In this episode of the Bill Press Pod, Bill interviews Ellie Mystal, Legal Analyst and Justice Correspondent for The Nation, on his new book, Bad Law: Ten Popular Laws That Are Ruining America. Mystal identifies ten laws plus a constitutional amendment that he argues are detrimental to America. During their conversation, they discuss the misconception of DEI (Diversity, Equity, and Inclusion) as redefined by Republicans, the problematic impact of the Hyde Amendment on abortion rights, and the adverse effects of mandatory minimum sentencing from crime bills supported by both Democrats and Republicans. They also delve into voting rights, gun liability laws, and the lack of effective representation in Congress, suggesting reforms like the Wyoming Rule for more equitable representation. Mystal underscores the role of neoliberalism in shaping harmful laws and calls for a reevaluation of laws passed before the 1965 Voting Rights Act.You can purchase your own copy of Elie Mystal's new book here.Today Bill highlights the work of The Nation magazine. Julian O'Neill, Crime and Justice Correspondent with BBC News Northern Ireland, outlines how a new report has confirmed human remains found in a grave in Co Monaghan last November are not those of Joe Lynskey.
In this episode, Bill and Elie Mystal, The Nation Magazine's Justice Correspondent, discuss the ongoing chaos and damage caused by the Trump administration and its close ties to Elon Musk including: The firing of prominent Black figures like Joy Reid of MSNBC and former Chairman of the Joint Chiefs of Staff General Charles Q. Brown Jr., which Mystal argues is part of a broader effort to remove Black voices and influence from the government and media. Concerns about Trump and Musk's disregard for the rule of law, including their apparent willingness to defy court orders and undermine federal agencies and regulations. The lack of meaningful checks on Trump's power, with Mystal arguing the courts and Congress have become ineffective in constraining the executive branch. The broader context of ongoing efforts to roll back Civil Rights progress and return to more overt forms of racism and discrimination under the guise of "merit-based" hiring.Despite the bleak outlook, Mystal maintains a glimmer of hope that the current authoritarian push will ultimately be short-lived, drawing parallels to the fall of other historical regimes that sought to establish long-lasting dictatorships. You can read Mystal at The Nation and pre-order his new book, Bad Law: Ten Popular Laws That are Ruining America at Bookshop.org. There's a troubling sense of normalcy bias among some Democratic leaders who believe they'll regain their footing in the 2026 midterms, riding another anti-Trump wave. But here's the critical question: will the United States even have free and fair elections? To answer that, we need to look back and ask: was the 2024 U.S. election free and fair? Elon Musk and Donald Trump, and those around them, break the law so brazenly, how can we trust they came to power without breaking the law? According to investigative journalist Greg Palast, this week's guest and director of the must-see film Vigilantes Inc., which you can watch for free, the answer is a resounding no. Palast's analysis reveals the shocking normalization of Republican voter suppression: over 3.5 million votes were effectively canceled in 2024. This means 3.5 million Americans were denied their fundamental right to vote. And according to Palast, a significant number of suppressed voters are nonwhite. This isn't just voter suppression; it's a modern-day resurrection of Jim Crow, fueled by the Republican Party's relentless assault on democracy. In this week's bonus episode, out Friday, Elie Mystal, the Justice Correspondent for The Nation, and author of the new book Bad Law: Ten Popular Laws That Are Ruining America, explains how the GOP's reaction to the first Black president was to gut the Voting Rights Act, paving the way for Trump. In this week's bonus episode, we also continue our conversation with Palast, diving into the power of film as a powerful force for confronting America's darkest history. Plus, we'll also hear from Mystal on why European nations must take a stand by imposing a travel ban on Ivanka Trump and others complicit in the destruction of our democracy—a move that could help hold the Musk-Trump regime accountable for its action, along with divestment strategies that brought down Apartheid. One of the most striking aspects of living under a dictatorship is how eerily normal life can appear on the surface. The sun still rises, children still play in parks. Yet, beneath this façade of normalcy, the foundations of democracy are being purged. Drug-fueled Nazi oligarchs, emboldened by their unchecked power, withhold critical funding, endanger lives, and proudly defy the courts. They destroy the rule of law and unleash a culture of corruption, all while the world watches America turn into a