Frazer Rice (00:06)Well, happy to have you on because we are now, most people sort of put their estate planning off toward the end of the year, but I have a feeling given where the legislation is going, et cetera, that the crush is going to happen earlier than we think. In the meantime, you and I were talking beforehand about some mistakes that people make from an estate planning perspective and that they're very avoidable. I thought we'd take this opportunity to go into that a little bit. David (00:48) - Structure and Other Planning Tactics Sure, absolutely. So the number one mistake that I think that people make is not having the proper estate planning documents. I see this happen time and time again. I don't know if it's because of the stigma. People are afraid to approach estate planning, right? Sometimes it makes your mortality very real. But the biggest estate planning mistake is not having the right documents. Everyone, everyone, I cannot stress, everyone needs to have at least a will, a power of attorney, and a healthcare proxy. And there are people that say, well, you know, I don't really have much, I don't need to do that, or ⁓ everything's gonna go directly to my husband and my children anyway. You know, that's how it works. But that's not exactly the case, right? You and I both know. So, especially if you have young children, young couples definitely want to have those things in place. You want to think about who is going to be the guardian for your child or your children if both of you pass away. And a lot of people don't think about that. And those only cause problems in the long run. I'll give you a quick example if we have time. But ⁓ Frazer Rice (02:02)⁓ please do. Johanna C. David (02:03) - Long Term Planning Issues and Avoiding Problems I remember, this was several years ago. I must have just started practicing and I had been a young attorney. So it was about 15 years ago and a woman came into the office and she and the decedent had been living together for about 30 years. They held themselves out to be married. Now, Frazer, you and I both know that New York does not recognize common law marriage. Frazer Rice (02:30)This is true. Johanna C. David (02:32) - Correcting a Big Will Mistake She was not aware of that. And so they were married for 30 years. Everything was in his name or excuse me, they were not married. They were together for 30 years, held themselves out to be married, not legally married. He owned the co-op apartment. Everything was in his name. Now he had a daughter from a previous marriage, legal marriage that was a strange. And you guessed it, our client did not get along with the daughter. So the father dies and guess who inherits the co-op that ...

The Seven Sons of Sceva • Sunday Service Website: www.PastorTodd.org To Give: www.ToddCoconato.com/give   The story of the seven sons of Sceva is a powerful reminder of the authority we have in Christ and the importance of having a genuine relationship with Him. This account, found in Acts 19, offers believers several lessons about spiritual authority, the dangers of imitation without faith, and the power that resides in the name of Jesus when used properly. The Story: Acts 19:11-20 (NKJV) Acts 19:11-12 (NKJV) “Now God worked unusual miracles by the hands of Paul, so that even handkerchiefs or aprons were brought from his body to the sick, and the diseases left them, and the evil spirits went out of them.” Commentary: Paul's ministry in Ephesus was marked by extraordinary miracles, as God moved mightily through him. The emphasis here is that these miracles were God's work through Paul—an important distinction. It's a reminder that miraculous works flow from God's authority, not human effort. It's also a testament to the power of God's Spirit working through a yielded vessel.* Acts 19:13 (NKJV) “Then some of the itinerant Jewish exorcists took it upon themselves to call the name of the Lord Jesus over those who had evil spirits, saying, ‘We exorcise you by the Jesus whom Paul preaches.'” Commentary: These Jewish exorcists, including the seven sons of Sceva, saw the power displayed through Paul's ministry and thought they could imitate it without truly knowing Jesus. They used Jesus' name like a magic formula, unaware that spiritual authority cannot be borrowed or mimicked. This serves as a warning against using the name of Jesus superficially or without a true connection to Him.* Acts 19:14-16 (NKJV) “Also there were seven sons of Sceva, a Jewish chief priest, who did so. And the evil spirit answered and said, ‘Jesus I know, and Paul I know; but who are you?' Then the man in whom the evil spirit was leaped on them, overpowered them, and prevailed against them, so that they fled out of that house naked and wounded.” The evil spirit recognized the authority of Jesus and the legitimacy of Paul's ministry, but the sons of Sceva had no real relationship with Christ. As a result, they were overpowered by the very force they sought to command. This demonstrates that the spiritual realm recognizes true authority, and without a genuine relationship with Christ, we lack the power to stand against evil. It also highlights the danger of engaging in spiritual matters without being properly equipped or covered by the blood of Jesus.