After touching on the important distinction between mass torts and class action lawsuits, Sam is joined by Attorney Kim Adams with Levin Pappantonio to discuss her ongoing litigation against the Canadian porn company formerly known as MindGeek (now Aylo) for encouraging, facilitating, and helping to disseminate child pornography on their site, unpacking the law (Section 230) that protects platforms from legal liability for third-party content and the tension between that and the active production, curation, boosting, and highlighting of said liable content, not to mention the heightened responsibility for pornography companies to be aware of the content the platform and sponsor. After expanding on the extensive community of impacted parties, be they plaintiffs or potential class members, and exploring the distinction between hosting and publishing, Adams summarizes the case's state right now. Next, Andy Birchfield from Beasley Allen joins, diving right into the ever-ongoing case against Johnson & Johnson for their manufacturing, sale, and promotion of their Talc-based baby powder formula despite internal awareness of the presence of asbestos and the devastating medical impact it can have on mothers and their children, with a particular focus on J&J knowingly marketing this toxic powder as a feminine hygiene product and the resulting development of ovarian cancer amongst consumers. Next, Birchfield dives deep into J&J's implementation of the “Texas Two-Step” legal maneuver to avoid responsibility, splitting off all of its liabilities from its assets into a separate company, before immediately moving said company to the asbestos-liability haven of North Carolina, where it would attempt to declare bankruptcy and render any attempts at accountability or compensation null. Walking through the circle of attrition that this has created in the courts, as we enter a third attempt to declare bankruptcy, Andy and Sam wrap up with the future of this case and the role public pressure, congressional legislation, and the questionable morals of J&J leadership all play in hopefully bringing this to a close. Sam and Emma also expand on the developing story about the Trump White House's obstruction of an FBI investigation into Brett Kavanaugh's allegations of sexual assault. Always being up front, truthful, always be hungry, but at the same time, be willing to hear a no. A no doesn't mean never, it's just not right now. I think a firm handshake and eye contact goes a long way. Sydney interviews Chris about his career and approach to assistive technology, including what Chris's focus on inclusive design, including more AT in the IEP, the need for AT considerations vs AT assessments, free AT professional learning resources, and more! Before the interview, Rachel and Chris discuss one of Rachel's clients who, prior to working with Rachel, was not making much progress using his AAC device. Rachel shares that, when an AAC user comes to her who hasn't made progress, their system is often not set up for success - too few buttons, scrolling home page, etc. Rachel recommended a new AAC layout for her client with more language, but everyone in this client's family was worried about moving to the new layout. Jim served in two churches in California before moving to Houston to lead First Presbyterian Church in 2009. Jim is a voracious reader, who tries to stay current on Christian theology and its practical applications to his ministry. Science fiction often operates as either an extended metaphor for human relationships or as a genuine attempt to encounter the alien Other. Both types of stories tend to rehearse the processes of colonialism, in which a sympathetic protagonist encounters and tames the unknown. Despite this logic, Native American writers have claimed the genre as a productive space in which they can critique historical colonialism and reassert the value of Indigenous worldviews. My guest Miriam C. Brown Spiers book Encountering the Sovereign Other proposes a new theoretical framework for understanding Indigenous science fiction, placing Native theorists like Vine Deloria Jr. and Gregory Cajete in conversation with science fiction theorists like Darko Suvin, David Higgins, and Michael Pinsky. In response to older colonial discourses, many contemporary Indigenous authors insist that readers acknowledge their humanity while recognizing them as distinct peoples who maintain their own cultures, beliefs, and nationhood. The book analyzes four novels: William Sanders's The Ballad of Billy Badass and the Rose of Turkestan, Stephen Graham Jones's It Came from Del Rio, D. L. Birchfield's Field of Honor, and Blake M. Hausman's Riding the Trail of Tears. Demonstrating how Indigenous science fiction expands the boundaries of the genre while reinforcing the relevance of Indigenous knowledge, Brown Spiers illustrates the use of science fiction as a critical compass for navigating and surviving the distinct challenges of the twenty-first century. Are you trying to find an officiant for your wedding, but are feeling overwhelmed and confused about the whole process. Updates throughout the day, including from Cartesville Medical Center where eight patients with positive tests remain in care and another 31 patients await their test results. Speaking of the hospital, a prayer vigil is set for 6 tonight where supporters are asked to surround the hospital with prayer. They are urged to stay in their cars and to please avoid blocking entrances and exits. Also this evening, Gov. Brian Kemp will