While some members of congress, like AOC and Dollar Store Obama were giving finger-wagging warnings, DHS continued to relay the facts of the case. We also got to watch Rep. Daniel Goldman (D-NY) get ripped by both DHS Secretary Kristi Noem and Rep. Marjorie Taylor Greene (R-GA). We again remind you how over-educated liberals are some of the most bigoted, condescending and despicable people. In that light, looks like the Wisconsin judge who aided and abetted the illegal out of her courtroom has been formally indicted by a Federal Grand Jury. I'm going to read a bit from the website NCResistsTheGrandJury.Wordpress.Com: What is a Grand Jury? In the federal legal system, the grand jury is used to decide whether someone should be charged (“indicted”) for a serious crime. The grand jury hears evidence presented by the prosecutor: the U.S. Attorney. The grand jury uses subpoenas to gather this evidence. It can subpoena documents, physical evidence, and witnesses to testify. The “special” federal grand jury, created in 1970, can be used to investigate “possible” organized criminal activity rather than a specific crime. The California legal system also has grand juries, but it is optional whether criminal prosecutions are initiated by grand jury indictment, or by a complaint by the District Attorney and preliminary hearing before a judge. How is a Grand Jury Different Than a Trial Jury? Unlike the “petit” jury, which is used to determine guilt in a trial, a grand jury consists of 16 to 23 jurors who are not screened for bias. The purpose of the grand jury is not to determine guilt or innocence, but to decide whether there is probable cause to prosecute someone for a felony crime. The grand jury operates in secrecy and the normal rules of evidence do not apply. The prosecutor runs the proceedings and no judge is present. Defense lawyers are not allowed to be present in the grand jury room and cannot present evidence, but may be available outside the room to consult with witnesses. The prosecutor and the grand jury members may not reveal what occurred in the grand jury room and witnesses cannot obtain a transcript of their testimony. How Has the Grand Jury Been Used by the State? Because of their broad subpoena powers and secretive nature, grand juries have been used by the government to gather information on political movements and to disrupt those movements by causing fear and mistrust. The grand jury lends itself to being used for improper political investigation due in part to the prosecutor's ability to question witnesses without regard for rules that prohibit irrelevant, unreliable or unlawfully obtained evidence. Those called before the grand jury may be compelled to answer any question, even those relating to lawful personal and political activities. That information has been used by the government as a basis to conduct further surveillance and disruption of political dissent. When used against political movements, the grand jury causes fear and mistrust because persons who refuse to answer questions about their First Amendment political activities, friends and associates may be jailed for the life of the grand jury: up to 18 months. If a witness asserts their Fifth Amendment right to remain silent, they may be forced to accept immunity or go to jail for contempt. Even a witness who attempts to cooperate can be jailed if minor inconsistencies are found in their testimony. Such a perjury charge may stand even when the grand jury fails to hand down any indictment for what it was ostensibly investigating. The grand jury is a complicated and opaque process, by design.  Our movements have decades of experience resisting grand juries, and there are resources available to learn more and support those who resist. Tom Fitton says the Trump indictment is run by ideologues and the DOJ Garland team and their appointees in the name of Jack Smith. They're using the Federal Grand Jury to target their political opponent and the Republican Party. The Special Counsel has refused to release the names of everyone working on his staff and Tom Fitton says there's no legal basis to withhold names from the public. Fitton says the Justice Department was upset when it was reported that he told Trump the DOJ analysis of the records issues was all wrong and that the President has a right to have those records. They are the President's personal records. Fitton says Trump shouldn't be accused of doing something wrong because they were his to keep. Judicial Watch has 30 years experience litigating federal records law and know what they're talking about. FBI had actually served Fitton with a subpoena last year when the Biden records started popping up. Fitton says right then he knew Biden had a records problem. Tom believes they sent the FBI to his home this spring to serve a subpoena to intimidate Judicial Watch and Tom. And he had to testify before a Grand Jury, without a lawyer. Joe Exotic Arrested for Murder for Hire Today Joe Schreibvogel Maldonado-Passage, aka “Joe Exotic,” was arrested after indicted by a Federal Grand Jury on two counts of “murder for hire” for seeking to hire someone to murder Carole Baskin, CEO of Big Cat Rescue. Maldonado had made threats online over a period of years including a video of him shooting in the head a blow up doll dressed to look like Carole and an image hanging her in effigy.   “It is important to understand that this is not the isolated act of one crazy bad apple,” Baskin said. “A significant part of our mission has been to stop mistreatment and exploitation big cats at roadside zoos, particularly those who rip tiger cubs from their mothers at birth to charge the public to pet and take photos with them. Because Big Cat Rescue has been a leader in working to stop what we view as abuse of big cats and been very effective in our work, I have received multiple death threats over the years, including at one point a number of snakes placed in my mailbox. According to the FBI, animal abuse is highly correlated with human-to-human violence.”   Maldonado ran, in our view, one of the most notorious cub petting roadside zoos in the country in Wynnewood, OK. Years ago he also operated a traveling exhibit that would bring cubs to malls throughout the Midwest and Southwest. When Big Cat Rescue educated the malls about the miserable life this created for the cubs and the malls started cancelling Maldonado's traveling exhibit, Maldonado retaliated by renaming his traveling show “Big Cat Rescue Entertainment” in order to confuse the public into thinking the show was operated by Big Cat Rescue. In 2011 Big Cat Rescue sued for violations of its intellectual property rights and in 2013 was granted a consent judgment for over $1 million. Litigation to collect on the judgment has been ongoing since then in Oklahoma.   We are ENORMOUSLY grateful to the U.S. Fish & Wildlife Service, the FBI, the US Attorney's Office for the Western District of Oklahoma and the U.S. Marshall's Service for the many months of incredibly hard work that went into this investigation and arrest.   Hi, I'm Carole Baskin and I've been writing my story since I was able to write, but when the media goes to share it, they only choose the parts that fit their idea of what will generate views.  These are my views and opinions. It's been nearly half a decade since thousands of indigenous water and land defenders and their accomplices and allies weathered a difficult winter and attacks by law enforcement and private security attempting to push through the Dakota Access Pipeline through so-called North Dakota. The DAPL was eventually built and has already, unsurprisingly damaged the lands, waters and sacred sites of the Standing Rock Sioux and other people native to the area. Resistance has also continued to this and other extractions and pipeline projects across Turtle Island and the defense against DAPL surely inspired and fed many other points of opposition in defense of the earth and native sovereignty. On one night in November, 2016, as government goons leveled fire hoses and “less-lethal” armaments at water defenders in freezing temperatures, Sophia Wilansky suffered an injury from an explosion that nearly took her arm. An Indigenous and Chicano former employee of another pipeline project named Steve Martinez volunteered to drive Sophia to the hospital in Bismark. For this, he was subpoenaed to a Federal Grand Jury, which he refused to participate in. Now, almost 4 and a half years later, Steve is being imprisoned for resisting another FGJ in Bismark. For the hour, we hear from Chava Shapiro with the Tucson Anti-Repression Committee and James Clark, a lawyer who works with the National Lawyers Guild, talk about Steve's case, the dangers of Grand Juries, and why it's imperative for movements to support their incarcerated comrades. June 11th 2020: Marius Mason support and words from Jeremy Hammond In this June 11th podcast special, we're happy to feature two interviews. The first is with Letha, a supporter of anarchist prisoner Marius Mason who is 7 years from release for animal and earth liberation front actions in the late 1990's. Marius, who tested positive for covid-19 recently at FCI Danbury, continues his activism including on behalf of other trans folks behind bars as well as to write and create. Then I spoke with Jeremy Hammond who is an anarchist prisoner supported by June11th for hactivist activities in the early 2010's as a member of Anonymous and other crews that released information to WikiLeaks to expose corporate and police spying and abuse and war crimes, as well as supporting whistleblowers in the Global War on Terror like Chelsea Manning. Jeremy also recently resisted a Federal Grand Jury around WikiLeaks with Chelsea Manning, he contracted covid-19 recently, and currently produces a podcast with his brother, Jason, called Twin Trouble which is in the Channel Zero Network. More on Jeremy's case at FreeJeremy.Net By way of introduction, June 11th is an important day for Anarchists. It began as a day of solidarity with Jeff “Free” Luers, an eco-anarchist who received a sentence of 22 years and 8 months in 2004 for burning 3 SUIVs on a car lot in Eugene, Oregon. Leurs was eventually released in 2009. In 2010, after the waves of the Green Scare subsided, the day was shifted to support Marius Mason and