A Diverse Trailblazer's Patent Strategies for Canada with Selena Kim

North America as a whole is a leader in the innovation system. In large part, that's due to the relationship between the United States and Canada. That raises these questions: How do we go about protecting intellectual property rights in Canada? What are effective strategies? We answer these questions and talk in-depth about diversity in the legal industry with today's guest Selena Kim. In this episode, Jeff Harty and Selena Kim discuss: Making great relationships with lawyers around the world. Handling multiple areas of law (and having them work together). The power of women in the innovation economy. Differences in U.S. and Canadian patent law. Key Takeaways: Being a litigator offers insight into the small comments in a patent that you may not otherwise recognize can get you in trouble later. If you are already filing in the United States, filing in Canada is not going to add much to the cost. With the North American market being as it is, filing in Canada as well may be the right choice for your patent. When you are going through litigation in both the United States and Canada, the cases can assist one another. Depending on the case, it may be beneficial to start with one before the other. While diversity in law firms in Canada has progressed, it is a slow progression. Firms can do more to bring their firms to resemble the diversity balance of their local population."You really need to think about your own personality and what will make you fulfilled in your career and your life and what kind of environment you are working in. And shape your practice that way to try to be as happy as you can now, rather than striving toward something that's vague and ill-defined." —Selena Kim  About Selena Kim: Selena Kim is a partner in Gowling WLG's Toronto office, practicing in intellectual property litigation, patent prosecution, transactional intellectual property work, and strategic intellectual property portfolio management. In 2020, Canadian Lawyer named her one of the Top 25 Most Influential Lawyers in Canada.Selena has been certified by the Law Society of Upper Canada as a specialist in intellectual property (patent, trademark, and copyright) and is the first woman to achieve this designation for patents in the Law Society's history. Selena's litigation experience includes work before all levels of court in Canada, involving patents for complex mechanical, electronic, and chemical inventions. She also conducts patent and design agency work before the Canadian Intellectual Property Office.Selena has a technical background, with a graduate degree in molecular biology and having conducted laboratory research in genetics, gene expression, and pharmacology. She is a registered patent agent before both the CIPO and the U.S. Patent and Trademark Office.Selena is an active member of professional associations, including the National Asian Pacific American Bar Association and the American Bar Association. Turns out it categorized the ASIN as an adult product.19:16 Does AMZ send review requests to customers automatically w/o me pressing the request review button or setting automation?21:22 You helped me get my trademark but now the problem is that my old brand name is one thing and I'm trying to change to my new brand name & I can't get this done.23:46 Will closing listings that are out of stock help my API score?28:02 If I have a list of 20 relevant KWs, is it a good strategy to put all 20 in a BR, PH, & EX campaign?30:36 New product launch furthermore how long would you wait to fully optimize those BR, PH, & auto campaigns & what is your criteria customer search term KW has to have for you to put it into its own EX campaign?32:24 Is there ever a reason to put a customer search term from an auto or BR and put it into a PH campaign & vice versa?35:04 Filed w/ CIPO. 20% success. Does a low success rate hurt me w/ AMZ in any way?36:56 When/how does the "New Item Available" appear on a PDP?40:46 What are some key metrics an ASIN should be meeting to justify launching a 2nd product?44:19 Launched seasonal product 20 days ago, I am now top in main KW and selling well. I'm in the season now and peak season ends in 15 days. My overall TACOS from the start of launch is 33% and my daily TACOS now is 20% when trying to reduce bids to reduce TACOS I lose my rank. How to reduce TACOS w/o losing rank?45:58 I'm working on the brand name change. The front end looks fine but in the "edit listing" view, under Vital info, the brand name is red-coded to the old brand name.47:22 Our FBA fees have gone up recently. How do we request a remeasure of our product?48:28 What did you learn the most from Prosper, aside from the people and relationships?52:47 One of our supplement products is marketed as Diabetes