I have this idea that I don't cry in the theatre. Movies, yes, all the time. TV, yep. But I think I don't really cry at plays. It's not true, though. It just doesn't happen very often. And pretty much every time it does, it's such a remarkable piece of theatre that I feel like I have to write about it. It happened at Indecent. And at One Night Only. In 1978, the appellant, R.A., was babysitting the then five-year-old complainant at his home. In a statement made to the police, he explained that he asked the complainant to touch him and she did so. The appellant was charged with one count of indecently assaulting the complainant contrary to s. 149 of the Criminal Code, R.S.C. 1970, c. C-34. Following a trial in the Provincial Court, the appellant was acquitted on the basis that there had been no “assault” under the Criminal Code. There had been no direct, intentional application of force to the complainant and no attempt or threat by an act or gesture to apply force to the complainant.On appeal, the Crown submitted that the trial judge erred by misinterpreting the elements of assault and holding that the sexual touching had to be physically initiated by the accused. The Court of Appeal unanimously allowed the appeal and set aside the acquittal. It concluded that the appellant touched the complainant in a manner constituting an assault and that any intentional contact with a child by an adult that is committed in circumstances of a sexual nature constitutes a direct and intentional application of force by the adult to the child's person, regardless of whose physical movement initiated the contact. Considering that the only issue was whether the appellant's conduct amounted to an assault and that the question had been answered in the affirmative, the court entered a conviction for indecent assault and remitted the matter to the Provincial Court for the appellant to be sentenced. In Australia, broadcaster Alan Jones has been charged with indecent assault and sexual touching offences spanning over two decades. Canberra correspondent Kerry-Anne Walsh spoke to Corin Dann.
Australian broadcaster Alan Jones has spent his first night on bail after having 24 indecent assault charges laid against him. They relate to eight alleged victims over the span of two decades, with the youngest being 17 years old at the time. The 83-year-old has been under investigation since March. Channel 9's Jack Hahn told Mike Hosking that Jones is a polarising and powerful figure in Australia. He says the news will be a surprise to many, given how the situation unfolded yesterday. The Minnesota Supreme Court is currently deliberating a case that could potentially redefine the boundaries of indecent exposure, at least in the state. At the center of the debate is Eloisa Rubi Plancarte, who was convicted after walking through a gas station parking lot with her breasts uncovered. While the case has sparked discussions on gender equality, the state's attorney introduced an even more perplexing argument. He suggested that under the current law, even exposing an elbow could theoretically violate Minnesota's indecent exposure statute. This is not a simple soup to throw together once you've already come down with a full-on cold or flu, as you may not have the energy to gather the ingredients and for preparation, however— this soup is more meant for helping to boost the immune system in the beginning stages of coming down with a seasonal bug, or as a preventative booster. This recipe's complex blend of vitamins and minerals from greens and root vegetables keeps its ingredients' wholesome nutritional value high by first oven roasting the vegetables in a medley before adding them to the pot rather than boiling them; the prep time for this recipe is about 2 hours, with an additional 1-2 hours of cook time to simmer for flavor and for the raw chickpeas to reach the ideal texture before serving— the blend of herbs and root vegetables will add a layer of immunity and protection against any oncoming disruption to your normal level of health, and is hearty enough to be served alone, or with a side dish of salad or even a half sandwich, if you're feeling up to it. Former BBC news anchor Huw Edwards has avoided jail after admitting to charges of making indecent images of children. Edwards has been handed a six month prison sentence suspended for two years, meaning he won't see jail as long as he doesn't re-offend. American short stories started out weird. Consider Nathaniel Hawthorne, as we just did in episode two this season—or, consider Edgar Allan Poe. Existential strangeness and cosmic peril pervade these nineteenth-century stories, and those moods have stayed with American short stories into the twenty-first century. Brevity can be crucial for such stories' maximal, cosmic weirdness. Justin Taylor points out here how Poe can get to extremity simply in a sentence. "What Poe brings to the table," Taylor says, "is that extreme purpleness of language, that kind of humidity, that really baroque Poe sentence, where it's kind of overwrought and maybe a little silly at times, but it's also really finely controlled." And Becca Rothfeld explains in this episode how short stories themselves aren't inherently contained, minimalist projects. A story, she tells us, “can resist ending by resisting presenting a satisfying or tidy conclusion," thereby inclining the reader toward something messy, something beyond, something expansive. Brevity might also express all that we can about overwhelming sublimity, in any case. It's time for a story. In this episode of our season on short stories in the United States, you'll hear Nathaniel Hawthorne's mysterious short story “Wakefield,” read by the actor Max Gordon Moore. It's a story from the 1830s, reflecting from the first sentence the early American interest in strange information found repeatedly in periodicals, and then it follows that strangeness to cosmic extremes. If you know Hawthorne mostly as the author of The Scarlet Letter, you're in for a surprise in this story about a guy who moves basically next door and hides for twenty years. Short stories are good at this kind of surprise, too. They can be vehicles for writers to explore especially unusual material, and Hawthorne pursued that exploration with something like baroque concision. The novelist Justin Taylor says, of Hawthorne the writer of short stories, “When he was good, he was so good.” Max Gordon Moore reflects on the especially active thinking that Hawthorne's story stirs up: “I find myself perplexed in a fun way,” he says. As Deborah Treisman mentions in this episode, of effective short stories in general, “If the reader has to do some work, the reader becomes implicated in the story.
