We dissect the complexities of non-compete and non-solicit agreements and how these contracts could be reshaped by recent FTC rulings. Discover how such constraints influence innovation, employee mobility, and wages across various industries, and hear firsthand accounts about the tricky nature of enforcing these legal bindings. We also examine the potential benefits and detriments of the FTC's proposed national ban on non-competes and its wider implications for the business world. We've all heard the courtroom dramas, but what happens when those dramas spill into real life, affecting wages, innovation, and the freedom to switch jobs? That's what we're unpacking in this episode. From the medical device industry's laser-focused contracts to insurance's preference for non-solicit agreements, we dissect the potential impact of the FTC's proposed ban on non-competes. And hold onto your hats—we're diving into the litigious nature of these agreements, sharing frontline experiences from the trenches where business and law collide. Finally, we don't just stop at contracts and courtrooms - we also tackle the significance of honest trade practices and supply chain transparency. The conversation turns to the repercussions of deceptive labeling, as seen in the recent Williams-Sonoma FTC fine, and the broader conversation about the value of American-made products. We explore the ethical, environmental, and economic factors that play into the manufacturing decisions of businesses and the ripple effect these choices have on our society. This week we talk about how back in the '70s, I grew up on a farm down by the lazy river where I had a horse with no name. The horse was sickly, but it had a heart of gold. Then there was the day that I found myself in the court of king heroin. I realized I was runnin' away and slipping into darkness with no one to depend on. Then came the day I lost everything I own. Until the 1980s, a lot of what we bought was made here from companies based here in the US. Now? Not so much. Sure, we still make plenty of stuff, but there are a lot of things we used to make here, entire categories of stuff, that we just don't anymore. From what I understand similar situations have played out in the UK and other countries, too. Why is that? What happened? Watch this episode on YouTube: https://youtu.be/Y-B5mIl2Zlk
I've never owned a tractor, but based on Kenny Chesney's 1999 hit She Thinks My Tractor's Sexy, I understand that some people find them to be quite alluring. (The same goes for farmer's tans, but that's more relevant to this post.) It's not clear whether Kenny's girlfriend was particularly attracted to American-made tractors, but some people are. That's why Kubota Tractor Corporation used to label their tractors as “Made in USA.” https://www.kelleydrye.com/viewpoints/blogs/ad-law-access/ftc-announces-2-million-penalty-over-made-in-usa-claims Gonzalo Mon gmon@kelleydrye.com (202) 342-8576 www.kelleydrye.com/people/gonzalo-e-mon Subscribe to the Ad Law Access blog - www.kelleydrye.com/subscribe Subscribe to the Ad Law News Newsletter - www.kelleydrye.com/subscribe View the Advertising and Privacy Law Resource Center - www.kelleydrye.com/advertising-and-privacy-law Find all of our links here linktr.ee/KelleyDryeAdLaw Hosted by Simone Roach

Leslie is joined by Scott Paul, President of the Alliance for American Manufacturing (AAM), a partnership established by some of America's leading manufacturers and the United Steelworkers union. Scott first shares his thoughts on 2023's weak manufacturing numbers in the U.S., why there's more to the data than meets the eye, and reasons that the future looks bright. He and Leslie then chat about not one but two(!!) new books on companies that have started up making apparel in the U.S. over the past decade. Both of these books--'Making It in America,' available now--and 'American Flannel'—available in March—are worth a read. Finally, Scott shares why he's more than a little worried by China's rise in automobile production, and why he believes it's an existential threat to American manufacturing jobs.
Bevin Bells, the only dedicated bell manufacturer in America, has been making bells in "Bell Town" East Hampton, Conn., since 1832. Many years ago, Waylon came across a uniquely simple, yun-ful watch display in an outdoor mall in LA. One was black, one white, both with wooden cases. He fell in love not only with the simple elegance, but the values—these are just about the only watches entirely Made in the USA, these days. Waylon bought a Weiss watch a year later, an early “adult” purchase. Recently, Waylon and Cameron Weiss, founder of Weiss Watch Company, speak about the sustainability of mechanical watches, how they can keep us in the present moment, and considerate about how we use our time; how a watch is often an heirloom item, and what that means. “A watch, like any thing, can be ethically-crafted & sourced, an heirloom to pass on to a loved one. Few are. Weiss is.” ~ Waylon Lewis We discuss ethical, eco, made-in-the-USA craft, which in many ways is a dying thing. Subscribers get the full conversation.