treatments and taken down as there is no word related to diabetes in PL copy and on the product itself. But we are using these diabetics in PPC.54:50 Can you talk about why you prefer fixed bids over dynamic down only? How is the fixed bid determined to start? Criteria to change to dynamic.55:45 I have a parent with 2 variations: If the parent or one of the children becomes the best seller, how can I delete the others or deactivate it?59:26 Can I edit the shipping order quantity after finishing creating the shipping labels?59:53 Is sales from SBV ads effective in ranking as SP sales?1:00:46 For SBV Ad broad target, how can I see the data that shows the search term orders came from?1:04:07 Do you design products w/ the Climate Friendly Pledge's Compact By Design in mind?1:06:34 How do I find all listings of products that are infringing on my utility patent?1:07:36 I created the shipping labels for 500 units, then 250, but the system does not let me create the other 250 for a total of 1,000. My limit is 1000. I have a professional account. My products are not 25 cubic feet. They are 2 cubic feet. 1:08:47 No questions for today for me, just quick feedback to say that the value I got for these shows surpasses everything I got from the other "FBA authorities" out there!1:09:21 How do you add icons to your bullet points?1:09:33 Does AMZ send the review request automatically to customers?Support the show (https://www.paypal.com/paypalme/myamazonguy)

In this episode Nathan takes us to Minas Gerais (general mines), Brazil, an inland state known for its food, rolling mountains and waterfalls, as well as historic architecture. Nathan tells us his inspirational story of how he joined the band Velotrol, a popular rock group in the capital Belo Horizonte (Belo), and how he became the lead guitarist after working different jobs for years and following his dreams. Next we dig deeper into Belo and its many botecos (typically sidewalk bars), the excellent Mercado Central which is full of local products (cheeses, cachaça, Brazilian sugar cane alcohol, and numerous fruits and vegetables only found in Minas. Outside of the city we discuss some national parks nearby, including Serra do Cipo, which is famous for waterfalls and hikes, and Serra do Gandarela. We round out the episode by discussing the poignant history of the colonial cities close to Belo, namely Ouro Preto, Mariana and Tiradentes. Each of those locations are UNESCO World Heritage sites, but there is more than meets the eye about the unseen history which you can learn more about at the Casa dos Contos in Ouro Preto. All in all, Minas is truly an off the beaten the track destination that has world class food, scenery, history and most of all welcoming and hospitable people. Part One of a Cipollini two-parter. Alfredo Binda’s record of 41 stage wins in the Giro d’Italia stood for 70 years, until Mario Cipollini went one better. With his wavy blonde locks, bulging biceps, and a penchant for an eye-catching skinsuit, Super Mario was as ruthless as he was fast. Cipo made headlines and Giro history – but few friends during his controversial and colourful career.Felix Lowe not only documents the incredible run that saw 'Mousselini' reign supreme but pits him against Binda: a man who on the surface was a cold and detached champion, a man who had about as much in common with the charismatic Cipollini as a smooth Barolo to Grappa. One was a champion vintage to savour long on the lips, another a coarse digestif enjoyed – if that’s the word – at the very end of a meal, something that came and went in a matter of seconds. And, once it hit the spot, it left behind a bitter aftertaste.Part Two will be released as the Giro peloton hits the streets of Turin on Saturday the 8th of May, where Felix delves into the murky world of Cipo's retirement.Re-Cycle is narrated by Graham Willgoss and produced by Pete Burton. Please rate and review us on your podcast platform of choice! E a equação é simples: SOMOS TODOS NATUREZA! Lauren Reimer is a blogger, content creator, and chronic illness community leader based in Fayetteville, Arkansas. At the age of 13, she was diagnosed with Chronic Intestinal Pseudo-Obstruction (CIPO), which means that her digestive tract acts as though it is obstructed — even when it is not. Lacking peristalsis, the worm-like movement that moves food, fluid, and air through her digestive tract, her body is unable to absorb adequate amounts of nutrients from eating alone. As such, she relies on IV nutrition (total parenteral nutrition, or TPN), administered from a 2.5-liter bag of fluid containing fats, protein, sugars, vitamins, and minerals that infuses over 12 hours while she sleeps. She’s been living on this therapy since her diagnosis, and while unusual, it has sustained her and allowed her to live a full