* What Can We Learn as Believers? 1. Authority Comes From Christ Matthew 28:18 (NKJV) “And Jesus came and spoke to them, saying, ‘All authority has been given to Me in heaven and on earth.'” 2. A Genuine Relationship with Christ is Essential John 15:5 (NKJV) “I am the vine, you are the branches. He who abides in Me, and I in him, bears much fruit; for without Me you can do nothing.” 3. Demons Recognize True Authority James 2:19 (NKJV) “You believe that there is one God. You do well. Even the demons believe—and tremble!” 4. Imitation Without Relationship Leads to Defeat Ephesians 6:10-11 (NKJV) “Finally, my brethren, be strong in the Lord and in the power of His might. Put on the whole armor of God, that you may be able to stand against the wiles of the devil.” 5. Spiritual Authority Requires Submission to God James 4:7 (NKJV) “Therefore submit to God. Resist the devil and he will flee from you.” 6. True Power is Found in the Name of Jesus Philippians 2:9-10 (NKJV) “Therefore God also has highly exalted Him and given Him the name which is above every name, that at the name of Jesus every knee should bow, of those in heaven, and of those on earth, and of those under the earth.” 7. Fear of the Lord and Revival Follow True Power Acts 19:17-18 (NKJV) “This became known both to all Jews and Greeks dwelling in Ephesus; and fear fell on them all, and the name of the Lord Jesus was magnified. And many who had believed came confessing and telling their deeds.” 8. God's Power Cannot be Manipulated Acts 8:18-20 (NKJV) “And when Simon saw that through the laying on of the apostles' hands the Holy Spirit was given, he offered them money, saying, ‘Give me this power also, that anyone on whom I lay hands may receive the Holy Spirit.' But Peter said to him, ‘Your money perish with you, because you thought that the gift of God could be purchased with money!'”   The story of the seven sons of Sceva teaches us that spiritual authority comes from a genuine relationship with Jesus, not from imitation or superficial use of His name. As believers, we must be rooted in Christ, submitted to His authority, and clothed in the armor of God to stand against the enemy. We cannot wield spiritual power without true faith and alignment with God's will. The authority we carry in Christ is real and powerful, but it is only effective when we operate within the bounds of our relationship with Him and in submission to His Spirit.

The Importance of Knowing God's WaysIn this passage, Moses, a devoted servant of God, engages in a heartfelt dialogue with the Almighty. He desires a deeper comprehension of God's ways, recognising his guidance is essential for the Israelites' journey. Moses longs to know God's heart. He understands the importance of knowing God's ways. However, God allows Moses to witness his glory - his presence and his ways - only from a distance, in what is often referred to as a "thin place." Thin places are locations or moments where the boundary between the earthly and divine blurs, offering us a heightened sense of God's presence. What Can We Learn from Moses' Experience?So, what can we learn from this encounter about knowing God's ways and the role of thin places? First, we must acknowledge our longing to know God's ways. Thin places can serve as a reminder of God's sovereignty. They encourage us to reflect on the profound mysteries of his ways. The blurring of boundaries in these moments signifies that God's wisdom often transcends our human comprehension. When we create "thin places" through prayer, meditation, or quiet reflection, we open ourselves to a deeper understanding of God's ways. These sacred moments allow us to see his heart more clearly and grasp the significance of his guidance. It is essential for us know God's ways. Let's commit to spending time with him in the "thin places" in our lives. Nothing From Nothing Leaves NothingIn 1974, Billy Preston, affectionally known as the fifth Beatle, had one of his major hits with the song “Nothing from Nothing,” which reached #1 on the Billboard Hot 100 for one week in October of that year. There was not much substance to the lyrics of his song, just a catchy phrase and an upbeat melody, but the overriding message of the title still rings true today. If you put nothing in, you'll get nothing out. There is no free ride, no free lunch. Success doesn't just happen, it's the result of hard work. Nothing is ever truly free, it always costs someone, something. Same is true in our spiritual lives. Even the free gift of salvation cost Christ His life. Jesus said we must deny ourselves, pick up our cross daily, in order to follow Him (Luke 9:23). Likewise, in the wilderness where God provided manna to feed His children for forty years, He still required them to get off their backsides and go out each morning and pick it up. God didn't employ Door Dash to foster their laziness. We see God's admonitions against the lazy and slothful throughout the