Commercial: CU of GA STORY 1: Woodstock Man Convicted of Kidnapping and False Imprisonment Gets 10 Years in Prison Cameron Burnett Long, 45, of Woodstock, was sentenced to 20 years, with 10 years in prison followed by 10 years on probation, for kidnapping and false imprisonment. The conviction stemmed from an incident where Long forcibly carried a woman into an apartment during a domestic dispute witnessed by an off-duty Cobb County police officer. Long and the woman were in a dating relationship with a history of domestic violence. He chased her into the parking lot, wrestled her to the ground, carried her back into the apartment, and pinned her down. The woman eventually escaped using pepper spray. The jury found Long guilty based on evidence including eyewitness testimony and video footage. Long is also prohibited from contacting the victim and is banished from Cherokee County after serving his prison term. STORY 2: Lawyers Deliver Final Arguments on Motion to Disqualify Willis From Trump Case Lawyers representing former President Donald Trump and co-defendants in the Georgia election interference case sought to disqualify Fulton County District Attorney Fani Willis, alleging a conflict of interest due to her romantic relationship with lead prosecutor Nathan Wade. Defense argued Willis financially benefited from the relationship, impacting her impartiality. They also criticized her remarks at a Black church, accusing her of playing the "race card." Willis denied any wrongdoing, stating the relationship began after Wade's hiring. The defense questioned the validity of cellphone records showing extensive communication between Willis and Wade. The judge is expected to issue a ruling within two weeks. STORY 3: Woodstock Fire Department Deploys New Automatic External Defibrillators The Woodstock Fire Department has equipped every vehicle in its fleet with automated external defibrillators (AEDs), enhancing its emergency response capabilities. The addition of five new Zoll AEDs, funded by a national opioid settlement, aims to address the effects of the opioid crisis. Fire Chief Shane Dobson emphasized the significance of this investment in life-saving equipment, highlighting the department's ability to provide crucial Basic Life Support (BLS) during cardiac emergencies. The department, which responded to 6,817 calls for service in 2023, also provides stand-by emergency medical services for community events. All CCSD high schools were named 2024 AP Honor Schools by the Georgia Department of Education, showcasing outstanding student performance and participation in AP exams. Assault occurs when one person intentionally puts another in reasonable apprehension of an imminent harmful or offensive contact. The key is the victim's reasonable fear. Example: If someone raises a fist and threatens to punch another person, putting them in fear of imminent harm, it constitutes assault. 2. Battery. Battery involves the intentional and harmful or offensive touching of another person without their consent. It's not the harm caused but the intentional act of touching that defines battery. Example: If someone intentionally punches another person, causing physical harm, it constitutes battery. 3. False Imprisonment. To succeed in an intentional tort claim, certain elements must be established: Intent: The defendant must have the intent to commit the act that resulted in harm. The Plaintiff, Mr. Reeves, sued the state of NSW for malicious prosecution and false imprisonment following the dismissal of a stalking charge against him. While he failed to prove the prosecution was malicious or that his arrest had been unlawful, he did succeed with a relatively novel claim of false imprisonment. Judge Abadee found that the actions of the police in transferring him into a police interview room, in circumstances where he had expressly declined to be interviewed, led to false imprisonment for the period of the unwanted interview. They discussed the march against CPS corruption. Patriot Mom discussed the retaliation they both have endured after filing a Mass Tort Federal Lawsuit on the County, but went into default, as well as discussing how the Governor terminated the Commissioner. There have been 3 false allegations placed on Patriot Dad. We discussed the fear tactics used in Texas against Patriot Dad, as he was driving to the gym and police pulled him over as he was surrounded by 16 US Marshalls, taken to Jail. Patriot Dad asserted his 8th Amendment Rights as they kept him in Suicide Watch for 24 hours and had to beg for his phone call. Bond was set at $50,000.00 and was able to go home the next day. This is just is just a taste of Texas justice system. Patriot Mom and Dad explained that CPS is a 53 billion dollar a year business as they separate children from their parents as well as dividing spouses. Patriot Mom gave excellent advice, "be strong for your spouse undergoing false allegations and be strong for your children." Patriot Mom and Dad discussed the help they have received from the NLPA (National League Professional Association). HB 19 is very damming to the Veterans, discrimination noted to Veterans. Patriot Dad recommends that you do no "consent to waive your right to a SPEEDY trial, and if the attorney motions for an extension he is waiving your right." New trial date June 12th. There is a limitation when you can hold a "speedy" trial from the time of indictment to trial is 3 years. May be able to move to vacate the case on June 13th 2023, as it is unconstitutional. This is Valentino Dixon's second appearance on Off Script - this time it was in person! We spoke to him shortly after his 2019 release from prison where he spent 27 years for a crime he did not commit. During his time in prison art was