Russia's aggression against Ukraine has been ongoing for 10 years. It started with the occupation of Crimea and parts of the Donbas in 2014 and culminated in the full-scale invasion in 2022. Various domestic and international justice initiatives to ensure accountability for war crimes and other conflict related violations have been unfolding since 2014. However, 2022 marked the start of a new important debate. How can Russia be held accountable for the underlying crime of aggression? In this RevDem Rule of Law podcast Oliver Garner discusses the proposal for a special tribunal to address Russia's crime of aggression in Ukraine with Kateryna Busol.

Israel spent the last few days engulfed in mass protests and paralyzed by a national strike after the bodies of six hostages, including an American Israeli, were recovered from a tunnel in southern Gaza this weekend. But despite national outcry for a ceasefire, Prime Minister Benjamin Netanyahu seemed to double down on his terms for a deal with Hamas during a press conference Monday night. While the war in Gaza captured most of the headlines this weekend, Russia's war in Ukraine is showing no signs of letting up either. On Monday, Russia fired a barrage of missiles and drone attacks on the capital city of Kyiv, while President Volodymyr Zelensky conceded that Ukrainian forces holding territory in Russia had not yet managed to divert troops away from the frontlines of the war in the country's east. Kateryna Hodunova, a journalist at the Kyiv Independent, explains where things stand in Ukraine after two and a half years of war.And in headlines: Vice President Kamala Harris and President Joe Biden held their first joint campaign event in Philadelphia to promote their support for unions, Brazil's Supreme Court upheld a decision to ban X in the country, and Italian Paralympic runner Valentina Petrillo became the first openly transgender woman to run in the games. Show Notes:Check out Kateryna's stories – https://tinyurl.com/3yztjcejSubscribe to the What A Day Newsletter – https://tinyurl.com/3kk4nyz8What A Day – YouTube – https://www.youtube.com/@whatadaypodcastFollow us on Instagram – https://www.instagram.com/crookedmedia/For a transcript of this episode, please visit crooked.com/whataday

On this edition of Parallax Views we've got a double feature. In the first half hour of the program historian Allan Lichtman of American University discusses his The Keys to the White House model for predicting Presidential election. This model has proven extremely robust at getting election predictions right and is based on 13 true/false statements about the candidates and/or their parties preceding the election. According to the model, "If five or fewer of the following statements are false, the incumbent party is predicted to win the election. If six or more are false, the incumbent party is predicted to lose." We'll discuss a number of issues related to this election including Joe Biden recently dropping out of the election and Kamala Harris becoming the presumptive Democratic Party Presidential candidate. What does it entail for the election? Find out in this conversation with Allan Lichtman! In the second segment of the show, a segment yours truly recorded a few months ago with Ukrainian lawyer Kateryna Busol. In a recent edition of the Journal of Genocide Studies, Busol penned a peice entitled "When the Head of State Makes Rape Jokes, His Troops Rape on the Ground: Conflict-Related Sexual Violence in Russia's Aggression against Ukraine". We'll be discussing the issue of conflict-related sexual violence (CRSV) in relation the Russo-Ukrainian war, the worrying rhetoric of Timofey Sergeytsev's "What Should Russia Do With Ukraine?" that was published in Russian state-owned outlet RIA Novosti, reparations for victims of CRSV, Kateryna's work on destruction of cultural heritage in war, and the importance of applying international law to other issues like the Gaza War.

On June 24, the International Criminal Court (ICC) issued arrest warrants for two top Russian officials for war crimes and crimes against humanity committed during Russia's full-scale invasion of Ukraine. Prosecutors allege that Sergei Shoigu, Russia's former defense minister, and Valery Gerasimov, the Chief of the General Staff of the Russian Armed Forces, directed missile strikes against Ukraine's power plants and electrical infrastructure. Russian attacks on Ukraine's power plants during the winter of 2022-2023 left 12 million people with limited or no access to energy and severely damaged Ukraine's health care system. Just how might the arrest warrants influence the war?  Joining the show to discuss the arrest warrants and their potential impact are Kateryna Busol and Rebecca Hamilton. Kateryna is a Ukrainian lawyer and an Associate Professor at the National University of Kyiv-Mohyla Academy. International Law in the Face of Russia's Aggression in Ukraine: The View from Lviv