Proverbs. Let's take this passage, for example. The soul of a lazy man desires and has nothing; but the soul of the diligent shall be made rich – Proverbs 13:4. And, as usual, we need to understand what the verse says before we can determine what it means. The soul (nep̱eš – the inner being with its thoughts and emotions, breath, the entire person, the seat of one's personality, their mind, will, passions, and volition, everything that makes them who they are) of a lazy man (ʿāṣēl – sluggish, slothful, useless, someone who will always fail because of laziness that becomes moral failure, a person who is undisciplined to work or exert himself) desires (ʾāwāh – to want strongly, to long for, to crave) and has nothing (ʾayin – none, no, not, nothing, nonexistence, without. Note: “he hates the process by which results are to be obtained”); but (conjunction, contrast) the soul (nep̱eš – the inner being with its thoughts and emotions, breath, the entire person, the seat of one's personality, their mind, will, passions, and volition, everything that makes them who they are) of the diligent (ḥārûṣ – sharp, industrious, a person who is characterized by care and perseverance in carrying out tasks. Note: diligence is not satisfied with desire, but with possession) shall be made rich (dāšēn – to be satisfied, to grow fat, having an abundance, thrive, to be made prosperous, to be richly supplied). So what is this passage saying? And what lessons can we take home from the life of a lazy, slothful, sluggard? What Can We Learn from a Lazy Man?Looking elsewhere in Proverbs, we find the lazy man will begin nothing. He is content to live in whatever squalor his apathy and laziness provide. He has no internal motivation to better himself other than the growl in his belly and will work only long enough to silence it for one day. What a sad state of a human being, especially a Christian. How long will you slumber, O sluggard? (No answer) When will you rise from your sleep? (Again, he doesn't know) A little sleep, a little slumber, a little folding of the hands to sleep— so shall your poverty come on you like a prowler, and your need like an armed man – Proverbs 6:9-11. We also discover that, if on a wild whim, the lazy man actually begins something, he will never finish it. Just beginning zaps all his energy and drive and whatever impulse prompted him to start, it is never enough to see the task to completion. The lazy man does not roast what he took in hunting, but diligence is man's precious possession – Proverbs 12:27. He works to accomplish something and then lets it spoil because he is too tired or too lazy to finish what he began. A lazy man buries his hand in the bowl, and...

You've probably heard people say that our dogs can "read" our emotions and moods, but is there science to back that up?! A group of researchers set out to answer that question and found an alarming answer. YES. Our dogs can and do pick up on the chemical changes in our bodies. THE STUDY The group started by having human participants watch either a clip that induced fear or happiness in the viewers. As they watched a clip, researchers collected a sample of their sweat. The second part of the study is where the dogs became involved. In a room, the researchers placed a dog with 3 things in the room. 1. Their pup parent (not trying to interact with or sway the dog) 2. A stranger (not trying to interact with or sway the dog) 3. A sampling of the sweat collected from human participants The sample of sweat was either (1) the "fear" sweat, (2) the "happy" sweat or (3) no sweat at all. The dogs were hooked up to heart rate monitors. On top of that, the researchers were viewing to see where the dogs ventured, where they looked, etc. The results were staggeringly clear. When the dogs smelled the human "fear" sweat, their heart rates went up and they showed clear signs of fear and anxiety. The dogs would sometimes even try to hide or cower behind their humans. When the dogs smelled the human "happy" sweat they had lower heart rates (than the "fear" test) and even showed more interaction with the strangers. WHAT CAN WE LEARN? A study like this has a couple of major takeaways. First, our dogs DO pick up on changes in our emotions and feelings. Even when we may not think we are exhibiting new feelings or emotions, our body changes. And when the chemicals in our body change, our dogs take notice. This is why dogs are so skilled at being emotional support animals because they can often sense problems before their human counterparts can. Additionally, from a dog training and behavior standpoint, this study emphasizes the importance of our own emotions when we interact and train our dogs. If we are constantly feeling anxious or overwhelmed when training, our dogs will pick up on that and mimic those feelings. Rick Garza Marijuana, What Can We Learn from Washington State?   On October 17, 2018, Canada will become the second nation, after Uruguay, to legalize marijuana. In doing so we have stepped outside of our commitment to the United Nations to restrict the use of Schedule 1 controlled substances. To date, the UN and other nations have not responded negatively to our new legislation.   