failed state. Joining us to unpack this dystopian nightmare, as well as what must be done to overcome this global threat, is Elie Mystal, Justice Correspondent for The Nation and author of the new book Bad Law: Ten Popular Laws That Are Ruining America. Mystal, a prophetic voice in the fight for democracy, breaks down what Biden and the Democrats should have done to curb Trump and MAGA extremism when they had the chance. (We'll be shouting we told you so all the way to the gulag!) He explains why Merrick Garland was, as we warned, a threat to democracy, what actions Democrats and the people must take now in the limited time we have left, and why New York State Attorney General Tish James serves as a vital reminder of the importance of local resistance. Most importantly, Mystal calls on world leaders to divest from America, an urgent strategy that helped bring down apartheid. This week's bonus show is our live recording with Russian mafia expert Olga Lautman, who answers listener questions about combating the Russian-backed fascist threat of the Musk/Trump regime. We also discuss Trump and Russia's attempts to strongarm Ukraine into a deal that would buy Russia time to continue its genocidal invasion. Don't miss this special episode, coming to you on Friday. Be sure to subscribe at Patreon.com/Gaslit to submit your questions, get all shows ad free, and hear the full bonus episode! Why is DeJoy still in charge? Well, it all comes down to numbers—specifically, the ones the Democrats don't have yet. The USPS Board of Governors is still short of the votes needed to remove Louis DeJoy. There's a glimmer of hope on the horizon with Biden's nominations of former Florida Rep. Val Demings and former Labor Secretary Marty Walsh, but they need to get through Senate confirmation first. Even if that happens, the entire Democratic bloc on the board has to agree to boot DeJoy. And here's the kicker: they'll also need an Independent to back them. Now, about that Independent, Amber McReynolds: she was appointed by Biden. But, plot twist—this Biden appointee has gone on record saying the USPS is doing just fine. So yeah, not exactly a slam dunk for Team “Fire DeJoy.” This is how corruption is allowed to fester—DeJoy stays, he enriches his family through shady deals, and the USPS, along with its overworked staff, remains on the chopping block. It's the Reaganomics playbook: shrink government services, weaken unions, and let privatization sweep in to pick at the bones. All while the people who depend on these services are left with empty mailboxes and a dysfunctional system. Welcome to DeJoy's America! This week's bonus show includes a fiery continuation of Gaslit Nation's interview with Elie Mystal, Justice Correspondent for The Nation and author of the bestselling book Allow Me to Retort A Black Guy's Guide to the Constitution. How do we protect ourselves from Trump's MAGA Supreme Court? Expand the court like our lives depend on it, because they do! Elie Mystal, the Justice Correspondent for The Nation, and the author of the New York Times bestselling book Allow Me to Retort: A Black Guy's Guide to the Constitution, joins Gaslit Nation to discuss urgently needed judicial reform and how to do it. One of the first things the Nazis did was take over the judiciary in Germany. Republicans have long waged lawfare against our democracy, and now they're just one election away from establishing a dictatorship. The far-right's long-game has been met with hand-wringing, complacency, and neoliberalism from Democrats. And now we're out of time, making court expanding an urgent priority for our nation, should Kamala Harris win. But will the Supreme Court steal the election for Republicans, like they did for George W. Bush in 2000? That and Trump's cult of toxic masculinity are discussed in this week's Gaslit Nation, also featuring Terrell Starr of the Black Diplomats Podcast and Substack. This week's bonus show, available for our subscribers at the Truth-teller ($5/month) level and higher, continues the conversation with a special focus on dangerous Attorney General Merrick Garland, and answers questions from our listeners at the Democracy Defender ($10/month) and higher for our bonus Q&A. ELIE MYSTAL, Justice Correspondent for The Nation magazine and a contributor to MSNBC, opens his first book, ALLOW ME TO RETORT: A Black Guy's Guide to the Constitution, with the following words: “Our Constitution is not good. It is a document designed to create a society of enduring white male dominance, hastily edited in the margins to allow for what basic political rights white men could be convinced to share.” His starting point is that far from perfect, this document of compromises necessary to win ratification from slave-owners is unworthy of the veneration promoted by the Right and accepted by too many on the Left. Once we get over that, perhaps we can roll up our sleeves and get to work to bring some of its underlying ideals to the real world.