hold a TV town hall session at 8. Cartersville Urgent Care has launched 'virtual visit' options. In other headlines today: Ware Mechanical Weather Center: Oostanaula nears flood stage; flood warnings for other local waterways. Three perfect spring days in a row starting today; highs in the upper 70s, low 80s. Dining: No Public Health restaurant inspection scores from Bartow from Wednesday. Our Crimewatch report has updates from the Bartow County Jail. RANT OF THE DAY: Taking it to the streets There’s a parade set for 1:30 this afternoon as Armuchee Elementary School staff and teachers do cruise-ins in these subdivisions: Battle Farm, Northwoods, Wood Glen, Emerald Oaks, Swan Lake, Applewood and Birchfield. Earlier in the day, Swift & Finch will have that funky coffee bus of theirs Live from the Twick – that is, in the Twickenham subdivision off Chulio Road after a successful visit in East Rome on Wednesday. Snow cone operators are on the move and even Frios will be mobile this coming Saturday along city and county streets. You’ll find chalk up and down local drive ways, some complete with editorial messages urging you to stay home (except for walking around the neighborhoods). And one of our neighbors, who’s daughter’s birthday party was cut short by the social distancing rules, had a little parade of their own (we remember how a relative did the same thing in Cave Spring one Independence Day, starting a Norman Rockwell-like setting every Fourth of July). All of this is new, a response to the coronavirus threat and closed schools and social distancing and curve flattening. Larger assemblies continue to be banned although even some of those rules are bending. We’ve seen drive-in church attempts, one of which has now been canceled. In Cartersville this evening, motorists are asked to surround the medical center there in a show of unity against the disease. Participants are advised to stay in their cars. Educators and businesses and the cleregy continue to take to the digital airwaves for distance learning or cybernetic blessings and such. Walking by one such event has us waiting for Peter Marshall and Paul Lynde to say something funny as these Zoom screens look like something out of Hollywood Squares. And all that whiz-bang tech stuff is great. But we’re more intrigued with the low-tech options -- school parades, neighborhood-based food trucks, and even chalk attacks. We continue to deal with a very serious medical threat and we’re far from over it. On March 22, 2012, respondent Jason Fagin was arrested on suspicion of driving while impaired. The deputies brought Fagin to the sheriff’s department and read him the implied-consent advisory. A deputy asked Fagin to submit to a blood or a urine test. Fagin refused. Appellant State of Minnesota charged Fagin with, among other offenses, first‑degree test refusal. In July 2012, Fagin pleaded guilty to the test-refusal charge. After he was convicted, Fagin did not pursue a direct appeal. In May 2017, Fagin filed a petition for postconviction relief, arguing that the rule announced in Birchfield v. North Dakota, 579 U.S. __, 136 S. Ct. 2160 (2016), and applied in State v Trahan, 886 N.W.2d 216 (Minn. 2016), and State v. Thompson, 886 N.W.2d 224 (Minn. 2016), cert. denied, 137 S. Ct. 1338 (2017) (the “Birchfield rule”) applied retroactively to his test-refusal conviction. Fagin argued that under the Birchfield rule, the test-refusal statute was unconstitutional as applied to him because he refused a warrantless blood and urine test, and the deputies did not demonstrate that exigent circumstances existed. The district court summarily denied the postconviction petition. The court of appeals reversed. On appeal to the supreme court, the following issues are presented: (1) which party bears the burden of proof with respect to exigent circumstances when a defendant challenges a final test-refusal conviction based on the retroactive application of the Birchfield rule; and (2) whether the district court properly denied Fagin’s postconviction petition without a hearing because Fagin did not allege sufficient facts to demonstrate that police could not compel him to submit to a blood or urine test. Today I'm talking to one of my dear friends from undergrad, Jessika Birchfield. Jessika is a wife, registered nurse, graduate student, and Justin Timberlake fan. We met in an exercise class in college and have been friends ever since. Jessika shares with us how she developed an eating disorder her freshman year of college and how she recovered from that. She touches on how an experience in 2nd grade helped shape her view of weight and her thoughts on social media's role in eating disorder recovery. Although there is definitely some deep conversation, we also share lots of laughs through other stories like when she broke her toe because I forced her to play in an intramural basketball game. Jessika recently finished her first half marathon and she shares what that experience was like for her. Government requests come in multiple forms. They can come in as requests for client information or even in the form of investigating your company or your employees. Requests for Client Information General Rule to Follow Without understanding the nuances of criminal and constitutional law and having to cite Supreme Court cases, any government requests for your client's information are rarely urgent and contemporaneous, i.e. usually they are made through formal channels and you are given time to comply. In such cases, it is only prudent to