his sanctuary, he began drawing beautiful pencil creations including the picturesque golf courses in Dubai, which is why our paths crossed in the first place. False imprisonment or unlawful imprisonment occurs when a person intentionally restricts another person's movement within any area without legal authority, justification, or the restrained person's permission. Actual physical restraint is not necessary for false imprisonment to occur. A false imprisonment claim may be made based upon private acts, or upon wrongful governmental detention. For detention by the police, proof of false imprisonment provides a basis to obtain a writ of habeas corpus. Under common law, false imprisonment is both a crime and a tort. Imprisonment. Within the context of false imprisonment, an imprisonment occurs when a person is restrained from moving from a location or bounded area, as a result of a wrongful intentional act, such as the use of force, threat, coercion, or abuse of authority. Detention that is not false imprisonment. Not all acts of involuntary detention amount to false imprisonment. An accidental detention will not support a claim of false imprisonment since false imprisonment requires an intentional act. The law may privilege a person to detain somebody else against their will. A legally authorized detention does not constitute false imprisonment. For example, if a parent or legal guardian of a child denies the child's request to leave their house, and prevents them from doing so, this would not ordinarily constitute false imprisonment. Under United States law, police officers have the right to detain individuals based on probable cause that a crime has been committed and the individual was involved, or based on reasonable suspicion that the individual has been, is, or is about to be engaged in a criminal activity. Elements. To prevail under a false imprisonment claim, a plaintiff must prove: 1. Willful detention in a bounded area 2. Without consent; and 3. Without authority of lawful arrest. Tonight, on It's Real Talk Radio, we will be discussing the recent conviction of Travis McMichael; the trigger man, his father; Gregory McMichael and their neighbor, William "Roddie" Bryan Jr. On Wednesday, November 24th, 2021, the nation watched in anticipation as a jury announced a guilty verdict for the murder of Ahmaud Arbery, a 25 year old unarmed Black man who was jogging through the neighborhood of the McMichael's and Roddie Bryan. Cheers of celebration erupted as a congregation of protesters and supporters stood outside the courthouse awaiting the verdict of the first defendant, Travis McMichael, who was the trigger man. 'Imprisonment is, as I apprehend, a total restraint of the liberty of the person, for however, short a time, and not a partial obstruction of his will, whatever inconvenience it may bring on him.' There must be complete restraint, therefore, if there are alternative routes that can be taken this is not false imprisonment. Such as in Bird v Jones where the claimant wanted to walk over Hammersmith bridge but the defendant had cordoned off the public footpath, however, this did not constitute false imprisonment because, through using a longer route, the claimant could have still reached their destination. Therefore, if there is a means of escape, this is not false imprisonment. There must be no reasonable means of escape and you may be compensated for any damages caused in order for you to escape reasonably. However, if you have not taken a reasonable route of escape/reasonable action you will not be awarded damages. The claimant does not need to be aware they are being imprisoned. It is still false imprisonment even where the claimant does not know at the time. So secretly locking someone in a room is false imprisonment. It may also be false imprisonment where a person is rendered unconscious, for example, by being punched (also a battery), or when their drink is spiked by drugs (also willful harm or negligence), because their freedom of movement is thereby restricted. For example, in the case of Meering v Grahame-White Aviation the claimant was told to stay in an office because property was going missing and if they tried to leave the office they would have been stopped. In our latest podcast we discuss the Coronavirus Bill, which no doubt will be on the statute book very soon, and the concept of false imprisonment. False imprisonment and Coronavirus at first blush may seem to have little in common other than we all wish no doubt that we had not heard of either, but with the prospect of a “lockdown” bear with us. There is a demand, if not a requirement, for our civil liberties to be curtailed so as to control the spread of the virus. We are being told to stay indoors and to keep our distance from our neighbours. So far these instructions have been polite requests to do as we are being asked. The implicit underlying message being that if we do not do as we are asked then the State will have to get tougher. Government has to tread wearily because it can tell us what to do but does it have the legal ability to insist we do so? The Coronavirus Bill contains provisions under clause 50 and schedule 21 to prohibit and restrict meetings and gatherings, and to close premises or restrict access, but that is as far as it goes. Clause 49 and schedule 20 however, gives the power to remove and detain a person who is believed to be infected. These provisions have to reflect the law which was recently analysed by the Supreme Court in R (on the application of Jalloh) v. Secretary of State for the Home Department [2020] UKSC 4. The case is highly relevant because it can be argued that Parliament cannot simply tell people to lock themselves up. Government has to have very specific powers granted