The Just Security Podcast

In the two years since Russia's full-scale invasion of Ukraine began, the fighting has caused widespread horror and devastation. Over 10,000 civilians have been killed and more than half a million people injured. Still millions of others are internally displaced, seeking refuge abroad, or are in dire need of humanitarian assistance. The idea of war – and how to prevent it – was a central concern when 51 nations came together to form the United Nations over seven decades ago. Russia's invasion of Ukraine poses deep challenges to the international rules-based order and raises complex questions of international law, not only for Ukraine, but for nations around the world. In partnership with the Ukrainian Association of International Law, which worked with other stakeholders such as the Ukrainian Bar Association, the American Society of International Law helped to convene a gathering of international lawyers in Lviv, Ukraine in December 2023. Lviv was home to three giants in the field of international law: Hersch Lauterpacht, Rafael Lemkin, and Louis Sohn. Lauterpacht developed the concept of crimes against humanity, Lemkin pioneered the term “genocide,” and pushed for the adoption of the U.N. Genocide Convention, and Sohn played a pivotal role in helping to conceptualize article 51 of the U.N. Charter on the right of self-defense. Many of those who gathered in Lviv are now sharing their reflections on the meeting in a Just Security symposium. Joining the show to discuss the symposium are four of its editors, Kateryna Busol, Olga Butkevych, Rebecca Hamilton, and Gregory Shaffer.  Kateryna is a Ukrainian lawyer and an Associate Professor at the National University of Kyiv-Mohyla Academy. Olga is President of the Ukrainian Association of International Law and Chaired Professor of Law at Kyiv's National University of Taras Shevchenko. Psychologist and non-violent communications trainer Kateryna Yasko and her husband, Vytautas Bučiūnas, Integral Master Coach and leadership development expert, relate what it's like to live in war-torn Ukraine, two years since the Russian invasion began. They share why they chose to return to Kyiv from the safe haven of Lithuania, and describe a “special form of happiness” that occurs when the fragility and beauty of life is brought to the fore, as Russian missiles and drones continue to target civilians and cultural landmarks. It is an existential battle being fought for Ukraine, and Kateryna & Vytas are deeply aware of the importance of keeping the soul of Ukraine alive, the cultural code, the foundation of any democratic nation's identity. Among other things, Kateryna works with theater groups to stage productions that help make meaning of what Ukrainians are going through, help with processing PTSD, and keep cultural expression alive. This poignant conversation reveals what extraordinary courage human beings are capable of when put to the test: to protect loved ones, country, and the values of truth, justice, freedom, and democracy. Kateryna and Vytas emphasize that love is not enough to protect our innate rights and that pacifism is not an option in this case. They provide us with a glimpse into personal family life in modern wartime, a psychological portrait of where Ukrainians are at, a request for help, and a wake up call for all to understand that democracy around the world is not a given and that there are times, like this, when we need to stand up and fight for it. 100 years ago, few in Western Europe cared about Ukraine – or its disappearance as an independent state – swallowed up as the newly born tyranny of the USSR flexed its imperial muscles; but that has now changed. Putin's Russian World revanchism and violence have accelerated the evolution of Ukrainian identity and increased the pressure for social, political, and economic change. Perhaps the most perverse Russian invasion narrative, is that Ukraine is not old, and is not distinct from Russia in any case. But Ukraine is not just a footnote to Russian imperial history. And at the end of this war, Ukraine could prove to be the rock upon which the decrepit, brittle hull of the Russian imperial ship tears itself apart and sinks from history. ---------- SUPPORT THE CHANNEL: https://www.buymeacoffee.com/siliconcurtain https://www.patreon.com/siliconcurtain ---------- Kateryna Babkina is a Ukrainian poet, short story writer, novelist, playwright, and screenwriter. GUEST: Kateryna Busol - Ukrainian lawyer, Senior lecturer and Robert Bosch Stiftung fellow at Chatham House. ---------- Calls to treat as legitimate the ‘security concerns' raised by Russia, and to account for these in a future settlement of the war in Ukraine, disregard the fact that Moscow's requirements are fundamentally incompatible with European security. Proponents of a settlement in the war on Ukraine often put forward the idea that Russian ‘security concerns' must be taken into account in any such settlement, but also in broader revisions to the European security system. These proposals echo the Russian information campaign over the past 30 years to persuade European publics that there can be ‘no security in Europe without Russia'. They provide false support to the argument that Western security policy after the collapse of the USSR unnecessarily encroached on core Russian interests by expanding NATO and forcing Moscow to militarize its foreign policy. In this telling, Russia was merely challenging what it viewed as an unjust European security order. ---------- SPEAKER: Kateryna Busol is a Ukrainian lawyer. She is a senior lecturer at the National University of Kyiv-Mohyla Academy and a fellow at the British Institute of International and Comparative Law. Kateryna has worked on various issues relating to Russia's aggression against Ukraine, with a particular focus on the weaponization of cultural heritage, conflict-related sexual violence, reparations, and Ukraine's transitional justice process. She has worked with the Clooney Foundation for Justice, UN Women, the Global Survivors Fund and Global Rights Compliance. Kateryna has collaborated with Ukrainian NGOs such as the Ukrainian Helsinki Human Rights Union and Truth Hounds and has advised Ukrainian prosecutors and judges on war-related proceedings. She was a visiting researcher at the Leibniz Institute for East and Southeast European Studies, a Robert Bosch Stiftung fellow at Chatham House, and a visiting professional at the Office of the Prosecutor of the International Criminal Court. ---------- LINKS: https://www.biicl.org/people/kateryna-busol https://www.ukma.edu.ua/eng/index.php/studies/departments/faculty-of-law/international-law/staff/61-dr-kateryna-busol https://www.linkedin.com/in/kateryna-busol-68b4271a9/ https://twitter.com/KaterynaBusol ---------- SUMMARY: Moscow's war of reconquest against Ukraine has confirmed in the most brutal terms how Russia rejects the values underpinning European security – the same values agreed between Moscow and the West at the end of the Cold War. As a revisionist power, Russia has made itself the primary obstacle to peace and security in Europe and beyond. For stability to be restored and protected, it is essential that the outcome of the war in Ukraine leads to a situation in which – in addition to the expulsion of occupying forces – the exercise of Russian power is contained rather than encouraged. Over time, Russia's leadership must also be persuaded to renounce its expansionist ambitions. It's now or never for Ukraine. A protracted or frozen conflict benefits Russia and hurts Ukraine, as does a ceasefire or negotiated settlement on Russia's terms. If Ukraine is to avoid these outcomes and turn tenacious defence and incremental battlefield gains into outright victory, it needs far more ambitious international military assistance than it has received to date. This report presents the case for an immediate and decisive increase in such support, seeks to dispel overhyped concerns about provoking Russia, and counsels against accommodating Moscow's demands. ---------- #katerynabusol #chathamhouse #ukraine #ukrainewar #russia #zelensky #putin #propaganda #war #disinformation #hybridwarfare #foreignpolicy #communism #sovietunion #postsoviet ----------