Eric McDavid. There is a history of June 11th written up at june11.org by Crimethinc from a few years back that is very thorough if you want more details. Suffice to say, Eric was released, Marius continues to sit behind bars. Since then, the list of long term anarchist prisoners has expanded as our numbers keep growing on the outside. The efforts to support those inside and to expand the struggles of those comrades behind bars also builds. As we recognize and are inspired by those who have stood up to inhuman power structures and suffered huge consequences, remember that not everyone has been caught, that being caught isn't always the end, and that we still have fight in us. Gord Hill on Art and Resistance Gord Hill is an indigenous author, anarchist, antifascist and militant, a member of the Kwakwaka'wakw nation living in so-called British Columbia, Canada. Gord is also graphic artist and comic book author who most recently published The Antifa Comic Book, out from Arsenal Pulp Press, and runs the website Warrior Publications and sometimes publishes under the nom-de-plume of ZigZag. For the hour we speak about his writings documenting indigenous resistance history in the so-called Americas (mostly with a focus on Turtle Island), antifascist organizing, intersections of indigenous struggle and anarchism and critiques of Pacifism (see Gord's “Smash Pacifism” zine). (Sean Swain at 3min 55sec, Gord Hill at 11min 27sec, announces at 57min 29sec) Rayquan Borum Trial Update In a brief and sad update to last week's interview on the case of Rayquan Borum, we'd like to read a statement from the fedbook page for Charlotte Uprising: We are deeply saddened to report that Rayquan Borum has been found guilty of possession of a firearm and second degree murder with him being sentenced to 25/26 years in a cage. We knew it would be difficult to receive a fair trial in the same court that allowed Officer Randall Kerrick to walk free for the murder of unarmed Jonathan Ferrell. We know the police will continue to kill Black and brown folks and escape accountability. We suffered extreme suppression from the judge from the start of the trial. Even though the medical examiner testified there was a 51% chance that ANYTHING else killed Justin Carr, Judge Hayes would not allow any testimony naming the police. Of course, it is far easier to scapegoat a random Black man than to launch an investigation into the same police force that killed ONLY Black people in 2015. We also know that Justin Carr would be alive were it not for the Charlotte Mecklenburg Police Department murder of Keith Lamont Scott (no trial for that officer, of course). We know that the Mecklenburg County Courts disproportionately sentence Black and brown bodies to time in cages. We know that CMPD disproportionately arrests Black and brown folks. Black people are 30% of Charlotte's population and make up about 70% of the jail population. Heinous. We know that this is the American Way. In response, we will continue to rise up and resist this colonized nation and work toward building a more decolonized world, for all of us. A support committee called “Chelsea Resists!” has been set up and updates will be coming from the website xychelsea.is and there's a fundraiser up at actionnetwork.com for her as well. We hope to feature members of her support as well as former Grand Jury resisters who've been on this show before in an episode soon. Trusdale Adult Detention Center 2001 Mill Road Alexandria, VA 22314 Some quick guidelines to keep her safer while writing are in the show notes Address your letter exactly as shown above send letters on white paper use the mail service to send letters include color drawings if you'd like sparingly send 4x6 photos, as she may only keep 10 at a time Do not send cards, packages, postcards, photocopies or cash Do not decorate the outside of the envelope do not send books or magazines Exonerated Vaughn 17 prisoners transferred out of state As the cases proceed against the Vaughn17, 17 prisoners on trial in Delaware for a prison uprising following the election of Trump as president, an uprising sometimes compared to the Lucasville Uprising, repression continues. The uprising was as follows: prisoners took over Building C at the Vaughn prison in Smyrna, Delaware, and took three prison guards and one prison counselor hostage. Demands issued during the hostage standoff included that Delaware Governor John Carney investigate poor living conditions at the facility. One correctional officer who was taken hostage, Steven Floyd, would later be found dead after police re-entered the facility. The case can be followed at vaughn17support.org as it enters it's third trial group. A few words from the support site note the continued repression of some of the court-exonerated prisoners: The State of Delaware retaliated against defendants in the Vaughn uprising trial last week, by moving them out of state to Pennsylvania. Kevin Berry, Abednego Baynes, Obadiah Miller, Johnny Bramble, Dwayne Staats, and Jarreau Ayers were all transferred to solitary confinement at SCI Camp Hill, a maximum security facility. They joined Deric Forney, who was