life. She also has two feedings tubes that she uses to decompress her stomach and intestine during her waking hours. What sets Lauren apart in her work is her boldness and color: this woman loves all things vintage, fashion, music, and art, and when not in COVID quarantine she loves to spend time with her friends (and there are many!). A frequent guest on her social media feed is her sweet dog Elway, a rescue who keeps her spirits high and her body active (when he’s not napping). Friends of UP: meet Lauren of Pretty Couch Potato! Tune in as Lauren shares: how she was first diagnosed what CIPO is, and how it affects her body why she’s permanently on TPN — and how her understanding of nutrition has changed over time and with experience how her experiments with holistic medicine failed her that while she doesn’t live with chronic pain, she is in chronic discomfort that she now has both a G-tube and a J-tube to assist in her digestion, as well as a central line for absorbing her TPN just how rare CIPO is how she has become her own advocate how chronic illness has directly impacted her education and career prospects that she is now able to work part-time remotely, matching TPN patients with the best care for them why she loves her work, which overlaps with advocacy that there is a lot of misinformation out there about TPN that TPN is not often or readily prescribed (about 40k/year in the US are prescribed it) — and many individuals prescribed the treatment are given it short-term in the NICU or in hospice — very few people live long-term on TPN, like Lauren does that she may explore multiple-organ transplant options in the future what eating is like for her, given that she gets no nutrition from food the misunderstanding that people living with disabilities aren’t willing to fully participate in life — and how she actively works to challenge that misconception why her big-city vs. small-town healthcare experiences have been so vastly different

Brandon Winfield and Sayeed Mehrjerdian are welcomed to the show to tell the powerful story behind their new app, iAccess Life, the Yelp for accessibility. After being injured in a Motocross accident at the age of 14, Winfield was left paralyzed from the chest down. Through a great support system of friends and family, Winfield continued to travel, adventure, and experience life. However, he was sometimes surprised by the lack of accessibility at places he would go out with friends, and he came up with the idea for an app that would inform users of accessibility ratings before going out. Knowing if there is handicapped parking, a ramp, an accessible bathroom, and other features before driving to eat at a restaurant, work at a coffee shop, or work out at a gym will prevent surprises and empower individuals with physical disabilities. Thus began the long journey to build the iAccess app to help the community, a journey marked by humility and resilience. Despite not having a college degree, Winfield has lead this Atlanta based tech startup as CEO, successfully raising support, breaking stereotypes, and inspiring others along the way. Mehrjerdian, an Industrial and Systems Engineer graduate from Georgia Tech, joined the venture as CIPO, Chief Innovation and Product Officer, to use his background in product management and starting technology companies to push iAccess forward. Recent success has shown through the launch of the app and in winning at the South by Southwest Pitch Competition. The two Co-founders together make an unstoppable team, and there is no doubt they will reach their vision of revolutionizing accessibility through information in the palm of your hand. Winfield and Mehrjerdian bring great insights into starting a company such as: Build a team with a common vision. This is make or break. Setbacks and failures often lead to success if you do not give up. Startups take a long time. Overnight success is an illusion. The only way to fail is to quit. Keep pushing through. Let your pride go of wanting to do this on your own. Ask for help. Never underestimate the power of your network. Stop making excuses. Pitch. Pitch. Pitch. Apply to as many opportunities to pitch as you can. Perfect practice makes perfect. When someone says no, ask why? You will learn from them. Raising money is hard, but not impossible. “What you are doing in your personal life reflects in the success of your business as well.” Make sure you are growing personally, not just in your career! “Be confident, believe in what you are doing, why are you doing it, and in yourself.” The number one thing to be successful in business is to believe in yourself and be confident in yourself, but don’t fool yourself into thinking it is working when it is not. Quality over quantity. --- Support this podcast: https://anchor.fm/startupdormroom/support