I've been horribly disillusioned by the corporate media, especially the outlets that purport to serve a progressive audience. But I do have to thank MSNBC for introducing me to the always brilliant Elie Mystal. I've been honored by his presence on this program a few times, and am thrilled to welcome him back today as his first book, "Allow Me To Retort: A Black Guy's Guide to the Constitution" is just released. Elie's premise that the constitution is "trash" raised some eyebrows on The View last week. That's because they don't know Elie. I get it... he'll explain! Of course, we'll begin with the latest news. And I'll share this weekend's updates from our friend in Ukraine, Tatiana from the Friends Forever Hostel in Kyiv (though she's no longer there...). We have been in contact, and I'll bring you up to speed. Then, we're joined by someone who's always one of my favorite guests! Elie Mystal is Justice Correspondent for The Nation, and his new book was just released last week. We'll talk about "Allow me to Retort: A Black Guy's Guide to the Constitution"
President Biden has addressed the nation for the first time and we couldn't help but notice some glaring omissions from his speech. It left us scratching our heads and wondering if we're the ones making too big of a deal out of the GOP's authoritarian regime. So, to help us make sense of this nonsense we brought in reinforcements--Justice Correspondent for the Nation, Elie Mystal! Hold onto your hats, we're coming in hot. Hosts: Danielle Moodie & Wajahat Ali Executive Producer: Adell Coleman Senior Producer: Quinton Hill Distributor: DCP Entertainment
Renato and Patti discussed hot legal topics, including U.S. Supreme Court, voting rights, and a potential prosecution of Donald Trump and his allies. They were joined by Elie Mystal, Justice Correspondent for The Nation.
Elie Mystal is Justice Correspondent at The Nation and he's back to discuss the current threat against Affirmative Action via our Supreme Court. SCOTUS took up two cases–one from Harvard and one from UNC, but Elie explains they are fundamentally the same case: a group of Asian-American students claim they outperform African-Americans and Latinos, but are still underrepresented at their universities. And in certain ways, their claims are valid–but the big problem stems from the person hiding behind those students, and is responsible for putting them up to it in the first place: Ed Blum. And if you don't know Ed Blum, he's made it his life's work to unravel civil rights advancements. It's a complicated situation with a lot of nuance but Elie breaks it down in his expert fashion to help us understand what's at stake and why the conversative supreme court could our worst fears through this time around. Elie Mystal, Legal Analyst and Justice Correspondent for The Nation, stops by Broken Law to talk with Jeanne Hruska about what he means when he says, "you either control the Supreme Court or you control nothing.” They discus the Supreme Court's role in creating the voting rights crisis confronting the country and the Court's mounting assault on the executive branch. Elie concludes by making the case for why having fifty justices on the Court could actually make sense. ----------------- Join the Progressive Legal Movement Today: ACSLaw.org Today's Host: Jeanne Hruska, ACS Senior Advisor for Communications and Strategy Guest: Elie Mystal, Legal Analyst and Justice Correspondent, The Nation Link: Allow Me to Retort, by Elie Mystal Visit the Podcast Website: Broken Law Podcast Email the Show: Podcast@ACSLaw.org Follow ACS on Social Media: Facebook | Instagram | Twitter | LinkedIn | YouTube ----------------- Production House: Flint Stone Media Copyright of American Constitution Society 2022.

Federal judges do die and retire, but usually not before a lifetime on the bench, so what does President Donald Trump's legacy of 245 appointed judges mean for progress in America? Elie Mystal, Justice Correspondent for The Nation, says the only way mitigate the Trump effect on the Federal Courts is to pack 'em ...from the District Courts to the Supreme. And he says, the Democrats better act fast before GOP gerrymandering re-shapes the 2022 Election.
Here's your WORT podcast bonus episode for October 18th, 2020: Thursday was the final day of Senate Judiciary Committee hearings for Amy Coney Barrett. The Committee has set a panel vote on Barrett's appointment to the U.S. Supreme Court for October 22nd, after which she'll be sent to the Senate floor for a final confirmation. Now, some Democrats are considering adding supreme court justices to the high court -- a process known as “court packing” -- in an effort to dilute the conservative justices. For more on Barrett's nomination, and why court packing isn't as unprecedented as some make it out to be, WORT Producer Jonah Chester spoke with Elie Mystal, Justice Correspondent for The Nation magazine. A shortened version of this conversation originally ran on the WORT 6 O'Clock News on October 15th, 2020.
Elie Mystal, Justice Correspondent at The Nation, talks with Lee Pacchia about the actual legislation and policy reforms likely to emerge from the recent spate of Black Lives Matter protests sweeping across the United States.