transferred weeks earlier in January. Berry, Baynes, and Forney have all been fully acquitted on all charges. “It's unusual to move prisoners with short terms left in their sentence out of state,” said Fariha Huriya, an organizer working closely with Vaughn 17 prisoners. “They're being held in solitary confinement, with no showers, no access to commissary, and limited phone calls. It's the same inhumane conditions that they faced at James T. Vaughn.” “The State's vindictiveness will cost them,” said Betty Rothstein, who also organizes with the prisoners. “The Vaughn 17 have resisted these charges, and will continue to resist and expose the corruption of the DOC and abuse on prisoners.” There are nine defendants who are still awaiting trial. New trial dates for groups 3 and 4 are scheduled for May 6th, 2019, and October 21st, 2019. . ... . .. Playlist

On Monday, July 31st, people will gather in Greensboro at 9am at the Federal Courthouse, 324 W. Market St in order to support Katie Yow, who is refusing to comply with a Federal Grand Jury convening there to which she's been subpoena'd. And here's an update from Katie on what she's learned about the fgj: "We have now learned more from the Assistant US Attorney about the subject of the federal grand jury to which I have been subpoenaed. This grand jury is looking into what the government has described as a bombing at the GOP headquarters in Hillsborough, NC this past fall. The AUSA has also indicated that they are interested in "other people" and "other events." I don't know anything relevant to a criminal investigation of the alleged incident at the GOP headquarters. The broad nature of the government's interest in other information makes clear the way that this and other grand juries are used as fishing expeditions to attempt to coerce testimony on 1st amendment protected information. This is one of the many ways grand juries are used to repress social movements, and one of many reasons why we resist them. Whatever new information we may learn about this grand jury, I will continue to refuse to cooperate. We didn't have to know what this grand jury was about to know what we are about. Our values are long held, they are nurtured through both triumph and incredible loss, and they cannot be compromised. My resistance to this grand jury is the easiest decision I have ever made, even if the consequences may be difficult. I will continue to refuse to comply with this subpoena, and I have every faith in my community's ability to support me in doing so." If yr feeling it, show up in Greensboro on Monday to show support! Longtime North Carolinian, organizer and anarchist, Katie Yow has just released a statement that she's been subpoena'd to a Federal Grand Jury in Greensboro and will be refusing to cooperate. We at the Final Straw Radio wish to express our care and support to Katie as she faces down this threat with our hearts full of the knowledge that she won't be resisting this alone, but alongside all of us who know that backing down is not a choice. Some Upcoming Events In the Asheville area, here are a few upcoming events: On Thursday, July 20th at 7:30pm at Firestorm there'll be a showing of Trouble #4, about movement defense and resisting repression followed by episode 2 of Channel (A)!, a compilation of screen representation of anarchists from popular media. This event sits in the international week of solidarity from July 20-27th with J20 defendants from the inauguration protests in D.C. this year. “We are calling for a Week of Solidarity with the J20 defendants from July 20 to 27, 2017. July 20 marks six months from the initial actions and arrests during Donald Trump's inauguration, and on July 27, a motion to dismiss the charges will be argued in court. On January 20, 2017, tens of thousands of people converged in Washington, D.C. for the DisruptJ20 protests to oppose the inauguration of yet another president. A combination of blockades, marches, and festive demonstrations shattered the spectacle of a peaceful transition of power. Unfortunately, with resistance comes repression. Approximately 214 arrestees now face a total of eight felony charges a piece, including conspiracy and destruction of property. All of the J20 defendants are now facing up to 75 years in prison. The majority of defendants are working together, collectively responding to the charges and using solidarity to push back against the state. How effectively we support the inauguration day defendants will determine how effectively anyone can keep resisting under the Trump administration. From the original announcement “In July 2017, the rulers of the world's 20 most powerful nations met in Hamburg, Germany to coordinate the preservation of capitalism and state power at the expense of humanity and the natural world. Over 20,000 police were brought into the city in order to brutally suppress dissent. Yet the more violently the police attacked demonstrators, the more the general population of Hamburg came together in rebellion against them. In the end, in response to escalating attempts at repression, massive riots paralyzed the city, with some areas becoming police-free zones.