Perhaps they are waiting and watching before determining if a response is required. Perhaps we can establish national protocols that will become an international standard. But where do we turn to for insights into the path from prohibition to legalization?   The first state in the United States to legalize marijuana was Washington State, what lessons can we learn from its experience with legalization?   Does marijuana use increase? Do DUI’s rise, how do you measure, monitor and ensure the highest standards? And how do you ensure use among teens does not increase? The issues are many and they cover everything from policing to public health, growing, producing, quality, retail and tax collection.   Will banks allow marijuana producers, processors and retailers to open bank accounts? Without them how are taxes paid? In Washington State, the national banks all said they were not going to launder drug money. The state had to pass a bill that allowed local banks to accept money from registered marijuana retailers and producers. Do we have to do the same here in Canada? Government requests come in multiple forms. They can come in as requests for client information or even in the form of investigating your company or your employees. Requests for Client Information General Rule to Follow Without understanding the nuances of criminal and constitutional law and having to cite Supreme Court cases, any government requests for your client's information are rarely urgent and contemporaneous, i.e. usually they are made through formal channels and you are given time to comply. In such cases, it is only prudent to procure legal representation. Failure to do so could open yourself to liability in the event that you release information when you should not have or if you do not release information when you should have done so. The more difficult situations arise when a police officer or other government official shows up at your business' lobby, such was the case at the hospital in Salt Lake City, Utah. Salt Lake City Hospital Nurse Arrest Incident A Utah nurse was aggressively arrested when an officer claimed she was interfering in an investigation after she refused to let him get a blood sample from an unconscious patient.; The Salt lake City police detective requested a blood sample from an unconscious admitted patient who suffered injuries from a fiery crash. Nurse Alex Wubbles, now famous from her viral arrest video, correctly explained to the the detective that hospital policy (and according to a 2016 Supreme Court case,;Birchfield v. North Dakota) barred a blood draw unless the patient is under arrest, or there is a warrant allowing the draw or the patient consents. ; Here is the 30 minute raw video of Officer Payne's body cam: [youtube]https://www.youtube.com/watch?v=9Piuenvb-Zg[/youtube] Days and weeks after, nurses, hospitals, and rights advocates alike were praising the efforts of Nurse Wubbles' confident position. She handled an obviously irate detective that seems to have intended to intimidate his way into obtaining a blood sample of an unconscious victim of a car accident, who later passed away from his injuries. In this instance, the hospital clearly had a written policy for such requests. Even citing the law, the hospital defended its nurse to explain that without a warrant or an arrest, there is no implied consent to draw blood (unlike a breathalyzer, which was also discussed in;Birchfield). What Can We Learn from Nurse Wubbles and her Hospital? First, it is extremely difficult for any employee, whether executive or operational level, to respond to government official requests--especially live requests from police officers or detectives. This means that employees need training. They need to understand when they have a right to refuse, when they should comply, or how they should do so. Nurse Wubbles handled herself very calmly and only until it was proclaimed that she was being placed under arrest did she show any exclaimed response. For the viewer, the response was a natural consequence to the unlawful arrest. Nurse Wubbles was clearly trained on how to deal with this situation, though the new revised hospital policy has it so that police are not to interact with the nurses but must work directly with department heads for such requests. Second, the hospital actually had a written policy. You can see in the video that she is referencing specific guidelines on what to do in such circumstances. Hospitals routinely receive such requests, and so it would make sense for them to have such a written policy, but hospitals are not the only common recipient for request of client information. How Do Data Giants Like Google and AirBnB Handle Data Requests for User's Data? Most online companies that store large amount of client data have received data requests from government agencies. It is inevitable that one of your clients will be involved in some criminal investigations or even civil; disputes.; Many of these companies actually post their policies online. For example,