procure legal representation. Failure to do so could open yourself to liability in the event that you release information when you should not have or if you do not release information when you should have done so. The more difficult situations arise when a police officer or other government official shows up at your business' lobby, such was the case at the hospital in Salt Lake City, Utah. Salt Lake City Hospital Nurse Arrest Incident A Utah nurse was aggressively arrested when an officer claimed she was interfering in an investigation after she refused to let him get a blood sample from an unconscious patient.; The Salt lake City police detective requested a blood sample from an unconscious admitted patient who suffered injuries from a fiery crash. Nurse Alex Wubbles, now famous from her viral arrest video, correctly explained to the the detective that hospital policy (and according to a 2016 Supreme Court case,;Birchfield v. North Dakota) barred a blood draw unless the patient is under arrest, or there is a warrant allowing the draw or the patient consents. ; Here is the 30 minute raw video of Officer Payne's body cam: [youtube]https://www.youtube.com/watch?v=9Piuenvb-Zg[/youtube] Days and weeks after, nurses, hospitals, and rights advocates alike were praising the efforts of Nurse Wubbles' confident position. She handled an obviously irate detective that seems to have intended to intimidate his way into obtaining a blood sample of an unconscious victim of a car accident, who later passed away from his injuries. In this instance, the hospital clearly had a written policy for such requests. Even citing the law, the hospital defended its nurse to explain that without a warrant or an arrest, there is no implied consent to draw blood (unlike a breathalyzer, which was also discussed in;Birchfield). What Can We Learn from Nurse Wubbles and her Hospital? First, it is extremely difficult for any employee, whether executive or operational level, to respond to government official requests--especially live requests from police officers or detectives. This means that employees need training. They need to understand when they have a right to refuse, when they should comply, or how they should do so. Nurse Wubbles handled herself very calmly and only until it was proclaimed that she was being placed under arrest did she show any exclaimed response. For the viewer, the response was a natural consequence to the unlawful arrest. Nurse Wubbles was clearly trained on how to deal with this situation, though the new revised hospital policy has it so that police are not to interact with the nurses but must work directly with department heads for such requests. Second, the hospital actually had a written policy. You can see in the video that she is referencing specific guidelines on what to do in such circumstances. Hospitals routinely receive such requests, and so it would make sense for them to have such a written policy, but hospitals are not the only common recipient for request of client information. How Do Data Giants Like Google and AirBnB Handle Data Requests for User's Data? Most online companies that store large amount of client data have received data requests from government agencies. It is inevitable that one of your clients will be involved in some criminal investigations or even civil; disputes.; Many of these companies actually post their policies online. For example,

On this episode we review the Court's decision in Birchfield v. North Dakota, which considered whether in the absence of a warrant, a State may make it a crime for a person to refuse to take a chemical test to detect the presence of alcohol in the person’s blood.
On April 20, 2016, the Supreme Court heard oral argument in Bernard v. Minnesota, which was consolidated with Birchfield v. North Dakota and Beylund v. Levi. -- In Bernard, William Robert Bernard, Jr., admitted he had been drinking, but he denied driving his truck and refused to perform a field sobriety test. He was arrested on suspicion of driving while impaired and taken to the police station, where he refused to consent to a chemical test in violation of Minnesota state law. Bernard was charged with two counts of first-degree test refusal pursuant to state law. In Birchfield, Danny Birchfield was arrested after failing field sobriety tests after he had driven his vehicle into a ditch, but he refused to consent to a chemical test, resulting in a misdemeanor charge. He moved to dismiss the charge and claimed that the state law in question violated his Fourth Amendment right against unreasonable search and seizure. In Beylund, Steve Beylund consented to a blood alcohol to test to confirm he was driving under the influence, but only after being informed it was a criminal offense to refuse a blood alcohol test in North Dakota. The test confirmed he was over the legal limit, and Beylund was charged with driving under the influence. -- The men in these cases challenged state statutes criminalizing refusal to submit to a chemical test, arguing among other things that the statutes violated the Fourth Amendment. The Supreme Court of Minnesota and the Supreme Court of North Dakota rejected their respective challenges. The question before the U.S. Supreme Court in these consolidated cases is whether, in the absence of a warrant, a state may make it a crime for a person to refuse to take a chemical test to detect the presence of alcohol in the person’s blood. -- To discuss the case, we have Jonathan Ellis, who is an Associate at Latham & Watkins.
