiles able to strike Japan, Pyongyang's April 5, 2009, attempt to orbit a satellite using a trajectory that passed over Japanese territory created ambiguity that might have caused Japan to believe it was under attack.