to it by Parliament to curtain a person’s liberty. The case required the Supreme Court to consider the meaning of imprisonment at common law and whether this should be aligned with the concept of deprivation of liberty under the European Convention on Human Rights (“ECHR”). The Claimant in Jalloh, who was apparently a Liberian national, had been released from immigration detention on bail. He was subsequently served a notice of restriction with conditions which included a curfew. Further he was warned that if he failed to observe the curfew he was liable to a fine or imprisonment. It later transpired that the Home Secretary did not have the power to impose the curfew this way. The High Court ordered the curfew to be lifted and the Home Secretary accepted it was unlawful. The claimant sought damages for unlawful imprisonment. In the High Court he was awarded £4000 (he had been subject to the curfew for 891 days). The Home Office argued that compensation was not payable because the curfew albeit unlawful did not amount to unlawful imprisonment, and that if it did it should be modified as a common law concept so as to be aligned with the more demanding concept of deprivation of liberty under article 5 ECHR. The Supreme Court did not accept the Home Secretary’s arguments. The essence of unlawful imprisonment is being made to stay in a particular place by another person. The methodology can be varied and include physical barriers, the placement of guards, the threats of force or legal action. The claimant was subject to a curfew. He had to stay indoors and was warned what would happen if he did not obey. This was simply detention or confinement. As for Article 5 ECHR it was possible for there to be imprisonment at common law without a deprivation of liberty. The latter depends on a number of factors: type, duration and effects of confinement. To align would be a retrograde step because it would restrict the classic understanding of imprisonment at common law to something far more nuanced and inhibit the citizen’s right to not be unlawfully imprisoned by the State. Getting back to the unique circumstances of Coronavirus, the Bill attempts to recognise that there may be particular circumstances where a citizen has not committed a crime but is potentially infected, and as such presents risk to others, and has to be detained. That is very different to telling the general public to stay indoors. Voluntary compliance on the part of the public is one thing, but being ordered to stay indoors and failing to do so would lead to a sanction is another. Parliament has to be very clear in what powers it gives Government and it in turn has to be very clear in how they are exercised because the Jalloh case reminds us that prison bars are not necessary for there to be false imprisonment.
When you think of false imprisonment you imagine being wrongly held in a prison, but the recent Supreme Court case of R (on the application of Jalloh) v. Secretary of State for the Home Department [2020] UKSC 4 demonstrates that the concept is far more nuanced. The appeal was concerned about the law of damages for false imprisonment. It required the Supreme Court to consider the meaning of imprisonment at common law and whether this should be aligned with the concept of deprivation of liberty under the European Covention on Human Rights (“ECHR”). The Claimant who was apparently a Liberian national had been released from immigration detention on bail. He was subsequently served a notice of restriction with conditions which contained restrictions that included a curfew. Further he was warned that if he failed to observe the curfew he was liable to a fine or imprisonment. It later transpired that the Home Secretary did not have the power to impose the curfew this way. The High Court ordered the curfew to be lifted and the Home Secretary accepted it was unlawful. The claimant sought damages for unlawful imprisonment. In the High Court he was awarded £4000 (he had been subject to the curfew for 891 days). The Home Office argued that compensation was not payable because the curfew albeit unlawful did not amount to unlawful imprisonment, and that if it did it should be modified as a common law Concept so as to be aligned with the more demanding concept of deprivation of liberty under article 5 ECHR. The Supreme Court did not accept the Home Secretary’s arguments. The essence of unlawful imprisonment is being made to stay in a particular place by another person. The methodology can be varied and include physical barriers, the placement of guards, the threats of force or legal action. The claimant was subject to a curfew. He had to stay indoors and was warned what would happen if he did not obey. This was simply detention or confinement. As for Article 5 it was possible for there to be imprisonment at common law without a deprivation of liberty. The latter depends on a number of factors: type, duration and effects of confinement. To align would be a retrograde step because it would restrict the classic understanding of imprisonment at common law to something far more nuanced, and inhibit the citizen’s right not be unlawfully imprisoned by the State.

We do not need to stay falsely imprisoned when there is a higher legal authority that has already given us the ability to be free.

On Februrary 11, 1987, 15-year-old Tim Masters walked through the field behind his house on the way to the school bus stop in Fort Collins, Colorado. There he discovered the body of Peggy Hettrick who was lying face up with her shirt pulled up and her pants pulled down around her knees. She had been stabbed and mutilated. The investigation that would follow would span over a decade and be bungled so severely that it saw an innocent man behind bars.
